1929-05-21 Regular CC Minutes5." U .R'MEETING OT THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, MAY 21ST, 1929. The meeting convened at 8 P. M. with Council-president Schaefer presiding. The roll was called and Councilmen Brodersen, Henning, Latham, Calcutt and President Schaefer, (5) were noted present. Absent: None. The minutes of the regular meeting of May 7th, 1929 were read and approved, with the exception of Paragraph 21 on Page 21. Mr. Brodersen called attention to the fact that the Clerk omitted to include in the minutes that portion of his motion that "no official of the City of Alameda shall be a member of the Transportation Committee". This correction beihg noted by the Clerk, the minutes were then approved. NEW BUSINESS,. The Clerk stated that notices had been posted under authority of the Council for the reclassification of all the property on both sides of Central Avenue, between the easterly line of Oak Street and the westerly line of Everett Street to a Business District, Class III; that the members of the City Planning Commission were present to confer with the council relative thereto. Mr. Calcutt moved that the council recess and sit with the City Planning Commission to discuss the proposed change. The motion was seconded by ur. Latham and carried. Upon reconvening all members of the Council were noted present. Mr. Calcutt moved that in view of the fact that no protests had been received and inasmuch as the Planning Commission recommended the reclassification, the recommendation of the Planning Commission be adopted, seconded by Mr. Latham and carried unanimously. Mr. Calcutt moved that the :embers of the ity Council meet with the City Manager, City Clerk, City Attorney and City Engineer, in the Mayor's office, one hour prior to the regular council meetings, for the purpose of be- coming better acquainted with civic affairs, thru a closer association with the active officials of the city, thereby enabling the members of the City Council to act more advantageously at the regular council meetings, on matters pertaining to the welfare of Alameda. The motion was seconded by Mr. Latham and after discussion, carried by the following vote:- AYES:Councilmen Latha, Calcutt and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Mr. Calcutt moved that the Board of public Utilities be requested to proceed with the installation of new electric light poles on Park Street at the earliest possible moment so that the widening and improvement of Park Street may proceed. The motion was seconded by Mr. Latham, and after consider- able discussion, the motion was lost by the following vote:- Ayes: Councilmen Calcutt and Latham, (2). Noes: Councilmen Henning and Brodersen, (2). Not voting: President Schaefer, (1). President Schaefer explained his vote by stating he desired more information in the matter as to costs between under- ground and above-ground service. Mr. Latham then moved that the Board of Public Utilities be requested to have complete plans and specifications prepared covering under-ground service, On park-street, from San Jose Avenue, north to the Bridge, these plans when com- pleted to be submitted to the Council. The motion was seconded by Mr. Henning and carried unanimously. Mr. Calcutt moved that if there is to be no effort made for a rehearing before the Railroad Commission for street car service on San Joee Avenue to 9th Street, the tracks be ordered taken up and the street put in order at once. The motion was seconded by Mr. Henning and carried unanimously. Mr. Calcutt requested to know what action the Park Street Bridge Rail committee have taken to have car tracks provided over the proposed new Park Street Bridge, President Schaefer stated that no action had been taken by he committee up to this time and after further disucssion, Mr. Latham moved that the committee be discharged. The motion was seconded by Mr. Henning and carried unanimously. Mr. Latham then moved that a new Committee, consisting of one councilman and the City manager be appointed to interview the County Board of Supervisors, relative to the placing of tracks on the new Park Street Bridge. The motion was seconded by Mr. Calcutt and carried unanimously. The Clerk stated that since the last meeting of the Council the following papers had been filed:- 8/ Oaths of office of Messrs. I ATIONS AND C0MMITTE E REPORTS: 14.V A petition was received signed by forty-six citizens_reauesting that a concrete stairway be erected by the city at the south end of Sherman Street. City Manager Hickok stated that this would cost approximately ;100.00. There- upon Mr. Latham moved that a sum not to exceed this amount be set aside for this improvement. The motion was seconded by Mr. Henning and on roll call carried unanimously. 