1941-12-02 Regular CC MinutesREGULAR rEETING OF TEE COUNCIL OF THE CITY OF A ATIE'DA H7LD TUESDAY EVENING D0 3E 2 1941 The meeting convened at 8:00 o'clock P. with Vice President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4), were noted present. Absent: President Weichhart, (1). 1.;,INUTE3: 1. The minutes of the regular meeting held November 18, 1941, and the special meeting held November 22, 1941, were approved as transcribed. WRITTEN COMMUNICATIONS. 2. From Mrs. Adelaide Firpo, protesting against payment of City taxes for 1942 on property formerly owned by her but now owned by the United States Government as a por- tion of the United States Housing Authority Project. The City Attorney stated the Council has no jurisdiction in this matter as the City ordinance provides for the cancellation of taxes only in the event the County or State becomes the owner of land and it does not provide for the cancellation of taxes on land owned by the Federal Government. There being no objections, the City Attorney was requested to reply to Mrs. Firpo letter in explanation of the matter. OPENING OF BIDS: 3. Bids were presented and read for the sale and removal of certain wood frame build- ings located on City owned property immediately adjacent to the City Hall, as follows: From Horton & Gilman 080.00 Accompanied by a cashier's c ck in amount of - 68.00 From Symon Bros. 520.00 Not accompanied by a check From Joseph D. Ballinger 82.50 Accompanied by cash in amount of 10.00 From S. Cirmelli 135.00 Accompanied by cashier's check in amount of 135.00 From R. B. Hoag 70.25 Accompanied by cashier's check in amount of 7.25 From Walnut Creek Wreckers 80.00 Accompanied by check in amount of 8.00 From J. J. Downs 68.07 Accompanied by cashier's check in amount of 7.00 From Cecil R. King 25.50 Accompanied by Bank of America Money Order in amount 5.00 From E. Lani 75.00 Accompanied by check in amount of 7.50 After perusal, the City Manager recommended the bid submitted by Horton & Gilman of Oakland be accepted at the price quoted by them. Councilman Branscheid then moved the recommendation of the City Manager be adopted; that the bid of Horton & Gilman in the amount of 080. be accepted and checks be returned to the unsuccessful bidders. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . Hoes: None. Absent: President Weichhart, (1). REPORTS OF 001,EITTEES: 4. From Mayor Weichhart, requesting an extension of his leave of absence from the City of Alameda and his duties as Mayor and Councilman until the end of the present calendar year. Councilman Maurer moved that the Mayor's leave be extended as requested. The motion was seconded by Councilman Howe and unanimously carried. vt. 5. From the Vice President of the Council, the City Manager and Auditor, submitting report on the count of money held November 19, 1941, and stating there was the amount of 11604,293.71 in the City Treasury at that time. There being no objections, the report was ordered filed. ORDINANCES INTRODUCED: 6. , Councilman Maurer introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-341 of The Alameda Municipal Code by Adding Subdivisions (23) and (24) Thereto." ---1111ISHED BUSINESS: 7. The matter of he proposed closing of portions of Second, Spruce and. Cypress Streets was, upon motion of Councilman Branscheid, continued until the first regular meeting in January, 1942. The motion was seconded by Councilman Howe and unanimously carried. y' 8. The matter regarding the action brought by the United. States Government to con- demn certain parcels of land in connection with cause pending in uhe District Court of the United. States, entitled: United. States of America, Plaintiff, vs. 98.204 acres of land, etc., Defendants, was presented. There being no objections, the matter was re- ferred to "Resolutions". RESOLUTIONS: 9. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "-Resolution No. 2691 Authorizing the City Attorney of the City of Alameda to Take Certain Action in Eminent Domain Proceedings Instituted by the United States of America." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call parried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4). Noes: 'None. Absent: President Weichhart, (1). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 10. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2692 Adopting Specifications for Furnishing Five (5) Two-Door Sedans to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise the Same." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1) . There- upon Vice President Godfrey declared said resolution duly adopted and passed. 11. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2693 Establishing an Additional Position of Sewer Foreman." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1) . There- upon Vice President Godfrey declared said resolution duly adopted and passed. FILING: 12. Financial Report - Goodell, Byers & Henry - City of Alameda - As at October 31, 1941. 13. Financial Report - Goodell, Byers & Henry - Bureau of Electricity - Month of October, 1941. 14. Specifications - For furnishing five new Two-Door Sedans for Police Department. 15. Auditor's Balance Sheet - Month ending November 30, 1941. BILLS: 16. The following claim against the City of Alameda in favor of Heafey-Moore Co. for the improvement of Webster Street, being estimate No. 3, in the amount of 1:21,685.84, was presented to the Council. Councilman Maurer moved the claim against the City in the amount listed and filed with the City Clerk on December 2, 1941, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4) . Noes: None.. Absent: President Weichhart, (1). ADJOURNMENT: 17.
