1926-07-06 Regular CC Meetingi.V REGUL MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, JULY 6TH, 1926. The meeting convened at 8 o'clock with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Traver and President Otis, (5) were noted present. Absent: None. The minutes of the regular meeting of June 15th, 1926 were approved as read. Mr. Noble introduced and moved the adoption of "Resolution No. 1049. Transferring $2127.29,from the Electric Light Fund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1050. Transferring $900.00 from the Electric Light Fund to the General Fund." Mr. Neiss seconded the motion to adopt the 'Resolution and on roll call it was adopted and passed unanimously. 3./ Mr. Neiss introduced and moved the adoption of "Resolution No. 1051. Transferring all Surplus Moneys to the General Fund." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted. and passed unanimously. 4. V Mr. Traver introduced and moved the adoption of "Resolution No. 1052. Transferring $8,000.00 from the General Fund to the Library Fund." Mr.. Latham Seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 5./ Mr. Noble introduced and moved the adoption of "Resolution No. 1053. Transferring $1000.00 from the General Fund to the Initiative Relief Fund." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following papers were ordered filed: 6.V Affidavit of publication, Delinquent Tax List. 7./ Affidavit of publication, Resolution No. 1048, re change of Grade of Webster ' treet. 8,V Report of Municipal Electric Light Plant for month of May, 1926. 9. Various communications re automobile ferry system previously referred to he Committee of the Whole. The following communications were received: 10.v/ From Alameda Improvement Club, re switch, Santa Clara Avenue and Webster Street. Ordered filed. 11.V' From City of Sacramento, re Loague of California Municipalities Convention, 1927. Mr. Latham moved that the communication be referred to the delegates, seconded by Mr. Neiss and carried. 12.V From Oakland Lions Club, re Resolution alleged discrepancies betwoen city and county assessments. Ordered filed. 13,1 From the City Clerk, requesting balance of annual vacation to leave the State. Mr. Latham moved that the request be franted, seconded by Mr. Noble and carried. 14.V From various residents on Portola Avenue, complaining of offensive smoke from burning of rubbish on Neptune Beach. Mr. Neiss moved that the communication be referred to the City Manager for investigation and report, seconded by Mr. Traver and carried. 15. From the Alameda Chamber of Commerce, requesting installation of wig-wag signal at High Street and Fernside Boulevard, and other matters. Mr. Neiss moved that the council favor the placing of a wig-wag signal on Fernside Boulevard, both at High Street and at Versailles Avenue, and that the City Manager be in- structed to communicate with the Southern Pacific Company to this end. The motion was seconded by Mr. Latham and carried. 16. From various residents in the vicinity of Santa Clara Avenue and High Street, protesting the erection of a Mutual Store at 1505 High Street. After dis- cussion, Mr. Neiss moved that the City Attorney be instructed to prepare an amendment to the Zoning Ordinance setting a time limit of six months after the granting of a change for a reclassification, when actual construction work shall be commenced. The motion was seconded by Mr. Noble and carried. T7. From the Alaska Packers Association, re statistics on tonnage entering or leaving piers of Alameda's waterfront. The communication was ordered filed, inas- much as the Chamber of Commerce has this matter in hand. 181 From the Mayor, Auditor and City Manager, re count of money. Ordered filed. ig.4 From the California State Board of Health, requesting the presence of the City Health Officer at the coming League of California Municipalities Conventiaa. Mr. Latham moved that the Health Officer of the City of Alameda be included in the list of delegates, seconded by Mr. Traver and carried. 20.V From the City Plaaning Commission, recommending the reclassification of the property situated on the south side of Buena Vista Avenue, 167.94 feet west of Park Street; thence westerly 100 feet, from a Residence District, Class II, to a Business District, Class IV, permitting the erection of a private school for Japanese children. After discussion, Mr. Latham moved that the rea)mmendation be approved, seconded by Mr. Traver and carried by the following vote:- Ayes: Councilmen Latham, Noble, Traver and President Otis, (4). Noes: Councilman Neiss (1). Absent: None. 21. From the City Planning Commission recommending the reclassification of the southwest corner of Buena Vista Avenue and Park Street, from a Residence District Class II, to a Business District, Class V, permitting the erection of an automobile service station. Mr. Traver moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Noble and carried unanimously. 