1927-04-05 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, APRIL 5TH, 1927. The meeting convened at 8 o'clock with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble, Traver and President Otis, (5) were noted present. Absent: None. The minutes of the regular meeting of March 15th, 1927 were approved with the exception of Paragraph 24, page 250, which should read as follows, commencing with line 4:- "After discussion, Mr. Latham moved that the matter be referred to the City Manager and City Attorney to report back at the next meeting of the council. The motion was seconded by Mr. Neiss and arried." 2.V Mr. Traver introduced and moved the adoption of "Resolution No. 1129. Transferring 32,437.50 from the Electric Light Fund to the Interest and Redemption Fund." Mr. Noble seoonded the motion to adopt the .desolution and on roll call it was adopted and passed unanimously. Mr. Traver introduced and moved the adoption of "Resolution No 1130. Transferring '10,000.00 from the Electric Light Fund to the General Fund." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimotaly. Mr. Traver introduced and moved the adoption. of "Resolution No. 1131, Cancelling Theatre License." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Traver introduced and moved the adoption of "Resolution No. 1132. Awarding Contracts for Crushed Rock, Screenings and Road Oil." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following papers were ordered filed: 6.V Copy of Decision No. 18,146 of the Railroad Commission, granting the Southern Pacific Company authorization to construct spur track on Blanding Avenue. Report of the Municipal Electric Light Plant for month of Pebruary, 1927. 8.+/ Oqth of Office of W. J. Parker, Special Officer, &loins.' Terminals. 9. Affidavit of publication of Notice to Bidders, on Road Oil. 10. V Affidar:it of Publication, Notice to Bidders on rock and screenings. From City Attorney Locke, relative to reorganization of City Planning Commission. Various communications and protest relative to establishment of primary school in neighborhood of Fraiklin Park. 20/ The following communications were received: From George H. Hagy and A. F. Strehlow, advising the council that campaign for raising funds for Byron Summers had been abandoned. The communication was Ordered filed. 214 From the County Board of Supervisors relative to the closing of High Street Bridge. Ordered filed. 1 22.‘i From Heafey-Moore Co., requesting an extensioh of 90 days on improvement of Blanding Avenue, Mr. Travers moved that the extension be granted, seconded by Mr. Latham and on roll call carried unanimously. 23,V From the City Planning Commission, recommending that a temporary permit for one year be granted,said permit to be automatically renewed thereafter until cause for revoking shall appear, for the reclassification of the property situated on the east side of Ninth Street, 100 feet north of Lincoln Avenue; thence northerly 86 feet, as per the petition of Mr. Arthur Beach, from a Residence District, Class I, to a Business District, Class III. Mr. Traver moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Neiss and carried. 24. From the Alaska Packers Association, requesting permission to alter cer- tain sewer connections. After discussion, Mr. Traver moved that the Alaska Packers Association be given permission to move the sewers, according to the plans of the City Engineer. The motion was seconded by Mr. Latham and on roll call carried unanimously. ?5./ Mr. Traver then moved that should an enlarged combined sanitary and drainage sewer be installed, the city would appropriate an amount not to exceed $1,000 towards its cost. The motion was seconded by Mr. Latham and on roll call carried by the following vote:- Ayes: Councilmen Traver, Latham and President Otis, (3). Noes: Councilmen Neiss and Noble, (2). The Clerk stated that he was in receipt of an affidavit of posting and mailing notice to abate nuisance, re delapidated building belonging to Mrs. Harriet Louis, 1560 Buena Vista Avenue, together with a copy of the notice so posted; also a registered mail receipt and registered mail return receipt and that the time had arrived for the hearing in accordance therewith. City Attorney Locke called Building Inspector Rogers as a first witness, who was duly sworn by President Otis. Building Inspector Rogers testified in substance that he was familiar with the conditions prevailing at 1560 Buena Vista Avenue and that they were extremely bad, the roof being full of holes, doors off the hinges, exterior of building wet and soggy and unfit for human habitation; that the timber from the floor down was in good shape, but from the floor upward was very bad and was rotted,and estimated it woi1d cost 4500.00 to put the building in repair. In his judgement, however, the building was not worth repair-. ing. The yard is at present in fair condition, on account of it having just been cleaned up by the city. He stated that the premises were a fire menace account of the old rags, papers and