HELD TUESDAY EVENING, JULY 7, 1942
The meeting convened at 8:00 p. m. with Vice President Maurer presiding.
ROLL CALL:
The roll was called and Councilmen Branscheid, Howe, Jones and Vice President Maurer,
(4), were noted present. Absent: President Godfrey, (1).
MINUTES:
1. The minutes of the regular meeting held. June 16, 1942, and of the adjourned regular
meetings held June 23, and. June 29, 1942, were approved as transcribed.
WRITTEN COMMUNICATIONS:
2. From Louis Goldstein, disabled world war veteran and resident of San Francisco, re-
questing a gratuitous license to sell floor coverings in the City of Alameda.
There being no objections, the request was referred to the City Manager for investigation.
3. From the California Sewage Works Association, requesting that an official of the
City of Alameda be authorized to become a member.
Upon recommendation of the City Manager, Councilman Jones moved that the City Engineer
be enrolled and the City subscribe to his membership in this organization. The motion
was seconded by Councilman Howe and unanimously carried.
4. From Mr. Angelo Spingola, requesting permission to move a house situated on property
known as 2126 Clement Avenue to a lot on the corner of Encinal Avenue and Court Street -
more specifically known as 1300 Court Street.
This request was accompanied by a recommendation from the Building Inspector that permis-
sion be granted to move this house provided all regulations of the zoning and building
ordinances and the Alameda Municipal Code be complied with. The present length of the
dwelling will necessitate removal of a room at the rear to permit the required front and
rear yards on this particular lot.
Councilman Howe moved the permit be granted provided that all conditions and regulations
of City ordinances be complied with. The motion was seconded by Councilman Jones and
unanimously carried.
5. From forty-five residents and property owners on Bay Street, between San Antonio
Avenue and the Bay, requesting that the heavier limbs be removed from the cork elm trees
growing on each side of the street so that further damage to the trees and adjacent side-
walks might be avoided, and that at the proper time these trees be trimmed correctly.
There being no objections, this matter was referred to the City Manager who gave assur-
ance that the trees would receive careful attention.
6. From the Board of Supervisors of Alameda County, advising that they had approved
the report of the County Surveyor concerning the proposed reconstruction of traffic
lanes in Posey Tube, as submitted by Mr. Lochiel M. King. The County Surveyor recom-
mends that the plan be rejected.
There being no objections, the communication was ordered filed.
7. From the Twelfth Naval District, San Francisco, requesting permission to commence
construction operations immediately for a national defense project on a parcel of land
at the foot of Pacific Avenue, Alameda, which is owned by the City and contains approxi-
mately twenty-one acres.
There being no objections, the matter was referred to "Resolutions".
8. An application from the American Dredging Company for a permit to dredge and fill
certain lands more particularly described on the map attached thereto and commonly known
as the old Liberty Shipyard property. This application was accompanied by a bond in the
amount of $5,000. as required by the Alameda Municipal Code.
Mr. Burnhill, Attorney for the American Dredging Company, was present and addressed the
Council further in this regard.
Councilman Branscheid then moved that this permit be granted provided all provisions of
City ordinances pertaining to the filling of land, be complied with. The motion was
seconded by Councilman Howe and unanimously carried.
ORAL COMMUNICATIONS:

9. Mr. Frank Gottstein addressed the Council with regard to painting curbs red to
designate loading zones for San Francisco buses at various points in Alameda, particularly
at the corner of Webster Street and. Lincoln Avenue.
The City Manager addressed the Council further in this matter and as the suggestion of
Mr. Gottstein was deemed to be of merit, it was referred to the City Manager for inves-
tigation.
OPENING OF BIDS:
Al/. Bid was presented from Heafey-Moore Co. for the improvement of Encinal Avenue,
from High Street to Fernside Boulevard, in the amount of 23,650.50. This bid was
accompanied by a certified check in the amount of $2,400.
There being no objections, the matter was referred to the City Manager and City Attorney
for study and recommendation.
REPORTS OF COMMITTEES:
11. From the Auditor and Assessor, submitting assessment figures of the City for the
year 1942. The total assessment for this year is $34,613.250. which is a gain of
1,005,965. over last year. This report was ordered filed.
1'. From the City Manager, recommending that contract be awarded to Rhodes-Jamieson,
Ltd., for furnishing Portland Cement to the City of Alameda for the fiscal year 1942-43,
at the amount set forth in its proposal.
Councilman Jones moved the recommendation of the City Manager be adopted; that contract
be awarded to Rhodes-Jamieson, Ltd. for furnishing cement to the City for the fiscal
year 1942-43, and that bid checks be returned to the unsuccessful bidders. The motion
was seconded by Councilman Howe and on roll call carried by the following vote. Ayes:
Councilmen Branscheid, Howe, Jones and Vice President Maurer, (4). Noes: None.
Absent: President Godfrey, (1).
13. At this point the City Manager verbally reported to the Council that upon exami-
nation of bids submitted for supplying crusher run rock to the City for the fiscal year
1942-43, it was his recommendation that this commodity could more profitably be pur-
chased in the open market and that, the bid of the Superior Rock Company which was pre-
sented to the Council at the meeting of June 16, 1942, be rejected.
There being no objections, the City Manager's report on this matter was accepted and
further referred to "Resolutions".
14. From the Building Inspector, advising that request has been made by Younger Con-
struction Company for refund of.building permit fee in the amount of $42., pertaining
to the building of a Government warehouse at 2007 Clement Avenue. This claim is based
on the fact that the land and huilding involved are owned by the United States Govern-
ment and therefore payment of building permit fee is not required.
There being no objections, this matter was referred to the City Attorney for investiga
tion and report.

