HELD TUESDAY EVENING, AUGUST 16th 1938
The meeting convened at 8 o'clock P.M. with President `,Neichhart presiding.
The roll was called, and Councilmen Carrington, Morris and President Weichhart,
(3), were noted present. Absent: Councilmen Godfrey and Maurer, (2).
MINUTES:
The.,minutes of the regular meeting of August 2nd,1938, were approved as transcribed.
WRITTEN COMMUNICATIONS:
1. Copy of a resolution was presented of the City Council of the City of Piedmont, request
ing the City of Oakland to extend invitation to the League of California Municipalities
to hold 1939 convention in the Oakland Area. The communication was ordered filed.
2. From the Alameda Improvement Club, requesting that metal signs be placed in each
block on Webster Street from Pacific to Central Avenues, informing the public that bicycle
riding is prohibited on the sidewalks. The communication was referred to the City Manager.
'3. From J. A. Fanning of Whittier, California, requesting a gratuitous license to dem-
onstrate and sell condensers for automobiles, on the grounds that he is a disabled Spanish
War veteran. The petition was referred to the City Manager.
/4. From A. C. Faris, Secretary, calling attention to the quarterly meeting of the East
Bay Division of the League of California Municipalities, to be held in Albany on Friday
evening, August 26th, 1938. All officials of the City were urged to attend and to
notify the City Manager so that he might inform Mr. Faris of the number of officials
who will be present from Alameda.
5. From Burton B. Brace, alleging that a nuisance is caused by use of the baseball
field at Washington Park through baseballs being batted over the fence and failing among
the Marina Court Apartments. The City Manager informed the Council that it was expected
that in the course of a few years the pumping plant in the park would require replace-
ment and at that time the ball field could be extended into the park area and permit
the moving of the home plate a greater distance from the present fence, and recommended
that, in the meantime, the height of the fence be increased to 60 or 65 feet. Council-
man Carrington moved that the recommendation of the City Manager be adopted, seconded
by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen
Carrington, Morris and President Weichhart, (3). Noes: None. Absent: Councilmen Godfrey
and Maurer, (2)..
HEARINGS:
A. An affidavit was received from the Building Inspector of the posting and mailing of
Notice to Abate Nuisance consisting of a building or structure situated at the rear of
premises known as 1530 Lincoln Avenue. Mr. G. E. Ingraham, owner of the property,
addressed the Council informing it that during periods of vacancy of the property un-
known persons damaged the premises, that this had occurred repeatedly and that he had
notified the police a number of times of the damage being done. The City Manager was
requested to investigate and to consult with the Police Department and report to the
Council.
7. An affidavit was presented by the Building Inspector of the posting and mailing of
Notice to Abate Nuisance consisting of a building or structure known as 1732 Buena Vista
Avenue. Councilman Morris moved that the above hearings be postponed until the
regular meeting of September 6th, 1938, seconded by Councilman Carrington and on roll
call carried by the following vote: Ayes: Councilmen Carrington, Morris and President
Weichhart, (3). Noes: None. Absent: Councilmen Godirey and Maurer, (2).
REPORTS OF COMMITTEES:
A. From the City Planning Board, recommending that a temporary revocable permit be
granted to Mrs. Effie Johnson to use property known as 891 Union Street, as a Rest
Home. Mr. Nelson Birkholm addressed the Council and stated that a number of property
owners adjacent to the premises had been absent on vacation when the proceedings had
begun and had not had an opportunity to file a protest. Councilman Morris suggested
that the hearing be postponed until the regular meeting of September 6th, 1938, and
it was so ordered
✓`9. From the Public Utilities Board, inclosing copy of a stipulation to be signed in
connection with the action of the City of Alameda vs. Charles Johnson, as the action had
been compromised. Councilman Morris moved that the City Attorney be authorized to
execute the stipulation, seconded by Councilman Carrington and on roll call carried by
the following vote: Ayes: Councilmen Carrington, Morris and President Weichhart, (3).
Noes: None. Absent: Councilman Godfrey and Maurer, (2).
10. From the City Manager, informing the Council that the Municipal Traffic Safety
Committee of the Western Safety Conference will hold its annual convention in Los
Angeles September 12 to 16, inclusive, and that he is Chairman of the Sub - Committee
on Coordination of Traffic Enforcement, Safety Engineering, Highway Construction and
Utility Operation and as such will be required to preside over a sectional meeting
to be held on Wednesday, September 14th. Councilman Carrington moved that the City
Manager be authorized to represent the City of Alameda at the convention referred to,
seconded by Councilman Morris and on roll call carried by the following vote: Ayes:
Councilmen Carrington, Morris and President Weichhart, (3). Noes: None. Absent:
Councilmen Godfrey and Maurer, (2) .
