1929-08-20 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, AUGUST 20th, 1929. The meeting convened at 8 o'clock with Council-president Schaefer presiding. The roll was called and councilmen Brodersen, Calcutt, Henning, Latham and President Schaefer, (5) were noted present. Absent: None. The minutes of the regular meeting of August 6th, 1929 were approved as read. The minutes of the adjourned regular meeting of August 13th, 1929 were approv- ed as read. 1.■/ Mr. Calcutt introduced and moved the adOption of "Resolution No. 1401. Ordering the RecommencemenT77 Proceedings fot the Improvement of Park Street." Mr. Latham seconded the motion to adopt the Resolution.DiScussion followed., TheOotncil was addressed by Measrs17Rosenthal, Neiss and Dr. Fierce, favoring the immediate commencement of the widening. At the request of Councilman Henning, the Resolution was amended by striking out all reference to the installation of new lighting standards. Thereupon the Resolution as amended, was on roll call, adopted unanimously. 3:, 4o1 , 89, 5d No. The Clerk stated that the following papers had been filed since the last meeting: Continuation Certifidate on bond of 4. J. Plummer, M. B. L. P. Balance Sheet, Alameda Belt Line, June 1929. Affidavit of posting Notice of Final Hearing, Resolution of Intention, No. N. 3. Santa Clara Avenue improvement. Affidatit of publication, Notice of Final Hearing, Resolution of Intention 89, N. S. Santa Clara Avenue improvement. Affidavit of publication, re Board of Equalization meeting. Recorded Grant of Easement, Mason Bowen to City of Alameda. Mr. Latham introduced and moved the adoption of "Resolution No. 1402. Transferring $5,000.00 from the Street Improve- ment Fund to the General Fund." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Lathamintroduced and moved the adoption of "Resolution No. 1403. Resolution of Acceptance and Consent to Recordation." (Haight School Property) Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 10.v' The following Resolution was introduced and unanimously adopted by all members of the Council:- CO CATIONS A "Resolution No. 1404. Commending Mr. Guss C. Wagner. WHEREAS, Mr. Guss C. Wagner has recently retired from active duty in the Tire Department of the City of Alameda after many years of faithful service, and a record for which he may well be proud, now therefore be it RESOLVED, by the city council of the City of Alameda that by his long and honorable career in the public service Mr. Wagner has set up a conspicuous example of loyalty and devOtion which finds its reward in the gratification and satisfaction of a duty well performed; RESOLVED, that a copy of these resolutions be spread in full upon the records of the council." COMMITTEE REPORTSa The following communications were received: From the City Planning Commission recommending the reclassification of all property fronting on both sides of Santa Clara Avenue, between Everett Street and Broadway, to a Business District, Class V, on the Council's own initiative be not approved. Mr. Henning moved that the council reject the recommendation of the City Planning Commission. The motion was seconded by Mr. Brodersen and same carried unanimously. 12.v/ From the City Planning Commission recommending the reclassification of all lots no* classified as residential, fronting on both sides of Central Avenue, between Oak and Everett Streets, to a Business District, Class III. Mr.'Latham moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Henning and carried unanimously. 13.1/ From the City Planning Commission recommending that,the lot on the north- east corner of Park Avenue and Central Avenue to; a Business District Class V, ONO be granted. Mr. Henning moved that the recommendation of the City Planning Commission be rejected. The motion was seconded by Mr. Brodersen and on roll call carried by the following vote:- Ayes: Brodersen, Calcutt and Henning, (3). Noes: Councilman Latham and President Schaefer, (2). 14.i( From the City Planning Commission, recommending reclassification of the lot on the southwest corner of Buena Vista Avenue and Arbor Street to a Business District, Class V. Mr. Latham moved the adoption of the recommendation of the Planning Commission, The motion was seconded by Mr. Calcutt and on roll call carried by the following vote:- Ayes: Councilmen Calcutt, Latham and Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). 15.v/ From the City Planning Commission, recommending the reclassification of the lot situated on the south line of Clinton Avenue, 148 feet west of Lafayette Street, to a Residence District, Class 1-3/4. Mr. Henning moved that the recommendation of the City Planning Commission be rejected. The motion was seconded by Mr. Brodersen and on roll call lost by the following vote:- Ayes: Councilmen Brodersen and Henning, (2). Noes: Councilmen Calcutt and Latham, and President Schaefer, (3). 