1929-04-02 Regular CC MinutesREGULAR MEETING O THE COUNCIL OP THE CITY OF ALAJEDA, TUESDAY EVENING, APRIL 2ND, 1929. The meeting convened at 8 o'clock with Council-president Otis presiding. The roll was called and Councilmen Calcutt, Latham, Neiss, Noble and President Otis, (5) were noted present. Absent: None. The minutes of the regular meeting of March 19th, 1929 were approved as read. 1.1 The regular order of business was suspended in order to permit the hearing upon the Council's own initiative for the reclassification of certain property situated on the north side of Santa Clara Avenue, between Everett Street and Broadway, more particularly described as Lots 8, 9, 16 and 17 in Block No. 2, "subdivision of the Chipman Blocks, Town of Alameda", from a Residence District, Class I, to a Business District, Class V. The following members of the City Planning Commission were present and sat with the Council in an advisory capacity:- Commissioners Haslett, Stow, Sharp and Godfrey. The Clerk stated that two petitions of protest had been filed, containing in all forty-seven names. Messrs. walthall, Gibson, Knox, and Zoller addressed the Council in support of the reclassification. Messrs. Hansen and Courtney addressed the council in protest. After a full dis- cussion,with members of the City Planning Commission, Mr. Noble moved that the re- classification be granted, providieg a fire-proof building be erected and that same be set back on a line with the residences on Santa Clara Avenue, and five feet on Webb Avenue. The motion was seconded by Mr. Neiss and on roll call same carried by the following vote:- Ayes: Councilmen Calcutt Latham, Neiss and Noble, (4). Noes: Council-presideht Otis, (1). Absent: None. 2.4 'Mr. Latham introduced and moved the adoption of "Resolution No. 1366. Transferring $1,000.00 from the School General Fund to the General Taind." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Neiss introduced and moved the adoption of "Resolution No. 1367. Transferring $25,000.00 from the Electric Light Fund to the General Fund." Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 4.V Mr. Noble introduced and moved the adoption of "Resolution No. 1368. Transferring $2,250,00 from the Electric Light Fund to the Interest and Redemption Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 5.v/ Mr. Noble introduced and moved the adoption of "Resolution No. 1369. Resolution of Acceptance and Consent toRecordation." (lAngfellow School) Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The Clerk stated the following papers had been filed since the last meeting of the Council:- 6." Continuation Certificate on bonds of A. D. Goldsworthy and H. P. Wichman, /Municipal Electric Light Plant. 7o/ Oath of office of J. H. Bailiss as regular police office; L. C. Nelson and j. C. Barlow as special police officers. . 8.V. Executed contract and bond, Standard Fence Company. 9. Recorded Deed, re Haight School property. lo.v/ Communication re moving of house to 1737 Alameda Avenue. The following communications were received; 11.V From the City Attorney rendering legal opinion as to request of the Veterans' Welfare Board to cancel taxes against certain property, recommending that the request be denied. Mr. Noble moved that the recommendation of the City Attorney be adopted, seconded by Mr. Latham and carried unanimously. 12./ From the City Attorney relative to petition of protedt against proposed improvement of Washington street, under Resolution of Intention No. 91, N. S. Mr. Latham moved that the matter be continued for six months, seconded by Mr. Oalcutt and carried unanimously. 13. From the United States Department of Agriculture, enclosing voucher for rent of Government Island, for the period Nov. 2, 1922 to Nov. 1, 1928. Mr. Noble moved that the payment be accepted,seconded by mr. Neiss and same carried unanimously. 14.1 From City Attorney Locke, relative to proposed ordinance regulating radio interference, redommending that no action be taken until the problem of insulating electric apparatus against radio interference has made further progress. Mr. Latham moved that the recommendation f the City Attorney be adopted, and that a copy of the City Attorney's communication be forwarded to R. H. Howard, The motion was seconded by Mr. Noble and same carried unanimously. 15.v/ From the City Attorney containing legal opinion as to the use of Jackson park for playground purposes. Mr. Neiss moved that the matter be taken under advisement, seconded by Mr. Calcutt and salve carried unanimously. From the Transportation Committee containing their recommendations. Mr. Neiss moved that Propositions Nos. 1 and 2 be adopted, providing the Key System Transit Company would pay their share of improvement. The motion was seconded by Mr. Latham and carried unanimously. Mr. Neiss then moved that the City Manager and City Attorney confer with the Railroad Commission, re the re-routing of busses, as per proposition No. 2. The motion was seconded by Mr. Calcutt and same carried unanimously. Mr. Latham moved that the Council oppose proposition No. 3, pertaining to skip-stop system. The motion was seconded by Mr. Neiss and same carried unanimously. Mr. Latham then moved that the balance of the report lay over until the next regular meeting of the Council. The motion was seconded by Mr. Neiss and carried. 18.," From City Attorney Locke, relative to temporary bus service over the Fruitvale Bridge, pending park Street bridge repairs. The communication was ordered filed. 19. 20. From Chief of police, 4m. H. Wahmuth, re soft drink application of Anton Dupont. Mr. Noble moved that the application be denied, seconded by Mr. Calcutt and carried. From the City Planning Commission recommending the reclassification of certain property owned by O. R. Gaunt, on Bay Farm Island, to a Business District, Class V. Mr. Latham moved the recommendation of the Planning Com- mission be adopted, seconded by Mr. Neiss and carried unanimously. 211 From the City Planning Commission recommending that certain property on the north side of Central Avenue, between Oak and Park Street, be reclassified from Class II to Class III. Mr. Neiss moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Noble and carried unanimously. 22.' petition was received from various persons doing business on the northerly side of Santa Clara Avenue, between Park and Everett Street, requesting that the manner of parking automobiles be changed from parallel to diagonal parking. Mr. Latham moved that the petition be referred to the City Manager, seconded by Mr. Calcutt and same carried unanimously. 23.4 The Clerk stated that he was in receipt of notice of posting and mailing of notice to abate nuisance, re dilapidated building at 1336 Pearl Street, and that the time had arrived for the hearing on same. Building Inspector Rogers stated that the building was an old vacant cottage and now left open, and that same was in a dilapidated conditioh. After discussion, Nr. Neiss moved that the hearing be continued Until the next regular meeting of the Council and that the City Attorney prepare papers in accordance with Ordinance No. 181, N. S., seconded by Mr. Noble and carried unanimously. 24. Applications for permit to sell soft drinks were received from . J. Cerreghino and H. E. Freeman. Upon the approval and recommendation of the Chief of Police, Mr. Latham introduced and moved the adoption of "Resolution No, 1370. Granting a Permit for a License to Sell Soft Drinks." Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 251 Mr. Latham moved that the hearing pertaining to Santa Clara Avenue improve- ment under Resolution of Intention No. 89, N. S. be continued to the next regular meeting of the Council. The motion was seconded by Mr. Noble and carried unanimously. .261 Mr. Latham moved that the hearing pertaining to Buena Vista Avenue improve- ment, under Resolution of Intention, No. 90, N. S. be continued to the next regular meeting of the Council. The motion was seconded by Mr. Calcutt and carried unanimously. (North side of Santa Clara Ave., between Everett and Broadway.)" The Clerk stated that he was in receipt of a sub-division Map of Grand Oak Tract, presented by Mason Bowen. Mr. Latham moved that the map be submitted to the City Planning Commission for their report. The motion was seconded by Mr. oalcutt and same carried unanimously.
