1939-08-15 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY- EVENING, AUGUST 15, 1939 The meeting convened at 8 o'clock P. M. with President Weichhart presiding. ROLL CALL: The roll was called and Councilmen Carrington, Godfrey and President Weichhart, ( were noted present. Absent: Councilmen Maurer and Morris, (2). MINUTES: 1. The minutes of the regular meeting of August 1, 1939 were approved as transcribed. WRITTEN COMMUNICATIONS: 2. A communication was presented from the Department of Public Health of the State of California, requesting the presence of the Health Officer of the City of Alameda at the annual meeting of California Health Officers to be held in connection with that of the League of California Municipalities, September 18 to 20, 1939. Mayor Weichhart offered to refer this matter to the City Health Officer and requested that a copy of this communication be prepared for Dr. Skilling. There being no objec- tion, it was so ordered. 3. From John L. McVey, Attorney at Law, notifying the Council that the matter of an encroachment by the City of Alameda in the form of a storm sewer upon the property belonging to Frank T. Correia at the southerly end of Park Avenue, had been placed in his hands for action. There being no objection this matter was referred to the City Manager and City Attorney. 4. A number of communications and petitions containing approximately 58 signatures were presented commending the Dime Taxi Company for its service to Alameda citizens and requesting the Council to pass no ordinance or regulations making it impossible for the Dime Taxi Company to continue its operations in the City of Alameda. There being no objection, consideration of these communications was continued until the next regular meeting of the Council to be held September 5, 1939, as it was the wish of the Council that all members be present when this natter is discussed. 5. From the Alameda Improvement Club requesting the Council to remedy the hazard of the sharp turn at the intersection of Buena Vista Avenue and Everett Street, either by rounding off the turn or installing a reflector warning sign at this location. There being no object ion, this communication was referred to the City Engineer for his report. 6. Two communications were presented from the Alameda Municipal Transportation League requesting the Council to advise which one of three propositions it is willing to recom- mend to bring about a municipal ferry system between Alameda and San Francisco, viz: 1. To obtain $500,000. from the Reconstruction Finance Corporation. 2. To obtain necessary moneys from the Public Utilities Department of the City. 3. To place a proposition on the November 7, 1939 ballot as to whether a $500,000. bond issue will be instigated for establishing a municipal ferry system. Councilman Carrington moved that this matter be referred to the Committee of the Whole for deliberation and to be taken up at the next regular meeting of the Council, seconded by Councilman Godfrey, and so ordered. Mr. Ben Lamborn addressed the Council regarding the desire of the League to expedite proceedings which would make it possible to place the proposition referred to on the November 7, 1939 ballot and urged that a special meeting of the Council be held to decide this transportation question. Councilman Godfrey stated that the Council is not prepared to make any decisions at this time or to set a date for a Council meeting to decide the ferry transportation question. 7. The City Attorney called attention to the fact that an amended ordinance would be re- introduced authorizing the leasing of certain tide and submerged lands to the United Engineering Company at this meeting and an adjourned regular meeting of the Council should be called after the lapse of five days for this ordinance's adoption. He sug- gested that as the Council is to meet as a Board of Equalization on Thursday Evening, August 24, 1939 that this regular Council meeting be adjourned to meet at 7 :30 o'clock on Thursday Evening, August 24, 1939. Whereupon Councilman Godfrey moved that when this meeting adjourns it do so to meet in adjourned regular meeting on Thursday Evening, August 24, 1939 at 7 :30 P. M., seconded by Councilman Carrington and on roll call car- ried by the following vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Mr. Frank Gottstein Addressed the Council re transportation and the urgency of speedy Council action to facilitate a proposition regarding a municipal ferry service to be placed on the November election ballot. OPENING OF BIDS: 9. Bids were presented and opened for the improvement of Lincoln Avenue from the easterly line of Park Street to the westerly gutter line of Everett Street, as follows: From Heafey -Moore Co. Councilman Godfrey moved that these bids be referred to the City Manager for study and recommendation, seconded by Councilman Carrington and on roll call carried by the fol- lowing vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). REPORTS OF COMMITTEES: X11. From the City Manager submitting his recommendation on the bids opened August 1, 1939 for furnishing Rock, Sand and Concrete Mix which had been referred to him for re- port and recommending that all bids be rejected. Councilman Carrington moved that bids for the furnishing of Rock, Sand and Concrete Mix to the City for the Fiscal year end- ing June 30, 1940, be rejected and that checks which accompanied bids be returned to the bidders. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). 4 12. From the Public Utilities Board, accompanied by its Resolution No. 386, "INCREASING DIVIDEND APPROPRIATION BY 37, 000." and requesting the City Manager to advise the Board when the City is ready for this special dividend so that necessary transfers can be made. There being no objection, this communication was ordered filed. 13. From the City Manager notifying the Council he is in receipt of a Certificate of Acceptance from the City Engineer for a well which has been drilled at the Municipal Golf Course under contract with Wilbur F. Nothacker and recommending that the contract be accepted. Councilman Carrington moved that the recommendation of the City Manager be adopted, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). 14. From Charles M. Romanowitz, member of the Public Utilities Board, requesting a leave of absence from the State of California for a period of four weeks commencing August 17, 1939. On motion of Councilman Godfrey, seconded by Councilman Carrington, this leave of absence was granted and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). 