The meeting convened at 6:00 o'clock P. M. with President Veichh presiding.
ROLL CALL:
The roll was called and Councilmen Franscheid, Codfrey, Howe, Maurer and Presi-
dent Weichhart (5), were noted present. Absent: None.

1. The minutes of the regular meeting of September 16, 1941, were approved as

2. A communication was presented from Mr. Edward Strong, requesting refund of 0.50
paid to the City for a license to sell box lunches.
As the City Attorney has previously determined that the City has no legal right
refund such fees, the communication was ordered filed.
3. A letter was read from Er. William D. Ross, requesting permission to move a house
now located in the rear of 1121 Park Street, to a vacant lot on the southwest corner
of Clinton Avenue and Oak Street. This request was accompanied by a recommendation
from the Building Inspector that the permit be granted, providing all sections of the
Alameda Municipal Code pertaining to house moving be complied with.
Councilman Maurer moved the request to move a house in the rear of 1121 Park Street
to the southwest corner of Clinton Avenue and Oak Street be granted, provided all
regulations contained in the Alameda Municipal Code pertaining to house moving be
complied with. The motion was seconded by Councilman Branscheid and on-roll call
carried by the following vote. Ayes: Councilmen Eranscheid, Godfrey, Howe, Maurer
and President Weichhart, (5) . Noes: None. Absent: None.
From Mr. S. C. Wriht, requesting the Council to give consideration to the ad-
visability of acquiring the swimming pool and beach at Neptune Gardens for 'use of
Alameda residents. There being no objections the communication was referred to the
committee of the Whole.
). From the Alameda County Taxpayers' Association, Inc., commending the Council on
maintaining the tax rate at 1.58. There being no objections, the communication was
ordered filed.
6. From the International City Managers' Association, extending an invitation to
the Council to .attend the 28th. annual conference of the International City Managers'
ssociation, to be held at Hollywood, Florida, November 23 to 27, 1941. There being
no objections, the communication was ordered filed.
7 From. the State of California, Department of Fublic Health, requesting the City of
Alameda to send its Health Officer to the annual meetlns of Health Officers to be held
in Sacramento, October 13 to 15, 1941. There being no objections, the communication
was ,ordered filed.

8. The City Manager reportod.on the improvement of Central Avenue, from Sherman to
Fourth Streets, and presented a letter from the City Engineer stating that the con-
tractor had completed the removal of tracks and the repaving of the street and the
work had been performed and materials furnished to his satisfaction and acceptance.
The City Manager recommended the acceptance of this work by the City.
Thereupon., Councilman Maurer moved the work as specified in the report of the City
Engineer be accepted and the report filed. The motion. was seconded by Councilman Howo
.
and on roll call carried by the following vote. Ayes: Councilmen B,ranscheid, Godfrey,
Howe, Maurer and President Weichhart, (5 ) . Noes : None. Absent: None.
9. The City Manager also stated that the improvement of Sncinal Avenue has begun,
moving west from Broadway to Oak Street and, upon completion of this portion, work will
start east from Broadway to "High Street.
10. Mayor Weichhart incuired about the progress of the repair work -having been done
and to be done on Lincoln Avenue between Fifth and Eighth Streets, and which the City
Manager explained.
OPENING 02 BIDS:
11, Bid was received and read from Rhodes & JaMieson, Ltd., for furnishing fresh water
river sand to the City as per Specifications and Provisions No. MS 9-4120 in the quan-
tity of 4,000 tons at 1.764 per ton. This bid was accompanied by a certified check in
the amount of 250.
The bid was referred to the City Manager for study and recommend

12. From the City Manager, recaumendinp', that contract for furnishing lubricating oil

to the City of Alameda for the fiscal year 1941-1942, be awarded to the General Petroleum
Corporation of California at its bid price of .3914 per gallon.
Councilman Branscheid moved the recommendation of the City Manager be adopted and con-
tract be awarded to General Petroleum Gerporation. of California for furnishing lubricat-
ing oil to the City for the fiscal year 1941-1942 at its bid price of .3914 per gallon
and that bid checks be returned to the unsuccessful bidders. The motion was seconded by
Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen
Branscheid Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent:
None.
13. From the City Manager, recommending that contract be accepted from P. E. Van Pelt
for furnishing certain fire apparatus to the City and that payments be made as specified
in the contract. This apparatus has been thoroughly tested and meets with the require-
ments of the Board of Fire Underwriters of the Pao fic.
Councilman Maurer moved the recommendation of the City Manager be approved and that con-
tract be accepted from P. E. Van Pelt for furnishing certain fire apparatus. The motion
was seconded by Councilman Branscheid and on roll call carried by the following vote.
Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5).
Nees: None. Absent: None.
14. From the City Manager, recommending that the City Clerk, City Attorney, City
Auditor and. City Manager represent the. City at the annual meeting of the League of
California Cities, to be held in Sacramento, October 13, 16, 1941, and that an amount
not to exceed 250. be appropriated to defray their expenses.

