HELD TUESDAY EVENING, SEPTEMBER 6th, . . . . 1938
The meeting convened at 8 o'clock P.M. with President Weichhart presiding,
The roll was called, and Councilmen Carrington, Godfrey, Maurer, Morris and President
Weichhart, (5), were noted present. Absent; None,
MINUTES:
The minutes of the regular meeting of August 16, 1938, and of the special meeting
of August 29, 1938, were approved as transcribed.
WRITTEN COMMUNICATIONS:
Vl. A letter from W. R. Calcutt in reference to distribution of handbills addressed to
the Mayor was presented, together with a copy of the Mayor's reply, and was referred to
the Committee of the Whole.
2. A letter was received from the City of Emeryville accompanied by a resolution request-
ing the City of Oakland to extend an invitation to the League of California Municipalities
to hold 1939 convention in,Oakland area. The communication was —ordered filed.
A. From Jordan & Ticoulet, informing the Council that an examination had been made of
the records and accounts of the Bureau of Electricity for the month of Ally 1938; that
the cattl: had been verified and agreed with the accounts of the Treasurer, the value
of the major merchandise equipment was within the restrictions imposed by the City
Charter and the report prepared by the Bureau of Electricity and submitted to the Council
and City Auditor is in agreement with the books of account of the Bureau. The communica-
tion was ordered filed.
v4. A petition was receivec4 signed by three property owners in the block on Fifth Street
between the north line of Pacific Avenue andthe south line of Buena Vista Avenue, request-
ing that the street be curbed and macadamized. The communication was referred to the
(City Manager.
5. From Earl Warren, Chairman of Advisory Board of California Technical Institute for
Peace Officers' Training, informing the Council that Chief of Police Vern Smith and
Inspector Lloyd R. Wendland had completed a course conducted at the San Jose State
College, and commending them for the manner in which they had completed the work. The
communication was ordered filed.
'13. From the International City Managers' Association, extending an invitation to the
Council to attend the twenty-fifth annual conference of the Association to be held in
Boston on September 26th to 29th inclusive. The communication was referred to the
Committee of the Whole.
4. From Barrett Camp No. 29, United. Spanish War Veterans, proposing that a fitting
memorial or testimonial be planned in memory of the late E. Harry Levy in recognition of
his labors for the welfare of the City, and requesting a conference between the Council
and a committee appointed for that purpose. The communication was referred to the
Committee of the Whole.
A. From Alameda Chapter No. 8, Disabled. American Veterans of the World War, requesting
permission to install pipe receptacles in the sidewalks in front of the premises of
local merchants, in order to display flags on patriotic holidays. The communication was
referred to the City Manager.
/9. From Judge Daniel H. Knox, requesting that the City allow him traveling expenses to
attend the Western Safety Conference in Los Angeles, September 12 to 16, inclusive.
Councilman Carrington moved that a sum not to exceed $50.00 be allowed for the purpose
requested, seconded by Councilman Maurer and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: Council-
man Godfrey, (1). Absent: None.
HEARINGS:
10. The matter of abandonment of building at 1732 Buena Vista Avenue and the structure
in rear of premises known as 1530 Lincoln Avenue came up for hearing, the hearing having
been postponed from the regular meeting of August 16th, 1938. At the request of the
Building Inspector, the hearing was postponed until the next regular meeting of the
Council, September 20th, 1938, due to the absence of the City Manager and the City Attorney
REPORTS OF COMMITTEES:
'11. From tae Mayor and City Manager and the Deputy Auditor reporting that the money and
securities of the City had been counted on August 17th, 1938, and it was foundthere was
under the control of the City Treasurer the amount which according to the Auditor's books
should have at that time been in the City Treasury. The report was ordered filed.
/12. From tie City Manager, recommending that the Building Inspector be granted permission
to attend the Pacific Coast Building Officials Conference to be held in Reno, Nevada,
October 4th to 8th. Councilman Maurer moved that the recommendation of the City Manager
be adorted, and the Building Inspector be granted an expense allowance not to exceed
$50.00, seconded by Councilman Morris and an roll call carried by the following vote:
Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and. President Weichhart, (5). Noes:
None. Absent: None.
-43. From the City Planning Board, recommending that a temporary revocable permit be
granted for the use of premises at 319 Santa Clara Avenue, as a day nursery. Council-
man Carrington moved that the recommendation be adopted, and a temporary revocable
permit be granted, seconded by Councilman Morris and on roll call carried by the
following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President
Weichhart, (5). Noes: None. Absent: None.
14. From the City Planning Board, recommending that property known as 1535 Everett
Street be reclassified from Residential District, Class I, to Residential District,
Class II, for the purpose of constructing and maintaining apartments. There being no
objections to the rezoning, Councilman Maurer moved that the recommendation of the
City Planning Board be adopted, seconded by Councilman Carrington and on roll call
carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None.
v15. From the City Planning Board, recommending the reclassification of property
situated on west side of Broadway, 150 feet south of San Jose Avenue, from Residential
District, Class I, to Residential District, Class II, for the purpose of erecting and
maintaining apartments. Councilman Maurer moved that the recommendation be adopted,
seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes:
Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes:
None. Absent: None.
216. From the City Planning Board, recommending the reclassification of property known
as 1244 Broadway, from Residential District, Class I, to Residential District, Class
1 3/4, for the purpose of remodeling into apartments. Councilman Maurer moved that the
recommendation be adopted, seconded by Councilman Carrington and on roll call carried
by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and Pres-
ident Weichhart, (5).Noes: None. Absent: None.

