HELD TUESDAY AFTERNOON, JANUARY 13, 1942
The meeting convened at 5:00 o'clock P. M. with President Godfrey presiding.
ROLL CALL:
The roll was called and Councilmen Branscheid, Howe, Jones, Maurer and President
Godfrey, (5), were noted present. Absent: None.
WRITTEN COMMUNICATIONS:
1. From the United Engineering Co., Ltd., addressed to the City Manager, requesting
permission to install a turn out switch on the City tracks adjacent to the west end of
the United Engineering Co.'s property at the foot of Main Street, the switch to be used
as a spur track. There being no objections, the matter was referred to "Resolutions".
2. From the American Dredging Company, requesting permission to install a twenty inch
dredge pipe under Main Street approximately 200 feet south of the entrance to the United
Engineering Co.'s yard. The pipe is to be used to carry dredged material from the
United Engineering Co.'s property to land adjacent to the Naval Air Station.
A second letter was also presented from the American Dredging Company, requesting per-
mission to install also two twenty-seven inch drainage pipes under Atlantic Avenue, to
be located approximately half way between Main Street and the Alameda Naval Air Station
property. There being no objections, the matter was referred to "Resolutions".
OPENING OF BIDS:
3. Bids were presented and opened for furnishing gasoline to the City of Alameda for
the fiscal year 1942-43, as follows:
From Tide Water Associated Oil Company
Accompanied by certified check in amount of $500.
From Union Oil Company of California
Accompanied by certified check in amount of $500.
From Standard Oil Company of California
Accompanied by certified check in amount of 43500.
From Signal Oil Company
Accompanied by cashier's check in amount of 43500.
There being no objections, these bids were referred to the City Manager and City Attor-
ney for study and recommendation.

4. Bid was presented and opened from Tom Henderson, Inc., for furnishing one new 1942
automobile sedan to Lhe City for the sum of $1,146.52. The bid was accompanied by a
certified check in the amount of 43114.65.
After perusal of the bid by the City Manager and City Attorney, the City Manager recom-
mended that bid be awarded to Tom Henderson, Inc., for furnishing one automobile sedan
to the City at price submitted, and in accordance with Specifications and Provisions
therefor, No. MS 1-421.
Councilman Maurer moved the recommendation of the City Manager be adopted. The motion
was seconded by Councilman Branscheid and on roll call carried by the following vote.
Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes:
None. Absent: None.
REPORTS OF COMMITTEES:
5. From Mayor Godfrey, nominating Mr. H. H. Buddington to the office of member of the
Library Board for a term expiring June 30, 1944, and until his successor is appointed
and qualified. Mr. Buddington will serve the unexpired term of Mr. Sherwood Jones,
resigned. There being no objections, the matter was referred to "Resolutions".
6/. From the City Attorney, recommending that he be authorized to file an answer in
the action entitled, "R. B. Bernard, et al., Plaintiffs, vs. City of Alameda, a muni-
cipal corporation, et al., defendants, No. 165429 in the Superior Court of Alameda
County." This action is to quiet title to certain property lying in the extreme south-
eastern end of the City of Alameda in the vicinity of Fillmore, Peach and Post Streets.
Councilman Branscheid moved, seconded by Councilman Maurer, that the recommendation of
the City Attorney be adopted and answer be filed in the above referred to action in
accordance with suggestions outlined in the communication. The motion carried unani-
mously.
7' 7 From the City Attorney, requesting authority to file an answer for the City of
Alameda in action entitled, "United States of America, Plaintiff, vs. Certain Parcels
of Land in the City of Alameda, County of Alameda, State of California, and L. Queriolo,
et al., Defendants", numbered 218463, to condemn a parcel of land in Alameda which has
recently been developed as a national defense housing project and which is officially
known as "Project No. Cal. 4112".
Councilman Maurer moved, seconded by Councilman Howe, that the City Attorney be authorized
to file an answer in accordance with recommendations outlined in his communication with
regard to the above titled proceedings. The motion carried unanimously.
RESOLUTIONS:
8. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2707
Appointing Member of the Library Board."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and
President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared
said resolution duly adopted and passed.
9. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2708
Authorizing Execution of Revocable Permit Granting
Permission to American Dredging Company, A Corpora-
tion to Construct and Maintain Two Dredge Pipes in
and Across Main Street and Atlantic Avenue."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President
Godfrey, (4) . Noes: None. Not Voting: Councilman Maurer, (1) . Absent: None.
Thereupon the Mayor declared said resolution duly adopted and passed.
10. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 2709
Granting Permit to United Engineering Company, Ltd.,
to Construct and Maintain a Railroad Turn Out Switch
and Spur Track Connecting with City of Alameda's
Railroad Track Adjacent to Lands Heretofore Leased
by the City to Said United Engineering Company."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President
Godfrey, (4). Noes: None. Not Voting: Councilman Maurer, (1). Absent: None.
Thereupon the Mayor declared said resolution duly adopted and passed.

Chapter 7, Title X of The Alameda Municipal Code."
Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by
Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent:
None.
12. "Ordinance No. 785,
New Series
An Ordinance Amending Section 17-321 and Repealing
Section 17-323 of The Alameda Municipal Code Relating
to Parallel Parking."
Councilman Branscheid moved the ordinance as read be adopted. The motion was seconded
by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None.
13. "Ordinance No. 786,
New Series
An Ordinance Amending The Alameda Municipal Code by
Repealing Subdivisions (1), (2), (4) and (5) of
Section 17-341, Repealing Section 17-342i and Adding
a New Section 17-343."
Councilman Howe moved the ordinance as read be adopted. The motion was seconded by
Councilman Jones and on roll call carried by the followin vote. Ayes: Councilmen
Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None.
14. "Ordinance No. 787,
New Series
An Ordinance Authorizing Acquisition of an Easement
from Alameda City Land Co. for Levee Purposes on
Bay Farm Island."
Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by
Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Howe, Jones, Maurer and. President Godfrey, (5). Noes: None. Absent:
None.
FILING:
15. Financial Statement - Goodell, Byers & Henry - City of Alameda, as of
December 31, 1941.
16. Form of Revocable Permit granted to American Dredging Company.
BILLS:
17. An itemized List of Claims against the City of Alameda and the General Depart-
ments in the total amount of $1,158.23 was presented to the City Council.
Councilman Maurer moved the bills and claims against the City in the amounts listed
and itemized in the List of Claims filed with the City Clerk on January 13, 1942,
and presented to the Council at this meeting, be allowed and paid. The motion was
seconded by Councilman Howe and on roll call carried by the following vote. Ayes:
Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None.
Absent: None.
ADJOURNMENT:
18. There being no further business to transact, the Council adjourned to assemble
in regular session on Tuesday evening, January 20, 1942, at 8:00 o'clock P. M.
