1926-04-20 Regular CC MinutesREGULAR MEETING 07 THE COUNCIL 01 THE CITY OF ALAMEDA, TUESDAY EVENING, APRIL 20TH, 1926. The meeting onvened at 8 o'clock P. M. with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Traver and President Otis, (5) were noted present. The minutes of the regular meeting of April 6th, 1926 were approved as read. The following papers were ordered filed: 1.V/ Report of the East Bay Municipal Utility District, as of April 15, 1926. 2. Affidavit of publication, Notice to Bidders for furnishing grass seed , for municipal golf course. Affidavit of publication, Resolution of Intention, No. 80, N. S. re official grade of Webster Street. 4. Quit Claim Deed, City of Alameda to Magnus Hollested. 5.J Contract of Employment Carl Werner, as architect, bungalow firehouse, East End. The following cornmunications were received: From the Alameda High School inviting the council to a baseball game. Ordered filed. From various residents requesting installetion of a putting green in Franklin Park. After discussion, Mr. Latham moved that the putting green be in- stalled at an estimated cost of 27.00, seconded by MR. Traver and carried unani- , measly. From the City Planning Commission, requesting postponement of Counci final action in the matter of automobile-ferry service. Mr. Neiss moved that the communication be filed seconded by Mr. Traver and carried. 9./ From the City Planning Commission, recommending the reclassification of the southwest corner of Park Street and Alameda Avenue, from a Business District, Class III, to a Business District, Class V. Mr. Traver moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Latham and carried. 10. From the City Planning Commission, recommending the reclassification of the property situated on the southern line of Santa Clara Avenue, distant easter- ly 140 feet from the intersection thereof with the eastern line of Webster Street, running thence easterly 50 feet,from a Residence District, Class II, to a Business District, Class IV. Mr. Neiss moved that the recommendation of the City Planning ,Commission be adopted, seconded by Mr. Traver and carried unanimously. 11,1 From the City Planning Commission, recommending the reclassification of the northwest corner of Encinal Avenue and. Walnut Street, from a Residence District Classes I and. II,to a Business District, Class III. Mr. Traver moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Noble and carried. 12.V From City Attorney, giving legal opinion, re taxi-cab stand in front of 1410 Webster Street. Ordered filed. 13.V From Herbert D. Schultz, resigning as Mr. Latham moved that the resignation be accep carried unanimously. 14.i Mr. Latham then moved that Mr. William Higby be appointed to fill the vacancy, caused by the resignation of Mr. Schultz, seconded by Er. Locke, City Attorney, re status of Eagle Avenue opening. Orde'e filed. eipt of copy of Resolution No. 171 From the Board of Public Utilities, regarding the granting of a permit to the City of Oakland to transmit electric current into the City of Alameda for dredging purposes only. The communication was ordered filed. 7rom Mr. D. J. Sueell, requesting permission to move a cottage on the westside of Grand. Street, between Eagle and. Clement Avenues, to a new location. Inasmuch as this did not receive the recommendation of City Manager Hickok, Mr. Noble moved that the request be denied, seconded by Mr. Traver and carried unanimously. 19.4 Mr. Latham moved that the council now take up, out of order, the matter of passing ordinances covering installation of Belt Line tracks on Buena Vista Avenue. The motion was seconded by Er. Traver and carried. There being a number of people in the council chamfer, President Otis stated that the council was now prepared to hear from those Who favored the adoptiohof the proposed ordinances and authorized the city clerk to read the same. Thereupon the Clerk read in sub- stance the ordinances as proposed. The Clerk presented to the council, petitions signed by approximately 313 property owners and residents, protesting the granting of the franchise to the Alameda neit Line, farthe laying of tracks in Buena Vista Avenue, between Grand and Benton Streets. These petitions were filed by Mr. A. J. Utley. Mr. A. K. Tichenor addressed the council, as did Hon. L. R. Weinmann, Hon. F. M, Angelotti and. Dr. Pierce, who spoke in favor of the passage of the two ordinances referred to. Messrs. P. F. Cavanaugh, Paul Neuman, Hon, E. K. Taylor, Capt. W. H. Tibbitts and. Mrs. Alice Caton addressed the council in protest. After farther discussion, President Otis requested Vice-president Neiss to preside, and then proceeded to read a statement as to his objections to the passage of these ordinances. The statement was filed. Whereupon, Mr. Neiss relinquished the chair to Mr. Otis. After further discssuion, A Bill entitled "A Bill For Ordinance No. New Series. An Ordinance Authorizing and Directing the Execution of an Agreement between the City of Alameda, a Municipal Corporation on the One Hand, and The Western Pacific Railroad Company, The Athison, Topeka and Santa Fie Railway Company, and Alameda Belt Line, Railroad Corporations, on the Other, Amending and. Modifying the Agreement Dated. December 