16./ City Manager Hickok filed a report relative to condition of a buildin and premises on Bay Island Avenue, between Versailles Avenue and Mound Street. City Attorney Lonke, stated that proposed amendments to our uniform building code would take care of similar conditions in the future and thereupon the communication was ordered filed. 17.1 From the Alameda Community Hotel Corporation, requesting that an appro- priation of 37500.00 be set aside in the budget for advertising purposes. Messrs. Traver, Strehlow and Barker of the Chamber of Commerce also addressed the council favoring the appropriation. Mr. Latham moved that the communication be referred to a meeting of the Committee of the Whole. The motion was seconded by Mr. Henning and carried unanimously. 18.\I From Mr. A. E. J. Duchesnay, requesting permission to supplement bulk- head granted under Resolution No. 1395. Mr. Calcutt moved that permission be granted, in accordance with the request, seconded by Mr. Latham and carried unanimously. 19. From Andre Fourchy, re transportation problem. Mr. Henning moved that the communication be referred to the Transportation Committee. The motion was seconded by Mr. Brodersen and carried unanimously. 20,v From A. R. Linn, Chairman of the Transportation Committee, requesting additional time to file report of the Transportation Committee. There being no objections the communication was ordered filed and the extension of time granted. From Dr. F. W. Vowinckel, re pottery works of N. Clark and Sons. Mr. Brodersen moved that a committee of the council be appointed to investigate and report back. The motion was seconded by Mr. Henning and on roll call lost by the following vote:- Ayes: Councilmen Brodersen and Henning, (2). Noes: Councilmen Calcutt and Latham, and President Schaefer, (3). Further discussion followed and the communication was ordered filed on the ground that the couhcil had no jurisdiction in the matter. 22a1 From the Aeolian Yacht Club, endorsing the proposed yacht harbor. Mr. Carl Strom addressed the council in support of the letter as did Mr. Sam Wright. There being no objections, the communication was referred to a meeting of the Committee of the Whole. 21.V/ 23.V From the AlamedaImprovement Club, relative to Yacht harbor lease. Referred to a meeting of the Committee of the Whole. 24.v( From the City Manager reporting as to the auto0obile traffic situation, containing recommendations therein. Mr. Latham moved that the recommendations be adopted, seconded by Mr. Brodersen and on roll call carried unanimously. From the Grand Lodge, American Order, Sons of St. George, containing thanks of that organization. Ordered filed. 26.1 From the Pacific Inter-club Yacht Association, endorsing yacht harbor. Referred to the Committee of the Whole. 27.7 From the California Conference of Seventh Day Adventists, requesting permission to carry on Harvest In-gathering Campaign. Mr. Latham moved that permission be granted, in accordance with the request seconded by Mr. Brodersen and carried unanimously. 28.v/ ?ram the Outboard Motor Association Of Northern California endorsing yacht, harbor. Referred to the Committee of the Whole. 29.V From the Coast Banker Publishing Company, requesting an appropriation for advertising in the Coast Banker. Referred to the Committee of the Whole. 30.'J Prom M. B. Morrison, requesting an appropriation of $200.00 from the advetising fund to defray expense of Nina Craig to Baltimore. City Attorney Locke stated that such an appropriation would be illegal. Thereupon Mr. Henning moved that the request be denied, seconded by Mr. Latham and carried unanimously. 3 . From R. E. Taylor, relative to reclassification of the southeast corner of Pearl Street and Encino]. Avenue. The communication was ordered filed. Councilman Calcutt called attention of the council to the great amount of parking space reserved by the Shell Oil Company at the corner of Oak Street and Santa Clara Avenue and after discussion moved that the matter be referred to the City Manager and City Attorney to investigate the parking spaces reserved for all 32.a/ service stations. The motion was seconded by Mr. Latham and carried unanimously. HEAYE 11GS 33.E The removal of the dilapidated building at 1914 Webs Brodersen moved that the matter be continued to September seconded by Mr. Latham and carried. 34.V Various applications to sell soft drinks were received from the Safeway Stores, and inasmuch as they had received the approval and recommendation of the Chief of Police, Mr. Latham introduced and moved the adoption of "Resolution No. 1405. Granting a Permit for a License to Sell Soft Drinks." er Street . Mr. rd. The motion was ter. