1926-05-18 Regular CC Minutes2./ REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAdEDA, TUESDAY EVENING, MAY 18th, 1926. The meeting convened at 8 P. M. with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Traver and Presi dent Otis, (5) were noted, present. Absent: None. The minutes of the regular meeting of May 4th, 1926 were approved as read. The minutes of the adjourned regular meeting of the Council dated. May 11, 1926 were then read. Paragraph 6 was amended to read as follows: aa),I "Mayor Otis then requested that he be relieved of the position as Director of the Alameda Belt Line. Mr. Neiss moved that his resignation as Director be accepted, seconded by Mr. Traver and carried unanimously. Mr. Neiss then moved that Mr. Latham be appointed to serve as Director of the Alameda Belt Line, as representing the City of Alameda, vice Frank Otis, resigned. The motion was seconded by Mr. Traver and carried unanimously." The minutes of the adjourned regular meeting of Tuesday evening, May llth, 1926 were then approved as read. The following papers were ordered filed: 3.v Affidavit of publication, Natice to Bidders, re fence, Golf Course. 4.1 Deed, Frank J. Bruzzone et al to City of Alameda, re firehouse lot, West End. 5.7 Copy of decision 16,668 of the Railroad Commission, re application 6.V Alameda Belt Line, construction of track across Oak Street. Copy of Quitclaim Deed, City of Alameda to Magnus Hollested, et al. 7.V Oath of Office, Frederick Maurer, as member of the Board of Rree Library Trustees. Report of East Bay Municipal Utility Distri t as of May 15th. The following communications were received: 9./ From the City Manager and City Engineer, re award of contracts for crushed rock and screenings for the street department. Mr. Latham moved that the recommendations as contained, therein be adopted, and contracts be entered into with the successfull bidders. The motion was seconded by Mr. Neiss and carried unanimously. 10a7 From the Board of Education, inviting the council to attend the Third Annual Competitive Drill of the Alameda Unit, R. 0. T. C. Mr. Neiss moved that the invitation be accepted, seconded by Mr. Traver and, carried. 8./ 11./ From L. Serralunga, re use of his property by the Alai-reds. Scavengers Association. Mr. Neiss moved that the City Manager and City Attorney be in- . structed to declare the use of the property in question a nuisnace and have the conditions as they now exist corrected. The motion was seconded by Mr. Latham and carried unanimously. 12.v/ From Frank L. Taylor, re renewal of lease, Golf Course ground. Ordered filed. 13,Y From Garrett W. McEnerney, containing application of the Roman Catholic Archbishop of San Francisco, for the reclassification of certain property in the East End of Alameda upon the Council's own initiative. Mr. Neiss moved that in asmuch as two previous attempts to reclassify this property had failed, the matter be referred to the City Attorney. The motion was seconded by Mr. Latham and carried unanimously. 14.V/ From the City Planning Commission, re protection of school children at intersecting streets, etc. Mr. Traver moved that the communication be referred to the City Manager, seconded by Mr. Noble and carried. 15.V From the City Planning Commission, re automobile ferry service. Mr. Noble moved that the communication be filed, seconded by Mr. Latham and carried unanimous- ly.' 16.V From the City Planning Commission, re street signs on diagonal corners of all street intersections. Mr. Neiss moved that the communication be referred //to the City Manager, seconded by Mr. Noble and carried unanimously. 17.1 From the City Planning Commission recommending to the council that the Boulevard Stop Sign at Central Avenue and. Webster Street be removed. Mr. Traver moved that the redommendation be rejected, seconded by Mr. Noble and carried. 18. From the City Planning Commission recommending the denial of the applica- tion for the reclassification of the northwest corner of Post and Madison Streets, from a Residence District, Class I, to a Business District, Class V. After dis- cussion, Mr. Neiss moved that final decision of the council be postponed until its next regular meeting to be held. June let, 1926, seconded by Mr. Traver and carried unaniMously. 19. 20. May 18th, 1926. From the City Planning Commission recommending that a temporary permit be granted upon the proposed reclassification of the property at 1433 Morton Street, from a Residence District, Class I, to a Business District, Class III, permitting the operation of a tea room. Mr. Noble moved that a temporary permit be granted, revocable at the will of the council. The motion was seconded by Mr. Traver and carried unanimously. From R. H. Creese, 1410 Webster Street, petitioning the council for per- mission to allow a taxi-cab stand in front of his property. After discussion, Mr. Traver introduced and moved the adoption of "Resolution No. 1041. Authorizing Yellow Cab Co. to Stand a Taxi-Cab in Front of 1410 Webster Street." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The Clerk stated that in response to advertised Notice to Bidders, re erection of wire fence on Golf Course, he was in receipt of four bids. Mr. Latham moved that the bids be opened and read, seconded by Ex. Noble and carried. Thereupon the Clerk opened and read the bids as follows: From the Standard Fence Company, accompanied by a certified check in amount of $200.00. For a five foot fence.........$1776.50 For a six foot fence 0000.00.00 1920.00 From Michel & Pfeffer, accompanied by a certified check in amount of $275.00. For a five foot fence. e004,00 .$1928.00 For a six foot feriae. WOW. 2146.00 Mr. Latham moved that the bids be referred to the Golf Commission, who were present, to report back immediately. The motion was seconded by MX. Traver and carried. 22d The Clerk stated that he was in receipt of one bid for the wrecking of the firehouse on the corner of Mound and Jackson Streets, in amount of $25.00, from the Clopton Wrecking Company. Mr. Neiss moved that the bid be rejected and the matter be left in the hands of the City Manager, seconded by Mr. Latham and carriea. 