15th 1924, Between said City of Alameda and the Two Railroad Companies first above Named, the Execution of Which Agreement by said City was Authorized and Directed by Ordinance No 259, (New Series), by changing the Protisions of said Agree- ment with Relation to the Route of That Portion of the Railroad to be Constructed by Alameda Belt Line Between a Point in the Existing Track of Alameda Belt Line on Clement Avenue near Minturn Street, and the Westerly line of Webster Street, so as to Eliminate All Requirements that Any Part of the Railroad to be Constructed, shall be located on the Sidewalk Area of Buena Vista Avenue, and so as to Provide that in so far as said Railroad is to be Located on and along said Buena Vista Avenue it Shall be Constructed along the Center line Thereof." came up for passage. Mr. Traver moved that the passage of the ordinancebe postponed until the next regular meeting of the Council to be held May 5th. An Ordinance Amending Sections 1 and 4 of Ordinance No. 273, (New Series) entitled "An Ordinance Granting to Alameda Belt Line, a Railroad Corporation, and its Successors and. Assigns the Right to Use Portions of Certain Streets, Highways and. Properties within the City of Alameda for the Purpose of the Acquisition, Construction,Maintenance and Operation of a Belt Line Railroad to Serve the Industrial Area and. Water- front of said City of Alameda, and the Right to Acquire, Construct, Maintain and. Operated. Such Belt Line Railroad upon, Along and. Across Designated. Portions of said Streets, Highways and Propertirs", adopted and passed by the Council February 3rd, 1925." came up for passage. Cohsenting t of Deed." e ordation Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 23.1/ Mr. Latham introduced and moved the adoption of "Resolution No. 1029. Granting a Temporary Permit to the City of Oakland to Lay an Electric Cable to the Alameda Shore for Dredging Purposes." Mr. Noble seconded the motion t adopt the Resolution and on roll call it was adopted and passed unanimously. 24.V' Mr. Noble introduced and moved the adoption of "Resolution No. 1030. Authorizing Payment of ',1:500.00 to Magnus Hollested, and Modifying Agreement of June 17, 1925." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 2 . 2 An application for a permit to sell soft drinks was received from R. . L. Butler, 930 Central Avenue. Inasmuch as the application had received ,the endorsement of Chief. of Police, Wm, H. Wahmuth, Mr. Neiss introduced and moved the adoption of 271 28.1 29. 30. "Resolution No. 1031. Granting aPermit for a License to Sell Soft Drinks." Mr. Traver seconded the motion to adopt the resolution and on roll call it was adopted and passed unanimously. The matter of the hearing under Resolution No. 1024, re the existence of a nuisance at 2331 Lincoln Avenue, Mr. Latham moved that in accordance with the request of Hon. L. i. Weinmann, representing F. R. McCann, that said matter lay over to the next meeting of the council, to be held May 4th, seconded by Mr. Neiss and carried. The Clerk stated that the time had arrived for consideration of the report of the City Manager re widening Park Street. Mr. Niess moved that further consideration of this matter lay over until the next meeting of the council, seconded by Mr. Traver and carried. The Cle& stated in response to the advertised notice to bidders for furnishing grass seed for the municiral golf course, he was in receipt of one bid. Mr. Traver moved that the bid be opened and read, seconded by Mr. Noble and carried, thereupon the Clere opened and read the bid as follows: From Sevin-Vincent Seed Co., accompanied by a certified check in the sum of 3700.00. Authorizing Purchase of Grass Seed in Open Market." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed. unanimously. Mr. Neiss moved that the ordinance as read be adopted., seconded by Mr. Traver and on roll call carried unanimously. Ordinance No. eiT\ New Series. Reclassifying Property. (South side of Buena Vista Avenue, 100 feet east of Jay Street.) Mr. Noble moved that the Ordinance as read be adopted, seconded by Mr. Latham and on roll call carried unanimously. Mr. Neiss moved that the City Manager and City Attorney, who were appoint- ed at a meeting of the council held. April 6th, to attend the hearing on the repair of bridges across the Estuary, be instructed to use the term "modern bridges, rather than "bascule" bridges, seconded by Mr. Latham and carried. Mr. T. J. Hargrave addressed the council complaining about the crowded condition of the Key System Transit Company's cars. The matter was referred to the City Manager, Claims ,against the General Departments amounting to 34353.18; Police Department, 3210.20; Fire Department, 35419.12; Street Department 32545.87; Health Department 352.24; Recreation Department, 3208.30; Golf Course, $478.52; Store Department, 32056; Council Relief Fund, 023.67; Health Center Fund, 3219.03; Electric Light Fund, 317,082.11; School Construction Fund, 320.00 and Eagle Avenue Opening Fund, No. 78, amounting to 33072.95, having been approved and audited by the proper officials were listed by the Clerk as follows: Labor Alameda Steam Laundry Assn, Alameda Times Star TT TT if American Law Book Bender Moss Co.
