1926-05-04 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, MAY 4TH, 1926. The meeting convened at 8 o'clock with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Traver and. President Otis (5) were noted present. Absent; None. The minutes of the regular meeting of April 20th were approved as read. 1 . The council unanimously agreed to take up out of order the matter of the passage of the following ordinances; Ordinance No. New Series. An Ordinance Authorizing and Directing the Execution of an Agreement between the City of Alameda, a Municipal Corporation, on the One Hand, and The Western Pacific Railroad Company, The Atchison, Topeka and Santa Fe Railway Company, and. Alameda Belt Line, Railroad Corporations, on the Other, Amending and. Modifying the Agreement Dated December 15th, 1924, Between said City of Alameda and the Two Railroad. Companies first above named, the Execution of whin. Agreement by said. City was authorized and Directed by Ordinance No. 259, (New Series), by changing the Provisions of said Agree- ment with Relation to the Route of that Portion of the Railroad to be Constructed by Alameda Belt Line Between a Point in the Existing Track of Alameda Belt Line on Clement Avenue near Minturn Street, and the Westerly line of Webster Street, so as to Eliminate all Require- ments that any part of the Railroad to be Constructed, shall be located on the Sidewalk Area of Buena Vista Avenue, and so as to Provide that in so far as said Railroad is to be Located on and along said Buena Vista Avenue it shall be Constructed along the Center line Thereof." and Ordinance No. New Series. An Ordinance Amending Sections 1 and 4 of Ordinance No. 273(New Series) entitled "An Ordinance Granting to Alameda Belt Line, a Railroad. Corporation, and its Successors and Assigns the Right to Use Portions of Certain Streets, Highways and Properties within the City of Alameda for the Purpose of the Acquisition, Construction, Maintenance and Operation of a Belt Line Railroad to Serve the Industrial Area and Waterfront of said City of Alameda, and the Right to Acquire, Construct, Maintain and Operate such Belt Line Rail- road upon, Along, and Across Designated Portions of said Streets, Highways and. Properties", adopted and pass- ed by the Council February 3rd, 1925." Mr. Neiss moved that the Ordinances be rejected, seconded by Mr. Traver and on roll call carried unanimously. 2. Mr. Latham moved that when the council adjourns it does so to meet in adjourned regular session, Tuesday evening, May llth, 1926 at 8 o'clock P. M., seconded by Mr. Traver and carried. 3.V Mr. Latham moved that a Commiteee of two be appointed by the council to inter- view the Alaska Packers Association and Alameda Belt Line, with a view of obtaining a franchise through the Alaska Packers Association's property for the railroad tnacks, instead of on the sidewalk area. The motion was seconded by Mr. Noble and carried unanimously. 4./ Mr. Neiss moved that Councilman Latham and Councilman Traver be appointed as such Committee, seconded by Mr. Noble and carried unanimously. 5.v Mr. Latham moved that the Committee be requested to report at the regular adjourned meeting of the council to be held Tuesday evening, May llth, seconded by Mr. Noble and carried unanimously. The following papers were ordered filed: Quitclaim Deed from the City of Alameda to Julia Bruzzone, et al. 7./ Quitclaim Deed from City of Alameda to Adelaide Bruzzone, et al. 8.v, Affidavit of publication, Notice of Change of Grade, re Webster Street. Deed, Adelaide Bruzzone, et al to City of Alameda, re Eagle Avenue opening. 10. Certificate of Title Insurance Policy, to firehouse lot on Pacific Avenue, west end. 110/ Report of Municipal Electric Light Plant, for the month of March, 1926. Affidavit of publication, Notice to Bidders on rock and screenings. 13.V Oath of Office of Charles M. Cadman, as member of the Board of Education. Mr. Neiss moved that the council take a recess of five minutes in order to allow the lobby to clear. The motion was seconded by Mr. Latham.and carried. The council then reconvened and all were noted present. 16. t/ Mr. Latham introduced and moved the adoption of "Resolution No. 1032. Transferring $21,506.89 from the Industrial Railroad Fund to the General Fund." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 17. Mr. Neiss introduced and moved the adoption of "Resolution No. 1033. Transferring ' g w20,000.00 from the Electric Light Fund to the General Fund." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 18. Mr. Traver introduced and moved the adoption of "Resolution No. 1034. Transferring $2,853.04 from the Electric Light Fund to the General Fund." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 19.V Mr. Noble introduced and moved the adoption of "Resolution No. 1035. Transferring $5,000.00 from the General Fund to the Compensation Insurance Fund." 20. 21, 12r. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1036. Authorizing Quitclaim Deed to Magnus Hollested and Wife." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Neiss introduced and moved the adoption of "Resolution. No. 1037. Authorizing and Directing Redemption Clerk to Depositt Certain Moneys in the General Fund." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 22. ' Mr. Traver introduced and moved the adoption of "Resolution No. 1038. Authorizing and Directing Treasurer to Deposit Certain Moneys in the General Fund." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 23.x+` Mr. Noble introduced and moved the adoption of "Resolution No. 1039. Authorizing and Directing Treasurer to Deposit Certain Moneys in the General Fund." