1942-04-07 Regular CC MinutesREGULAR MEETING OF THEqp7cTI, OF THE CITY OF ALAMEDA IELD_TUESDAY.EVENING, APRIL 7.. 1942 The meeting convened at 8:00 o'clock P. M. with President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held Tuesday evening, March 17, 1942, were approved as transcribed. WRITTEN COMMUNICATIONS: From the Twelfth Naval District, advising that the Government has obtained a judg- ment of possession through condemnation proceedings on property owned by the City of Alameda situated on the Estuary between the General Engineering and Dry Dock Company and the Pacific Bridge Company. There being no necessity for action by the City on this matter, the communication was erdered filed. 3. From the Twelfth Naval District, requesting authority from the City for the Navy Department to purchase the railroad track material owned by the City of Alameda and located in the vicinity of the Alameda Mole. The Navy Department is to salvage the material and pay for same at the maximum price of $30. per gross ton, less the cost of salvaging which is estimated to be $4.50 per ton. Usable splice bars and tie plates are also to be salvaged and paid for at the prevailing rates of the Office of Price Administration. There being no objections, this matter was referred to "Resolutions". 4. Communication from The Duncanson-Harrelson Co., San Francisco, submitting price of $28. per ton for approximately 2,500 track feet of rails now located in he vicinity of the Alameda Mole. There being no objections, the matter was referred to "Resolutions". From Mr. Harry Young, representing the Harbor Tug and. Barge Company, requesting the City to cancel its present lease with the company and enter into a new lease pro- viding for a lower rental. There being no objections, this matter was referred to the Committee of the Whole. 6. From McChesney & Co., requesting permission to move two houses known as 2019 Clement Avenue and 2008 Chestnut Street, to new location approximately 50 feet east of 2124 Pacific Avenue. Mayor Godfrey stated that removal of these houses to the specified location has been recommended by the Building Inspector, providing all provisions of The Alameda Munici- pal Code pertaining to house moving are complied with. The Building Inspector also recommends the moving of houses subsequently requested by the next two communications. Councilman Maurer then moved that permission be granted to McChesney & Co. to move houses as stipulated in its request, provided all requirements and regulations of the Alameda Municipal Code pertaining to house moving are complied with. The motion was seconded by Councilman Branscheid and unanimously carried. 7. From Mr, T. A. Nilson, owner, and Mr. J. H. Pickrell, contractor, requesting per- mission to move a house from 2009 Clement Avenue to he east side of Schiller Street, 150 feet north of Pacific Avenue, adjacent to 1722 Schiller Street. Councilman Maurer moved that permissionbe granted to move house as specified in the communication, provided all requirements and regulations of The Alameda Municipal Code pertaining to house moving are complied with. The motion was seconded by Councilman Howe and unanimously carried. Nv- 8. Communication was presented from Mr. Giocondo Sabatini, owner, and J. H. Pickrell, contractor, requesting permission to move a house from 2015 Clement Avenue to the south side of Pacific Avenue between 2124 and 2136 Pacific Avenue. Councilman Maurer moved that permission be given to move this house as specified in the communication, provided all requirements and provisions of The Alameda Municipal Code pertaining to house moving are complied with. The motion was seconded by Council- man Branscheid and unanimously carried. ORAL COMYJUNICATIONS: v. °. The City Manager reported that he had had a conference with some of the chief engineers working on the proposed new tube and they expect to take test borings within the next few days; a great deal of work has already been done in this matter and the survey is progressing satisfactorily. The final report will be made to the Bureau of Roads. REPORTS OF COMMITTEES: 10. From the Building Inspector, recommending certain changes or amendments to the Building, Plumbing and Electrical Codes of the City of Alameda, in order to meet the requirements of the War Production Board and the list of materials available for de- fense housing. The City Attorney explained that the ordinance relating in general to this matter, to be introduced later at this meeting, was determined upon jointly by the Building Inspector and himself as the most advisable remedy for the existing difficulties in obtaining building materials. The communication was filed. 11. From the Alameda Municipal Civil Service Employees Association, enclosing copy of its resolution of April 3, 1942, requesting consideration by the Council of adopting a bonus plan for City employees in preparing the budget for the coming fiscal year. There being no objections, the communication was referred to the Committee of the Whole. 