15.1%7 From the City Attorney re expenditure of public moneys for advertising purposes. Ordered filed. From the Civic Club, of Alameda, containing resolutions of commendation to the Honorable Victor L. schaefer. Ordered filed. prom the Alameda Improvement Club, relative to the condition of Santa Clara Avenue, between webster and Third Street. City Engineer Hamilton stated that the general condition of the street at the present time was too good for scarification and resurfacing, but that the repairs to this street was included in the regular street program and would be attended to within the next two weeks. The communication was ordered filed. From the Alameda Improvement Club re public hearings upon the 'city's budget. Mr. Brodersen moved that the suggestion be adopted, seconded by Mr. Henning and carried unanimously. From the Alameda Improvement Club relative to the inclusion of a sum of A500.00 toward defraying the expenses for Independence Day celebration. City Attorney Locke stated that the Council could not lawfully expend public moneys for this purpose. The communication then was ordered filed. ?rom the Alameda Improvement Club requesting that plans and specifi- cations be immediately prepared for the widening, lighting and improving of both Nebster and park Streets, including the placing of power wires under ground. The communication was ordered filed. From the Fernside Home Owners Association, urging the council to request the Southern pacific Company to make Fernside a regular stop for its electric trains. Mr. Latham moved that the matter be referred to the City Attorney and City manager to take up with the Railroad Commission and the Southern pacific company, in an endeavor to have this request complied with. The motion was seconded by Mr. Calcutt and carried unanimously. From the Alameda Veterans' Memorial Building Commission requesting the city to furnish Shrubbery, lawn and up-keep for the new Veterans' Memorial Building grounds. City Attorney Locke stated he believed it was lawful to comply with the request and suggested that the communication be referred to the City Attorney and City Manager for report, and such was the order. From the City Planning Commission recommending that Zoning Ordinance No. 370, N. s. be amended by adding a section to be known as 1)p--, covering the erection of duplex bungalows and bungalow courts. Mr. Latham moved that the recommendation of the City Planning Commission be adopted, seconded by mr. Calcutt and carried. From City Manager Hickok, relative to the sale of the firehouse lot on webster Street. Mr. Latham moved that the recommendation of the City Manager be adopted, seconded by Mr. Henning and carried unanimously. From the Treasurer and Tax Collector advising the appointment of Henry A. veicki as deputy. Ordered filed. From City manager Hickok, transmitting letter from G. S. Lincoln, Area Coordinator, relative to lands on Government Island. After discussion, Mr. Henning moved that the City Manager notify the government that the City, of Alameda will only consider selling the Island as a whole and that the City Manager be instructed to investigate property values and report back a tentative price at the next meeting of the Council. The motion was seconded by Mr. Latham and carried unanimously. From the City Manager relative to the keeping of bees by Mr. J. R. Joseph, 1532 Verdi Street, recommending that the City Attorney be instructed to have this declared a public nuisance. A petition signed by seven property owners and residents in the vicinity was attacht5d to the City Manager's communication. After discussion, Mr. Latham moved that the recommendation of City Manager Hickok be adopted, seconded by Mr. Calcutt and carried unanimously. Prom the City Attorney rendering opinion as to the legality of the payment of a bill in amount of $676.00, presented by the Alameda Chamber of Commerce, covering 6,000 8 page folders. After discussion, Mr. Henning introduced and moved the adoption of "Resolution No. 1382. Ratifying a Claim for Adveilising the Ci The motion to adopt the Resolution was seconded by Mr. Brodersen and on roll call it was adopted and passed by the following vote:- Ayes: Councilmen Brodersen, Henning, Latham and president Schaefer, (4). Noes: Councilman Calcutt, (1). Mr. Latham moved that the Council place itself on record that no one shall be authorized to expend any sum of money out of the advertising fund, without first receiving authorizing of the city council. The motion was second- ed by Mr. Brodersen and carried. Prom the North Side Protective Club, protesting a twenty-one cents trans- portation charge to Alameda Airport, from Neptune Beach. City Attorney Locke stated that this matter was now pending before the Railroad Commission, thereupon the communication was ordered filed. 32. 33. 36.1 38. 39. 