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 24/ Mr. Neiss introduced and moved the adoption of 26. "Resolution No. 1040. Instructing Treasurer to Return Monies Received in Payment for purported Taxes on Government Island." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following communications were received: From the Mayor, appointing Frederick Maurer as a member of the Board of Free Library Trustees for a five year term,from April 22, 1926. Ordered filed. From the Mayor, appointing Charles M. Cadman as a member of the Board of Education for a period of five years from April 26, 1926. Ordered filed. 27./ From City Attorney Locke, re continuance of hearing on the application of the Key System Transit Company for an increase of rates from May 4th to September 14, 1926. Ordered filed. 281 From the East Bay Safety Council, re safety parade to be held on Saturday, May 22nd, 1926. Mr. Neiss moved that the communication be referred to the City Manager, seconded by Mr. Traver and carried. From Samuel Evans Gordon & Co., re bid, annual audit of books. Ordered 29./ O. 311 32. 331 34/ 38. 3 40. filed. From the Secretary of War, containing rules and regulations governing the opening of the three bridges across the Estuary. Ordered filed. From the Key System Transit Company, inviting the council to the keel laying of one of their new ferry boats. Ordered filed. From City Attorney Locke, advising the council of the decision of the Supreme Court, re ownership of Government Island. The communication was ordered filed. Mayor Otis stated that City Attorney Locke as entitled to the highest degree of credit for his efforts and successful termination of this particular case. From City Attorney Locke, re granting by the Railroad Commission permission to construct a street on Eagle Avenue, across the tracks of the Central Pacific Railway. Ordered filed. From the City Planning Commission, transmitting reports of the findings of the committee, re automobile ferry systems. Ordered filed. From the City Planning Commission, containing recommendation of special committee, re automobile ferry service. Ordered filed. A petition was received from various residents of the city of Alameda, requesting a bowling green to be established in one of the city parks or playgrounds. Mr. Latham moved that this communication be referred to the Golf Commission, seconded by Mr. Neiss and carried unanimously. A petition was received from various residents protesting the locatiaa of the Alameda Scavengers Association. After discussion, Mr. Neiss moved that the petition be referred to the City Manager, City Attorney and Health Officer, with full power to act, seconded by Mr. Latham and carried. Additional petitions of protest were received re laying of railroad tracks on Buena Vista Avenue. The petitions were ordered filed. In the matter of the hearing under Resolution No. 1024, regarding the existence of a lottery nuisance at 2331 Lincoln Avenue, Judge L. R. Weinmann appeared representing F. W. McCann, the owner, and made a statement. After discussion, Mr. Latham moved that the matter be referred to the Chief of Police for investigation as proposed new tenants, seconded by Mr. Neiss and carried. The Clerk stated that the time had arrived for the opening of bids for screenings and rock, and that in response to the published notice four bids were received. Mr. Latham moved that the bids be opened and read, seconded by Mr. Noble and carried. Whereupon the Clerk opened and read the bids as follows: From Heafey, Moore & McNair, accompanied by a certified check in amount of $1000.00. Mr. Latham moved that the bids be referred to the City Engineer and City Manager to report back to the council at the meeting to be held Tuesday evening, May 18th, 1926, seconded by Mr. Neiss and carried. The following ordinances came up for passage and were read by the Clerk: "Ordinance No. New Series. Reclassifying Property. (Southwest corner of Park Street and Alameda Avenue." Mr. Neiss moved that the ordinance as read be adopted, seconded by Mr. Latham and on roll call it was adopted and passed unanimously. "Ordinance No. New Series. --- Reclassifying Property. (Northwest corner Encinal Avenue and Walnut Street." Mr. Noble, poved that the ordinance :as read be adopted, seconded by Mr. Traver and on roll call it as adopted and passed Uhanimously. "Ordinance No. ____ Series. Reclassifyinoperty. (South side of Santa Clara Avenue, 140 feet East of Webster Street.) Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Neiss and on roll call it was adopted and passed unanimously. 44.1 In the matter of the widening of Park Street, Mr. Traver moved that the matter be considered in the preparation of the next budget, from San Jose to Lincoln Avenue, seconded by Mr. Noble and carried unanimously. 45•/ Mr. Neiss moved that an amount of $450.00 be appropriated for advertising purposes, in exploiting the harbor project as recommended and adopted by the council, in the recent report of Harbor Engineers. The motion was seconded by Mr. Traver and on roll call carried unanimously. Mr. Latham moved that the City Clerk be instructed to advertise for bids for the erection of 2200 linear feet of wire fence on the Golf Course, in adcordance with the plans and , specifications on file with the City Engineer, seconded by Mr. Neiss and carried. Mr. Latham moved that the City Manager be instructed to inotify the owners of the Golf Course property of our intention to renew the lease now held by the City of Alameda.