Councilman Godfrey moved the recommendation of the City Manager be adopted and that the
above specified City officials represent the City at this meeting of the League. The
motion was seconded by Councilman Branscheid and on roll call carried by the following
vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart,
(5) . Noes: None. Absent: None.
15. From the City Manager, recommending that Dr. George H. Barry, Food Inspector, be
authorized to represent the City at the annual meeting of the California Association
of Dairy and Milk Inspectors, to be held in Sacramento, October 13 to 15, 1941, inclu-
sive, and that an amount not to exceed 40. be appropriated for his expenses.
Councilman Branscheid moved the recommendation of the City Manager be adopted, seconded
by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5).' Noes: Nene. Ab ant:

16. From the City Manager, recommending the Chief of Police, Vern Smith, be authorized
to attend the annual meeting of the Peace Officers' Association of the State of Cali-
fornia, to,be held in Santa Rosa, October 9 to 11, 1941, inclusive, and that a cnn not
to exceed N.O. be appropriated for his expenses.
Councilman Maurer moved the recommendation of the City Manager be adopted, seconded by
Councilman Branscheid, and on roll call the motion carried by the following vote.
Ayes: Councilmen Branscheid, Godfrey Howe, Maurer and President Weichhart, (5).
Noes: None. Absent: None.
17. From the City Manager, recommending that construction of a ten inch sanitary sewer
on Lincoln Avenue for an approximate length of twelve hundred feet be approved as a
Works Progress Administration Project and the job performed without contract and call,
for bids. There being no objections, the matter was referred to w.Resolutions".
18. From Mayor Weichhart, appointing Mr. Al. J. Mathebat as a member of the Alameda
Defense Council and Chairman of Human Resources and Skills Dommittee.
Councilman Maurer moved the appointment be confirmed as recommended by the Mayor. The
motion was seconded by Councilman Branscheid and on roll call carried by the following
vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5).
Noes: None. Absent: None.
19, From Mayor Weichhart, appointing Mr. S. Chesley Anderson as a member of the Alameda
Defense Council and Chairman of the Industrial Resources and Production Committee.
Action was deferred on this appointment until after the adoption of the resolution
creating an industrial Resources and Production Committee.'
20. From the City Manager, requesting authorization from the Council to give each of
the tenants now occupying property belonging to the City, situated on the west side of
Oak Street north of and adjacent to the present City Hall premises, a "Notice to quit"
as of November 30, 1941. There being no objections, the communication was referred to
"Resolutions".
21. From the City Attorney, requesting permission to file Disclaimer as to certain.
portions of lands included in Eminent Domain Action entitled "United States of America,
plaintiff, vs. Certain Parcels of Land in the City of Alameda, County of Alameda, State
of California, and L. queriolo, et al., defendants" instituted by the United States of
America and officially known as National Defense Housing Project Cal. 4112. There
being no objections, this matter was referred to "Resolutions".
ORDINANCES INTRODUCED:
22. Councilman Godfrey introduced the following ordinance, after which it was laid
over under provision of law and the Charter:

UNFINISHED BUSINESS:
24. On motion pf Councilman Godfrey, the matter of the proposed closing of portions
of Second, Spruce and. Cypress Streets, which was continued from the regular meeting
of September 2, 1941, was again continued until the regular meeting of November 4,
1941.- The motion was seconded by Councilman Branscheid and unanimously carried.
RESOLUTIONS:
25. The foil wing resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution Kb. 2669
Authorizing Construction of Sanitary Sewer on Lincoln
Avenue Without Contract."
The motion to adopt said resolution was seconded by Councilman Branscheid and on roll
call carried by the following vote. Ayes: Councilmen Eranscheid, Godfrey, Howe,
Maurer and President Weichhart, (5). Noes: None, Absent: None. Thereupon the
Mayor declared said resolution duly adopted and passed.
26. Tie 'allowing resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No 2670
Creating a Committee on Industrial Resources and Production."
The motion to adopt said resolution was seconded by Councilman. Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer
and. President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de-
clared said resolution duly.adopted and passed.

27. Councilman Maurer then moved that the appointment of Mr. S. Chesley Anderson,
by Mayor Weichhart, as a member of the Alameda Defense Council and Chairman. of In
dustrial Resources and Production Committee, be confirmed. The motion was seconded
by Councilman Branscheid and on roll call carried by the following vote. Ayes:
Councilmen Sranscheid, Godfrey, Howe Maurer and President Weichhart, (5) . Noes:
None. Absent: None.
78. The following resolution was introduced by Councilman Howe, who moved it
adoption:
"Resolution No. 2671
Authorizing the City Manager to Execute Notices of
Termination of Tenancy and to take Necessary Steps
to Secure Possession of Certain Premises Owned by
the City."
The motion to adopt said resolution was seconded by Councilman Branscheid and on roll
call carried by the following vote. Ayes: Councilmen :3ranscheid, Godfrey, Lowe,
Maurer and. President -eichhart, (5) . Noes: None. Absent: None. Thereupon the
Mayor declared said resolution duly adopted and passed.
29. The following resolution was introduced by Councilman Godfrey, who moved its
adoption:

Action Instituted by the United States of America."
The motion to adopt said resolution was seconded by Councilman Branscheid and on roll

Ulayor declared said resolution duly adooted and passed.

31. At this time, Mayor Weichtart expressed. his appreciation to Vice President Godfrey