2/ the City Planning Commission, recommending the reclassification of the southeast corner of Park Avenue and Santa Clara Avenue, from a Residence District, Class II, to a Business District, Class V, permitting the erection of a brick building to contain an automobile show room and repair shop. Mr. Noble moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Traver and carried unanimously. 23. From W. A. Maze and A. J. Hurt, requesting permission to move the bungalow situated at 1627 Buena Vista Avenue to the vacant lot situated on the south side of Pacific Avenue '72 feet west of Minturn Street. Inasmuch as this request had received the approval of the City Manager, Mr. Neiss moved that per- mission be granted in accordance with the request, seconded by Mr. Latham and carried unanimously. 24.1 From Wm. H. Wahmuth, Chief of Police, requesting the council to cancel the soft drink licenses granted to Henry Steinkamp, 1601 Webster Street, and also that granted to A. Matson, 1212 Lincoln Avenue. Mr. Latham moved that the licenses be revoked for the reasons stated in the communication, seconded by Mr. 251 Travers and carried unanimously. The Clerk stated that the time had arrived for the hearing of the abatement proleedings against 2331 Lincoln Avenue. City Attorney Locke made the opening statement to the council relative to the case. Messrs. Hon. L. R. Weinmann and 7. A. McCann did not answer to call. City Attorney Locke then read notificatinn of Nuisance and Affidavit of Service of same, and testimony was then given by the following, who were sworn by President Otis:- Detective Conant, Officer Sevina and Chief of Police, Wm. H. Wahmuth. After discussion, Mr. Traver moved that the City Attorney prepare in writing an affidavit as to the statements made and that copies of same be forwarded to Hon. L. R. Weinmann, and that a further hearing in the matter be continued to the next regular meeting of the council to be held Tuesday evening, July 20th. Mr. Neiss seconded the motion and the same carried unanimously. The following Ordinances came up for passage and were read by the Clerk: 26V Ordinance No. New Series. Reclassifying Property. (Lot, North side of Central Avenue, 350 feet West of Oak Street.) 2 . Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Noble and on roll call it was adopted and passed unanimously. Ordinance No. 2c1 New Series. Authorizing Annual Vacations for City Officials and. Employees." Mr. Latham moved that Section 2 be amended by striking out the word practically". Mr. Traver seconded the motion and on roll call carried unanimously. Mr. Latham then moved the adoption of the ordinance as amended, seconded by Mr. Neiss and on roll call it was adopted and passed unanimously. The following ordinanaeswere introduced and laid over under a provision of the charter:- 28. 30 32./ "Ordinance No. New Series. Reclassifying Property. (South side of Buena Vista Avenue, 167.94 ft. West o± Park Street, Private School for Japanese.)" "Ordinance No. New Series. Reclassifying Property. (Southwest corner of Park Street and. Buena Vista Avenue - Service Station.)" "Ordinance No. New Series. Reclassifying Property. (Southeast corner of Park Avenue and. Santa Clara Avenue.) 'Ordinance No. New Series. An Ordinance Regulating Auction Sales and the Business of Auctioneering in the City of Alameda, Providing a License Tax or Fee Thereon and Prescribing the Penalty for a Violation of said Ordinance." Mrs. .Alice Caton addressed the council requesting installation of Stop signals on Pacific Avenue. After discussion, Mr. NeiEs moved that the matter be referred to the City Manager for investigation as to the advisability of declar- ing Buena Vista Avenue, Pacific Avenue and such other streets as are necessary, boulevards, for Stop signals. The motion was seconded by Mr. Traver and carried. 33.V Mr. Neiss moved that the City Attorney be instructed to intervene in the case of Southern Pacific Company vs. Dow 8: Baxter, as Attorney, representing the City of Alameda. The motion was seconded by Mr. Latham and carried. 34.V In the matter of the application of the American Dredging Company for permission to deposit dredged materials on the westerly portion of Tract 39 and the southeasterly portion of Tract 35, Mr. Latham moved the request be granted in accordance with Ordinance No. 91, New Series. The motion was seconded by Mr. Noble and carried unanimously. City Manager Hickok called attention of the council to the fact that our neighboring cities were joining together in the preparation of a uniform building code and were contributing various sums of money for this purpose. After discussion, Mr. Latham moved that the City ivianager be authorized to enter into an Agreement for the expenditure of a sum not to exceed 0100.00, if after investigation with City Attorney Locke, this action proves beneficial. The motion was seconded by Mr. Traver and on roll call carried unanitously. Claims against the General Departments amounting to 02322.37; Police Department, 0611.06.
