1937-05-04 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, MAY 4th, . . . . . . . . 1937 The meeting convened at 8 o'clock P.M. with President Weichhart presiding. The roll was called, and Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5), were noted present. Absent: None. ES: The minutes of the regular meeting of April 20th, 1937, were approved as transcribed WRITTEN COMMUNICATIONS: 11. A communication was presented from the Port of Oakland, accompanied by a resolution endorsing the City's efforts toward securing adequate transportation facilities connect- ing with the San Francisco- Oakland Bay Bridge. The communication was ordered filed and a copy furnished to the Interurban Transportation Committee of the City of Alameda. 1/2. From Mr. C. C. Howard, tendering his resignation as a member of the City Planning Commission effective as of May lst, 1937. Councilman Maurer moved that the resignation be accepted, seconded by Councilman Morris and, after Mr. Howard had addressed the Council, the motion was on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 3. From the Golden Gate International Exposition, requesting the City's support of Assembly Bill No. 252 now before the legislature in Sacramento. The communication was referred to the City Attorney. ,j4. From Mr. Alonzo S. Wood, tendering his resignation as a member of the City Plan- ning Commission to take effect at once. On motion of Councilman Morris, seconded by Councilman Godfrey, the resignation was accepted on roll call by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 5. From the War Department, San Francisco Harbor Line Board, giving notice of a public hearing of the San Francisco Harbor Line Board to be held on Tuesday, May 25th, 1937, to consider the application of the Commandant of the Twelfth Naval District and Naval Operating Base, San Francisco, for modification of bulkhead and pierhead lines on the eastern side of San Francisco Bay southwest and south of the proposed Naval air station at Alameda. Councilman Maurer moved that the City Clerk inform the Board that the Council is in accord with the request of the Commandant, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Y6. From Charles A. Carver, containing a petition for the closing of Harrison Avenue in front of his property on the southerly line of Harrison Avenue running easterly 40 feet to the easterly line of said property. Councilman Maurer moved that the City Attorney be requested to prepare the necessary papers for instituting proceedings to close Harrison Avenue from Pearl Street to Versailles Avenue, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington, God- frey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 0 ® =L COMMUNICATIONS: 7. Mr. Frank Gottstein addressed the Council on various subjects, including transports tion. HEARINGS: /8. The recommendation of the Building Inspector, that a resolution be passed declaring the old house at 1439 Morton Street a public nuisance, consideration at which has been postponed from time to time, was presented and, after the Building Inspector, E. H. Rogers, and the Attorney for the mortgage holders had addressed the Council, Councilman Morris moved that the hearing be postponed until the meeting of June 1st, 1937, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. REPORTS OF COMMITTEES, ETC: 9. From the City Manager and the City Engineer, recommending that the contract for the improvement of High Street from the High Street Bridge south to the southern line of San Jose Avenue be awarded to the low bidder, the Independent Construction Co., Ltd., for the sum of 425,520.51. The communication was ordered filed. 10. From the City Planning Commission, recommending the adoption of plans submitted by the City Manager, for the improvement of McKinley Park. Councilman Morris moved that the plans of the City Manager be again referred to the City Planning Commission on ac- count of the newly appointed members of that Commission, seconded by Councilman Carring- ton. Councilman Godfrey moved to amend the motion to provide that the Council accept the recommendation of the City Planning Commission. After the Council had been addressed by E. R. Neiss and A. Kist and others, the motion to amend was withdrawn, and the orig- inal motion, on roll call, carried by the following vote: Ayes: Councilmen Carrington, Maurer,Morris and President Weichhart, (4). Noes: Councilman Godfrey, (1). Absent: None. 11. From the City Planning Commission, recommending the reclassification of property known as 1839 Clinton Avenue from Residential District, 'Class I, to Residential Dist- rict, Class 1 3/4, for the purpose of converting the building into flats. Councilman Maurer moved that the recommendation be adopted, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President ; Weichhart, (5). Noes: None. Absent: None. 112. From the City Manager, giving a report of his investigation of the question of granting free use of electric lights in the tennis courts in the City parks and suggest- ing that a new switch be installed at each court which would automatically make the lights available between the hours of 7 and 10 o'clock P.M., installation of switches not to cost more than $50.00 per court. Councilman Maurer moved that the City Manager confer with the Superintendent of the Bureau of Electricity and endeavor to work out a plan to supply free lights without the installation of switches and that the plan be tried out for a period ending not later than November 30th, 1937, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Carrington, God- frey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. vl3. From Mayor Henry A. Weichhart, appointing Mr. Henry H. Meyers a member of the City Planning Commission to fill the office of