1925-10-27 Special CC MinutesSPECIAL MEETING OF THE COUNCIL OF THE CITY OF ALA, 'D , TUESDAY EVENIING, OCTOBER 27TH, 1925. The mooting convened at 8 o'clock with Council-presidont Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Probst and President Otis, (5) were noted present. It was moved by Mr. Neiss, seconded by Ir. _Noble that City Attorney Locke act as Clerk of the meeting. Motion carried unanimously. 2.v/ The Acting Clerk then read the call of the special meeting and proof of notice, as follows: "October 26th, 1925. Dear Sir: A special meeting of the Council of the City of Alameda is hereby called for Tuesday, October 27th, 1925, at 8 o'clock P. M. in the council chambers in the City Hall, to consider a Resolution defining Alameda's position in the matter of improving the Estuary, and such other business as may be brought before the meeting. By order of the Mayor, H. Dudgeon-Tearle, Deputy City Clerk." "Alameda,California. October 26th, 1926. I, Officer S. C. Boyson, hereby certify that I delivered the attached call for a special meeting of the Council of the City of Alameda, to be held Tuesday, October 27th, 1925, at 8 o'clock P. M. to the following addresses: Frank Otis A. Latham E. J. Probst, E. R. Neiss, Geo. H. Noble 1609 Santa Clara Ave. 1131 Bay Street 1445 Sixth Street 1132 Broadway, 1336 Park Street Officer S. C. Boyson." A large number of ex-servise men were present to urge some action by the Council toward securing a building from the County, It was moved and carried that the matter be taken up for consideration in Committee of the Whole, whereupon the council took a recess. 4.1 After the lapse of half an hour the council was again called to order and upon recommendation of the Committee of the Whole, it was moved by Mr. Latham seconded by Mr. Probst that the council adopt the following "Resolution No. 954. Favoring a Building for the Ex-service Men of the City of Alameda." 5.14/ The Resolution was adopted unanimously. Pursuant to the Resolution the council then appointed the following Committee:- E. Z. Taylor, C. R. Smith, R. M. Toalson, H. M. Bradley, C. E. Mason and Councilmen Latham and Noble. The Council then took up for consideration the matter of declaring Alameda's stand on Oakland's Harbor program. After some discussion, Councilman Probst introduced and moved the adoptioh of "Resolution No. 955. Resolution in Re Oakland's Harbor Prog: Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The Council's attention was next called to an applicationof E. C. Sessions for permission to dredge along the shore of Government Island. The City Attorney advised the council to oppose the application, whereupon Councilman Noble intro- duced and moved the adoption of "Resolution No. 956. Resolution Against the Application of E. 0. Sessions." Councilman Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. A legal opinion was received and read from the City Attorney, to the e that a fire house could not be located in Lincoln Park. Ordered filed. City Manager Hickok called the attention of the council to a dredging project by Mr. Strehlow of Neptune Beach, and suggested that the proponent's attention be called to Alameda's ordinance covering the matter. It was moved and carried that it be referred to the City Manager for solution. There being no further business to transact the Council adjourned to meet in regular session, Tuesday evening, November 3, 1925 at 8 o'clock P. M. The minutes of the regular meeting of October 20th, 1925, were approved as read. The minutes of the special meeting of October 27th, 1925, were approved as read. Mr. Probst introduced and moved the adoption of "Resolution No. 957. Directing Assessor and Tax Collector to Cancel Certain Taxes Against Property on Bay Farm Island Recently Acquired by the City." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 2. Mr. Latham introduced and moved the adoption of "Resolution No. 958. In Re Concordia Street." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. .!� Mr. Neils introduced and moved the adoption of 4 . 5.. 6. 7. 10 11. 12. "Resolution No. 959. Providing for Municipal Golf Links and the Employment of an Architect and Supervisor of Construction." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote ; - Ayes: Councilmen Latham, Neiss, Noble and Probst, (4). Noes: Council- president Otis, (1). Absent: None. The following papers were received and filed: Policy of title insurance re golf course, Bay Farm Island. Receipt and option, re golf course, Bay. Farm Island. Oath of Office, C. C. Vermillion, Special Police Officer, Encinal Terminals. Affidavit of publication, Notice of City Taxes. The following communications were received: From the Key System Transit Company, re car stops in Alameda. Mr. Latham moved that the communication be referred to the City Manager and that he protest against the arrangement of car stops as outlined. The motion was second- ed by Mr. Probst and carried. From the Southern Pacific Company relative to Easement for detouring traffic on Webster Street. In relation thereto, Mr. Noble introduced end moved the adoption of "Resolution No. 960. Covering Use of Southern Pacific Company Property during Construction of Tube." The motion to adopt