stuff piled in the house; that when he came out of the house upon the completion of the investigation he was covered with vermin. Tire Chief Steinmetz was then called and sworn. He testified that in response to a fire call at the premises about two months ago he found the chimney was not connected to the outside from the stove; the rooms of the house were filled with refuse and piled high, making it quite a fire menace. Sanitary Inspector, E. C. Mailiot, was then called and morn. He stated that his inspection of the premises was from a sanitary standpoint only and was made on March llth. He found the toilet entirely out of order, i. e. no flowing Water; that he could make no examination of the plumbing of the sink, on account of the refuse which was piled up on it. In his judgment the place was not fit for human habitation. Mrs. May Samuels addressed the council stating that she had interested herself and others in an an endeavor to help Mrs. Louis, and requested postponement of immediate action by the council. After further discussion, Mr. Traver introduced and moved the adoption of 27./ 28a 2 30. 31. "Resolution No. 1133. Dealaring Building at 1560 Buena Vista Avenue to be a Public Nuisance." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. An application for a permit to sell soft drinks was received from A. C. Manderscheid,and inasmuch as it did not receive the approval or recommendation of the Chief of Police, Mr. Traver moved that the application be denied. The motion was seconded by Mr. Noble and carried unanimoasly. Applications for permits to sell sfot drinks were received from Jenny Wren Stores, Inc. and Skaggs Safeway Stores. Inasmuch as these applications had re- ceived the approval of Chief of Police Wahmuth, Mr. Traver introduced and moved the adoption of "Resolution No. 1134. Granting a Permit for a License to Sell Soft Drinks." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. An application for a gratuitous license was received from Albert Peterson, 535 Market Street, Oakland. After discussion, Mr. Traver moved that the appli- cation be denied, seconded by Mr. Neiss and carried unanimously. An application for a gratuitous license was received from Harry A. Presby, 123 South Shore Drive, South Alameda, to sell a cleaning compound. After dis- cussion, Mr. Traver moved that a permit for six months be issued. The motion was seconded by Mr. Latham and carried unanimously. The matter of the reclassification of the lot situated on the west side of Benton Street, commencing at a point 50 feet northerly from the north line of Encinal Avenue, Mr. Traver moved that further consideration be postponed until the next regular meeting of the council. The motion was seconded be Mr. Noble and /carried. 2. The following ordinance cane up for passage and was read by the Clerk: "Ordinance No. New Series, Reclassifying Property. (California Mill & Lumber Company.) 33. Mr. Traver moved that the ordinance as read be adopted, seconded by Mr. Latham and on roll call carried unanimously.. An Ordinance entitled "Ordinance No. New Series. Regulating the Parking of Vehicles Around the High School Block." carne up for passage. Mr. Traver moved that the consideration of the passage of this ordi- nance be postponed until the next regular meeting of the council to be held Tuesday evening, April 19th. The motion was seconded by Mr. Noble and carried. 254.1( The following ordinance was introduced and laid over under a provision of the charter:- 35. "Ordinance No. New Series. Regulating the Parking of Vehicles and Providing for One Hour Parking on Alameda Avenue, between Oak and Park Streets." City Manager Hickok called attention of the council to the fact that the Supplementary Agreement on contract to H. MacDonald for the Washington Park Con- cession had expired, but recommended its renewal for one year at the stipulated amount of $60.00. Mr. Traver moved that the City Manager be authorized to extend the contract one year under these conditions, seconded by Mr. Latham and on roll call carried unanimously. 36. City Manager Hickok stated that an offer had been received for the Sherman Street Firehouse lot in amount of $1100.00, less commission of five per cent. After discussion, Mr. Traver moved that the offer be accepted. The motion was seconded by Mr. Neiss and on roll call carried unanimously. Claims against the General Departments amounting to $4739.38; Police Department, 1'305.49; Pire Department, $912.04; Street Department, $2506.90; Health Department '9217.69; Recreation Department, $252.56; Golf Course Department, $6506.39; Store Department, $98.56; Council Relief Fund, $127.69; Health Center Fund, $364.92; Electric Light Fund, $5935.11; Pension Fund,$944.16; Initiative Relief Fund, $424.25: East Bay Water Company Payments Fund $2937.10; and Compensation Insurance Fund, $215.46 having been approved and audited by the proper officials were listed by the Clerk as follows: Labor Ader, Leon H. /lameda Land Company Alameda Shade Shop Alameda Steam Laundry Assn.
