1938-12-20 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF TI- CITY OF ALAZEDA HELD TUESDAY EVENING, DECEMBER 20th . . . . . 1938 The meeting convened at 8 o'clock P.M. with Council President Weichhart presiding. The roll was called, and Councilmen Carrington, Godfrey, Maurer, Morris and Pres- ident Weichhart, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting of December 6th, 1938, were approved as trans- cribed. WRITTEN COLEUNICATIONS: (2. A communication was received from Harry G. Williams, Auditor of the City of Oakland, extending an invitation to attend a Christmas gathering at the Oakland City Hall on Thursday, December 22nd,1938, between the hours of one and five. After the Mayor had requested as many members of the Council as could to attend, the communication was ordered filed. /3. From the Blind Workers Guild of California, calling attention to violations of the State law regulating the operation of a vehicle when approaching wholly or partially blind persons carrying a cane, white in color or white tipped with red, and requesting cooperation of the Council in enforcing the law. After the City Manager had informed the Council there had been, to his knowledge, no accident in Alameda resulting from violation of the law, the communication was ordered filed. FEARINGS: /4• Councilman'Maurer moved that the hearing on the abatement proceedings against 1530 Lincoln Avenue be postponed for thirty days, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 5. In reference to the hearing on the proposed rezoning of the northeast corner of Versailles Avenue and Fernside Boulevard and the northwest corner of High Street and Fernside Boulevard, the Council was addressed by Attorney E. J. Silver in behalf of the owners of a portion of the property, W. K. Powell, Secretary of the Fernside Home Owners Association, Mr. Ward and Er. Windsor. Councilman Godfrey moved that the City Attorney be requested to draft a resolution of intention to rezone putions of the property now in Class 1 to Class I and to ascertain which other property in the vicinity should be reclassified into Class I, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. OPENING OF BIDS: ,6. Bids were received for furnishing l ton dump truck, as follows: T. H. REPORTS OF C011aTTEES: /7. From the City Manager, submitting a sunnnary of the activities of the City for the month of November 1938. The report was ordered filed. 8. Councilman Morris requested that an effort be made to have the Southern Pacific Company repair the pavement adjoining its tracks in the vicinity of some of the stations on Lincoln Avenue, and the City Engineer reported that a representative of the railroad company had agreed to make such repairs. , 9. From the Interurban Transportation Committee, outlining its efforts to promote the construction of a tube parallel to the present Posey Tube, and recommending that efforts be continued to establish responsibility for the reconstruction of the Fruitvale Avenue Bridge, and the elimination of congested conditions of traffic at 7th and Harrison Streets in Oakland. The communication was referred to the Committee aC the Whole. NEW BUSITESS: .10. Councilman Godfrey moved that City Attorney H. Albert George be granted a vacation of two weeks, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, 15). Noes: None. Absent: None. 11. Councilman Morris read and presented for filing a statement concerning additional traffic regulations throughout the City, to which the City Manager declared he would give consideration. \-12, Councilman Carrington called attention to the conditions of some of the street signs throughout the City, and was informed that it was the custom of the Street Department to make an annual survey and remedy any deficiencies in the signs RESOLUTIONS: 13. Councilman Maurer introduced and moved the adoption of "Resolution No. 2317 Adopting Specifications for Furnishing One Standard Two Door Coupe to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise the Same", Councilman Morris seconded the motion, and on roll call parried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. ORDINANCES PASSED: 14. Councilman Maurer moved that it be the unanimous consent of the Council that all ordinances to be voted on at this meeting be read by title only, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 15. "Ordinance No. 667 New Series Amending Sections 17-111 and 17-411 and Repealing Sections 17-112, 17-113 and 17-114 of the Alameda Municipal Code", Councilman Maurer moved that the ordinance as designated be adopted, seconded by Council- man Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 16. "Ordinance No. 668 New Series Amending Section 17-333 of, and Adding Section 17-334 to, the Alameda Municipal Code", Councilman Morris moved that the ordinance as designated be adopted, seconded by Council- man Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 17. "Ordinance No. 669 New Series Repealing Sections 17-343 and 17-344 of, and Adding Section 17-346 to, the Alameda Municipal Code", Councilman Carrington moved that the ordinance as designated be adopted, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Car- rington, Godfrey, Maurer, Morris and President Weichhart, (5). "Ordinance No. 670 New Series Amending Section 17-341 of the A1ar,eda Municipal Code by Adding Subsections (8), (9) and (10) Thereto", Councilman Carrington moved that the ordinance as designated be adopted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). "Ordinance No. 671 New Series Amending Article 3, Chapter 4, of Title VII of the Alameda Municipal Code", Councilman Morris moved that the ordinance as designated be adopted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). "Ordinance No. 672 New Series Accepting Conveyance of Certain Easements to the City of Alameda", Councilman Carrington moved that the ordinance as designated be adopted, seconded by Councilman Godfrey and on roll call canried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 21. "Ordinance No. 673 New Series An Ordinance Establishing a Retirement, Pension and Insurance System for Officers and Employees of the City of Alameda", Councilman Godfrey moved that the ordinance as designated be adopted, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Car- rington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. FILING: 22, Financial Statement, Jordan & Ticoulet, as of November 30, 1938. 23. Grant of Easement and Right of Way, Soares, Silva and Silva. BILLS: 24. List of Claims against the City of Alameda were presented: Councilman Godfrey moved, seconded by Councilman Maurer, that the claims and bills against the City in the amounts as listed and itemized in the List of Claims filed with the City Clerk on December 20, 1938, and presented to the Council at this meeting be allowed and paid.