Commissioner H. F. Schlichting whose term has expired. On motion of Councilman Morris, seconded by Councilman Maurer the appointment was, on roll call,confirmed'by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. j14. From Mayor Henry A. Weichhart, appointing Mr. Harold B Fisher a member of the City Planning Commission to fill the office of commissioner for the balance of the unexpired term of Mr. C. C. Howard, resigned. On motion of Councilman Godfrey, seconded by Council- man Carrington, the appointment was on roll call confirmed by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart,(5). Noes: None. Absent: None. 115. From Mayor Henry A. Weichhart, appointing Mr. George S. Williams a member of the City Planning Commission to fill the office of commissioner for the unexpired term here- tofore held by Mr. Alonzo S. Wood, resigned. On motion of Councilman Maurer, seconded by Councilman Morris, the appointment was on roll call confirmed by the following vote: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 16. From Mayor Henry A. Weichhart, appointing Dr. Harold A. Miller a member of the Board of Library Trustees for a term of five years beginning May 1st, 1937. On motion of Councilman Morris, seconded by Councilman Godfrey, the appointment was on roll call confirmed by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent None. /17. From Mayor Henry A. Weichhart, appointing Mr. Kenneth C. Smith, a member of the Board of Education for a term of five years beginning May 1st, 1937. Councilman Carrington moved that the Council confirm the appointment, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. QRDINANCES INTRODUCED 18. The following ordinance was introduced and laid over, under provision of the charter: "Ordinance No. New Series Reclassifying Property. (Property Known as 1829 Clinton Avenue)" NEW BUSINESS: 19. Councilman Morris moved that the canvass of election returns be deferred until the other business of the meeting had been disposed of, and the Mayor so ordered. RESOLUTIONS: 20. Councilman Morris introduced and moved the adoption of "Resolution No. 2158 Authorizing Execution of Contract with Independent Construction Co., Ltd., for the Improvement of High Street ", Councilman Maurer seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Councilman Maurer made a motion, seconded by Councilman Morris and unanimously carded, that the certified checks be returned to the unsuccessful bidders. 21. Councilman Maurer introduced and moved the adoption of "Resolution No. 2159 Transferring $3,192.00 from Contingent Fund to Building Repairs ", Councilman Morris seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 22. Councilman Morris introduced and moved the adoption of "Resolution No. 2160 Endorsing Assembly Bill 252 Relating to Appropriation for Exposition Building ", ORDINANCES PASSED: 23 "Ordinance No. New Series Designating Lincoln Avenue from the Easterly Line of Park Street to the Westerly Line of Gibbons Drive a Through Highway, Providing for the Erection of Traffic Stop Signs at all Intersecting Streets, and Requiring Drivers or Operators of all Vehicles to Come to a Full Stop at Street Intersections before Crossing said Avenue", Councilman Morris moved that the ordinance as read be adopted, seconded by Councilman God- frey, and on roll call carried by the following vote: Ayes: Councilmen Currington, Godfrey Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 24. "Ordinance No. New Series Reclassifying Property. (Property Known as 1252 Broadway)", Councilman Maurer moved that the ordinance as read be adopted, seconded by Councilman Mor- ris, and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey; Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 25. "Ordinance No. New Series Reclassifying Property (Property Known as 1038 Santa Clare Avenue) Councilman Morris: moved that the ordinance as read be adopted, seconded by Councilmen Carringtonond on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. FILING: 26. The Clerk stated that since the last meeting of the Council the following papers had been received for filing: Financial Statement of the City, as of March 31, 1937, Jordan & Ticoulet. Affidavit of Publication - Notice of Charters Available Affidavit of Publication - Election Proclamation. BILLS: 27. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General De- partments, $4453.09; Police Department, $1506.53; Police and Fire Commission, $15.94; Pound Department, $9.29; Fire Department, $132.51; Street Department, $1119.58; Health Department, $242.35; Park Department, $163.16; Golf Course Department, 0320.13; Store Department, $296.16; Social Service Department, $182.87; Initiative Relief Fund, $8.00; Gas Tax Fund #1, $192.00 and East Bay Mun.Utility Dist. Payments Fund, $2495.42. Councilman Godfrey moved, seconded by Councilman Maurer, that the claims and bills against the City in the amounts as listed and itemized in the List of Claims filed with the City Clerk on May 4th, 1937, and presented to the Council at this meeting be allowed and paid. On roll call this motion carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 28. At this time the Council reverted back to "New Business", in order to canvass the elec- tion returns, following which Councilman Morris introduced and moved the adoption of "Resolution No. 2161 Declaring Result of Special Election Held in the City of Alameda on April 29, 1937, for the Purpose of Submitting to the Electors of Said City the Proposal for the Adoption of a Proposed Charter of Said City", seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 29. There being no further business to transact, the Council adjourned to 'meet in regular session on Tuesday evening, May 18th, 1937, at 8 o'clock P.M. Respectfu ted, C erk.
