1939-07-18 Regular CC Minutes1 REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, JULY 18, . . ... . .1939 The meeting convened at 8:02 o'clock P.M. with President Weichhart presiding. ROLL CALL: The roll was called, and Councilmen Carrington, Godfrey, Maurer, Morris and Pres- ident Weichhart, (5), were noted present. Absent: None. 1. The minutes of the regular meeting of July 5, 1939, and of the adjourned regular meeting of July 11, 1939, were approved as transcribed. WRITTEN COMMUNICATIONS: 42. A request was presented from Frances Ferguson of Oakland, California, for a permit to conduct a gospel tent meeting at the corner of Webster Street and Taylor Avenue, Alameda, during the months of August and.September. The request was accompanied by recommendation from the Building Inspector that,due to the proposed location of the tent being in Fire Zone No. 1 which does not permit the erection of combustible struc- tures the permit be not granted. Councilman Maurer moved that the request be denied, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None, Absent: None. ORAL COMMUNICATIONS: 3. The City Manager reported on the necessity and advisability of the STOP signs at Fernside Boulevard and Pearl Street which was referred to him for investigation at the regular meeting of July 5, 1939. Councilman Morris asked about the advisability of re- moving only the sign on the north side of Fernside Boulevard and the City Manager stated that, as only one train a day now passes this intersection, he believes both signs could well be removed, and that an ordinance will be introduced at the next regular meeting of the Council changing the traffic laws accordingly. 4. The City Manager reported on the adequacy of the 25 mile per hour sign located at the side of the roadway on Webster Street coming into Alameda, which matter was discussed at the regular meeting of the Council held May 16, 1939, stating that there was to be erected an illuminated sign twice as large as the present one, which will give sufficient light to permit drivers to clearly see it. Councilman Maurer moved that the regular order of business be suspended and the meeting proceed under "Reports of Committees", seconded by Councilman Godfrey and un- animously carried. REPORTS OF COMMITTEES: '6. From the Public Utilities Board with attached communications from Goodell & Henry, Certified Public Accountants, and George B. Middleton & Co., Accountants and Auditors, which were presented to the meeting of the Public Utilities Board held July 13, 1939, and referred to the City Council without action. There being no objection, the matter was referred to "Resolutions". '7. From the City Planning Board, recommending the reclassification of property on the north line of Central Avenue 300 feet east of Chestnut Street, from Residential District, Class I, to Residential District, Class 1 3/4, for the purpose of construct- ing an apartment building. Councilman Godfrey moved that the recommendation of the City Planning Board be approved, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and Pres- ident Weichhart, (5). Noes: None. Absent: None. , ORDINANCES INTRODUCED: 8. "Ordinance No. New Series RECLASSIFYING PROPERTY (Property on the North Line of Central Avenue 300 Feet East of Chestnut Street)', was introduced by Councilman Maurer and laid over under provision of law and the Charter. 9• "Ordinance No. New Series An Ordinance Repealing Sections 7-111 to 7-118 Inclusive, and Amending the Alameda Municipal Code by Adding to Title VII Thereof a New Chapter and Article to be Known as *Chapter 1, Article 1* Regulating Vehicles for Hire", was introduced by Councilman Maurer and laid over under provision of law and the Charter. NEW BUSINESS: 10. The City Attorney requested permission to take one week of his annual vacation during the last of July. Councilman Maurer moved that the City Attorney's request be granted, seconded by Councilman Morris and unanimously carried. 11. At this point Councilman Carrington moved that the order of business revert back to "Opening of Bids ", seconded by Councilman Maurer and unanimously carried. OPENING OF BIDS: 12. Bid was presented and opened for the furnishing to the City of street lighting standards, as per specifications No. MS 7 -3910, as follows: From Taper Tube Pole Co., Accompanied by certified check in the sum of $ 200.00. The bid was referred to the City Attorney and the City Manager for examination, after which the City Manager recommended that the bid be accepted and contract be awarded to Taper Tube Pole Co., in amount of $1919.92. Councilman Maurer moved that the recom- mendation of the City Manager be adopted, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Carrington,Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 1919.92 NEW BUSINESS :Continued. 13. The City Manager stated that Mr. Ben F. Lamborn had requested permission to hold a meeting of the Alameda Municipal Transportation League in the Council Chambers, the exact date for which had not yet bondetermined. Councilman Morris moved that the request be granted and the City Manager be authorized to set a date at his discretion, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Car- rington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent. None. RESOLUTIONS: 14. Councilman Carrington introduced and moved the adoption of "Resolution No. 2398 Adopting Specifications for Furnishing Rock, Sand and Concrete Mix to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise the Same ", Councilman Maurer secorried the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 15. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2399 Approving Form and Terms of Contracts with Wallace Boggs and City of Oakland for Rendering Services in Connection with Subaqueous Tunnel Investigation and Authorizing the Execution Thereof; and Authorizing Hiring of Additional Employees Required for Such Investigation ", Councilman Maurer seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 16. Councilman Maurer introduced and moved the adoption of "Resolution No. 2400 Approving Contract with Goodell & Henry, Certified Public Accountants,and Authorizing the Execution Thereof ", Councilman Godfrey seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. ORDINANCE FOR PASSAGE: 17. "Ordinance No. New Series An Ordinance Leasing Certain Tide and Submerged Lands to United Engineering Company, a Corporation; Approving the Form and Terms of Said Lease and Authorizing Execution Thereof Councilman Godfrey moved that action of passing the foregoing ordinance be postponed until the next regular meeting of the Council to be held August 1, 1939, in order to give the City Manager time to receive replies to his letters sent to the Southern Pacific Company and adjoining property owners, notifying them of the proposed leasing of this property. The motion was seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. FILING: 18. Report of the City Manager, giving City's activities for the month of June 1939. 19. Specifications for Furnishing Sand, Rock and Concrete Mix to the City during the fiscal year ending June 30,1940. 20. Form of Agreement with Wallace B. Boggs, re Subaqueous Tunnel. 21. Form of Agreement with Goodell & Henry, Certified Public Accountants, for the fiscal year ending June 30,1940. BILLS: 23. An itemized list of claims against the City of Alameda and the several depart- ments thereof in the total amounts as follows, was presented to the City Council: General Departments, $4831.01; Police Department, $275.01; Pound Department, 116.48; Fire Department, $264.06; Street Department, $2502.62; Health Department, $30 .11; Recreation Department, $91.15; Park Department, $1039.54; Golf Course Department, $1318.74; Store Department, $91.07; Social Service Department, $138.51; Initiative Relief Fund, $84.00; Street Improvement Fund, $126.00 and Pension Fund, $76.40. Councilman Carrington moved, seconded by Councilman Maurer, that the claims and bills against the City in the amounts as listed and itemized in the Lilt of Claims filed with the City Clerk on July 18, 1939, and presented to the Council at this meeting, be allow- ed and paid. On roll call the motion carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 24.