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The matter of hearing of protests under Resolution of Intention No. 89, New Series. Santa Clara Avenue improvement. There being none, Mr. Latham intro- duced and moved the adoption of "Resolution No. 1406. In the Matter of Acquisition and Improvement District Co. 1 of the City of Alameda. Resolution and Final Order Accepting the Work." WHEREAS, on February 19, 1929, the City Council of the City of Alameda adopted its Resolution of Intention No. 89, U. S., to order the im- provement of Santa Clara Avenue in the above - entitled matter, under and pursuant to the provisions of the Acquisition and Improvement .Act of 1925, :reference being hereby expressly made to said. Resolution, of Intention for further particulars, and WHEREAS, said work was done accordingly and the superintendent of work and the contract have filed a verified declaration and statement of the completion of said work, amount of incidental expenses and other matters, as 'required by the provisions of section twenty-two (22) of said act, and WHEREAS, the Council fixed Tuesday, the 20th day of August, 1929, at the hour of 8 o'clook p. m. of said day, in the chamber of the City Council of the City Hall in said city as the day, hour and place for holding the final hearing, in the above - entitled matter as required by said act, and it appears from the affidavits on file with the clerk that notice of said hearing was published and posted inthe time, form and manner required by law, and WHEREAS, the time set for said hearing having arrived, and no person or persons interested in any of the work or improvement done under said proceeding or in any matter affecting said work and the assess- ment district therefor, have appeared before the council feeling aggrieved by any action or determination done or made in said pro- ceedings or claim that any of the previous acts or proceedings are irregular, defective, erroneous or faulty, or claim that the work or improvement has not been performed according to the contract in a good and substantial manner, or claim that any portion of the work or improvement for any reason was omitted or illegally included in the contract for the same, or have any objections to offer or any reason to advance why bonds dbuld not be issued in the amount set forth in the declaration and statement on file, nor have any protests or objections whatever been presented, either in writing or orally, in response to said notice of final hearing, now therefore be it RESOLVED, determined and declared by the City Council of the City of Alameda that, in the opinion of the council, the said work has been completed and performed aocording to the contract in a good and substantial manner, and that said work be and the same is hereby accepted; that the amount of the contract price of the doing of said work and improvement is Sixty-two Thousand Four Hundred Thirty -six and 85/100 Dollars, ($62,436.85), and that the amount of the incidental expenses thereof and of the proceedings therefor, which are to be charged against and to be paid by the contractor, are One Thousand Nine Hundred Five and 28/100 Dollars,(e1905.28) . The aggregate amount for which bonds are to be issued to the con- tractor or his assigns is Sixty -four Thousand Three Hundred Forty - two and 13/100 Dollars ($64,342.13). This resolution and order shall be entered in full upon the minutes of the board. Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. City Engineer Hamilton filed a declaration of completion of work, under Resolution of Intention No. 90, N. S., re improvement of Buena Vista Avenue. Thereupon Mr. Calcutt introduced and moved the adoption of "Resolution No ",. 140'7. In the Matter of Acquisition and Improvement District No. 2 of the City of Alameda. Resolution Fixing time and Place of Final Hearing." 7. 38. 39.- 40•1 41., 42. 43.4 44.v/ Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following ordinances came up for passage:- "Ordinance No. New Series. Regulating the Expenditure of Public Money for Advertising Purposes." Mr. Calcutt moved that action on the proposed ordinance be continued to September 3rd, 1929. The motion was seconded by Mr. Henning and carried unanimously. "Ordinance No. New Series. Making Santa Clara Avenue, between Wehster and High Streets a Boulevard, and Prohibiting Thereon Heavy Vehicles Except Passenger Busses." Mr. Calcutt moved that the ordinance as read be adopted, seconded by Mr. Latham and on roll call it wqs adopted and passed unanimously: "Ordinance No. New Series. An Ordinance Authorizing and Providing for the Leasing of 50 acres of tide and submerged land on the western waterfront of the city, for a Yacht Harbor, in Exchange for 53 acres more or less of such land at the eastern end of the Alameda Airport." Mr. Latham moved that action on. the proposed ordinance be continued to September 3rd, 1929. The motion was seconded by Mr. Calcutt and carried unanimously.
