1927-09-06 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAM DA,
TUESDAY EVENING, SEPTEMBER 6, 1927.
The meeting convened at 8 o'oloek with Council - president Otis presiding.
The roll was called and Councilmen Calcutt, Latham, Neiss, Noble and President
Otis (5) were noted present.
The minutes of the regular meeting of August 16th were approved as read.
Mr. Latham introduced and moved the adoption of
"Resolution No. 1173.
Transferring $590.63 from the Electric Light
Fund to the Interest and Reemption Fund."
Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted
and passed unanimously.
The following papers were filed:

3.1 Report of Municipal Electric Light Plant for the month of July, 1927.
4. Report of Municipal Eleetr c ,Light Plant for the year ending June 30, 1927.

9. 4 Deed James H. Dowling, et al, to City of Alameda, dedicating extension of
Clay Street.
10. The Clerk presentedtothe council a duly verified petition protesting the passage
of Ordinance No. 346, N. S. containing the names of 1541 qualified electors of the city
of Alameda as required,under the law relating to referendum of municipal ordinances,
also, his certificate in accordance therewith. Mr. Calcutt moved that Ordinance
No. 346, N. S. be repealed. The motion was seconded by Mr. Otis and upon roll call the
motion was lost by the following vote : - Ayes: Councilman Calcutt and President Otis, (2).
Noes: Councilmen Latham, Neiss and Noble, (3). Mr. Neiss moved that the question of
referendum be submitted to the electors of the city of Alameda in a consolidated
election to be held with the proposed East Bay Municipal Utility District bond election
in the latter part of October or early part of November, the date to be definitely
fixed later by the directors of the East Bay Municipal Utility District. The motion
was seconded by Mr. Latham and upon roll call carried unanimously.
11 In the matter of the removal of the dilapidated building at 3214 Washington
Street, communications were read from Building Inspector Rogers and Hon. R. B. Tappan,
stating that the building would be removed and requesting that the proceedings be
dropped. Mr. Latham moved that further proceedings be dropped and that the City Clerk
notify Judge Tappan that upon the advise of the City Attorney it would be impossible
for the city to allow the fire department to assist in the wrecking of the building.
The motion was seconded by Mr. Noble and same carried unanimously.
The following communications were received:
12a From F. J. Croll, Redemption Clerk, submitting list of all properties sold
to the city of Alameda for taxes as of June 24, 1927. Mr. Neiss moved that the list be
received and published in accordance with provisions of Ordinance No. 250, N. S. The
motion was seconded by Mr. Latham and on roll call carried unanimously.
13.`y From the California Conference of 7th Day Adventists, requesting permission
to carry on their annual campaign in the city of Alameda for funds. Mr. Neiss moved
that the request be granted, seconded by Mr. Noble and carried unanimously.
14.V / From the Alameda Improvement Club, re opening of Buena Vista Avenue, Fifth
and Sixth Streets. Mr. Latham moved that inasmuch as this matter was still being
considered by the committee of the whole, that this communication be referred like-
wise, seconded by Mr. Neiss and carried unanimously.
15. From the Alameda Improvement Club, relative to the purchase or condemnation
of the Vowinkel property at the end of Pacific Avenue for public park purposes. Mr.
Neiss moved that the communication be referred to the Commitee of the Whole, seconded
by Mr. Noble and carried unanimously.
161 From the Alameda Improvement Club, relative to extermination of mosquitoes.
Mr. Neiss moved that the communication be filed, seconded by Mr. Latham and carried.
17.'' From the Alameda Improvement Club, requesting that owners of airplanes on
municipal or private airports within the city be enjoined to carry liability and property
damage insurance. Mr. Latham moved that the communication be referred to the City
Attorney for investigation. The motion was seconded by Mr. Noble and carried unanimous -

18.`J From the Alameda Improvement Club, requesting that an appropriation of $500.00
be placed in the budget for the purpose of defraying the expense of a suitable In-
dependence Day celebration in 1928. City Attorney Locke advised the council that
compliance with such a request would be unconstitutional, thereupon Mr. Neiss moved
that the communication be filed, and that the City Clerk so advise the Alameda Improvement
Club. The motion was seconded by Mr. Latham and carried unanimously.

