1939-09-19 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, SEPTEMBER 19, 1939 The meeting convened at 8:00 o'clock P. E. with President Weichhart, presiding. ROLL CALL: The roll was called and Councilmen Carrington, Maurer, Morris and President Weichhart, (4) were noted present. Absent: Councilman Godfrey, (1). MINUTES: 1. The minutes of the regular meeting of September cribed. 1939 were approved as trans- WRITTEN COMMUNICATIONS: 2. A communication was received from the City of Long Beach stating that it is de- sirous of being host to the 1940 Convention of the League of California Municipalities and requesting the support of the City Council in this regard. There being no objec- tion, the request was referred to the delegates of the League of California Municipali- ties who are now meeting in convention in Oakland. 3. From the Alameda Dahlia Society, extending appreciation to the City Council for its cooperation and courtesy with regard to the Dahlia Show which was held in the Alameda High School, August 19-20, 1939, and especially commending Er. Kenneth Sutherland, Labor Supervisor of the Park Department, for his assistance. There being no objection, the communication was ordered filed. 4. From Harry Bartell, requesting a further extension of six months? time within which to start construction of a building project on Lots Numbers 22-26 in the Hastings Tract on Broadway in Alameda. He stated that the work had been begun by tearing down one of the homes in preparation to construct the proposed apartment building but that various details had not as yet been completed with the Federal Government and asked for the additional six months extension of time in order to obviate any legal complications. Ordinance No. 657 N. S., reclassifying this property to Residential District, Class 2, was adopted September 20, 1938 and six months' extension of time allowed by the City Council on March 21, 1939. Councilman Carrington moved that Mr. Bartell's request be granted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilman Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 5. From the Fernside Home Owners Association, requesting that the present street lights in the Fernside District be replaced with lighting standards similar to those installed in Tract No. 526, generally known as North Fernside Tract. There being no objection, the matter was referred to the City Manager for his study and report. VI 6. From Frank A. Gottstein, calling the Council's attention to the present location of the railroad station at Webster Street and Lincoln Avenue, the station being some distance from the point where the train stops to discharge and take on passengers, this situation causing inconvenience to persons during the rainy weather. Attention was also called to the depression in the street on Lincoln Avenue between the two tracks, which causes water to collect therein. Councilman Morris moved that the Southern Pacific Company be officially requested by the Council to make a stop at either side of Webster Street so that passengers might avail themselves of the convenience of the railroad station. There was no second to Councilman Morris' motion. The City Manager stated he believed this matter could be taken care of through his con- tact with the Southern Pacific Company and that they would consent to the additional stop. Councilman Maurer stated he believes this situation should be viewed primarily from a safety standpoint and he considers the train stopping at the near side of Web- ster Street before it crosses the street, to be the more important phase of the matter, more vital than whether or not persons awaiting arrival of trains should or should not be protected by a shelter. Mayor Weichhart expressed himself as feeling confident that the matter could be satisfactorily settled by negotiations between the City Manager and the Southern Pacific Company, and referred the matter to the City Manager for disposi- tion. He also requested the City Manager to investigate the condition of the roadbed between the tracks on Lincoln Avenue where water is claimed to stand in rainy weather. VI 7. Mayor Weichhart questioned the City Manager regarding the safety hazard of the Alameda Belt Line crossing Webster Street, to which Mr. Schwanenberg replied he had caused a notice to be put in the local newspaper cautioning persons to be alert at this train crossing and stated that a flagman would be stationed at this point. After the lapse of a test period, it might be necessary to have the Belt Line install a wig- wag. 8. Frank Gottstein addressed the Council regarding trains crossing Webster Street and the situation of the Webster Street stations on both the Lincoln Avenue and Encinal Avenue Lines. REPORTS OF COMMITTEES: 9. From the City Manager recommending that Charles R. Lohmeyer, Executive Secretary to the Civil Service Board, be authorized to represent the City of Alameda at the Civil service Assembly of United. States and. Canada Convention to be held in San Francisco on October 16 to 20, 1939. Councilman Maurer moved that the recommendation of the City Manager be adopted, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 10. From the City Manager, recommending that contract for furnishing sixteen street lighting standards for Broadway be accepted as the delivery has been completed to his satisfaction. Councilman Carrington moved that the recommendation of the City Manager be adopted, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 11. From the City Manager, notifying the Council that the contract for furnishing the ton Chevrolet Dump Truck had been completed, the truck having been delivered and