REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA
HELD TUESDAY EVENING, MAY 2, 1939
The meeting convened at 8:02 o'clock P.M. with President Weichhart pres ding.
The roll was called, and Councilmen ā€˛Carrington, Godfrey, Maurer, Morris and Presi-
dent Weichhart, (5), were noted present. .Absent: None.
MINUTES:
1. The minutes of the regular meeting of April 18, 1939, were approved as transcribed.
WRITTEN COMMUNICATIONS:
v2. Two Legislative Bulletins from the League of California Municipalities were presented.
A motion prevailed that these and all future bulletins of this nature be referred to the
Committee of the Whole for study.
V 3. From Mrs. D. Elmer Dyer, expressing her appreciation to Mayor Weichhart and other
members of the Council and City officials, for their tribute to the memory of her late
husband. The communication was ordered filed.
14. From the Alameda Municipal Transportation League, asking for aid in helping to
regain for the people of Alameda a resumption of the ferry service between Alameda and
San Francisco and return, and, believing that. the United States Government will not
permit inadequate and unsatisfactory transportation service, requests an opportunity for
citizens of Alameda to be given a conference with representatives of the Reconstruction
Finance Corporation regarding the possibility of resumption of ferry service. Councilman
Godfrey asked that the City Manager be requested to arrange a meeting between members of
the Alameda Municipal Transportation League and, the Council to discuss this matter and
that the League be requested to have all data and suggestions in readiness for
presentation, and it was so ordered.
/ 5. From Richardsons, Realtors, commending the Council for its authorization of a new
zone survey and zoning map, and offering the planning engineer use of maps in their real
estate office. After Mayor Weichhart had expressed his gratification upon receipt of
the communication, it was ordered filed.
/6. From William D. Bell, requesting that a two hour parking zone be established on
the north and south sides of Lincoln Avenue 300 feet east of Park Street. There being
no objections, the matter was referred to the City Manager for investigation and report.
j 7. From the Alameda High School Dads' Club, wishing to go on record as being in favor
of a municipal swimming pool. Councilman Morris inquired about the probable cost of such
a pool and suggested that some thought be given to appointing a Committee to gather data.
The City Manager stated that he had obtained figures regarding the construction of a
swimming pool and he hoped to be able to make a report thereon at the next meeting of
the Council.
8. From P. Steccone, requesting that a ten foot right of way in the Bay View Tract,
Block 6 between Lots 5 and 6 and 28 and 29, be closed and the property returned to its
former owners.. The communication was referred to the City Manager for investigation
and report.
9. At this time Councilman Maurer moved that the regular order of business be suspended
and the Council proceed under "Opening of Bids", seconded by Councilman Carrington and
unanimously carried.

11. Bid was presented and opened from the National Cash Register Company for furnishing
electrically operated Cash Register, as per specifications No. MS-4-392, filed April 18,

12. The following bids were received and opened for the furnishing of petroleum pro-
ducts, under specifications No. MS-4-391, filed Apr.18,199. Each bid was accompanied
by a certified check in amount of $500.00

A motion prevailed that these bids be referred to the City Manager and the City Attorney
for their recommendation.
/13. At this time the City Manager recommended that contract be awarded to the National
Cash Register Company in amount of $1556.24 for the purchase of an electrically
operated cash register to be used at the Golf Course. Councilman Godfrey moved that
the recommendation of the City Manager be adopted and a contract awarded to the National
Cash Register Company in amount of $1556.24, seconded by Councilman Maurer and on roll
call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None.
14. Councilman Morris moved that the order of business revert to "Hearings; seconded by
Councilman Carrington, and unanimously carried.
BEARINGS:
v/ 15. The matter of the proceedings for the closing of that portion of Park Avenue lying
south of the southerly line of Roosevelt Drive, instituted under Resolution of Intention
No. 2343 adopted. March 21, 1939, came up for hearing at the hour of 8:30 o'clock P.M.,
the hour heretofore fixed by the Council, and there were presented for filing Affidavit
of Posting of Notices thereon, Affidavit of Publication of Notice of Public Work in
the Alameda Times-Star and Affidavit of the Acting City Clerk showing mailing of notices
of this hearing. The same were ordered filed.
Dr. Alfred A. Siebert,appearingfor himself and on behalf of other protestants, spoke
before the Council protesting the closing of the street. Mr. Tom Powers, Mr. M. J.
Kosty, Mr. Thau, Mr. Alves and Mr. Shaw also addressed the Council in protest. Mr.
Montgomery Flynn, Attorney at Law and representing the owner of the property, Mr.
Frank T. Corrah, spoke in favor of closing the portion of the street in question, as
did Mr. Edmund Buckley. After discussion, a motion was made by Councilman Maurer that
the hearing on the objections to the closing of that portion of Park Avenue lying south
of the southerly line of Roosevelt Drive be adjourned and continued to the regular
meeting of the Council to be held on June 6, 1939, at 8 o'clock P.M. The motion was
seconded by Councilman Carrington and on roll call carried by the following vote:
Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5).
Noes: None. Absent: None.
16. The Council then proceeded to "Oral Communications", but as the Council was not
addressed, business continued under regular order to "Reports of Committees".
REPORTS OF COMMITTEES:
"17. From the City Attorney, replying to various questions regarding transportation from
the Alameda Municipal Transportation League which was presented to the Council at the
regular meeting of April 4, 1939, and referred to the City Attorney. The communication
was ordered filed.
J18. Report from the City Manager of activities of the City of Alameda for the month of
March 1939. The report was ordered filed. Councilman Morris moved that in the future
this report be filed and not read in Council meetings but copies be sent to each member
of the Council together with the lists of warrants to be approved and passed, copies
of minutes of Council meetings and the agenda, which are delivered twenty-four hours
preceding regular meetings of the Council. This motion was seconded by Councilman
Carrington and unanimously carried.
19. From the Alameda Recreation Department Basketball Commission, regarding the success-
ful basketball season just passed, and commending the work of Otto Rittler, Superintend-
ent of Recreation. After Mayor Weichhart expressed appreciation of the efforts which
resulted in the successful basketball year, the communication was ordered filed.
/20. From the City Manager, submitting various recommendations whereby a representative
of the City of Alameda could be sent as a medium of advertising the City and the
Municipal Golf Course to the National Public Links Championship Tournament to be
held in Baltimore, Maryland, in the month of July 1939, and recommending that the
representative be allowed the cost of transportation and traveling expenses in t he sum
not to exceed $200.00, same to be paid on completion of the project. Councilman Maurer
moved that the City Managers's recommendations be adopted, seconded by Councilman Morris
and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey,
Maurer, Morris and President Weichhart (5). Noes: None. Absent: None.

