1929-05-07 Regular CC Minutes2.t/ 7.1 8 . REGULAR MEETING 0 TUESDAY EV THE COUNCIL OF THE CITY OF ALAIEDA, ING, MAY 7TH, 1929. The meeting convened at 8 o'clock with Council- president Schaefer presiding. The roll was called and Councilmen Brodersen, Henning, Latham, Calcutt and president Schaefer, (5) were noted present. Absent: None. The minutes of the regular meeting of April 16th were approved as read. Councilman Henning addressed the council re the establishment of rules covering order of business for meetings, and moved that new business should constitute the first order of business on the program and that reports of committees be discussed under communications. The motion was seconded by Mr. Brodersen and carried. Mr. Henning stated that he and Mr. Brodersen had requested the Board of public utilities to postpone for the time being the matter of letting a contract for Park Street light standards, and moved that further discussion on the matter be postponed to the next meeting of the council. The motion was seconded by Mr. Brodersen and carried unanimously. A communication was read from G. S. Lincoln, Area Coordinator, relative to the lease now held by the United States Government on Government Island. After discussion, Mr. Latham moved that the council reject the offer contained in paragraph (1) of this communication. The motion was seconded by Mr. Henning and carried unanimously. A communication was read from G. S. Lincoln, Area Coordinator, under date of March 22nd, addressed to C. E. Hickok, City manager, relative to the proposed naval base site. After discussion, Mr. Latham moved that the matter be referred to the City Manager to take up with the government authorities in an endeavor to ascertain how much the United States government would be willing to pay for the land in question. The motion was seconded by Mr. Henning and carried unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1376. Tran::ferring $4309.64 from the Electric Light Fund to the General Fund." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1377. Accepting Grant of Right of Na Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No'. 1378. Resolution of Acceptance and Consent to Recordation." (Longfellow School) Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. S. Mr. Latham moved that the bida be opened and read, seconded by Mr. Calcutt and carried. Thereupon the Clerk opened and read the bids as follows: All bids were accompanied by bonds. A. 0. Mr. Latham moved that the bids be opened and read, seconded by Mr. Calcutt and carried unanimously. The following communications were received:- From the Citizens and Officials Transportation Committee, submitting their report. Mr. Brodersen moved that the report be received and the Committee discharged with thanks. The motion was seconded by r. Henning and same carried unanimously. 21.- Mr. Brodersen moved that the appointment of a new committee be made and that each councilman suggest the name of one citizen to the Mayor as a member thereof; this committee to carry on the work of the Transportation Committee and to render its report to the council. The motion was seconded by Mr. Henning and same carried unanimously. 22.V From the City Manager, re opening and improvement of an Industrial Highway west of :lobster Street. Mr. Latham moved that the report of the City Manager be adopted and negotiations be dontinued covering payment for the pavement in line with the report, and that the City Manager report back to the council at a later date. The motion was seconded by Mr. Calcutt and carried unanimously. 23:7 From the City Manager, Building Inspector and City Attorney recommending the adoption of the Uniform Building Code. Mr. Latham moved that the recommendation be adopted, seconded by Mr. Henning and carried unanimously. 24.V Prom John B. Hurton, requesting permission to paint house numbers on curb along the streets of the city. Mr. Henning moved that the City Manager be instruct- ed to grant permits to all painters desiring to do this kind of work. The motion was seconded by Mr. Brodersen and carried unanimously. 25.v prom City manager Hickok, recommending that the soft drink license held by Ieonore H. Smith, 2258 Alameda Avenue, be revoked. Mr. Brodersen moved that the recommendation of the City Manager be adopted, seconded by Mr. Calcutt and carried unanimously. 26.v/ From the Mayor, advising the appointl-nent of Mr. Toni E. Samuel as a member of the Board of Library Trustees. Ordered filed. 27.1 From the mayor, advising the appointment of Councilman Wm. H. Henning as chairman, Councilman E. M. Brodersen and Mayor Victor L. Schaefer as members of the Transportation Committee to confer with the County Board of Supervisors, re car tracks on proposed new Park Street Bridge. Ordered filed. prom the Alameda Improvement Club, requesting the installation of electroliers in the district between Third and Main Streets and from Pacific Avenue to the Bay. Mr. Latham moved that the communication be referred to the Board of public Utilities. The motion was seconded by Mr. Brodersen and carried unanimously. 