✓ 11. The City Manager recommended that the City Attorney, the City Manager and the
Health Officer be authorized to represent the City of Alameda at the convention of
the League of California Municipalities to be held. in Santa Barbara on September 6 to
9 inclusive, Councilman Carrington moved'that, the recommendation of the City Manager
be adopted, seconded by Councilman Morris and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Morris and President Weichhart, (3). Noes: None. Absent:
Councilmen Godfrey and Maurer, (2).
112. The City Manager recommended that the bids for furnishing cement to the City of
Alameda for the fiscal year 1938 -1939, which were opened at the Council meeting of
August 2nd, 1938, be rejected, for the reason that it is possible to purchase cement
in the open market at a price lower than at price bid. As it would require a four -
fifths vote of the Council to carry a resolution to that effect, Councilman Morris
moved that action be postponed until the next regular meeting of the Council to be
held September 6th, 1938, seconded by Councilman Carrington and unanimously carried.
X13. The City Manager reported that the bids for furnishing gasoline to the City for
the fiscal year 1938 -1939, which were opened at the regular meeting of the Council
held August 2nd, 1938, were irregular with the exception of the bid of The Hancock
Oil Company of California, which was the low bidder, and recommended that the contract
be awarded to that company. Councilman Morris moved that the recommendation of the
City Manager be adopted and that contract be awarded to The Hancock Oil Company of
California and that the certified checks which accompanied the other bids be returned
to the bidders, seconded by Councilmen Carrington and on roll call carried by the
following vote: Ayes: Councilman Carrington, Morris and President Weichhart, (3). Noes:
None. Absent: Councilmen Godfrey and Maurer, (2).
X14. The City Manager submitted a summary of activities of the City for the month of
July 1938. The report was ordered filed.
UNFINISHED BUSINESS
-'15. The recommendation of the City Planning Board that the petition be denied
for the reclassification of property known as 325 Pacific Avenue from Residential
District, Class I, to Resiantial District, Class II, and that the petitioner be granted
a temporary revocable permit to conduct a boarding house in the building now located
on the property, came up for consideration. This matter had formerly been presented
at the regular meeting of the Council held August 2nd, 1938, and was postponed until
this meeting. Mr. Rice, representing the executors of the Vowinckel estate, presented
drawings and plans of the contemplat&improvements on the property and Mr. Clifford
Mehrtens, representing the 'Webster Street merchants, Mr. Bleeson and Col. Ned Orr and
others, representing the property owners in favor of reclassifying the property also
spoke. Councilman Morris moved that the recommendation of the City Planning Board
be not adopted and that the property be reclassified from Residential District, Class I,
to Residential District, Class II, seconded by Councilman Carrington after stressing
the necessity of a complete survey of the City for zoning purposes and the adoption of
a new zoning map and ordinance, and on roll call the motion carried by the following
vote: Ayes: Councilmen Carrington, Morris and President Weichhart, (3). Noes: None.
Absent: Councilmen Godfrey and Maurer, (2).
RESOLUTIONS:
16. Councilman Morris introduced and moved the adoption of
"Resolution No. 2279
Providing for the Amount per Diem for the Officers and Employees
of the City of Alameda for Traveling Expenses ",
Councilman Carrington seconded the motion and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Morris and President leichhart, (3). Noes: None. Absent:
Councilmen Godfrey and Maurer, (2).
17. Councilman Carrington introduced and moved the adoption of
"Resolution No. 2280
Granting Permit to Henry C. Hacke, His Heirs and Assigns, to
Construct, Reconstruct, Maintain and Operate a Railroad Spur
Track on Certain Portions of Bryant and Spruce Streets in the
City of Alameda ",
Councilman Morris seconded the motion, and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Morris and President Weichhart, (3). Noes: None. Absent:
Councilmen Godfrey and Maurer, (2).

23. The Mayor declared a recess to permit the City Attorney to draw up an ordinance for
introduction, following which the Council resumed the session under the heading of

thereof in the total amounts as follows, was presented to the City Council: General De-

Department, $140.48; Park Department, $637.47; Golf Course Department, $590.85; Store

Councilman Carrington moved, seconded by Councilman Morris, that the claims and bills
against the City in the amounts as listed and itemized in the List of Claims filed with
the City Clerk on August 16th, 1938, and presented to the Council at this meeting be
allowed and paid. On roll call this motion carried by the following vote: Ayes: Council-
men Carrington, Morris and President Weichhart, (3). Noes: None. Absent: Councilmen
Godfrey and Maurer, (2) .
26. There being no further business to transact, the Council adjourned to meet in
regular session on Tuesday evening, September 6th, 1938, at 8 o'clock P.M.
