1926-02-16 Regular CC Minutes2 44/ 5./ 6.7 Foun REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENTNG, FEBRUARY 16, 1926. The meeting convened at 8 o'clock with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Traver and President Otis were noted present. Absent: None. The minutes of the regular meeting of February 2nd, 1926 were approved as read. Mr. Latham moved that the regular order of business be suspended and that the bids for the proposed firehouse be received and opened, seconded by Mr. Neiss and carried unanimously. Thereupon the Clerk opened and read the bids as follows: From the Dinnie Construction Company for the sum of ,13,571.00. The bid was accompanied by a certified check in amount of 11400.00. From John M. Bartlett, for the sum of 113,988.00. The bid was accompanied by a certified check in amount of 11400.00. From A. Wegner, for the sum of $16,870.00. The bid was accompanied by a certified check in amount of 11750.00. From J. A. Bryant, for the sum of $16,881.00. The bid was accompanied by a certified check in amount of $2,000.00. From Sullivan & Sullivan, for the sum of 1 700.50. The bid was accompanied by a certified check for $1370.50. From F. R. Siegrist Company for the sum of 114,977.00. The bid was accompanied by a certified check in amount of 11600.00. From Alfred L. Vezina, for the sum of •13,984.00. The bid was accompanied by a certified check in amount of 11500.00. From Heath & Wendt, for the sum of 114,533.00. The bid was accompanied by a certified check in amount of 11500.00. From McIntosh Bros. for the sum.of 114,747.00. The bid was accompanied by a certified check in amount of ;01500.00. Prom Conrad Roth, for the sum of $14,776.00. The bid was accompanied by a certified check in amount of '4500.00. From Thebo, Starr & Anderton, for the swn of 114,678.00. accompanied by a certified check in amount of $1800.00. The bid was Mr. Latham moved that the bids be referred to a committee consisting of the City Manager, Tire Chief and Architect. The motion was seconded by Mr. Noble and carried. The following papers were ordered filed: Oath of office of Lloyd R. Wendland, as Police Officer. Oath of office of Alvin W. Hovey, as Police Officer. Report of the Municipal Electric Light Plant for the month of December,1925. Re/Dort of the East Bay Municipal Utility District as of February 15, 1926. Oakland Title Insurance Company's policy covering firehouse lot, corner of n and Jackson Streets. Bond of Lloyd W. Battersby, as Collector, Municipal Electric Light Plant. The following communications were received: 8.t7 From H. E. Macdonald, requesting extension of another year on concessions at Washington Park, for which he agrees to pay $60.00. Mr. Neiss moved that the City Attorney be instructed to prepare a lease and that said lease contain a thirty days notice of cancellation clause. The motion was seconded by Mr. Latham and carried unanimously. From Hon. Friend W. Richardson, acknowledging receipt of Resolution No. 92. Ordered filed. 10.V From Wm. A. Sherman, President of the State Board of Harbor Commi ssioners acknowledging receipt of Resolution No. 992. Ordered filed. 11.V From the Golf Commission recommending that all bids for the sprinkler system be rejected, and that checks be returned to the bidders. Also, advising of the resig- nation of Prank J. Marshall as a member of the Commission. Mr. Latham moved that the recommendation of the Golf Commissien, pertaining to the rejection of all bids and the action of the city clerk in returning certified checks be approved by the council, second- ed by Mr. Noble and on roll call carried unanimously. 12. In the matter of the resignation of Mr. Marshall, as a member of the Golf Commission, Mr. Latham moved that the resignation be accepted, seconded by Mr. Traver and carried. 1 Mr. Neiss moved the appointment of Herbert D. Schultz, as a member of the Golf Commission, vice Frank J. Marshall, resigned, seconded by Mr. Traver and carried unanimously. 14. From the Golf Commission, asking the City Engineer to prepare new plans and specifications covering Sprinkler System to be used on the Golf course. Ordered filed. 15./ From the Encinal Terminals, re proposed Sunday closing ordinance. Order- ed filed. 17. 