1938-12-06 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, DECEMBER 6th 1938 The meeting convened at 8 o'clock P.M. with President Weichhart presiding. The roll was called, and Councilmen Godfrey, raurer, Morris and President Weichhart, (4), were noted present. Absent Councilman Carrington. MINUTES: 1. The minutes of the regular meeting of November 15th, 1938, were approved as transcribed. WRITTEN COITMULICATIONS: Y2. From the California Section of the American Chemical Society, in which was in- corporated a resolution calling for the elimination of the odor nuisance in the East Bay approach to the Bay Bridge. The communication was referred to the Mayor for reply. ..)• From A.G. Faris, Secretary of the East Lay Division of League of California Munici- palities calling attention to the postponement of the meeting of the League to be held at !:artinez, from December 2nd to December 9th. Coillmunication was ordered filed. /4. From Alameda County Mosquito Abatement District, informing the Council that the term of Burnett Hamilton as Trustee for the District expires on January 2, 1939, and reeuestine that his successor be appointed. Communication was referred to Resolu- tions. -/5. From Frank A. Gottstein, in reference to the construction of an additional section to the Posey Tube. Communication was ordered filed after the Councilmen had been addressed by Councilman Morris in reference to the proposed under-pass at 23rd Avenue and the Southern Pacific Railroad tracks; by Mr. Gottstein in reference to the new highway thru Oakland connecting with the San Francisco Bay Bridge; and by Councilman Godfrey in reference to the activities of the Transportation Committee. REPORTS OF COMMITTEES: /6. The Mayor, City Manager and Auditor reported that the money and securities in the City Treasury had been counted on November 23, 1938, and it was found there was charge- able to and under the control of the City Treasurer the sum of $382,668.48; which was the amount that should be in the City Treasury, according to the Auditor's books. 7. From the Tax Collector, informing the Council that Max Cherry, holder of a junk dealer's license effective September 20, 1938 and for which he paid 37.52, had died on November 18, 1938, and his widow had requested that the license be cancelled and the balance of the license fee returned to her. The Tax Collector recommended that the unearned balance of 29.12 be returned to Mrs. Cherry. Councilman Godfrey moved that the amount specified be refunded, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and. President Weichhart, (4). Noes: None. Absent: Councilman Carrington. From Jordan (7: Ticoulet, informing the Council that, in accordance with the Charter, an examination had been made of the records and accounts of the Bureau of Electricity for the month of October, 1938; that a detailed audit of the cash receipts and exnen- ditures had been elade and the balance verified and reconciled with the accounts of the City Treasurer, and that the books had been kept in accordance with the regulations 9f the California Railroad Commission. Communication was ordered filed. 9. From the City Planning Board, recommending that the re'luest of the Fernside Home Owners Association be granted for the reclassification of the Northwest corner of 'erigh Street and Fernside Boulevard, and the Northeast corner of Versailles Avenue and Fernside Boulevard, from Business District, Class III, to Residential District, Class 1-1/2; that the Council take the necessary procedure to reclassify the property. Councilman Morris moved that the Council defer action until the next regular meeting and that the parties interested in the proposed proceedings be notified to appear, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Godfrey, laurer, Morris and President Weichhart, (4). roes: None. Absent: Councilman Carrington. 10. From the City Manager, referring to the bids received at the regular meeting of November 15, 1938, for furnishing automobiles to the Police Department, and recommend- ing that the contract be awarded to the Dietz Motor Company, the lowest bidder, at the following net prices: Specification 11-381 - 3 automobiles 1105.00 Specification 11-382 - 1 automobile --- 245.12 Specification 11-383 - 1 automobile --- 245.12 Councilman Maurer moved that the contract be awarded to the Dietz Notor Company at the prices listed above and that the Certified Checks be returned to the unsuccessful bidders, seconded by Councilman Morris and on roll call carried by the following vote: Ayes, Councilmen Godfrey, Maurer, Morris and -2eresident