1932-10-18 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE .CITY OF ALAMEDA TUESDAY EVENING, OCTOBER 18, 1932. The meeting convened at 8 o'clock with Council-president Murray presiding. The roll was called and Councilmen Morris, Schaefer, Shanly and President Murray (4) were noted present. Absent: Councilman Leydecker (1). The minutes of the regular meeting of October 4, 1932 were approved as read. Mr. Schaefer moved, seconded by Mr. Shanly, that the regular order of business be suspended and the Council refer to new business, the motion being unanimously carried. NEW BUSINESS: 1. V' On motion of Mr. Schaefer, seconded by Mr. Shanly, the Clerk was requested to open and read the bids received in response to advertised notice to bidders for furnishing materials to be delivered to the Corporation Yard at the North end of Grand Street. From Phoenix Iron Works, accompanied by certified check in the amount of 465.00. 72 - 22 " x 22" Hand Hole Frames and Covers 0 4463.68 10 - 3 piece, 24" Catch Basin Castings 99.75 4 - 3 piece Manhole Frames and Covers 39.75 Upon motion of Mr. Schaefer, seconded by Mr. Shanly, and carried unanimously, the City Engineer was requested to prepare a tabulation of the bids received and report back to the Council while they proceeded with the order of business. WRITTEN COMMUNICATIONS: The following communications were received:- 2. / From the City Manager, pointing out that the traffic conditions formerly existing at the intersection of Park Street and Enzinal Avenue had been materially modified by reason of the closing of the old theatre on Park Street and the hazard of the railroad crossing at this point was materially decreased, and ender the circumstances recommending that the Southern Pacific Company now be permitted to dispense with the human flagman stationed at this intersection. On motion of Mr. Shanly, seconded by Mr. Schaefer, and unanimously carried, the recommendation was adopted. 3. / From the City Manager, accompanying an application from the Hitchcock Patrol and Detective Service requesting a permit to institute a patrol system in the City of Alameda. There being no objection, the application was referred back to the City Manager for further investigation. 4. From the City Attorney advising the Council that the City of Alameda follows the State Law in the matter of penalties in delinquent :takes and the Council has no jurisdiction to remit any penalties or dispense with the collection thereof, and that the only manner in which any penalty might be remitted or dispensed with would be by an amendment to the various tax provisions of the Political Code of the State of California which would have to be done, if at all, by the State Legislature. There being no objection, the communication was ordered filed and the Clerk instructed to notify of the decision various correspondents who have written to the Council concerning the matter covered by the opinion. 5. afFrom the Alameda Dahlia Society with reference to an appropriation of funds for the Alameda Dahlia Show which was declined by the City Council, and calling attention to donations which had been given to other organizations for the financing of floats used in parades, and re- questing that future claims for appropriations be given consideration. After Mr. Morris had explained the nature of the Alameda Dahlia Society and the organizations to which the donations referred to had been made, the communication was, without objection, ordered filed. 6. si From the Southern Pacific Company enclosing bond in the amount of 45,000.00 in favor of the City of Alameda, executed by the Southern Pacific Company, as Principal, and the Pacific Indemnity Company, as Surety, to guarantee the performance of the terms and conditions of franchise granted to the Southern Pacific Company by Ordinance No. 504, adopted September 28, 1908, to be substituted for the present bond on file, executed by the United States Fidelity and Guaranty Company as Surety, and requesting that a Resolution similar to a form accompany- ing the communication be adopted. In view of the fact that there was a conflict in the dates named in the Resolution with those named in the bond form submitted, it was ordered that the communication be filed and the Southern Pacific Company be cammanicated with for the purpose of reconciling the dates named in both instruments. 7. / From the Auditor and Assessor and Redemption Clerk, in accordance with Ordinance No. 250 N.S., submitting a list of the last known owners and descriptions of their property soldto the City of Alameda for non-payment of taxes for the fiscal year 1931-1932, ordered filed. 8. ,/ From Captain H. M. Bradley, extending an invitation to the Mayor and Council of tree City of Alameda to attend a battalion review and parade of the First Battalion 159th Infantry, Californie—National Guards, at the Alameda Armory, Washington Park, Tuesday evening, October 25, 1932, at 8:45 P. M. Mr. Schaefer made a motion that the invitation be accepted and as many members of the Council as possible attend the review and parade, seconded by Mr. Shanly, and carried unanimously. NEW BUSINESS:i On motion of Mr. Schaefer, seconded by Mr. Morris, and carried unanimously, the City Engineer was requested to report to the Council the result of his tabulation of bids received for material as advertised, and the names of the lowest bidders. The Western Pipe and Steel Company presented the lowest bid for the Corrugated Part Circle Culverts with a total bid of 4707.20. Mr. Morris moved that the contract be awarded to the Western Pipe and Steel Company, seconded by Mr. Shanly, and on roll call carried unanimously. The U. S. Foundry Company, with a price of 4515.30, presented the lowest bid for Castings. Mr. Shanly made a motion, seconded by Mr. Schaefer, that the U. S. Foundry Company be awarded the contract for castings which on roll call was carried unanimously. N. Clark & Sons, with a price of 41063.20, presented the lowest bid for Vitrofied Iron Stone Sewer Pipe. Mr. Schaefer moved, seconded by Mr. Morris, and on roll call carried unanimously, that the contract be awarded to N. Clark & Sons. Mr. Schaefer moved that the certified checks accompanying the bids of all unsuccessful bidders be returned to them, seconded by Mr. Morris, and carried unanimously. RESOLUTIONS: 9. A Resolution submitted by the Southern Pacific Company providing for the substitution of bonds guaranteeing performance of conditions of franchise granted by Ordinance No. 504 was withdrawn for correction on motion of Mr. Shanly, seconded by Mr. Morris, unanimously carried. 10. Mr. Schaefer introduced and moved the adoption of - October 18, 1932. Mr. Morris seconded the motion to adopt the Resolution and on roll call it was carried unanimously. 11. Mr. Morris introduced and recommended the adoption of - Resolution No. 1697 Transferring 45,718.75 from the Electric Light Fund to The Redemption Fund. 1'1r. Shanly seconded the motion to adopt the Resolution and on roll call it was carried unanimously. 12. Mr. Schaefer introduced and recommended the adoption of - Resolution No. 1698 Rescinding Resolution No. 1692. Mr. Shanly seconded the motion to adopt the Resolution and on roll call it was carried unanimously. 13. Mr. Shanly introduced and recommended the adoption of - Resolution No. 1699 Granting a Temporary Revocable Permit for the Use of Property Located at the Southwest Corner of Park Street and Bank Alley for the Purposes Allowed in Class V, Excepting the Sale of Gasoline. Mr. Morris seconded the motion to adopt the Resolution and on roll call it was carried unanimously. The Clerk stated that since the last meeting the following papers had been received and filed: 14.
