1925-12-29 Regular CC MinutesADJOURNED REGULAR MEETING OF THE COUNCIL 02 THE CITY OF ALAMEDA, TUESDAY EVENING, DEC. 29, 1925. The meeting convened at 8 o'clock with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Probst and President Otis were noted present. Absent: None. Owing to the enforced absence of City Clerk W. E. Varcoe, City Attorney, Wm. J. Locke, was appointed City Clerk pro tem. The following paper was received and filed: Affidavit of publication of Notice of Delinquent Assessments, Opening Eagle Avenue. The following communications were received:, Prom A. W. Schander of 2305 Buena Vista Avenue, under date of December 23rd, 1925, calling attention to an advertising sign of the Brooklyn Lumber Co., advertising building materials for sale. The communication was ordered filed. From Hutchinson Company, Incorporated, petitioning the city council for permission to grade, curb, gutter, macadamize and sidewalk the extension of Clahoun Street, between Broadway and Regent Street. Alsom another communication from the same company, requesting permission to likewise improve the extension of Clay Street, between Broadway and Regent Street. Both communications were order- ed filed and upon motion of Councilman Neiss, seconded by Mr. Latham, permission wqs granted as requested. 4., From the West End Merchants Association, under date of December 28, 1925, stating that at the last regular meeting of said Association a motion was passed, requesting the council to appoint a West End man residing west of Ninth Street, to fill the vacancy on the city council caused by the resignation of Mx. Probst. Upon motion of Mr. Latham, seconded by Mr. Neiss, the communication was filed and the subject matter referred to the Committee of the Whole. 54/ A petition addressed to the city council and containing seven hundred and twenty-six sigriaturespetitioning the council, in case of a vacancy resulting from the resignation of Councilman Probst, to appoint a representative man from the West End section of Alameda to fill such vacancy. Upon motion of Mx. Probst, seconded by Mr. Latham, the petition was ordered filed and referred to the Committee of the Whole for further consideration. Prom the Executive Committee of the Water-side Thompson Improvement Club, stating that at a meeting of said organization held Saturday evening, December 19, 1925, the matter of filling the impending vacancy 011 the council was discussed at length with the result that a resolution was unanimously adopted, urging the appointment of a resident of the East End of Alameda to fill such vacancy, and recommending W. B. O'Brien as a suitable person. The communication was signed in the name of the Club, by H. H. Fassett, Secretary-Treasurer. Upon motion of Mr. Noble, seconded by Mr. Neiss, the communication was referred to the Committee of the Whole for further consideration. 7.V Mr. Probst introduced and moved the adoption of "Resolution No. 974. Cancelling Taxes on Washington Park Property." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 8./ Mr. Probst introduced and moved the adoption of 'Resolution No. 975. Directing the Transfer of $3,734.29 from the General Fund to the Eagle Avenue Opening Pund No. 78." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. probst introduced and moved the adoption of "Resolution No. 976. Directing Mayor to Convey Alameda Belt Line." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopte d and passed unanimously. 10./ Mr. Probst introduced and moved the adoption of "Resolution No. 977. -AcIcePing Grant of Easement and Consent to Recordation." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 11.v/ Mr. Probst introduced and moved the adoption of "Resolution No. 978. Declaring Public Interest and Necessity Require the Acquisition of a Block for School Purposes." Mr. Latham seconded the motion to adopt the Resolation and on roll call it was adopt- ed and passed unanimously. 12. The Clerk pro tem then submitted an Agreement requested by the Bay Farm Island Reclamation District, whereby the said District grants an easement and right of way to the city on and over South Levee of Unit No. 1, and also over North Levee of Unit No. 1, on condition that the city maintain a ten foot rOadWay on the North Levee and maintain and pave an eighteen foot roadway on the South Levee. After an explanation by the City Attorney and attention being called to the fact that the Agreement was similar in substance to one entered into with the District by the City of Oakland, upon motion of Mr. Probst, seconded by Mr. Latham, the council unanimously approved the Agreement and directed the Mayor to execute the same for and on behalf of the city. 13,V Mr. Latham reported on behalf of the Golf Commission that bids had been re- ceived for the proposed well on the Golf Course, as a result of which the Com- mission recommended that all bids, except that submitted by Mr. J. W. Bankhead, be rejected, and certified checks returned to the unsuccessful bidders. Upon motion of Mr. Probst, seconded by Mr. Neiss, the recommendation of the Golf Com- mission was unanimously approved. 14.v The City Clerk pro tem then read a communication addressed to the council, dated December 29th, 1925, whereby Mr. E. J. Probst tendered his resignation as a member of the council and requested that it take effect immediately, in order that he might enter upon his duties as Superintendent of Parks and Playgrounds, to which position he was recently appointed by the city manager. It was moved by Mr. Latham, seconded by Mr. Neiss, that the resignation be accepted, whereupon each member of the city council and also the City Attorney, took the occasion to testify to the long and valuable service rendered by Councilman Probst. The motion was thereapon carried unanimously. 15.v' 7here being no further business to transact the council adjourned to Met in regular session, Tuesday evening, January 5th, 1926, at 8 o'clock P. M.
