HELD TUESDAY EVENING, NOVEMBER 4, 1941
The meeting convened at 8:00 o'clock P. M. with Vice President Godfrey presiding.
ROLL CALL:
The roll was called and. Councilmen Branscheid, Howe, Maurer and Vice President
Godfrey, (4), were noted present. Absent: President Weichhart, (1).
MINUTES:
1. The minutes of the regular meeting held October 21, 1941, and the adjourned regular
meeting held. October 28 1941, were approved as transcribed.
WRITTEN COMMUNICATIONS:

2. From the East Bay Division of League of California Cities, giving notice of the
next meeting to be held Friday evening, November 21, 1941, at 7:00 o'clock P. M., at
Los Medanos Hotel in Pittsburg.
Vice President Godfrey requested that all those who could attend please notify the City
Manager in order that the necessary reservations may be made with the Secretary of the
League.
3. A communication was presented from Robert and Ruth Ayars, requesting a permit to
erect a six-foot fence at the extreme end of Regent Street, running parallel thereto
for approximately thirty-two feet along their property.
The City Attorney explained that under the regulations of the present Zoning Ordinance,
adjustments can be requested covering only certain specified matters and the height of
a fence is not included in this provision. Therefore, the Council has no authority to
grant such a permit. The City Clerk was instructed to so inform Mr. and Mrs. Ayars.
4. A letter was presented from Mr. G. M. Perkins, 3301 Wisconsin Street, Oakland,
submitting an offer of $5.00 for the purchase of ten pieces of pipe removed from the
vicinity of Central Avenue and Eighth Street.
The City Manager recommended that this offer be accepted and the pipe sold for the sum
stipulated.
Councilman Branscheid moved the recommendation of the City Manager be adopted; that ten
pieces of pipe be sold to G. M. Perkins for 5.00. The motion was seconded by Council-
man Maurer and unanimously carried.
A communication was presented from J. M. and K. H. Bridge, 924 Broadway, Alameda,
requesting that prompt action be taken to eliminate the present traffic hazard to school
children living in the southeasterly section of the City, who attend Lincoln School.
The City Manager reported that this matter had been brought before the Alameda Safety
Council at its meeting last week. An investigation is being conducted to ascertain the
most practicable method of solving this problem and the Traffic Safety Committee anti-
cipates making a definite recommendation to eliminate the hazard within the next thirty
days.
The City Clerk was requested to inform Mr. and Mrs. Bridge that this matter was still
under consideration and action would be taken at an early date.
6. A communication was presented from the Department of Justice, concerning action by
the United States v. certain parcels of land in the City of Alameda, County of Alameda,
State of California, L. Queriolo, et al., No. 21846-S, with regard to delinquent taxes.
The City Attorney stated action had already been taken with regard to this matter.
Resolution No. 2672, adopted by the Council on October 7, 1941, authorized the City
Attorney to file Disclaimer in Eminent Domain Action, which covers the property referred
to in this letter. There being no objections, the communication was ordered filed.
ORAL COMMUNICATIONS:
The City Manager reported verbally that the repaving of Encinal Avenue, between
Oak and High Streets, will be completed shortly if the work is not further delayed by
bad weather.
B. Mr. Robert Ayar addressed the Council concerning his request to erect a six-foot
fence at the foot of Regent Street. The City Attorney explained the situation to Mr.
Ayars' satisfaction.
OPENING OF BIDS:
9. Bids were presented and read for the project of reconstruction and repair of levee
in the westerly portion of Bay Farm Island, as follows:

There being no objections, these bids were referred to the City Manager for study
and recommendation.
REPORTS OF COMMITTEES:
10. From the City Planning Board, recommending denial of petition filed by Mrs. Tennie
F. Tawse, for reclassification of property known as 1117 Park Street, from the "E"
General Business District, to the "C" Multiple Dwelling District.
Councilman Branscheid moved the recommendation of the City Planning Board be approved;
that the petition for reclassification be denied. The motion was seconded by Council-
man Maurer and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Howe, Maurer and. Vice President Godfrey, (4). Noes: None. Absent:
President Weichhart, (1).
11. From the City Planning Board, recommending the granting of petition filed by
Edward T. and. Norine M. Codiga, for reclassification of property situated on the south
line of Fernside Boulevard, 250 feet east of Cornell Drive, from the "A" One-family
Dwelling District, to the "A-1" One-family Dwelling District, to permit construction
of a duplex.
Councilman Maurer moved the recommendation of the City Planning Board be approved;
that the petition for reclassification of the above described property be granted and
the matter referred to "Ordinances Introduced". The motion was seconded by Councilman
Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid,
Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President
Weichhart, (1).
12. From the City Attorney, in connection with cause pending in the District Court
of the United States with regard to condemnation of approximately 2.271 acres of land
belonging to the City of Alameda and described in the complaint as "Parcel Number 1"
Vice President Godfrey stated it was advisable to defer action on this matter for the
present.
ORDINANCES TNTRODUCED:
13. Councilman Maurer introduced the following ordinance, afterwhich it was laid over
under provision of law and the Charter:

17. Councilman Maurer introduced the following ordinance, after which it was laid

UNFINISHED BUSINESS:
18, Councilman Maurer moved the matter of the proposed closing of portions of Second,
Spruce and Cypress Streets, which was continued from the regular meeting of October 7,
1941, be again continued until the regular meeting to be held December 2, 1941. The
motion was seconded by Councilman Branscheid and unanimously carried.
RESOLUTIONS:
19. The following resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No. 2678
Cancelling City Taxes on Property Acquired by
the City of Alameda for Municipal Purposes."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice
President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). Thereupon
Vice President Godfrey declared said resolution duly adopted and passed.
20. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2679
Accepting Conveyance to the City of Alameda of
an Easement for Sewer Purposes and Consenting
to the Recordation Thereof."
The motion to adopt said resolution was seconded by Councilman Maurer and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice
President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). Thereupon
Vice President Godfrey declared said resolution duly adopted and passed.

An Ordinance Authorizing the Acquisition of Certain
Easements for the Repair and Reconstruction of a
Levee in the Westerly Portion of Bay Farm Island."
Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by
Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent:
President Weichhart, (1) .

26. Councilman Branscheid moved the Council adjourn to assemble in adjourned regular
meeting on Thursday afternoon, November 6, 1941, at 5:00 o'clock. The motion was
seconded by Councilman Howe and unanimously carried.