40.v/ 41.V 42.il From the North side Protective Club, endorsing the proposed municipal bus line. There being no objections, this was referred to the new Transportation committee. From Mrs. AIice Caton, relative to conditions in the police Department. An explanation was made by City Manager Hickok, after which the communication was ordered filed. A petition was received signed by fifteen onwers of property fronting on Santa Clara Avenue, between Everett Street and Broadway, requesting the council to reclassify both sides of this block to Class V. After discussion, Mr. Calcutt moved that the matter be referred to the City Attorney and City manager, to take the necessary steps for zoning on the Council's own initiative. The motion was seconded by Mr. Latham and carried. From Fire chief, N. T. Steinmetz, relative to Pacific Oca st Asspciation of Chief's Cohvention in Vancouver in July. Mr. Latham moved the request be denied and that the Council Oppose officials leaving the state for Convention purposes. The motion was seconded by Mr. Henning and carried unanimously. A hearing was held in the matter of the removal of the dilapidated building at 2615 Calhoun Street. Building Inspector Rogers was present and stated that the building was over forty years old, unsanitary and dilapidated and had been unoccupied for six months or more; that the windows and doors were broken and same constituted a fire menace; and that neighbors had made complaihts relative to same. It was his opinion that it would cost considerably more to repair than to tear down the building. After discussion, Mr. Latham moved that the City Attorney prepare the necessary papers calling for its removal. The motion was seconded by Mr. Calcutt and carried unanimously. The following ordinances came up for passage and were read by the Clerk:- 11,0rA1nanza JN. o New Series, Establishing Rules and Regulations for the In- stallation of plumbing, by Adopting the California Plumbing Code, Amending Section 44, 97, and 152 of said Code and Repealing Sections 43, 158 and 159 Thereof." Mr. W. S. Lewis was presented and filed with the Council a petition signed by nineteen registered plumbers requesting the adoption of the ordinance. Messrs. Feldhammer and Roth spoke against the fees connected therewith. After further discussion, Mr. Latham moved that final action on the adoption of the ordinance be postponed to the next regular meeting of the council. The motion was second- ed by Mr. Henning and carried unanimously. "Ordinance No. New Series. Adopting the Uniform Building Code by Reference." Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Henning and on roll call it was adopted and passed unanimously. "Ordinance No. New Series. Reclassifying Property. (Northeast corner, Union St. and Central Ave.)" Mr. Calcutt moved that the ordinance as read be adopted, seconded by Mr. Latham and on roll call it was adopted and passed by the following vote:- Ayes: Council- men Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). "Ordinance No. 3%7 New Series. Reclassifying Property. (South Side of Lincoln Avenue, 100 ft. Fast of 5th St.)" Mr. Calcutt moved that the ordinance as read be adoption, seconded by Mr. Latham and on roll call it was adopted and passed unanimous_ . "Ordinance No. New Series. Reclassifying Property. (South lihe of Lincoln Ave. 197 ft. W. of 9th St.)" Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Calcutt and on roll call it was adopted and passed by the following vote:- Ayes: Council- men Caldutt, Latham and president Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). "Ordinance No. New Series. Requiring Premises Whereon Soft Drinks are Dis pensed to be Visible from the Street." Mr. Calcutt moved that the ordinance as read be adopted, seconded by Mr. Henning and on roll call it was adopted and passed unanimously. The following Ordinances were introduced and laid over under a provision of the Charter:- 43.1 44.a/ 45•/ 46./ 47. 48.1 "Ordinance No. New Series. Reclassifying property. (Both Sides of Central Avenue, between Oak and Everett Streets.)" "Ordinance No. New Series. Amending an Ordinance entitled "Ordinance No. 370, New Series. Establishing Districts or Zones and Regulating Therein the Use of Property, Height of Buildings, and Required Open Spaces for Light and Ventilation of such Buildings, and Repealing A11 Ordinances in Conflict Herewith, Including Ordinances Nos. 227, N. S., 319 N. S. and 338 N. S., Excepting, However, the zone Map Heretofore Adopted by Ordinance No. 227, N. S., and Referred to in Section One (1) Hereof", by Adding Thereto a New Section to be known as Section 3A So as to provide for Residential Districts of Class 1, ithin Which single Family Dwellings, Duplex Bungalows and Bungalow Courts may be Erected and Maintained. The matter of carrying liability insurance by the City of Alameda was referred to the City manager for report. Mr. A. R. Linn addressed the Council relative to the opening of ?[ebb Avenue to Broddway,‘ After discussion, Mr. Latham moved that the City manager ascertain the cost and attitude of property owners as to the proposed opening. The motion was seconded by Mr. Henning and carried unanimously. Mr. A. R. Linn requested, on behalf of the Reat Estate Board, an appro- priation of 50.00 covering an advertisement for the city of Alameda in the Real Betate Magazine Convention Number to be published in July. After dis- cussion, Mr. Henning moved that the request be granted, providing the City Attorney says such expenditure was legal. The motion was seconded by Mr. Brodersen and on roll call carried unanimously. Mr. Brodersen moved that the council ratify the Transportation Committee appointed by the Mayor, consisting of John U. Desch, as Chairman, A. R. Linn, T. R. Neville, gallace D. Meracle and A. R. Hougard. The motion was seconded by Mr. Henning and carried unanimously.