23.V Applications for a permit to sell soft drinks sere received from Earl S. T. Clifford, 2327 Central Avenue and Mrs. E. Strotkamp, 2100 Lincoln Avenue. Inasmuch as both applications had received the endorsement of Chief of Police, Wm. H. Wahmuth, Mr. Latham introduced and moved the adoption of 24.c 25.V/ "Resolution No. 1042. Granting a Permit for a License to Sell Soft Drinks." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The Clerk stated that he was in receipt of fifteen petitions, containing approximately 1374 names, favoring the establishment of the Golden Gate Ferry system. Mr. Neiss mOved that the petitions be received and filed, seconded by Mr. Noble and carried. The following Ordinances came up for passage: "Ordinance No. \, New Series. An Ordinance Amending Sections land 4 of Ordinance No. 273 (New Series) Entitled "An Ordinance Granting to Alameda Belt Line, a Railroad Corporation, and its Successors and Assigns, the Right to Use Portions of Certain Streets, Highways and. Properties within the City of Alameda for the Purpose of the Acquisition, Construction, Maintenance and Operation of a Belt Line Railroad to Serve the Industrial Area and Water- front of said City of Alameda, d the Hight to Acquire, Con- struct, Maintain and. Operate such Belt Line Railroad. Upon, Along, and Across Designated Portions of said Streets, Highways and Properties", adopted and passed by the Council February 3rd, 1925." Mr. Latham moved the adoption of the Ordinance, seconded by Mr. Noble and on roll call it was adopted and passed unanimously. 26./ 27 2 May 18th, 1926. "Ordinance No. ui New Series. An Ordinance Authorizing and Directing the Execution of an Agreement Between the City of Alameda, a Municipal Corporation on the One Hand, and the Western Pacific Railroad Company, The Atchison, Topeka and Santa Fe Railway Company, and Alameda Belt Line, Railroad Corpora- tions, on the Other, Amending and Modifying the Agreement dated December 15th, 1924, between said City of Alameda and the Two Railroad Companies First Above Named, The Execu- tion of Which Agreement by said City was Authorized and Directed by Ordinance No. 259 (New Series), by Changing the Provisions of said Agreement with Relation to the Route of that Portion of the Railroad to be Constructed by Alameda Belt Line Between a Point in the Existing Track of Alameda Belt Line on Clement Avenue, near Minturn Street, and the Westerly line of Webster Street, so as to Eliminate All Requirements that Any Part of the Railroad to be Constructed shall be Located on the Sidewalk Area of Buena Vista Avenue, and So as To Provide that the Portion of said Railroad to be Constructed between Hibbard Street and Sherman Street May Be Constructed Over, Along and Upon Private Property." Mr. Traver moved the adoption of the Ordinance, seconded by Mr. Neiss and on roll call it was adopted and passed unanimously. An Application for a Gratuitous license was received from Nealie W. Jackson 1928 Lafayette Street, to purchase and sell junk. A communication from Beulah E. Spurn, Executive Secretary of the Alameda Social Service Board, was attached to the application, endorsing same. Inasmuch as the application had received the still further endorsement of Wm. H. Wahmuth, Chief of Police, Mr. Latham moved that the request be granted, seconded by Mr. Noble and carried unanimously. The Golf Commission, through CityManager Hickok, reported that the Com- mission unanimously recommended to the council the awarding of the contract for the erection of the wire fence on the Municipal Golf Course, to the Standard Fence Company, whose bid was $1920.00 for a six foot fence. Mr. Latham moved that the recommendation be accepted and the Mayor be authorized to sign the con- tract covering same, and that the City Clerk be instructed to return the certi- fied checks of the unsuccessful bidders. The motion was seconded by Mr. Traver and carried unanimously. In the matter of a hearing on the proposed auto ferry system between Alameda and San Francisco, Mr. Neiss moved that this matter lay over until the next regular meeting of the council. The motion was seconded by Mr. Traver and carried unanimously. Mr. Latham stated that it would be impossible for him to be present at the next meeting of the council, but that he wished to be placed on record as favoring both the Golden Gate Ferry and the Southern Pacific Company systems. 30., Mr. Noble introduced and moved the adoption of 32 "Resolution No. 1043. Rescinding all Public Proceedings Heretofore Taken for the Improvement of Clay and Calhoun Streets between Regent and Broadway." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. City Manager Hickok filed with the council, a communication relative to the number of arrests th <t had been made on property owned by Mx. F. A. McCann, and attached thereto was a communication from Chief of Police Wm. H. Wahmuth, giving detailed record of such arrests. After discussion, Mr. Latham moved that Hon. L. R. Weinmann, who appeared on behalf of Mr. McCann be notified to attend the next meeting of the council, together with Mr. McCann for the purpose of a further hearing, inth matter of the abatement proceedings against the property at 2331 Lincoln Avenue. The motion was seconded by Mr. Neiss and carried unanimously. The City Manager invited member o.f the council to attend the opening of the new firehouse in the East End on Thursday evening, May 20th. Claims against the General Departments amounting to 35267.06; Police Department, $167.05; Fire Department, $4013.13; Street Department, $3037.59; Health Department, $72.92; Recreation Department, 0207.57; Golf Course, '6471.36; Store Department $26.12; Council Relief Fund, 990.07; Health Center, 0255.40; Electric Light Fund, $12,676.09; Pension Fund, 4975.24; East Bay Water Co. Payments Fund $691.24; and Compensation Insurance Fund amounting to 0295.07 having been approved and audited by the proper officials were listed by the Clerk as follows: May 18, 1926.
