1925-08-04 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF''THE CITY OF ALAMEDA, TUESDAY EVENING, AUGUST 4TH, 1925. The meeting convened at 8 o'clock with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Probst and President Otis, (5) were noted present. The minutes of the regular meeting of July 21st, 1925 were approved as read. Mr. Probst introduced and moved the adoption of "Resolution No. 917. Transferring :2,157.83 from the Electric Light Fund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 2A1 Mr. Latham introduced and moved the adoption of "Resolution No. 918. Transferring 000.00 from the Electric Light Fund to the General Fund." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 3.V Mr. Neiss introduced and moved the adoption of "Resolution No. 919. Resolution of Acceptance." (Magnus and Christine Hollested to the City of Alameda./ Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 4.V Mr. Noble introduced and moved the adoption of "Resolution No. 920. Granting. The American DredgingCoMpanyirermiSsion to Erect and Maintain an Overhead Pole Line for the Transmission of Electricity to be Used by said Dredging Company in the Estuary near Government Island.." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 5.I/7 Mr. Probst introduced and moved the adoption of "Resolution No. 921. Granting Strip of Land to L. Bertero." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 922. Requesting a Survey of Alameda's Harbor." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Neiss introduced and moved the adoption of "Resolution No. 923. Directing the Payment of 075.00 to Alfred S. Twichell for the Piece of Property Ad- joining the Electric Light Plant." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following papers were ordered filed: 8.V: Oath of office of Wm. J. S. (Calhoun Street) 12.V' Affidavit of publication, Notice of the time of. filing of assessment and the time of hearing, under Resolution of Intention No. 74, N. S. (Bay Island Ave.) 13.V, Affidavit of publication, Delinquent Property sold to the City of Alameda. 14. Report of the Municipal Electric Light Plant for the month of May, 1925. 15. City Engineer's Assessment under Resolution of Intention No. 76, N. S. 16.v Affidavit of mailing Notices of hearing on Assessmants under Resolution of ,,Intention No. 76, N. S. (Calhoun Street. 174/ Affidavit of Mailing Notices of hearing on Assessments under Resolution of Intention No. 74, N. S. (Bay Island Avenue.) 18.f Report of Commissioner re extending and opening of Eagle Avenue. The following communications were received: 19.+ Opinion from City Attorney Locke re expending public money for various purposes. Ordered filed. 20.x/ From the Board of Public Utilities re granting of permit to the Paeific Gas & Electric Company to furnish electricity to the American Dredging Company. Ordered filed. 21.x/ From the American Dredging Company, requesting permission to erect transmission lines on Government Island. Ordered filed. 2 2 / From the Loop Lumber Company, requesting the installation of additional water mains for fire protection. Mr. Latham moved that the communication be re- ferred to the City Manager to report back at the next meeting of the Council, seconded by Mr. Noble and carried. From Capt. Harry Dean, requesting per mission to use the Council Chamber for an illustrated lecture on the Republic of Liberia. Mr. Neiss moved that the request be granted, under the supervision of the City Manager, seconded by Mr. Latham and carried. 24.x% From Alameda Park Company, requesting contribution to the $800.00 fund to defray expenses of Miss Fay Lamphier to Atlantic City. Mr. A. F. Strehlow was present and addressed the Council, but was advised that in view of the opinion of City Attorney Locke, the Council was unable to contribute to the Fund. The com- munication was ordered filed. 25. 26. From the Industrial Accident Commission, re Alameda High School Building, with copy of reply to Mayor Otis attached. Ordered filed. From the City Planning Commission, recommending the reclassification of the let on the east side of Chestnut Street, beginning at a point 150 feet north of Santa Clara Avenue, thencenortherly 57 feet, 8 inches, from a Residence District, Class I, to a Church District, Class IV. Mr. Neiss moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Probst and carried unanimously. From the City Planning Commission, recommending the denial of the petition for the reclassification of the north side of Fernside Boulevard, between Versailles' Avenue and High Street, from a Residential District, Class I, to an Industrial District, Class VII. Mr. Homer R. Spence was present in the Council Chamber and filed with the Council a communication in protest, together with a copy of a memorandum against the reclassification previously filed with the City Planning Com- mission. Mr. Neiss moved that the Council proceed with the hearing in the matter, seconded by Mr. Probst and carried. After a discussion, which was participated in by Messrs. Spence, Steele, Stratton, Williams and Fassett for the protestants, and Messrs. Keane and Donovan for the petitioners, Mr. Latham moved that the matter be referred to a meeting of the Committee of the Whole for consideration, seconded by Mr. Probst and carried unanimously. 