21. From the City Plannin Board, recommending the denial of a petition to reclassify
property on the north line of Santa Clara Avenue beginning 100 feet east of Webster Street
and running thence easterly 40 feet, from Business District, Class III, to Business
District, Class V, for the operation of a creamery and automobile repair shop in the rear
of the building. The present classification of the property will permit the operation
of a creamery and an automobile repair shop for the exclusive use of the owner but, it
being the desire of the petitioner to repair automobiles belonging to outsiders as well
as his own fleet of cars, the City Planning Board recommended, further, that a temporary
revocable permit be granted to allow for the, operation of a public repair shop without
the privilege of selling gasoline. Councilman Morris moved that the recommendation of
the City Planning Board be adopted, seconded by Councilman Godfrey and on roll call
carried by the following vote: Ayes: Councilmen CarrinL7ton, Godfrey, Maurer, Morris and
President Weichhart, (5). Nbes: None. Absent: None.
22. From Mayor Henry A. Weichhart, nominating Mr. John Parker, 1712 Palmera Court,
for the office of member of the Board of Education to fill the unexpired term of
Mr. Kenneth C. Smith, resigned. The communication was referred to "Resolutions".
UNFINISHED BUSINESS:
23. Councilman Morris complained about low flying aeroplanes over the City of Alameda
and requested the City Manager to investigate and contact the proper authorities to stop
this annoying and dangerous situation. The City Manager reported that he had contacted
the Civil Aeronautics Authority regarding the nuisance and would again protest to the
Authority to see if planes could not be prevented from flying low over the City of Alameda.
24. VMr. Frank Gottstein addressed the Council on the matter, of low flying aircraft.
RESOLUTIONS:
25. Councilman Godfrey introduced and moved the adoption of
"Resolution No. 2353
Approving Memorandum of Agreement for Expenditure of 1/4
Cent Gas Tax Allocated for State Highways",
Councilman Maurer seconded the motion, and on roll call carried by the following vote:

26. Councilman Carrington introduced and moved the adoption of
"Resolution No. 2354
Adopting Specifications for Furnishing One Standard Two-door
Coupe to the City of Alameda, Calling for Bids and Directing
the City Clcrk to Advertise the Same."

Councilman Morris seconded the motion, and on roll call carried by the following vote:

34. An itemized list of claims against the City of Alameda and the several departments
thereof in the total amounts as follows, was presented to the City Council: General
Departments, $1789.21; Civil Service Department, $6.32; Street Department, $122.10*
Health Department, $52.72; Recreation Department, 24.19; Golf Course Department, .25;
Social Service Deparument, $123.01; Initiative Relief Fund, $124.00; Street Improvement
Fund, $66.00 and East Bay Municipal Utility District Payments Fund, $2500.33.
Councilman Maurer moved, seconded by Councilman Carrington, that the claims and bills
against the City in the amounts as listed and itemized in the List of Claims filed
with the Acting City Clerk on May 2, 1939, and presented tothe Council at this meeting
be allowed and paid. On roll call this motion carried by the following vote: Ayes:

35. There being no further business to transact, the Council adjourned to meet in
regular session on Tuesday evening, May 16, 1939, at 8 o'clock P.M.