T:Teichhart, (4). From the Public Utilities Board, informing the Council that the Utility had an accumulation of 28,000 pounds of scrap wire, which accumulation was continuing and would, in the near future, exceed the valuation ,of ,:3,000.00, and reeuesting as rei!uired by the Charter the consent of the Council to make the sale. Councilman Godfrey moved that the request be granted, seconded by Councilman ITaurer and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington. .12. From the City Manager, informing the Council that it was possible to change the secuence of the lights on street traffic signals to conform with the State and. National recommendations for uniform traffic lights, by changinu the position of the red and green lenses of the signals. Co=unication was ordered filed. ORDINANCES INTRODUCED: 13. Councilman Maurer introduced "Ordinance No. New Series Amending Sections 17-111 and 17-411 and Repealing Sections 17-112, 17-113 and 17-114 of the Alameda Municipal Code." 14. Councilman Godfrey introduced. "Ordinance No. New Series Amending Section 17-333 of, and adding Section 17-334 to, the Alameda Municipal Code." 15. Councilman Maurer introduced "Ordinance No. New Series Repealing Sections 17-343 and 17-344 of, and adding Section 17-346 to, the Alameda Municipal Code." 16. Councilman Maurer introduced "Ordinance No. Nev Series Amending Section 17-341 of the Alameda Municipal Code by adding Subsections (8), (9) and (10) thereto. 17. Councilman Godfrey introduced "Ordinance No. New Series Amending Article 3, Chapter 4, of Title XVII of the Alameda Municipal Code." .18. Councilman Morris introduced "Ordinance No. New Series Accepting. Conveyance of certain Easements to the City of Alameda." 19. Councilman Maurer introduced "Ordinance No. New Series An Ordinance establishing a retirement, pension and insurance system for officers and employees of the City of Alameda." ti UNFITISEED DUSIlIESS: v20. Councilman Godfrey sw-gested that the Council meet and consider the report of the Yacht harbor Committee, which had been referred to the Committee of the whole. The Council, thereupon, agreed to .:'eet as a Committee of the whole after the regular Council Meeting December 20, 1938. RESOLUTIONS: 21. Councilman 1::orris moved that it..be the unanimous consent of the Council that the following Resolution be read by title, seconded by Councilman Maurer and unanimously carried. 22. Councilman Morris introduced and moved the adoption of "Resolution No. 2313 Cancelling City Taxes on property acc,,uired b- the City of Alameda for municipal -urposes", Councilman Maurer seconded, the motion, and on roll call carried by the following vote: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington. 23. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2314 Adopting Specifications for furnishing one steel cab, 1-1/2 ton dump truck to the City of Alameda, calling for bids and directing the City Clerk to advertise the same", 24. Councilman Taurer introduced and moved the adoption of "Resolution No. 2315 Appointing Burnett Hamilton on Board of Trustees of the Alameda County Mosquito Abatement District," Councilman Godfrey seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington. 25. Councilman Morris introduced and moved the adoption of "Resolution No. 2316 Approving recording of Survey Tap filed by 7Ialter J. Seaborn", Councilman 11.aurer seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington. ORD=CE 702 PASSAGE: 26. "Ordinance No. 666 New Series TLECLASSIFYING PROPERTY (Property known as 1804 Santa Clara Avenue Councilman Maurer moved that the ordinance as read be adopted, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4 ). Noes: None. Absent: Councilman Carrington. 27. Acceptance of gas franchise by Pacific Gas and Electric Company, filed in City Clerk's office November 29, 1938. 28, Resolution No. 33114 - Board of Supervisors. 29. Balance Sheet - Bureau of Electricity. 30. Auditor's Balance Sheet, Jonth of November 1938. 31. Memorandum of Agreement - State of California for accumulation of 1/4 cent gas tax. 32. Financial Statement for fiscal year 1938-1939, as of October 31, 1938. BILLS: 33. Councilman Godfrey moved, seconded by Councilman Maurer, that the claims and bills against the City in the amounts as listed and itemized in the List of Claims filed with the City Clerk on December 6th, 1938, and presented to the Council at this meeting be allowed and paid. On roll call this motion carried by the following vote: Ayes, Council- men Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Council- man Carrington. 34.