From the Mayor, Auditor and City Manager, relative to count of money.
Ordered filed.
From the City Planning Commission, recommending the reclassification
of certain property on Bay Farm Island, owned by Oscar R. Gaunt, from a
Residence District, Class I, to a Business District, Class V. Mr. Latham moved
that the recommendation of the City Planning Commission be adopted, seconded by
Mr. Neiss and carried unanimously.
From the City Planning Commission, recommending the reclassification
of 1729 Everett Street, from a Residence District, Class I, to a Business
District, Class VI, permitting the operation of a private hospital. Mr. Niess
moved that the recommendation of the City Planning Commission be adopted, second-
ed by Mr. Noble and carried unanimously.
From the Olty Planning Commission, calling attention to Resolution
passed by that body under date of January 13, 1926, relative to street closings.
Mr. Neiss moved that the matter be referred to the City Attorney, seconded by
Mr. Noble and carried unanimously.
From the City Planning Commission containing resolution relative to
set-back lines. Mr. Latham moved that the communication be referred to a
meeting of the Committee of the Whole, seconded by Mr. Calcutt and carried
unanimously.
From the ExtenSionof the Order Committee, N.S.G.W., inviting the coun-
cil to participate in the celebration to be held at Santa Cruz on Admission
Day. Mr. Neiss moved that the invitation be accepted, seconded by Mr. Latham
and carried unanimously.
From the City of San Bernardino requesting support at the coming
League of California Municipalities Convention for the designating of San
Bernardino as its next meeting place. Mr. Latham moved that the communication
be referred to the delegates, seconded by Mr. Noble and carried.
r. Latham moved that the City Clerk,City Engineer, Health Officer
and Food Inspector, and as many of the council desiring to attend, be appoint-
ed at the official delegates of the city at the League of California Muni-
cipalities Convention to be held in Sacramento, during the week commencing
September 20th. The motion was seconded by Mr. Neiss and on roll call carried
unanimously.
An application for a permit to sell soft drinks was received from
Chin Que, 2331 Lincoln Avenue. Inasmuch as this did not receive the approval
or recommendation of the Chief of Police, Mr. Noble moved that the application
be denied, seconded by Mr. Latham and carried unanimously.
An application for a permit to sell soft drinks was received from Phillip
Rardner, 1429 High Street. Inasmuch as this received the recommendation and
approval of Chief of Police, W. H. Wahmuth, Mr. Noble -introduced and moved the
adoption of - •
"Resolution No. 1174.
Granting a Permit for a License to Sell Soft Drinks."
Mr. Niess seconded the motion to adopt the Resolution and on roll call it was
adopted and passed unanimously.
The following ordinance came up for massage:
"Ordinance No.
New Series.
An Ordinance Regulating the Parking of Vehicles
Around the High School Block."
Mr. Latham moved that further action by the council upon the adoption of the
ordinance be postponed until the meeting of the council to be held November 1,
1927. The motion was seconded by Mr. Neiss and carried.
The following ordinances were introduced and laid over under aprovision
of the Charter:

32.1/ Mr. Latham moved that all ex-service men in the employ of the city desir-
ing to attend the American Legion Convention at Paris be allowed six weeks
leave of absence with pay. The motion was seconded by Mr. Neiss and on roll
call carried by the following vote:- Ayes: Councilmen Calcutt, Latham, Neiss,
and Noble, (4). Noes: None. Not Voting: President Otis, (1). Absent: None.
33.v Mr. C. L. Traver and a delegation representing the directors of the
Alameda Community Hotel addressed the council, requesting that electtic light
standards similar to those fronting the Alameda High School be placed on
Central Avenue and Santa Clara Avenue between Park Street and Broadway, also
on the west side of Broadway, between CentralAvenue and Santa Clara Avenue.
After discussion, Mr. Latham moved that inasmuch as this was a matter entirely
within the jurisdiction of the Board of Public Utilities, that the delegation
present their demands to that body, but that the couhcil place itself on record
as favoring such installation. The motion was seconded by Mr. Neiss and carried
unanimo usly.
Claims against the General Departments amounting to $3009.00; Police Depart-
went 0115.30; Fire Department, 4285.42 ; -- Street Department, $3090.59; Health-Depart-
ment $335.94; Recreation Department, $262.19; Golf Course Department $1263.50;
Store Department, $20.24; Council Relief $116.23; Health Center Fund, $199.00;
Electric Light Fund, $3627.03; Pension Fund, $944.16; Initiative Relief Fund,
$25.00; and Compensation Insurance \ind, $121.96 having been approved and audited
by. the proper officials were listed by the Clerk as follows:

and on roll call carried unanimously.
There being no further business to transact the Council adjourned to
meet in regular session, Tuesday evening, September 20th, 1927 at 8 o'clock.