the Resolution was seconded by Mr. Probst and on roll call it was adopted and passed unanimously. From Major John W. N. Schulz, re public hearing on construction of bridges or tubes across San Francisco Bay. Mr. Latham moved that the Mayor, City Manager, City Attorney and City Engineer be appointed as a Committee to attend this meeting, as representing the City of Alameda, seconded by Mr. Neiss and carried. From the City Planning Commission, recommending the reclassification of the property situated on the southwest corner of Central Avenue and Ninth Street, from a Residence District, Class I, to a Business District, Class III, in order that a one - story frame building to contain stores may be constructed thereon. There being no objectors present in the council Chamber, Mr. Probst moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Noble and on roll call carried unanimously. From the City Planning Commission, recommending the reclassification of the property situated on the west side of Oak Street, commencing at a point 150 feet south of Clement Avenue; thence southerly 360 feet; westerly 450 feet; northerly 360 feet and easterly 450 feet from a Residence District, Class I, to a Factory District, Class VII, permitting the erection of a one - story steel frame building to contain a plant for the manufacturing of metal products. Mr. S. C. Wright, represented a number of protestants present and addressed the council in support of the petition of protest already filed in the matter. Messrs. Troutman, Gibson, McDermott, Moore, Kaisner, and Smith address- ed the council in protest, either a home owners or the introducing of testimony to show that the proposed factory would be a nuisance as tO noise and vibration. Messrs. Travers and Norris addressed the council in support of the petition. After considerable discussion, Mr. Neiss moved that the matter be referred to the Committee of the Whole, seconded by Mr. Probst and carried unanimously. 13X Applications for a permit to sell soft drinks were received from Martha G. Lea and the Mutual Creamery Co., by E. Sharp. Both of these applications received the endorsement of Chief of Police Wahmuth, and thereupon Mr. Neiss introduced and moved the adoption of "Resolution No. 961. Granting a Permit for a License to Sell Soft Drinks." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 14." A Bill entitled "A Bill For Ordinance No. New Series, Reclassifying Property. (N. side of Santa Clara Avenue, 234.17 ft. easterly of Park Street; thence easterly 253.75 ft. by 84 ft.) Garage." came up for passage and was read by the Clerk. Mr. Probst moved that the ordinance as read be adopted, seconded by Mr. Latham and on roll call carried unanimously. A Bill, entitled "A Bill For Ordinance No. A_ New Series. Reclassifying Props y. (1001 Santa Clara Avenue.) Church. came up for passage and was read by the Clerk. Mr. Neiss moved that the ordi- nance as read be adopted, seconded by Mr. Probst and on roll call it was adopted and passed unanimously. 16.\/ A Bill entitled 17. "A Bill For Ordinance No. 2cL3 New Series., Providing for the Appointment of a Municipal Golf Commission and Specifying Its Powers and Duties." came up for passage and was read by the Clerk. Mr. Latham moved that the ordi- nance as read be adopted, seconded by Mr. Neiss and on roll call it was adopted and passed by the following vote, to wit; AYES: Councilmen Latham, Neiss, Noble and Probst, (4). Noes: Council-president Otis, (1). Absent; None. A Bill entitled "A Bill For , Ordinance No. _____ Series. An Ordinance rohibiting Use or Occupation of the Public Streets for Business Purposes." came up for passage. Mr. Probst moved that action on the ordinance be postponed until the next regular meeting of the Council seconded by Mr. Neiss and carried. 18. A Bill entitled "A Bill For Ordinance No. New Series. Reclassifying Property. (Southwest corner, 9th St. and Central Ave. was introduced and laid over under a provision of the Charter. 19.‘" A Bill entitled For "A Bill Ordinance No. .... New Series. Reclassifying Property." (Factory) was introduced and laid over under a provision of the charter. 20.V/ The Clerk offered for filing a new offer of dedication of the land for street purposes in Bay View Tract. The offer of dedication was ordered filed and Mr. Neiss introduced and moved the adoption of "Resolution No. 962. Accepting Offer of Dedication of Streets in the "Bay View Tract." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Probst requested the City Attorney to look into the legality of an ordinance which would require the closing of all stores at 6 o'clock P. M. , and to report back to the council. Claims against the General Departments amounting to $8,606.18; Police Department, $1447.39; Fire Department, $59.28; Street Department, $6,719.54; Health Department, $232.82; Recreation Department, 0294.09; Store Department $66.46; Social Service Department, $72.63; Health Center, 0269.14; Electric Light Fund $13,638.00 Initiative Relief Illund $64.00; Pension Fund 0860.83; Industrial Railroad Fund 025.16 and Compensation Insurance Fund 020.00, having been approved and audited by the proper officials were listed by the Clerk as follows: Labor Ader, Leon H.
