Abeent: None, EILUTES: The minutes of the regular meeting held June 2, 1942, were approved as transcribed. WRITTEN COlaUNICATIONS: i • 2. Front the Department of Justice, regar ing certain action entitled, "United States v. 7.66 acres of land, more or less, in Alameda County, California, Carlo Carlevaro, et al., #,22133-W," and requesting that the assessment for the 1942-43 taxes be can- celled promptly. There being no objections, the matter was referred to "Resolutions". 1 3. From Er. Earl M. Templeman, recuesting additional exemption on his property listed as Lot 2, Block 22 - Oak Shade Tract, for the years 1938, 1939 and 1940. This exemp- tion, according to the Assessor's books, is not warranted. The Assessor had requested that this matter be referred to him for disposition, and there being no objections, it was so ordered. v/ 4. From the Alameda Belt Line, petitioning the Council for permission to construct, maintain 'and operate a spur track in conformance with its blue print 1-4-667, beginning at a point on the center line of Clement Avenue 14'7.62 feet easterly from the easterly line of Chestnut Street. From the City Attorney, re certain action known as "R. B. Bernard, Plaintiff, v. B. McCabe, et al., Defendants, No. 167496 in the Superior Court of Alameda County," and recommending that the City Attorney be authorized to file an answer in said action. Councilman Maurer moved that the City Attorney be authorized to proceed in this matter as recommended in his report. The motion was seconded by Councilmen Dranscheid and unanimously carried. v' 11. From the City Attorney, re "United States of America, Plaintiff, v. Certain Parcel of Land in the City of Alameda, Alameda County, California, City of Alameda, et al., Defendants, No. 22180-S." The property involved in this action embraces a portion of the premises on which Longfellow School is now situated, for which property the Government has deposited the sum of 5,000, in the Registry of the Court. The City Attorney recommended that a resolution be adopted authorizing him to file an answer on behalf of the City, setting up the City's claims and accepting the offer made by the Government. There being no objections, the matter was referred to "Resolutions". ORDINANCES FOR INTRODUCTION: 12. Councilman 'Maurer introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series AN Ordinance Leasing Certain Portions of the Alameda Municipal Golf Course to the United States of America." tv/ 13. At this time the City Manager recommended that the bid for legal advertising as sub- mitted by the Alameda Times-Star, be accepted. Councilman Branscheid moved the recommendation of the Gity Tanager be adopted and that contract be awarded. to the Alameda Times-Star for furnishing 1ea1 advertising for the fiscal year ending June 30, 1943, at the rates submitted in its bid. The motion. was seconded by Councilman Howe and unanimously carried. 14. The City Manager recommended that the bid in the amount of '710. for operating con- cessions in Lincoln and Washington Parks, as submitted by Louis Alexander, for the period beginning July 1, 1942, and ending December 31, 1942, be accepted. Councilman Branscheid moved the recommendation of the City Gity Manager be adopted and that contract for operating refreshment concessions be awarded to Louis Alexander at the price of $710. The motion was seconded by Councilman Jones and unanimously carried. 15. The matter of covering City property with war damage insurance was then, presented. Councilman Jones moved the City Clerk be authorized to make application and purchase through The Home Insurance Company, war damage insurance on ali property now insured against fire, under a blanket form with the 90 average clause in the amount of 050,000. and that the City Manager and Auditor be authorized to issue the necessary warrant against the emergency revolving fund when the amount of the premium is determined. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: None. Absent: None. RESOLUTIONS: 16. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2758 Cancelling City Taxes and Assessments on Real Property Acquired by the United States of America." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5) . Noes: Hone. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 17. The following . resolution was introduced by Councilman Jones, who moved its adoption: "Resolution No. 2759 Authorizing Filing of Disclaimer in Eminent Domain Action Instituted by the United States of America." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Dranscheid, Howe, Jones, Maurer and President Godfrey, (5). Noes: Hone. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 12. The following resolution was introduced by adoption: ouncilman Branscheid, who moved its "Resolution No. 2760 Approving Contract with Goodell, Byers & Henry, Certified Public Accountants, and Authorizing the Execution Thereof." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried. by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5) . Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 19. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2761 Designating Certain Lands Dedicated for Street or Highway Purposes as 'Edison Court'." The motion to adopt said resolution was seconded b- Councilman Eranscheid and on roll call carried bv the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5) . Noes: Hone. Absent: None. Thereupon the Eayor declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution No. 2762 Approving First Supplemental Memorandum of Agreement for Expenditure of 1/4 Cent Gas Tax Allocated for State Highways." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Hbwe, Jones, Maurer and President Godfrey, (5) . Nees: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 21. The following resolution was introduced by Councilman Howe, who moved 1 adoption: "Resolution Lo. 2763 Adopting Budget and Approving Mbmorandum of Agreement for Expenditure of 1/4 Cent Gas Tax Allocated for Streets of Major importance." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2764 Authorizing Performance and Completion of a Project for the Improvement of Encinal Avenue in the City of Alameda and Directing the City Clerk to Advertise for Sealed Bids." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Dranscheid, Howe, Jones, Maurer and. President Godfrey, (5) . Noes: None. Absent: None. Thereupon. the Mayor declared said resolution duly adopted and passed. 23. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2765 Authorizing the City Attorney of the City of Alameda to Take Certain Action in Eminent Domain. Proceedings Instituted by the United States of America." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5). Nees: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 24. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2766 Granting Permit to Alameda Belt Line to Construct, Maintain and. Operate a Railroad Spur Track Across Clement Avenue in the City of Alameda." The motion to adopt said resolution was seconded oy Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Maurer and President Godfrey, (5) . Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 25. "Ordinance No. 802, New Series An Ordinance Accepting Conveyance of Certain Lands from Union iron Works Dry Dock Company for Street Purposes." Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by Councilman Howe and on roll call carried by the following vote.
