1926-09-21 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF AT,AMEDA, TUESDAY EVENING, SEPTEMBER 21, 1926. The meeting convened at 8 o'clock with Council- president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Traver and President Otis, (5) were noted present. The minutes of the regular meeting of Tuesday, September 7th, 1926, were approved as read. The following papers were filed: 1. Oath of office of H. F. Copenhaver as special police officer, Municipal Golf Course. 2. Report of the Municipal Electric Light Plant for the month of August,, %f 1926. 3. Report of the East Bay Municipal Utility District, as of September 8, 1926. 4. The official budget for the year 1926 -27. 5. President Otis stated that he wished to be recorded as objecting to some of the items appearing in the budget, particularly those to which he had objected to in the past, further stating that his objections, however, would not be material to the tax rate as fixed. 6./ Mr. Latham introduced and moved the adoption of "Resolution No. 1063. Determining the Rate and Levying the Tax 1926 -27." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Traver introduced and moved the adoption of "Resolution No. 1064. Fixing Salaries of the Following Officers and Employees of the City of Alameda, to wit: Custodian of City Hall, Lieutenant of Police, Superintendent of Parks and Recreation, Assistant City Engineer, Janitor of the Health Center and Clerk in the Health Department." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Noble introduced and moved the adoption of "Resolution No. 1065. Regulating the Salary of the Golf Architect." Mr. Traver seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following communications were received: From the City Planning Commission, containing various resolutions: - /1. Protesting General Use of Tube for Traffic:.. The Resolution was ordered filed. /2 Protesting Use of Regular Passenger Boats to Alameda Pier for Trans- portation of Automobiles. Mr. Traver moved that the Resolution be referred to the City Attorney, to communicate with the Southern Pacific Company, stating the council protested the use of regular passenger boats transportating automobiles and that the City Attorney use every endeavor to have this matter corrected. The motion was seconded by Mr. Latham and carried unanimously. Relative to Establishing a Primary School South of Encinal Avenue in the City of Alameda. Mr. Traver moved that the Resolution be referred to a Meeting of the Committee of the Whole, seconded by Mr. Latham. Mr. Neiss moved to amend, that theesolution be placed on file. The amendment was seconded by Mr. Noble and the amendment carried by the unanimous vote of the council. 4. To Regulate Rate of Speed on Auto Ferry Roadway. City Attorney Locke stated that this was a matter of state regulation and upon this recommenda- tion Mr. Traver moved that the Resolution be filed, seconded by Mr. % atham and carried. 5.VRelative to Future Street Construction and Improvements. This resolution was ordered filed. 11. 12.E 13. From the Southern Pacific Company relative to the opening of the upper entrances to the Alameda boats in the Ferry Building. The communication was ordered filed. From the League of California Municipalities, relative to gasoline tax. Ordered filed. From Messrs. F. Sobrero and A. Ghiglione, relative to flooding by drainage water upon their property extending from the north line of Buena Vista Avenue at Fifth Street to the Segregation line. Mr. Traver moved that the communication be referred to the City Engineer for investigation and report at the next meeting of the council, seconded by Mr. Latham and carried. From the Mayor, Auditor and City Manager, re count of money. Ordered filed. From City Attorney Locke, re various matters. Ordered filed. 15. From the Alameda Improvement Club, protesting city acquiring property for school purposes on the south side. Ordered filed. 16.V From City Manager Hickok, relative to soft drink license of A. H. Albert - sen, 1546 Park Street. After discussion, Mr. Neiss moved that further action by the council be laid over until the case at present pending in the Federal Court is disposed of, seconded by Mr. Traver and carried unanimously. 17.)/` From Mayor John L. Davie, requesting Alameda's participation in an East Bay observance of Armistice Day. Mr. Latham moved that the communication be re- ferred to Councilman Noble, who is a member of the Veteran's Association in Alameda. The motion was seconded by Mr. Neiss and carried. 18. V From A. Vogel, requesting permission to move a house to 2225 Pacific Avenue from 2259 Alameda Avenue. Upon the recommendation of the City Manager, Mr. Latham moved that the request be granted, seconded by Mr. Traver and carried. From City Manager Hickok, relative to application of Harbor Tug and Barge Company, for a war department permit to construct 8 mooring dolphins along a line seventy feet northerly of the north line of the South Channel near the west end of Brooklyn Basin, Oakland Harbor. After discussion, Mr. Noble moved that the communication be referred to the City Attorney with full power to act, seconded by Mr. Latham and carried. 