1925-05-05 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, MAY 5TH, 1925. The meeting convened at 8 o'-clock P. M. with Council-president Otis presiding. The roll was called and Councilmen Latham; Neiss, Noble and President Otis, (4) were noted present. Absent: Councilman Probst, (1). The minutes Of the regular meeting of April 21, 1925 were approved as read. The minutes of the special meeting of April 28th, 1925, were approved as read. The following papers were ordered filed: Report of the East Bay Municipal Utility District, as to April 27th, 1925. 2.V Affidavit of posting Notice of Award of Contract, under Resolution of In- tention No. 76, New Series. (Calhoun Street). . Affidavit of publication of Notice of Award of Contract, under Resolution of ,Intention No. 76, New Series. (Calhoun Street.) .4 Affidavit of service of Notice to Abate Public Nuisance, stable at 1622 Broadway. 51 Oath of office of Agnes S. Hauch, member of the Board of Free Library Trustees. 6of 7. Repart of the Municipal Electric Light Plant for the month of February, 1925. Mr. Latham introduced and moved the adoption of "Resolution NO. 890. Transferring $470.23 from the Electric Light Fund to the General Fund." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Neiss introduced and moved the adoption of "Resolution No. 891. Transferring $2783.23 from the Electric Light Fund to the General Fund." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Noble introduced and moved the adoption of "Resolution No. 892.• Transferring $30,000 from the Electric Light Fund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 10.4 Mr. Latham introduced and moved the adoption of "Resplution No. 893. Resolution of Intention No. 78, New Series. (Opening westerly end of Eagle Avenue.)" Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following communications were received: 11. From the Mayor, appointing Mrs. Agnes S. Hauch a member of the Board of Free Library Trustees. Ordered filed. 12A/ From the Mayor, appointing David. E. Graves, a member of the Board of Education. rdered filed. 13.s/ From the Mayor, appointing E. Howard Baxter, a member of the Board of Public Utilities. Ordered filed. 14.V From R. E. Tilden, re survey of har1or and tidelands. Ordered filed. 16. From the California Packing Corporation, re removal of pole line on right of way. Mr. Latham moved that the communication be referred to the Board of Public Utilities, second- ed by Mr. Noble and oarried. 16.v// Communication and petition from Wm. J. Southard, requesting position in fire department. Ordered filed. President Otis stated that Council under the charter had no jurisdiction in the matter. 17.\I From A. W. Sohander, re carnival on Bay Island Avenue. Ordered filed. 18. The Clerk stated that the time had arrived for hearing protests under Resolution of Intention No. 77, New Series, Opening West End Streets, and that in response to the published notice, petitions of protest had been received. Also, that a petition had been received in support of the opening,and he proceeded to read the same. Mr. David C. Dutton, and Miss Stegner°, representing property owners, addressed the Council. After discussion, Mr. Neiss introduced and moved the adoption of "Resolution No. 894. Resolution Overruling Protest." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 19.V Mr. Noble introduced and moved the adoption of "Resolution No. 895. Resolution Ordering the Work." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 20,W The City Planning Commission submitted a tentative report on the zoning of the tidelands on the east and south shores of the City, which was ordered filed. ljf The City Planning Commission submitted a report re the opening of Webb Avenue. Mr. Neiss moved that the report be adopted, seconded by Mt. Latham and carried unanimously. 22.v/ A. Bill entitled "A Bill For Ordinance No. New Series. An Ordinance Providing for the Licensing of Certain Peddlers, Providing aPenalty for the Violation Therefo, and Repealing any and all Ordinances in Conflict Therewith." came up for passage. Mr. Latham moved that action by the Council be continuned Until the next regular meeting of the Council to be held May 19th, seconded by Mr. Neiss and carried. 23.4 A Bill entitled 24. 254/ 26. "A Bill For Ordinance No. _ Series. Extending Fire Limits No7-—bn Park Street, and Fire Limits No. 2 on Webster Street." came up for passage and was read by the Clerk. Mr. Noise moved that the ordinance be adopted, seconded by Mr. Latham and on roll call carried unaniMously. A Bill entitled "A Bill Re Reclassification of Portion of Webster Street." came up for passage and was read by the Clerk. Mr. Latham moved that the ordinance be adopted, seconded by Mr. Noble and on roll call carried unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 896. Rejecting Bids for Building a Dyke in Brooklyn Channel, and Declaring that the Work Can be Performed More Economically by Day Labor." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed Unanimously. Messrs. Porter and Walsh addressed the council re the building of the dyke on Government Island, using a concrete ship's hull for dyke purposes. After disdussion, Mr. Latham moved that the matter be referred to the Government Islana Committee, with power to act and to report back to the council for ratification. The motion was seconded by Mr. Noble and carried. The City Attorney stated that a partial distribution of the Cohen Estate had been handed down by the Superior Court and that Versailles Avenue opening would be started soon, and asked the council to rescind its previous order authorizing the city attorney to draw up a Resalution of Intention under public proceedings. Mr. Latham so moved, seconded by Mr. Neiss and carried. Claims against the General Departments arnoanting to $3,797.20; Police Department, $123.09; Fire Department, $82.92; Street Department, '3084.80; Health Department, $120.72; Recreation Department, $383.35; Store Department, $1.22; Council Relief, 117.13; Health Center, $72.72; Electric plght Fund $1834.78; School Construction Fund, $2188.851 Pension Fund, $860.83; Initiatie Relief Fund, $56.00; East Bay Water Company Payments Fund, $2849.86 and Compensation Insurance Fund, $2.50, having been approved and audited by the proper officials were listed by the Clerk as follows: May 5th, 1925.