28. i Mr. Latham moved that the Council meet in regular adjourned session Tuesday evening, August llth, at 8 o'clock P. N., seconded ny Mr,. Probst and carried. 29,, From the City Planning Commission recommending the granting of the petition for the reclassification of Lots 247 to 253 inclusive, in Block "0 ", Map of Fernside, from a Residential District, Class I, to a Business District, Class III. Mr. Latham moved that the recommendation of the City Planning Commission be adopted. There being no second to this motion, Mr. Neiss moved that the matter be referred to a meeting of the Committee of the Whole, seconded by Mr. Latham and carried. 301 From the City Planning Commission, recommending the granting of the petition for the reclassification of Lot. No. 246, in Block "0 ", Map of Fernside", from a Residence District, Class I, to a Business District, Class V. Mr. Latham moved the adoption of the recommendation- ofthe City Planning Commission. The motion was / seconded by Mr. Probst and carried unanimously. 31.V The matter of the reclassification of the northeast corner of Central Avenue and Sherman Street from a Residence District, Class 1, to a Business District, Class V. permitting the erection of an oil supply station, previously postponed, was taken up by the Council. Hon. L. R. Weinmann, addressed the Council in support of the petition and after discussion, Mr. Neils moved that the recommendation of the City Planning Commission be rejected and that the petition for the reclassification be granted, seconded by Mr. Probst and on roll call carried by the following vote, to wit: - Ayes: Councilmen Noble, Neils and Probst. (3). Noes: Council- president Otis, (1). Not Voting: Councilman Latham, (1). Absent: None. 32.1 A copy of a Resolution re increase of fares between San Francisco and the east bay cities from the Alameda Improvement Club was read and ordered filed. 33.E Mr. Latham moved that the Council expend a sum not to exceed $750.00 for the employment of three engineers to investigate and make a report to the council as to the safety of the truss' and brick construction of the nevi Alameda High School. The motion was seconded by Mr. Neiss and on roll call carried unanimously. The following Ordinances were introduced and laid over under a provision of the Charter:- 34. "A Bill for Ordinance No. New Series. Naming the New Highway on Bay Farm Island, and Prohibiting the Driving of Trucks ,Thereon." 36.V 37.V 38. For For A Bill entitled "A Bill Ordinance No. New Series. Reclassifying Property. (Church) "A Bill Ordinance No. New Series. Reclassifyihg Property. (Fernside, Oil oapply Station) "A Bill For Ordinance No. New Series. Reclassifying Property. (Fernside) came up for passage and was read by the Clerk. Mr. Latham moved that the Ordinance be adopted, seconded by Mr. Neiss and on roll call it was adopted and passed unanimously. A Bill entitled "A Bill For Ordinance No. _____ Series. Adopting .Final Report of the City Planning Commission on Zoning The Tidelands." came up for passage and be adopted, seconded by unanimously. 39W A Bill entitled was read by the Clerk. Mr. Neiss moved that the Ordinance Mr. Probst and on roll call itwasadopted and passed "A Bill For Ordinance No. New Series. Amending Section 242 of Ordinance No. 1, New Series known as the Municipal Code of the City of Alameda." came up for passage. Mr. Probst moved that action by the Council be postponed until the next regular meeting, seconded by Mr. Latham and carried. 40.V Members of the Board of Education, together with the architect and superintendent of construction of the new Alameda High School Building being present in the Council Chamber, Mr. Otis filed with the Clerk a report of the Board of Engineers employed by the Council to investigate the safety of truss and brick construction of the Alameda High School, which was read. Mr. Neiss moved that the report of the engineers be adopted, seconded by Mr. Latham and carried. Messrs. Carl Werner, Architect and Wilford N. Ball, Superintendent of Construction, filed a letter in answer to the report which was ordered filed. Claims against the General Departments amounting to 84551.05; Pire Department, 81.55; Street Department, 4:3135.16; Health Department :110.62; Recreation Department, 4333.65; Store Department, $27.83; Electric Light Fund 2351.14; Pension Fund ,$860.83; Industrial Railroad Pund 430.00 and the East Bay Water Company Payments Fund, 2905.85 having been approved and audited by the proper officials were listed by the Clerk as folLows: Labor Alameda Alameda TT Co.
