HELD TUESDAY EVENING, OCTOBER 21, - - - 1941
The meeting convened at 8:00 o'clock P. M. with Vice President Godfrey presiding.
ROLL CALL:
The roll was called and Councilmen Branscheid, Maurer and Vice President Godfrey,
(3), were noted present. Absent: Councilman Howe and President Weichhart, (2).
MINUTES:
l. The minutes of the regular meeting held October 7, 1941, were approved as
transcribed.
WRITTEN COMMUNICATIONS:
2. From Mr. Walter H. Clark, protesting the installation of stop signs at certain
intersections of Grand Street, particularly San Jose Avenue, and recommending that
San Jose Avenue be made a boulevard stop street from High to Morton Streets. There
being no objections, the communication was referred to the City Manager.
3. From the Alameda Belt Line, requesting that the City grant it a permit to con-
struct, maintain and operate a spur track beginning at a point on the center line of
the existing track on Clement Avenue and lying 77 feet west of the eastern line of
Stanford. Street, being further and more particularly described in the map attached
to the petition. There being no objections, the matter was referred to "Resolutions".
ORAL COMMUNICATIONS:
4. The City Manager reported on the progress being made in cooperation with Oakland
City officials regarding congestion of traffic on Harrison Street and vicinity near
the Oakland entrance of Posey Tube.
Mr. Frank Gottstein also addressed the Council on this same subject.
5. The City Manager explained to the Council the present situation with regard to
the recent levee breaks on Bay Farm Island, stating the Alameda Land Company, owners
of property where the break occurred last Sunday, are desirous of cooperating with
the City in rectifying the liability of further floods. He recommended that nego-
tiations be again motivated in cooperation with Bay Farm Island Improvement Club,
its attorneys and other parties involved, to form a Reclamation District as soon as
possible.
Vice President Godfrey referred to the previous authorization of the Council at the
meeting of March 4, 1941, to the effect that the City Manager cooperate with and
bend every effort to bring this situation to a satisfactory conclusion by contacting
and working with all parties concerned.
Even though a meeting has been held with a representative of the Committee from. Bay
Farm Island, the City Manager and City Attorney were here authorized to endeavor to
make progress in the general situation.
REPORTS OF COMMITTEES:
6. From the City Manager, recommending that contract for furnishing one thousand
tons of fresh water river sand to the City be awarded to Rhodes & Jamieson, Ltd. at
its bid price of $1.764 per ton. Bids were opened for furnishing this matterial at
the regular meeting held October 7, 1941, and referred to the City Manager for
recommendation.
Councilman Maurer moved the recommendation of the City Manager be approved and that
Rhodes & Jamieson, Ltd. be awarded contract for furnishing this sand at the price
quoted. The motion was seconded by Councilman Branscheid and on roll call carried
by the following vote. Ayes: Councilmen Branscheid, Maurer and Vice President
Godfrey, (3). Noes: None. Absent: Councilman Howe and. President Weichhart, (2).