UNFINISHED BUSINESS:
21. A recommendation was presented from the City Manager that the Council reject the bid
for furnishing cement to the City for the fiscal year 1938-1939, which was opened at the
regular meeting of August 6th, 1938, for the reason that it is possible to purchase cement
in the open market at a lower price than that bid. Councilman Carrington moved that the
recommendation of the City Manager be adopted and the bid be rejected, seconded by Coucil-
man Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington,
Godfrey, Maurer, Morris and President Weichhart,(5). Noes: None. Absent: None.
22. There was presented for consideration the recommendation of the City Planning Board
that a temporary revocable permit be granted for the use of the property known as 891
Union Street for a rest home. Action on this matter was postponed from the regular
meeting of the Council held on August 16th, 1938. Mr. H. J. Clayfish, representing Mrs.
Effie Johnson, addressed the Council in behalf of the petitioner. Mr. A. C. Keane,
representing the opponents, requested a continuance of two weeks, in order that he might
familiarize himself with the situation. A number of property owners also spoke in
behalf of the petitioner and following a discussion by members of the Council, Council-
man Maurer moved th t the petition be referred back to the City Planning Board for a
hearing at its next regular meeting, Wednesday evening, September 14,1938, seconded by
Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen
Carrington, Godfrey, Maurer and President Weichhart, (4). Noes: Councilman Morris,(1).
Absent: None.
NEW BUSINESS:
23. Councilman Carrington addressed the Council in reference to the employment of Mr.
I. N. Shattuck to supervise a complete survey of the City and prepare a new zoning map
and new zoning ordinance, as had been recommended by the City Planning Board, and moved
that Mr. Shattuck be invited to appear at the next Council meeting for the .purpose of
discussing the work, and the motion was seconded by Councilman Maurer, Councilman Morris
moved to amend the motion and that Mr. Shattuck be invited to attend a meeting of the
Council as Committee of the Whole, to be held after the next regular Council meeting,
September 20, 1938. Councilman Maurer seconded the motion and on roll call carried by
the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer,Morris and President
Weichhart, (5). Noes: None. Absent: None.
RESOLUTIONS:
24. Councilman Carrington introduced and moved the adoption of
"Resolution No. 2283
Rejecting Bids and Authorizing the Purchase of
Portland. Cement in the Open Market",
Councilman Maurer seconded the motion, and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes:

25, Councilman Maurer introduced and moved the adoption of

Approving and Adopting a Budget for the Fiscal Year

Councilman Godfrey seconded the motion, and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart (5).

26. Councilman Godfrey introduced and moved the adoption of
"Resolution No. 2285
Fixing the Rate and Levying a Tax on all Real
and Personal Property in the City of Alameda
for the Fiscal Year 1938-1939, and Apportioning
the Same Among tne Several Funds of the City",
Councilman Carrington seconded the motion, and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Godfrey, Maurcr, Morris and President Weichhart, (5). Noes:
None. Absent: None.
'/27. Councilman Godfrey moved that the Council go on record as expressing its approval
of the efficient and capable management of the City Manager, which was largely respon-
sible for keeping the tax rate at the figure adopted in the foregoing resolution,
seconded by Councilman Marer, and on roll call carrieu by the following vote: Ayes:
Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes:
None. Absent: None.
28. Councilman Maurer introduced and moved the adoption of
"Resolution No. 2286
Authorizing the Deposit of Public Funds in Active
and Inactive Deposits in Certain Banks",
Councilman Morris seconded the motion, and on roll call cairied by the following vote:
Ayes: Councilmen Carrington, Godfr-y, Maurer, Morris and President Weichhart, (5). Noes;
None. Absent: None.

3. Councilman Morris moved that the budget for the fiscal year 1938-1939, as filed
in the office of the City Clerk, be accepted and filed, seconded by Councilman Carrington,
and unanimously carried.
BILLS:
34. An itemized list of claims against the City of Alameda and the several departments
thereof inthe total amounts as follows, was presented to the City Council: General
Departments,$816.53; Civil Service Department, $77.50; Police Department, $161.04;
Pound Department, $27.70; Fire Department, $137.45; Street Department, $614.21; Health
Department, $153.23; Recreation Department, $458.30; Park Department, $484.11; Golf
Course Department, $588.51; Store Department, $268.18; Social Service Department,
$197.36; Initiative Relief Fund, $85.00; Street Improvement Fund, !p'154.25; East Bay
Municipal Utility District Payments Fund, $2499.19.
Councilman Maurer moved, seconded by Councilman Morris, that the claims and bills
against the City in the amounts as listed and itemized in the List of Claims filed with
the City Clerk on September 6, 1938, and presented to the Council at this meeting be
allowed and paid. On roll call this motion carried by the following vote: Ayes:
Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes:
None. Absent: None.
35. There being no further business to transact, the Council adjourned to meet in
regular session on Tuesday evening, September 20th, 1938, at 8 o'clock P.M.