19./ 2o./ 214 241 From August J. Fromm, re proposed Sunday closing Ordinance. Ordered filed. From the Alameda Improvement Club, calling attention to a depression in the center of the roadway at Santa Clara Avenue and Page Street. Mr. Neiss moved that the communication be referred to the Superintendent of Street, second- ed by Mr. Latham and carried unanimously. Two communications from the Golden Gate Gun Club, requesting the council for some assistance in beautifying the shooting grounds in West Alameda. After discussion, Mr. Latham moved that the communications be referred to the City Attorney to report back to the next meeting of the council as to whether public moneys could be expended for this purpose. The motion was seconded by Mr. Neiss and carried. cFrom the West End Merchant's Association, re the raising of Webster Street to proper grade. Mr. Traver moved that this communication, as well as the communication received from the Alameda Improvement Club, previously re- ferred to—the Committee of the Whole, be referred to the City Manager for answer. The motion was seconded be/ Mr. Latham and carried. From Hutchinson Company, Trio., requesting permission to grade, curb, gutter and macadamize Bay Island Avenue, from the western line of Park Avenue to the Eastern line of Park Street. Mr. Neiss moved that permission be granted, seconded by Mr. Traver and carried unanimously. ?Tom City Attorney Locke, re Memorial Hall for soliders. After dis- cussion, Mr. Neiss moved that the communicated be referred to the committee of the whole, seconded by Mr. Traver and carried unanimously. From the Alameda Real Estate Board, recommending the widening of Park Street, from San Jose Avenue to Lincoln Avenue, and Webster Street, from Central Avenue to Eagle Avenue. Upon motion, the communication was unanimously referred to a meeting of the commiteee of the whole. The Committee appointed by the council, to which was referred the bids for the firehouse returned to the council chambers and .recommended that the bid of the Dinnie Construction Company, for the sum of $13,571.00 be accepted. After discussion, Mr. Latham introduced and moved the adoption of "Resolution No. 994. Resolution of Award. (New Firehouse) Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Applications for a permit to sell soft drinks were received from Edward S. Babue, 1500 Webster Street, Richard Louis Netherwood, 2007i Lincoln Avenue, and the Piggly-Wiggly Company, 1201 Chestnut Street. Inasmuch as these appli- cations had received the recommendation of the Chief of Police, Mx. Latham introduced and moved the adoption of "Resolution No. 995. Granting a Permit for a License to Sell Soft Drinks." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 25,1 A communication was received from the Pacific Telephone & Telegraph Company, requesting the council to reclassifying upon its own initiative certain proper situated at the southeast corner of Willow Street and Central Avenue, from a Regidence District, Class 1, to a Business District, Class 111, for the purpose or constructing a two-story class "A" bhilding thereon for telephone business purposes. Mr. Latham moved that the request be complied with, seconded by Mr. Neiss and on roll call carried unanimously. 26.1/ The Clerk stated that in accordance with the published notice re e Resolution of Intention No. 79, New Series, for the improvement of Clay and Calhoun Streets, a petition of protest had been received in the matter, The petition of protest was received and ordered filed. Mr. S. Hinton, addressed the council in connection with the petition of protest and after discussion, Mr. Neiss moved that the matter be referred to the City Attorney, and that further action by the council be continued until the next regular meeting of the council to be held March 2nd, 1926. The motion was seconded by Mr. Traver and carried unanimously. 27. Mr. Latham introduced and moved the adoption of Resolution No. 996. Resolution Authorizing the Sqle of Chestnut Street Property." Mr. Noble seconded the motion to adopt the Resolution, and on roll call it was adopted and passed unanimously. 28./ Mr. Noble introduced and moved the adoption of Resolution No. 997. Cancelling Certain Taxes on Property Acquired By the Veterans' Welfare Board and Other Prop- erty Acquiried by the High School. Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 29.,v Mr. Traver introduced and moved the adoption of Canoe ng "Resolution No. 998. Delinquent Tax Sales on Publicly Owned Property." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 0.i Mr. Neiss introduced and moved the adoption of "Resolution No. 999. Cancelling Street Opening Assessments." Mr. Noble seconded the motion to adopt the Resolution and on roll call was adopted and passed unanimously. 310/ Mr. Noble introduced and moved the adoption of 32./ 3 "Resolution-No. 1000. Rejecting Plans for the Sprinkler System for Bay Farm Island Golf Course." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. City Engineer Hamilton presented new plans and specifications for automatic sprinkler system for the Alameda Municipal Golf Course. Mr. Latham moved that the plans and specifications be adopted, seconded by Mr. Noble and on roll call carried unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1001. Rejecting All Bids on Sprinkler System on Bay Farm Island Golf Course, and Instructing the Cleric to Call for Bids on New Plans." Mr. Noble seconded the motion to adapt the Resolution and on roll call it was adopted and passed unanimously. 34.V Mr. Latham introduced and moved the adoption of "Resolution No. 1CO2. Requesting the Railroad Commission to Grant A Rehearing to the Golden Gate Ferry Company." Mr. Neiss seconded the motion to adopt the Resolution and on roll c adopted and passed unanimously. 35d A Bill entitled "A Bill ?or Ordinance No. New Series. Reclassifying Property. (2254 Alameda Avenue)" was came up for passage and was read by the Clerk. Mr. Traver moved that the Ordinance as read be adopted, seconded by Mr. Niees and on roll call it was adopted and passed unanimously. 36./ A Bill entitled "A Bill For Ordinance No. New Series. Reclassifying Property. (Business - Dyeing and Cleaning)" came up for passage,: and was read by the Clerk. Mr. Latham movcd that the ordinance as read be adopted, seconded by Mr. Noble and on roll call it was adopted and passdd unanitously. 37.V/ A Bill entitled "A Bill For Ordinance No. _____ Series. An Ordinance Provising for the Erection of Traffic Stop Signals on Both Sides of Central Avenue at All Intersecting streets except Park Street, and Requir- ing the Drivers of All Vehicles to Come to a Full Stop at Street Intersections Before Crossing Said Avenue." came up for passage and was read by the Clerk. Mr. Travers moved that the ordinance as read be adopted, seconded by Mr. Latham and on roll call carried unanimously. 38. A Bill entitled "A Bill For Ordinance No, New Series. An Ordinance Forbidding the Carrying on of Certain Occupations within the City of Alameda on Sunday, so as to Provide a Day of Rest One Day in the Week for Persons Pursuing Those Ocaapations." came up for passge and was read by the Clerk. Mr. Latham moved that a time limit of three minutes be pleced upon those who desired to speak for or against the adoption of this ordinance, unless the party speaking represented a group, and then the time limit to be extended to ten minutes. The motion was seconded by Mr. Neiss and carried. Thereupon the following people spoke in favor of the adoption of the ordinance:- Messrs. Edward Champion, F. W. Perryman, H. H. Sack, representing individual grocers, R. V. Longfellow, representing the Piggly-Wiggly store, E. M. Lewis, representing Skaggs and A. V. Larsen, representing the Pon Honor stores, also, W. L. Suter. Those who spoke against the adoption of the ordinance were Messrs. A. Andronico, Hon. L. R. Weinmann,representing various interests, Capt. W. G. Tibbitts, representiTe shipbuilding interests, Mrs. Alice Caton and Mrs. I. W. Cleverdon, of the State Housewives League, C. M. Covell of the Encinal Terminals, P. W. Hone, Attorney for the Associated Oil Company, S. F. Falkenburg, representing Seventh Day Adventists and E. Hagestrom, President, Mutual Creamery Company. After disoussion, Mr. Neiss moved that the ordinance be referred back to a meeting of the Committee of the Whole, for further consideration, seconded by Mr. Latham and carriei unanimously. Claims against the General Departments amounting to ment e734.52; Fire' Department, 240.93; Street Department ment 117.35; Recreation Department, 3462.25; Golf Course 77.60; Council Relief Fund, 3121.88; Health Center Fund, 248.50; Electric Light Fund 317,436.76; East Bay Water Co.