15. From the City Manager and City Attorney, recommending that bids received for fur-
nishing rock, sand and concrete Mix to the City for the fiscal year 1942-43, be rejected,
and that the Council adopt a resolution authorizing the purchase of this material in
the open market.
There being no objections, the recommendation of the City Manager and City Attorney was
accepted and the matter referred further to "Resolutions".
ORDINANCES FOR INTRODUCTION:
16. Councilman Howe introduced the following ordinance, after which it was laid over
under provision of law and the Charter:

17. Councilman Jones introduced the following ordinance, after which it was laid over
under provision of law and the Charter:

An Ordinance Authorizing Emergency Suspension of All
Building, Electrical, Gas Appliances or Plumbing
Ordinances, Authorizing the Use of Substitute Materials
and Methods During the Period of National Emergency,
and Declaring an Emergency."
RESOLUTIONS:
18. The following resolution was introduced by Councilman Howe, who moved its
adoption:
"Resolution No. 2771
Transferring $1,000.00 from the General Fund
to the Initiative Relief Fund."
The motion to adopt said resolution was seconded by Councilman Branscheid and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and
Vice President Maurer, (4). Noes: None. Absent: President Godfrey, (1). Thereupon
Vice President Maurer declared said resolution duly adopted and passed.
19. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2772
Granting Permission to the United States to Enter
Certain Lands Belonging to the City of Alameda and
to Commence Construction Thereon."
The motion to adopt said resolution was seconded by Councilman Jones and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice
President Maurer, (4). Noes: None, Absent: President Godfrey, (1). Thereupon Vice
President Maurer declared said resolution duly adopted and passed.
20. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 2773
Providing for the Amount Per Diem for Officers and
Employees of the City of Alameda for Traveling Expenses."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice
President Maurer, (4). Noes: None. Absent: President Godfrey, (1). Thereupon Vice
President Maurer declared said resolution duly adopted and passed.
21. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2774
Authorizing Execution of Lease Between the City of
Alameda and the County of Alameda of a Portion of
the Health Center Building."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and. Vice
President Maurer, (4). Noes: None. Absent: President Godfrey, (1). Thereupon Vice
President Maurer declared said resolution duly adopted and passed.
22. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2775
Authorizing Purchase of Crusher Run Rock for the
Fiscal Year 1942-43 in the Open Market."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice
President Maurer, (4). Noes: None, Absent: President Godfrey, (1) . Thereupon Vice
President Maurer declared said resolution duly adopted and passed.
23. The following resolution was introduced by Councilman Howe, who moved its
adoption:
"Resolution No. 2776
Authorizing Purchase of Rock, Sand and Concrete Mix
for the Fiscal Year 1942-1943 in the Open Market."
The motion to adopt said resolution was seconded by Councilman Jones and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and Vice
President Maurer, (4). Noes: None. Absent: President Godfrey, (1). Thereupon Vice
President Maurer declared said resolution duly adopted and passed.
FILING:
24. Auditor's Balance Sheet - Month ending June 30, 1942.
25. Form of Lease - Between City of Alameda and County of Alameda for portion
of Health Center Building.
BILLS:
26. An itemized. List of Claims against the City of Alameda and the Initiative Relief
Fund in the amount of $50. was presented to the City Council.
Councilman Branscheid moved the bills and claims against the City in the amounts listed
and itemized in the List of Claims filed with the City Clerk on July 7, 1942, and pre-
sented to the Council at this meeting, be allowed and paid. The motion was seconded
by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Howe, Jones and Vice President Maurer, (4). Noes: None. Absent:
President Godfrey, (1).
ADJOURNMENT:
27. There being no further business to come before the meeting, the Council adjourned
to assemble in regular session on Tuesday evening, July 21, 1942, at 8:00 p. m.