7. From the City Manager, accompanied by a certificate of acceptance from the City
Engineer, recommending that the removal of tracks and the paving of track areas on
Lincoln Avenue from Mastick Junction to Fifth Street, be officially approved.
Councilman Branscheid moved the recommendation of the City Manager be adopted and
that the work of improvement of Lincoln Avenue from Mastick Junction to Fifth Street,
be approved. The motion was seconded by Councilman Maurer and unanimously carried.
8. From the City Attorney, advising that the City has been served with a summons
and complaint in a cause pending in the District Court of the United States, regard-
ing the condemnation of land belonging to the City - being a triangular parcel con-
taining approximately 2.271 acres - bounded on the north by Main Street, on the east
by the Peralta Grant Line and on the west by lands owned by the United States Navy.
The Government has deposited in the registry of the Court the sum of $4,501. as the
estimated price of this land.
The City Attorney requests that the Council determine whether or not to accept this
offer, or whether or not it should file an answer contesting the amount.
After discussion, it was determined that this price is acceptable to the City but
the City Manager requested that before any further action is taken, he be permitted, out
of courtesy, to confer with The Board of Regents of the University of California, owners
of adjacent land involved in this proceedings. Such permission was granted.
NEW BUSINESS:
9. The City Clerk requested permission to take her annual vacation from October 27,
1941, to November 10, 1941. There being no objections, the request was granted.
RESOLUTIONS:
10. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2673
Transferring 3,000. from the General Fund Contingent
Account 70b to Retirement Fund Expense Account 82."
The motion to adopt said resolution was seconded by Councilman Maurer and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Maurer and Vice President
Godfrey, (3). Noes: None. Absent: Councilman Howe and President Weichhart, (2).
Thereupon Vice President Godfrey declared said resolution duly adopted and passed.
11. The following resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No. 2674
Granting Permit to Alameda Belt Line to Construct,
Maintain and Operate a Railroad Spur Track Across
Clement Avenue in the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Branscheid and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Maurer and Vice
President Godfrey, (3). Noes: None. Absent: Councilman Howe and President Weichhart,
(2). Thereupon Vice President Godfrey declared said resolution duly adopted and passed.
12. The following resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No. 2675
Requesting Cancellation of Taxes on Property Acquired
by City of Alameda for Municipal Purposes."
The motion to adopt said resolution was seconded by Councilman Branscheid and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Maurer and Vice
President Godfrey, (3). Noes: None. Absent: Councilman Howe and President Weichhart,
(2). Thereupon Vice President Godfrey declared said resolution duly adopted and passed.
13. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2676
Resolution of Intention to Order the Vacation of
Portions of Atlantic Avenue and Portions of
Stanford Street in the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Maurer and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Maurer and Vice President
Godfrey, (3). Noes: None. Absent: Councilman Howe and President Weichhart, (2).
Thereupon Vice President Godfrey declared said resolution duly adopted and passed.
ORDINANCES PASSED:

An Ordinance Amending Section 17-432 of The Alameda
Municipal Code by Adding Subsections (12), (13) and
(14) Thereto."
Councilman Branscheid moved the ordinance as read be adopted. The motion was seconded
by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Maurer and Vice President Godfrey, (3). Noes: None. Absent: Councilman
Howe and President Weichhart, (2).

An Ordinance Amending The Alameda Municipal Code by
Adding Subdivisions (18), (19), (20), (21) and (22)

Councilman Maurer moved the ordinance as read be adopted. The motion was seconded
by Councilman Branscheid and on roll call carried by the following vote. Ayes:
Councilmen Branscheid, Maurer and Vice President Godfrey, (3). Noes: None.
Absent: Councilman Howe and President Weichhart, (2).

16. Financial Statement - City of Alameda, as of September 30, 1941 - Goodell,

17. Map of proposed vacation of portions of Stanford Street and Atlantic Avenue.

18. An itemized List of Claims against the City of Alameda and the several departments
thereof in the total amounts as follows, was presented to the City Council: General
Departments, $4,976.91; Police Department, $538.96; Pound. Department, $43.77,
Fire Department, $3,819.67; Street Department, $308.00; Health Department, $106.19;
Recreation Department, $28.86; Park Department, $723.64; Golf Course Department,
$480.70; Store Department, $14.27; Social Service Department, $86.64; Initia-

Councilman Branscheid moved the bills and claims against the City in the amounts listed
and itemized in the List of Claims filed with the City Clerk on October 21, 1941, and
presented to the Council at this meeting, be allowed and paid. The motion was seconded
by Councilman Maurer and on roll call carried by the following vote. Ayes: Council-
men Branscheid, Maurer and Vice President Godfrey, (3). Noes: None. Absent:
Councilman Howe and President Weichhart, (2).
ADJOURNMENT:
19. There being no further business to transact, Councilman Maurer moved the Council
adjourn to meet in adjourned regular session on Tuesday afternoon, October 28, 1941,
at 5:00 o'clock P. M. The motion was seconded by Councilman Branscheid and
unanimously carried.
