1941-11-06 Regular CC Minutes CC MinutesADJOURNED REGULAR MEETING. OF THE COUNCIL OF THE CITY OF ALAMEDA HELD THURSDAY AFTERNOON NOVEMBER 6 ----------- 1941 The meeting convened at 5:05 o'clock P. M. with Vice President Godfrey presiding. ROLL CALL: The roll was called and. Councilmen Branscheid, Howe and Vice President Godfrey, were noted present. Absent: Councilman Maurer and. President Weichhart, (2). Vice President Godfrey then declared a short recess. After the meeting was resumed, Councilman Branscheid moved the regular order of busi- ness be suspended and the Council proceed under the heading of "Reports of Committees". The motion was seconded by Councilman Howe and unanimously carried. REPORTS OF COMMITTEES: 1. From the City Manager, recommending that contract for the reconstruction and repair of a levee in the westerly portion of Bay Farm Island be awarded to Heafey-Moore Co., the low bidder, at its bid price of 1.10 per ton. Councilman Branscheid moved the recommendation of the City Manager be adopted; that contract be awarded to Heafey-Moore Co. at its bid price of 1.10 per ton for the re- construction and repair of a levee in the westerly portion of Bay Farm Island and that checks be returned to the unsuccessful bidders. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe and Vice President Godfrey, (3). Noes: None. Absent: Councilman Maurer and President Weichhart, (2). 2. From the City Attorney, recommending he be authorized to file an answer in action to quiet title of certain real property, more particularly described in the communica- tion, re Stanley Hiller, Plaintiff, vs. City of Alameda, et al., Defendants, No. 164232, Superior Court of Alameda County. Councilman Branscheid moved the City Attorney's recommendation be adopted and that he be authorized to take action in accordance therewith. The motion was seconded by Councilman Howe and unanimously carried. v 3. From the City Attorney, recommending he be authorized to file an answer in action to partition certain real property, more particularly described in the communication, re Blanche H. Cary, et al., Plaintiffs, vs. Robert McEwing, et al., Defendants, No. 163515, Superior Court of Alameda County. Councilman Branscheid moved the recommendation of the City Attorney be adopted and that he be authorized to take action as outlined therein. The motion was seconded by Coun- cilman Howe and unanimously carried. There being no objections, the order of business was referred back to '!Hearings". HEARINGS: 4. The matter of the proposed vacation of portions of Atlantic Avenue and portions of Stanford Street was presented for hearing. Mr. Leland B. Groezinger, Attorney for Kate G. Pedersen, Estate of Lars A. Pedersen and Laura Pedersen, owners of property situated on both sides of the area proposed to be vacated, addressed the Council and stated the parties concerned had no objections whatsoever to the contemplated closing of these portions of streets. The City Manager gave evidence that the streets proposed to be abandoned had never been improved nor used for public travel. There being no objections, the matter was referred to "Resolutions". RESOLUTIONS: 5. The following resolution was introduced by Councilman Howe, who moved its adoption: (3) "Resolution No. 2680 Ordering the Vacation of Portions of Atlantic Avenue and Portions of Stanford Street in the City of Alameda." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe and Vice President Godfrey, (3). Noes: None. Absent: Councilman Maurer and President Weichhart, (2). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 6. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2681 Accepting Conveyance to the City of Alameda of an Easement for Levee Purposes on Bay Farm Island and Consenting to the Recordation Thereof." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe and. Vice President Godfrey, (3) . Noes: None. Absent: Councilman Maurer and President Weichhart, (2). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 7. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2682 Accepting Conveyance to the City of Alameda of an Easement for Levee Purposes on Bay Farm Island and Consenting to the Recordation Thereof." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe and Vice President Godfrey, (3). Noes: None. Absent: Councilman Maurer and President Weichhart, (2). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 8. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2683 Accepting Conveyance to the City of Alameda of an Easement for Levee Purposes on Bay Farm Island and Consenting to the Recordation Thereof." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe and Vice President Godfrey, (3). Noes: None. Absent: Councilman Maurer and President Weichhart, (2). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 9. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2684 Authorizing Execution of Revocable Permit Granting Permission to the United States of America to Construct and Maintain Certain Landing Facilities, a Plank Walk, an Underground. Electrical Duct and Necessary Appurtenances in, on and across Tide and. Submerged Lands of the City of Alameda." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe and Vice President Godfrey, (3) . Noes: None. Absent: Councilman Maurer and President Weichhart, (2). Thereupon Vice President declared said resolution duly adopted and passed. 10. At this time, Vice President Godfrey stated he believed some official action should be taken concerning President Weichhart's absence and would therefore entertain a motion with regard to the matter. Councilman Branscheid moved Mayor Weichhart be granted permission to absent himself from the City of Alameda and from Council meetings for a period of thirty days from this date. The motion was seconded by Councilman Howe and unanimously carried. FILING: 11. Form of Revocable Permit granted by the City of Alameda to the United States of America, re certain landing facilities on tide lands adjoining the Naval Air Station. ADJ-OURNMENT: 12.