12. At this time, the City Manager filed with the City Clerk a letter addressed to him from the salary committee of the Fire Department, requesting consideration by him and the Council of salary increases. This letter was also referred to the Committee of the Whole. ORDINANCES INTRODUCED: 13, Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending The Alameda Municipal Code by Amending Sec. 11-1517 of Article 1, Chapter 1, Title XI Thereof Relating to Accessory Buildings in rear and Side Yards." 14. Councilman Maurer introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Leasing Certain Portions of the Alameda Municipal Golf Course to the United States of America." 15. Councilman Jones introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Permitting the Use of Building Materials in Substitution for Those Prohibited by the National Defense Regulations." NEW BUSINESS: 16. Schedule bond of the American Surety Company of New York, covering various City of Alameda officials and employees, effective from April 16, 1942 to April 16, 1943, was presented for approval. Councilman Maurer moved this bond be accepted and approved. The motion was seconded by Councilman Howe and unanimously carried. 17. Bond of American Surety Company of New York, running from April 16, 1942 to April 16, 1943, covering the City Clerk, was also presented for approval. Councilman Branscheid moved this bond be accepted and approved. The motion was seconded by Councilman Maurer and unanimously carried. 18. The City Manager requested permission to be absent from the City for a two weeks' vacation at such time in this month as he feels he can best be away. Councilman Branscheid moved the City Manager be permitted to take two weeks' vacation during the month of April. The motion was seconded by Councilman Jones and unanimously carried. RESOLUTIONS: 19. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2730 Authorizing the Mayor of the City of Alameda to Consent to the Recordation of Deeds or Grants to Said City." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2731 Accepting Conveyance from Central Pacific Railway Company and Southern Pacific Company of an Easement to Construct, Reconstruct, Maintain and Operate a High Tension Power Line Upon, Along and Across Certain Strips and Parcels of Land in the City of Alameda and Consenting to the Recorda- tion Thereof." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 21. The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution No. 2732 Accepting Conveyance from Central Pacific Railway Company and Southern Pacific Company of an Easement to Reconstruct, Maintain and Operate a 13 K. V. Power Transmission Line Upon, Along and Across Certain Strips and Parcels of Land in the City of Alameda and Consenting to the Recordation Thereof." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 22. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2733 Authorizing City Attorney to File Stipulation in Eminent Domain Action Instituted by the United States of America." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 23. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2734 Authorizing Execution of Agreements with Respect to Loans of Supplies by the Office of Civilian Defense and Appointing Charles R. Schwanenberg as Local Property Officer." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Absent: None. Noes: None. Thereupon the Mayor declared said resolution duly adopted and passed. 24. The following resolution was introduced by Councilman Branscheid who moved its adoption: "Resolution No. 2735 Authorizing the Sale of Certain Railroad Tracks." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 25. "Ordinance No. 793, New Series An Ordinance Leasing Washington Park Bath House to the United States of America; Approving Form and Terms of Lease; and Authorizing the Execution. Thereof." Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. 26. "Ordinance No. 794, New Series An Ordinance Amending Subdivision (4) of Section 17-431 of The Alameda Municipal Code." Councilman Howe moved the ordinance as read be adopted. The motion was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5) . Noes: None. Absent: None. FILING: 27. Financial Statement - City of Alameda - Goodell, Byers & Henry - As of February 28, 1942. 28. Financial Statement - Bureau of Electricity - Goodell, Byers & Henry - Month of February, 1942. 29. Auditor's Balance Sheet - As of March 31, 1942. 30. Certified copy of resolution of California Highway Commission, designating certain named streets as State Highway Routes and relinquishing certain others no longer required. 31. Form of Lease between United States of America and City of Alameda re portion of Golf Course Grounds. BILLS: 32. An itemized List of Claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to uhe City Council: General Departments, $60,00; Initiative Relief Fund, $67.50. Councilman Branscheid moved the bills and claims against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on April 7, 1942, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. ADJOURNMNT: 33. Councilman Branscheid moved the Council adjourn to assemble in adjourned regular session on Tuesday afternoon, April 14, 1942, at 5:00 o'clock P. M.