15• At this time Mayor Weichhart addressed the Council regarding the gift of $7,000. from Mrs. Ida Krusi, deceased, for the cost of a building to be erected on the property donated by herself and Mr. Krusi for park purposes and now officially known as "Krusi Park". NEW BUSINESS 16. A form of lease between the City of Alameda and United Engineering Company was presented for filing. Councilman Godfrey moved that this form of lease be filed, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). RESOLUTIONS: 17. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2406 Granting to the United States of America an Indeterminate Revocable Permit to Construct and. Maintain Storm Drainage Pipes Across Tide and. Submerged. Lands of the City Adjoining the Naval Air Station." Councilman Carrington seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey and. President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and. Morris, (2). ORDINANCES PASSED: 18. "Ordinance No. 690 New SerieS RECLASSIFYING PROPERTY (Southwest Corner of Lafayette Street and Santa Clara Avenue) Councilman Godfrey moved that the ordinance as'read be'adopted, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey and. President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). 19. "Ordinance No. 691 (Amending Subsection (4) of Section 17-431 of the Alameda Municipal Code)." Councilman Carrington moved that the ordinance as read be adopted, seconded by Council- man Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington Godfrey and President Weichhart, (3). "Ordinance No. An Ordinance Repealing Sections 7-111 to 7-118 Inclusive, and Amending the Alameda Municipal Code by Adding to Title VII Thereof a new Chapter and Article to be known as "Chapter 1, Article 1", Regulating Vehicles for Hire." At this point Councilman Godfrey moved that the proposed ordinance entitled "AN ORDINANCE LEASING CERTAIN TIDE AND SUBMERGED LANDS TO THE UNITED ENGINEERING COMPANY, A CORPORATION: APPROVING THE FORM AND TERMS OF SAID LEASE AND AUTHORIZING EXECUTION THEREOF" introduced at the adjourned regular meeting of this Council held on July 11, 1939 be amended in the following particulars: Strike out the word "September" in line 13 of the first para- graph of the preamble thereof and substitute in lieu thereof the word "October"; strike out the words "July 11" in line 4 of the third paragraph of the preamble thereof and substitute in lieu thereof the words "August 15"; and strike out the word "adjourned" in the fourth line of the third paragraph of the said preamble". The motion was seconded by Councilman Carrington and on roll call carried by the follow- ing vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Councilman Godfrey moved that the regular order of business be suspended and that the Council proceed under "Ordinances Introduced", seconded by Councilman Carrington and unanimously carried. ORDINANCES INTRODUCED: 23. Councilman Godfrey re-introduced, as amended, the following ordinance, after which it was laid over as provided by law and the Charter: "Ordinance No. New Series 1•11•11•■••■• An Ordinance Leasing Certain Tide and Submerged Lands to United. Engineering Company, A Corporation; Approving, the Form and Terms of said Lease and Authorizing Execution Thereof". 24. Councilman Godfrey now moved that the Council proceed under the regular order of business, "Filing", seconded by Councilman Carrington and unanimously carried. FILING: 25. Councilman Carrington inquired if a date had been set for a meeting between the manager of the Public Utilities Department and the members of the Council to discuss improved lighting facilities at the intersections of Santa Clara Avenue and cross streets. Mayor Weichhart stated he assumed this matter would be taken care of upon return of the City Manager who is now on vacation. 34. At this point Councilman Carrington moved that the Council revert back to "New Business", seconded by Councilman Godfrey and unanimously carried. NEW BUSINESS continued) 35. The City Attorney requested he be authorized to employ Mr. Bestor Robinson, Attor- ney at Law, to assist him in litigation and other matters now pending in his office, at a maximum fee of $250. Bills for Mr. Robinson will be presented as work is completed and paid upon authorization of the Council. On motion of Councilman Carrington, seconded by Councilman Godfrey, the City Attorney was authorized to employ Mr. Robinson's services at a fee not to exceed $250., to assist him in litigation and other matters now pending in the City Attorney's office. On roll call, the motion carried by the follow ing vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). 36. Councilman Godfrey requested that copies of the two letters submitted to this meet- ing of the Council by the Alameda Municipal Transportation League be furnished each member of the Council. '137. Councilman Carrington moved that the City Clerk be requested to send copies of the amended ordinance "LEASING CERTAIN TIDE AND SUBMERGED LANDS TO UNITED ENGINEERING COM- PANY, A CORPORATION: APPROVING THE FORM AND TERMS OF SAID LEASE AND AUTHORIZING EXECU- TION THEREOF", to the Southern Pacific Company and the Central Railway Company, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). 38. At this point Councilman Godfrey moved that the regular order of business be resumed and the Council proceed under "Bills", seconded by Councilman Carrington and unanimously carried. BILLS: 39. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Departments, $3,665.80; Police Department, $62•20; Civil Service Department, 814.88; Pound Department, $4.43; Fire Department, $312.97; Street Department, $1,200.80; Health Department, $303.51; Recreation Department $299.80; Park Department, $1,122.42; Golf Course Department, $5,327.45; Store Department, $146.74; Social Service Department, $143.75; Initiative Relief Fund, $96.25; Street Improvement Fund, $126.00. A motion was made by Councilman Carrington and seconded by Councilman Godfrey that the claims and bills against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on August 15, 1939, and presented to the Council at this meeting, be allowed and paid. On roll call the motion carried by the following vote: Ayes: Councilmen Carrington, Godfrey, and President Weichhart, (3). Noes: None. Absent: Councilmen Maurer and Morris, (2). 40. A motion was made by Councilman Carrington that the meeting adjourn to meet in ad- journed regular session on Thursday Evening, August 24, 1939 at 7:30 P. M.
