HELD TUESDAY AFTERNOON, FEBRUARY 10, 1942
The meeting convened at 5:00 o'clock P. M. with Vice President Maurer presiding.
ROLL CALL:
The roll was called and Councilmen Branscheid, Howe, Jones and Vice President
Maurer, (4), were noted present. Absent: President Godfrey, (1).
WRITTEN COMMUNICATIONS:
1. Communication was presented, signed by eight residents of the west end of Alameda,
regarding the improvement of sewer conditions in the vicinity of Pacific and Santa
Clara Avenues.
There being no objections, the City Manager was requested to investigate and notify
the signers of this communication as to the reasons for the existing condition in the
area.

2. From the United States Conference of Mayors, Washington, D. C., submitting a form
letter with regard to the taxing of municipal bonds.
There being no objections, the matter was referred to "Resolutions".
3. From the Norwich Union Indemnity Company, enclosing releases in the amount of
$46.50 in connection with the City's claim against M. Hirota, arising out of an acci-
dent occurring December 23, 1941, and requesting that the releases be executed.
Councilman Jones moved that the duplicate forms of the release be executed. The motion
was seconded by Councilman Howe and unanimously carried.
REPORTS OF COMMITTEES:
4: From the City Manager, requesting permission to attend the annual meeting of the
City Managers' Section of the League of California Cities, to be held in San Mateo,
February 20 to 22, inclusive, and that an amount not to exceed $30. be appropriated to
cover his expenses.
Councilman Howe moved the request of the City Manager be granted; that he be authorized
to attend the annual meeting of the City Managers' Section of the League of California
Cities and a sum not to exceed $30. be appropriated for his expenses. The motion was
seconded by Councilman Branscheid and on roll call carried by the following vote.
Ayes: Councilmen Branscheid, Howe, Jones and Vice President Maurer, (4). Noes: None.
Absent: President Godfrey, (1).
5. From the City Manager, recommending that Police Officer H. D. Manbert be dele-
gated to attend the school on Chemical Warfare conducted by the Office of Civilian
Defense at Stanford University for a ten-day period beginning February 11, 1942. The
City Manager also recommended that an amount not to exceed 60. be appropriated to
defray Officer Manbert's expenses.
Councilman Branscheid moved that the recommendation of the City Manager be adopted; that
Officer Manbert attend the school as stated above and an amount not to exceed $60. be
appropriated for his expenses. The motion was seconded by Councilman Howe and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice
President Maurer, (4) . Noes: None. Absent: President Godfrey, (1).
6. From the City Manager, recommending that repair and clearing out of the main south
side sewer, from Central Avenue and Eighth Street to the foot of Ninth Street, be done
without written contract or call for bids. The sewer now discharges into the Bay of
San Francisco, creating an unsanitary condition which necessitates emergency repairs.
The approximate cost of this work will be $845.
There being no objections, the matter was referred to "Resolutions".
ORDINANCES INTRODUCED:
7. Councilman Branscheid introduced the following ordinance, after which it was laid
over under provision of law and the Charter:
"Ordinance No.

An Ordinance Amending Section 8 of Ordinance No. 642,
New Series, Entitled "An Ordinance Establishing and
Regulating the Civil Service System of the City of
Alameda."
RESOLUTIONS:
8. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2719
Declaring an Emergency and Authorizing Repair of
Sewer Without Written Contract or Call for Bids."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice
President idaurer, (4). Noes: None. Absent: President Godfrey, (1). Thereupon Vice
President Maurer declared said resolution duly adopted and passed.
9. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2720
Expressing City of Alameda's Opposition to Federal
Taxation of Municipal Bonds."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and. Vice
President Maurer, (4). Noes: None. Absent: President Godfrey, (1). Thereupon Vice
President Maurer declared said resolution duly adopted and passed.
ORDINANCES FOR PASSAGE:
JO. Councilman Maurer requested that the ordinance entitled, "An Ordinance Leasing
Certain Tide and Submerged Lands to United Engineering Company, Ltd., a Corporation;
Approving the Form and Terms of Said Lease and Authorizing Execution Thereof," be held
over for passage until the next regular meeting of the Council. It was so ordered.
11, "Ordinance No. 789
New Series
An Ordinance Approving the Form and Terms of an
Agreement Granting to the City of Alameda an
Easement for Street or Highway Purposes and
Authorizing the Execution Thereof."
Councilman Howe moved the ordinance as read be adopted. The motion was seconded by
Councilman Branscheid and on roll call carried by the following vote. Ayes: Coun-
cilmen Branscheid, Howe, Jones and Vice President Maurer, (4). Noes: None. Absent:
President Godfrey, (1).
FILING:
12. Copy of Decision No. 34999 - Railroad Commis ion of State of California.
13. Financial Statement - Goodell, Byers & Henry - City of Alameda as of
January 31, 1942.
14. At this point Councilman Branscheid moved the Council revert back to "New
Business". The motion was seconded by Councilman Jones and unanimously carried.
NEW BUSINESS:
15. The City Manager addressed the Council with regard to the proposed re-routing
of the Oakland-Alameda motor coach line No. 51.
Councilman Branscheid moved the City of Alameda concur with the Forty-fourth Supple-
mental Application No. 19502 filed by the East Bay Transit Company with the Railroad.
Commission of the State of California on January 21, 1942, requesting authorization
from said Commission to re-route its No. 51 Oakland-Alameda motor coach line in the
City of Alameda, and that the Railroad Commission be apprised of this action. The
motion was seconded by Councilman Howe and unanimously carried.
ADJOURNMENT:
16. There being no further business to transact, the Council adjourned to assemble
in regular meeting on Tuesday evening, February 17, 1942, at 8:00 o'clock P. M.