29.v/ From the Alameda Improvement Club, relative to routing of proposed bus system. Mr. Henning moved that the communication be referred to the new Transportation Committee, when appointed by the Mayor. The motion was seconded by Mr. Latham and carried unaniMously. From Mrs. A. Tomei, requesting permission to move house from 534 pacific Avenue. Inasmuch as this had received the approval and recommendation of the City manager, Mr. Latham moved that permission to move be granted, seconded by Mr. Henning , and carried. 31. An invitation from the Recreation Department for the council to attend the annual May Day festival was upon motion of Councilman Latham seconded by Councilman Henning, accepted. 32.1/ From the City Manager containing report of Building Inspector Rogers on construction of three-story apartment houses. The report was ordered filed. 33,V rom the City Attorney, relative to retention of certain lands owned by 34. 35.1 36.V 37.V 38/ 39/ 40.k/ 41. 42. 43. 44/ 45. 46. the East Bay municipal utility District for park purposes. The communication was ordered filed. From the City Planning Commission recommending the reclassification of certain property situated on the south line of Lincoln Avenue, 197 feet west of Ninth street, to a Business District, Class III. Mr. Latham moved that the recommendation of the City Planning Commission be adopted, seconded by Ur. Calcutt and on roll call carried by the following vote:- Ayes: Councilmen Latham,ealcutt and presidant Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Absent: None. From the City planning Commission recommending the reclassification of the lot situated on the south side of Lincoln Avenue, 100 feet east of Fifth Street, to a Residence District, Class II. Mr. Calcutt moved the adoption of the recommendation of the City Planning Commission. The motion was seconded by Mr. Latham and on roll call carried by the following vote:- Ayes: Councilmen Latham, Calcutt and president Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Absent: None. From the City Planning Commission recommending that the reclassification of a lot situated on the north side of Briggs Avenue, 400 feet east of High Street, to a Residence District, Class 11, be denied. Mr. Latham moved that the recommenda- tion of the City planning Commission be adopted, seconded by Mr. Calcutt and on roll call carried unanimously. From G. L. Diehl, requesting that the council enact an ordinance prohibiting the keeping of large numbers of bees, within the residence districts of the city. Mr. Calcutt moved that the communication be referred to the City Manager for investi- gation. The motion was seconded by Mr. Brodersen and carried unanimously. From the Alameda Housewives League, opposing the establishment of a munici- pally owned bus line on San Jose Avenue. Mr. Brodersen moved that this communication be referred to the new Transportation Committee when appointed. The motion was second- ed by Mr. Henning and carried. A communication from the City Planning Commission, recommending the reclassifi- cation of the northeast corner of Central Avenue and Union Street to a Residence District, Class II, laid over for further consideration by the council at its last meeting was then discussed. Mr. Calcutt moved that the recommendation of the City planning Commission granting the reclassification be adopted. The motion was seconded by Mr. Latham and on roll call carried by the following vote:- Ayes: Councilmen Calcutt, Latham and President schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Absent; None. Applications for permits to sell soft drinks were received from Jas. A. Murphy and Dorothy Dana. Inasmuch as these had received the approval and recommendation of the Chief of police, Mr. Latham introduced and moved the adoption of "Resolution No. 1379. Granting a Permit for a License to Sell Soft Drinks." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. In the matter of the communication from Mr. R. B. Taylor, requesting a rehearing on the application for the reclassification of the southwest corner of pearl Street and Encinal Avenue, Mr. Taylor was present and addressed the council relative to same. City Attorney Locke stated that Mr. Taylor was entirely out of order in the matter of pro- cedure and such was declared the order. The matter of the petition of the Porter School Parent-Teacher's Association, for use of Jackson park for playground purposes, covered in an opinion by City Attorney Locke of the legality of such use, was then discussed. Mr. E. N. Clintsmal, addressed the Council relative to same. Mr. Henning moved that the petition be denied, seconded by Mr. Brodersen and carried unanimously. The following Ordinances came up for passage and were read by the Clerk:- "Ordinance No. New Series. Reclassifying Prop erty. (Central Avenue, between Oak and park Street N. 0. Ford.)" Mr. Latham moved that the ordinance as read be adopted seconded by Mr. Calcutt and on roll call carried unanimously. "Ordinance No. New Series. Reclassifying Property. (O. R. Gaunt property, Bay Farm Island.)" Mr. Latham moved that the ordinance as. read be adopted,seconded by Mr. Calcutt and on roll call