19. 20.V From the Key System Transit Company, relative to -the re- routing of the No. 9 car line. Ordered filed. 21. V From the Alameda Improvement Club, relative to water on the property of A. Ghighlione during winter. Mr. Noble moved that the matter be referred to the City Engineer, seconded by Mr. Neiss and carried. 22.E From the Alameda Improvement Club, suggesting the placing of an amend- ment to the charter on the ballot :3 at the next municipal election. Mr. Latham moved that the communication be filed, seconded by Mt. Neiss and carried. 23.v''` From Giovanni Stefani, requesting permission to move two houses at 1522 and 1524 4th Street, to Second Street, between Pacific Avenue and Cypress Street. Mr. Neiss moved that the matter be referred to the City Manager with power to act, seconded by Mr. Noble and carried. 24./ From Mrs. Rose Haslett, offering property at 1315 Clinton Avenue, at a price of $20,000 for school purposes. The communication was ordered filed. 25.✓f From the Loop Lumber Company, requesting that steps be taken to pave Blanding Avenue, from Park Street to a point approximately 267 feet east of Broadway, also recommending that the sidewalk area be out from twelve feet to six feet. After discussion, Mr. Latham moved that the City Attorney be instructed to commencing the necessary proceedings in conjunction with the City Engineer, and that the width of the sidewalk be reduced. The motion was seconded by Mr. Neiss and carried unanimously. 26. An application for a permit to sell soft drinks was received from Nick Trusas. Upon the recommendation of Chief of Police, Wm. H,.Wahmuth, Mr. Latham introduced and moved the adoption of "Resolution No. 1066. Granting a Permit for a License to Sell Soft Drinks." The motion to adopt the Resolution was seconded by Mr. Noble and on roll call it was adopted and passed unanimously. The following Ordinances came up for passage; and were read by the Clerk: "Ordinance No. New Series. Reclassifying Property. (Northwest corner of Central Avenue and Ninth Street.) (Automobile Service Station)" Mr. Neiss moved that the ordinance as read be adopted, seconded by Mr. Traver and on roll call it was adopted and passed unanimously. 28./ 29./ 30. 31. 32. 33. "Ordinance No. New Series. Reclassifying Property. (Southeast Corner of Pacific Avenue and Main Street) (Gasoline and Oil Service Station)" Mr. Noble moved that the ordinance as read be adopted, seconded by Mr. Traver and on roll call it was adopted and passed unanimously. "Ordinance No. �.. New Series. An Ordinance Regulating the Construction and Maintenance of Establishments for Dry Cleaning." Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. on roll call it Was adopted and passed unanimously. "Ordinance No. New Series. An Ordinance Regulating the Construction and Maintenance of Establishments for the Purpose of Conducting Musical, ,Dramatic or Theatrical Shows in the City of Alameda, and Prescribing the License Tax Therefor." Traver and UIr. Latham moved that this ordinance be withdrawn, seconded by Mr. Traver carried unanimously. "Ordinance No. 'ZIr New Series. Repealing Ordinance No. 254, N.S., entitled an Ordinance "Prescribing the License Tax for Dramatic or Musical Shows ", and Purporting to Authorize Dramatic or Musical Shows to be Conducted in a Tent Provided such Tent shall have a Flooring of Wood or Canvas." and was then introduced and read by the Clerk. Mr. Traver moved that the ordinance as read be adopted, seconded by Mr. Noble and on roll call it was adopted and passed unanimously. "Ordinance No. New Series. An Ordinance Regulating the Parking of Vehicles. on the High School Block and on the face of the four blocks fronting thereon." came up for passage. Mayor Otis protested the passage of the Ordinance as at present framed. Mr. Latham moved that the ordinance be amended by striking out Oak Street, Walnut Street and Alameda Avenue. The motion was seconded by Mr. Traver and. carried. Mr. Latham then moved that the Ordinance lay over one meeting, seconded by Mr. Traver and carried unanimously. Mr. Latham moved that the City Clerk notify property owners in the Woodstock Tract that pursuant to agreement with the council, that said owners proceed with street improvements as agreed, under private contract, on October 1, 1926. The motion was seconded by Mr. Neiss and carried unanimously.. Claims against the General Departments amounting to $3009.71; Police Depart - ment $238.38; Fire Department, $313.20• Street Department, $2049.13; Health Depart- ment, $106.27; Recreation Department, $238.23; Golf Course, $2185.87; Store Depart - ment $19.11; Council Relief Fund, $78.02; Health Center Fund, $148.74; and Electric Light Fund $10.774.85, having been approved and audited by the proper officials were listed by the Clerk as follows: Labor Alameda Cyclery Alameda Times Star Brandt, L.