accepted by the Street Department, and recommending that the contract be accepted. Councilman Maurer moved that the recommendation of the City Manager be adopted, seconded by Councilman Carrington and on roll call carried by the following vote: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 12. From the City Attorney, stating that in his opinion the refund of a portion of junk dealer's license requested by one Bruce Sutherland, 1528 Adeline Street, Oakland, is not justified. Councilman Maurer moved that the request of Bruce Sutherland for refund of a portion of the amount paid by him for a junk dealer's license be denied, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Coun- cilmen Carrington, Maurer, Morris, and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 13. From the City Planning Board, recommending reclassification of property known as 2056 Eagle Avenue from Residential District, Class 1, to Residential District, Class 1 3/4, for the purpose of remodelling into apartments. Councilman Maurer moved that the recom- mendation of the City Planning Board be adopted, seconded by Councilman Carrington and on roll call, carried by the following vote: Ayes: Councilman Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). ORDINANCES INTRODUCED: 14. Councilman Maurer introduced the following ordinances, after which they were laid over under provision of law and the Charter: Ordinance No. New Series RECLASSIFYING PROPERTY (Known as 2056 Eagle Avenue) 15. Ordinance No. New Series Amending Section 19 of an Ordinance Entitled "An Ordinance Establishing Districts or Zones and Regulating Therein the use of Property, Height of Buildings and Required open spaces for Light and Ventilation of such Buildings and Repealing all Ordinances in Conflict Therewith, Including Ordi- nances Nos. 227 N. S., 319 N. S., and 338 N. S., Excepting, However, the Zone Map Heretofore Adopted by Ordinance No. 227, N. S., and Referred to in Section 1 Hereof," as Amended. RESOLUTIONS: 16. Councilman Morris introduced and moved the adoption of Resolution No. 2418 Authorizing Installation of Street Lighting Standards on Santa Clara Avenue Without Contract. Councilman Carrington seconded the motion and on roll call carried by the following vote: Ayes: Councilman Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 17. Councilman Maurer introduced and moved the adoption of Resolution No. 2419 Adopting Specifications for Furnishing Street Lighting Standards to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise the Same. Councilman Carrington seconded the motion and on roll call carried by the following vote: Ayes: Councilman Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 18. Councilman Carrington introduced and moved the adoption of Resolution No. 2420 Authorizing the Making of Certain Work and Improvements Without Contract. Councilman Maurer seconded the motion and on roll call carried by the following vote: Ayes: Councilman Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 19. Councilman Maurer introduced and moved the adoption of Resolution No. 2421 Authorizing Execution of Contract with the Alameda Chamber of Commerce for Advertising for the Fiscal Year Ending June 30, 1940. Councilman Carrington seconded the motion and on roll call carried by the following vote: Ayes: Councilman Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 20. Upon request of Councilman Morris, the City Manager explained for what purpose the money set up in the Advertising Fund of the City had been and is contemplated to be expended. ORDINANCES P ED: 21. Ordinance No. 693 New Series An Ordinance Repealing Sections 7-111 to 7-118 Inclusive, and Amending the Alameda Municipal Code by Adding to Title VII Thereof a New Chapter and. Article to be Known as "Chapter 1, Article 1", Regulating Vehicles for Hire. Councilman Maurer moved that, as all members of the Council have received copies of and are familiar with this Ordinance, it be not read but passed by title only, seconded by Councilman Carrington and unanimously carried. Councilman Morris moved that the Ordi- nance so designated be adopted, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilman Carrington, Maurer, Morris and Presi- dent Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 22. Councilman Morris inquired of the City Attorney how soon after the passage of the above referred to ordinance must taxi companies carry adequate insurance. He was in- formed that this requirement takes effect thirty days after the passage of the ordi- nance or when the ordinance becomes effective. 23. A motion was made by Councilman Maurer, seconded by Councilman Carrington that the following matters be taken out of the Committee of the Whole and ordered filed. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Departments, $4,069.86; Police Department, 407.70; Civil Service Department, $4.81; Pound Department, $27.71; Fire Department, §336.24; Street Department, $5,039.78; Health Department, $171.68; Recreation Department, $92.54; Park Department, $399.36; Golf Course Department, $1,342.55; Store Department, $124.28; Social Service Depart- ment; $167.06; Initiative Relief Fund, $79.50; Street Improvement Department, $922.58; East Bay Municipal Utility District Payment Fund, $2,284.84. A motion was made by Councilman Carrington and seconded by Councilman Maurer that the claims and bills against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on September 19, 1939, and presented to the Council at this meeting be allowed and paid. On roll call the motion carried by the following vote: Ayes: Councilmen Carrington, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 30.