carried by the following vote:- Ayes: Councilmen Calcutt, Latham and Presi- dent Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Absent: None. "Ordinance No. New Series. Reclassifying property. (N. side of Santa Ulara Avenue, between Everett and Broadway, arage.)" The question of the passage of the ordinance being submitted, on roll call it was refused passage by the following vote:- eyes: COuncilmen Brodersen, Henning, Latham, Calcutt and president Schaefer, (5). "Ordinance No. New Series. Establishing Rules and Regulations for the Installation of plumbing, by Adopting the 47./ 48.1" California Plumbing Code; Amending Sections 44,97, and 152 of said Code and Repealing Sections 43, 158 and 159 Thereof." Mr. Latham moved that don ideration of the paseage of this ordinance be postponed until the next regular meeting of the Council. The motion was seconded by Mr. Henning and carried unanimously. City Engineer, Burnett Hamilton, reported as to the status of the bids receiv- ed under Resolution of Intention No. 89, N. 3. for the improvement of Santa Clara Avenue, and recommended that the bid be awarded to the California Construction cempany. Thereupon Mr. Lathamintroduced and moved the adoption of "Resolution No. 1380. In the Matter of Acquisition and Improvement District No. 1, of the City of Alameda. Resolution of Award. (Santa Clara Avenue)." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. City Engineer Hamilton report upon the status of the bids received under Resolution of Intention, No. 90, N. S. for the improvement of Buena Vista Avenue and recommending that the bid be awarded to the California Construction Company. Thereupon Mr. Latham introduced and moved the adoption of "Resolution No. 1381. In the Matter of Acquisition & Improvement District No. 2 of the City of Alameda. Resolution of Award. (Buena Vista Avenue.)" Er. Broderson seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 49.% Mr. Henning moved, upon the recommendation of the City Manager, that the pacific Engineering Laboratory be employed to inspect the work under Resolutions of Intention No. 89, N. E. and No. 90, N. S. on a per ton basis at the plant and on a per diem basis in the field, in accordance with their letter to City Engineer Hamilton under date of April 20th, 1929. The motion was seconded by Mr. Brodersen and same carried unanimously. 50 .vi 51.'s/ 52./ 53:1 55.11 The following Ordinances were introduced and laid over under a 'provision of the Charter:- "Ordinance No. New Seties. Requiring premises Whereon Soft Drinks are Dispensed to be Visible from the Street." "Ordinance No. New Series. Adopting the Uniform Building Code by Reference." (s. "Ordinance No. New Series. Reclassifying Property. line of Lincoln Avenue, 197 feet West of Ninth Street.)" "Ordinance No. New Series. Reclassifying Property. (S. line of Lincoln Avenue, 100 feet East of Fifth Street.)" "Ordinance No. New Series. Reclassifying Property. (Northeast corner of Union Street and Central Avenue.)" Councilman Calcutt offered the following motions- That the City Manager be instructed to present the City Council the following information, with the idea of creating a municipal owned and operated bus line between Alameda and 20th and Broadway, Oakland, or equal distances. Service in Alameda to equal that in use previous to the recent curtailment, and to include bus line covering route of #9 to City Hall, Oakland; Estimated Cost of equipment. 7stimated Cost of operation. Estimated ost of maintenance and depreciation. Estimated revenue to be expeoted from a 5 fare. Estimated revenue to be expected from a 7e fare. Upon receipt of this information, the Mayor to appoint a committee composed of 2 members from the Clearing HOUSG. 2 members from Real Estate Board. 2 members from Alameda Chamber of Commerce., to meet with the City officials to consider the advisability of a bond issue, necessary to the inauguration of a municipal owned bus line. Mr. Latham seconded the motion and on roll call carried by the following vote:- Ayes: Councilmen Calcutt, Latham and president schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). After further discussion, Mr. Calcutt then moved that the former motion be withdrawn, This motion was seconded by Mr. Latham and same carried unanimously. 57.V Mr. Calcutt moved that the council on its own initiative reclassify, as an emergency measure, both sides of Central Avenue, between Oak Street and Everett Street to a Business District, Class III. The motion was seconded by Mr. Henning and on roll call carried unanimously. Mr. Latham moved that the Street Department be instructed to erect the platform for the American Legion at Bay Station for Memorial Day exercises. The motion was seconded by Mr. Brodersen and carried unanimously. Mr. A. R. Linn addressed the council relative to a bill in amount of $676.00, covering 6,000, 8 -page folders, pertaining to the city of Alameda and requested payment of same. After discussion, Mr. Latham moved that the bill be referred to the City Attorney and City mana•ger to report back as to its legality. The motion was seconded by mr. Henning and carried.
