1929-09-03 Regular CC MinutesREGULAR MEETING OF THE TUESDAY EVENING, UNCIL OF THE CITY OF A PTEMBER 3RD, 1929. The meeting convened at 8 o'clock with Council - president Schaefer presid ng. The roll was called and Councilmen Brodersen_, Calcutt, Henning, Latham and President Schaefer, (5) were noted present. Absent: None. The minutes of the regular meeting of August 20th, 1929 were approved as read. NEW BUSINESS. 1.V7 Mr. Latham moved that Tuesday evening, September 10th, 1929 at 8 o'clock be set aside by the council for the purpose of public discussion of the tentative budget; that the budget be published one time and that a notice of this public meeting be published for three times. The motion was seconded by Mr.Hanning and carried unanimously. 2. 4.N/ 5. 6. Mr. Henning moved that Capt. H: M. Bradley of Co. G. of the National Guard be instructed to select some other night for drill night other than Tuesday. The motion was seconded by Mr. Latham and carried unanimously. Mr. Henning submitted sketch and specifications covering underground wiring on Park Street, and stated that the estimated cost of such installation would ap- proximate $99,700.00. Ivlr. Latham moved that the plans be submitted to the Board of Public Utilities with a request that they report back to the council at its next meeting of September 17th. The motion was seconded by Mr. Calcutt and carried unanimously. The Clerk stated the following papers had been filed since the last meeting: Continuation- Certificate on bond of Clark G. Woodbury, M. E. L. P. Title Insurance Policy, covering Haight School property. Oath of office, F. A. Williamson, as member of. the Board of Free Library Trustees. Mr. Latham introduced and moved the adoption of "Resolution No. 1408. Transferring $2846.92 from the Electric Light Fund to the General Fund.." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 8.' Mr. Calcutt introduced and moved the adoption of "Resolution No. 1409. Transferring $534.38 from the Electric Light Fund to the Interest and Redemptinn Fund." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 9.'J Mr. Latham introduced and moved the adoption of "Resolution No. 1410. Authorizing Harbor Tug and Barge Company to Take Possession of Premises at Foot of Grand Street." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 10.x` Mr. Latham introduced and moved the adoption of "Resolution No. 1411. Authorizing Quitclaim Deed to Caine Buck." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 11.V Mr. Brodersen introduced and moved the adoption of "Resolution No. 1412. Cancelling Building Permit #238, and Refunding Fee Paid For Same." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1413. In the Natter of Acquisition and Improvement District No. I of the City of Alameda. Resolution and Order for the Issuance of Bond Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 13. Mr. Calcutt introduced and moved the adoption of "Resolution No. 1414. In the Matterof Acquisition and Improvement District No. 3 of the City of Alameda. Appointing and Employing Burnett Hamilton Engineer of Work." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 14." Mr. Latham introduced and moved the adoption of "Resolution No. 1415. In the Matter of Acquisition and Improvement District No. 3 of the City of Alameda. Resolution Approving Specifications." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. COMMUNICATIONS AND COMMITTEE REPORTS. The following communications were received: 15. From Breed, Burpee & Robinson relative to fees covering work as Assistant Attorney in various matters. Ordered filed. 16.E From Breed, Burpee & Robinson notifying the council as to result of damage suit in case of Krausse v. City of Alameda, and including bill for services rendered. Ordered filed. 17.V From Alameda Council, Boy Snouts of America, requesting permission to use Council Chamber on September 23rd. Mr. Caloutt moved that permission be granted providing the council chambers are available due to renovation. The motion was second- ed by Mr. Henning and carried unanimously. 18.V f From Mayor Schaefer advising of the appointment of F. A. Williamson as a member of the Board of Free Library Trustees. Ordered filed. From C. H. Uznay, Vice - President and General Manager, California Appraisal Co., relative to the appointment of an insurance advisor. Mr. Henning moved that the communication be filed. The. motion was seconded by Mr. Brodersen and carried unanimous- ly. From the California Conference, Seventh Day Adventists, thanking the council for its action at the last regular meeting. Ordered filed. 21..i From the Alameda Improvement Club, relative to San Francisco Bay Bridge. Mr. Henning moved that the communication be referred to a meeting of the Committee of the '/hole, seoonded by Mr. Brodersen and carried unanimously. 22.x% From the Alameda Airport, Inc.,. in reply to the communication of the Alameda Improvement Club. Mr. Latham moved that the communication be referred to a meeting of the Committee of the Whole,, and that the council meet as a Committee of the Whole, Tuesday evening, September 10th, 1929 at 7 O'clock, in the office of the City Manager. The motion was seconded by Mr. Henning and carried unanimously. 23. From the City Planning Commission, recommending the reclassification of a lot on the north side of Calhoun Street, 196 feet, 7 inches east of Regent Street to a Residence District, Class lr Mr. Latham moved that the reoommendation of the City Planning Commission be adopted, seconded by Mr. Caloutt and on roll pall carried unanimously. 24. From the City Attorney, relative to the case of Krausse v. City of Alameda. Ordered filed. 25. From T. W. Howen, relative to erection of a garage on the rear of his lot at 3239 Central Avenue. Mr. Latham moved that the communication be referred to the City Attorney, City Manager, and Building Inspector. The motion was seconded by Mr. Broder- sen and carried unanimously. HEARINGS. 26.✓ Application for permit to sell soft drinks was received from Clyde I. and Julia Blake. Inasmuch as it had received the approval and recommendation of the Chief of Police, Mr. Caloutt introduced and moved the adoption of 28 "Resolution No. 1416. Granting a Permit for a License to Sell Soft Drinks." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. A petition was received from Merchants located on both sides of Santa Clara Avenue, between Oak and Everett Street, requesting relief from parallel parking. Mr. Henning moved that the Council rescind its former action relative to parallel parking on Santa Clara Avenue, between the streets mentioned, and that the petition be referred to the City Manager with power to act. Mr. Calcutt seconded the motion and on roll call it was carried unanimously. The matter of the removal of the dilapidated building at 1914 Webster Street came up. Mr. Latham moved that the matter be referred to the next meeting of the council, seconded by Mr. Brodersen and parried unanimously. 29.'x' Mr. Henning introduced and moved the adoption of "Resolution No. 1417. In the Matter of Acquisition and Improvement District No. 2 of the City of Alameda. Resolution and Final Order Accepting the Work. WHEREAS, on February 19, 1929, the City Council of the City of Alameda adopted its Resolution of Intention to order certain work to be done and improvements to be made in the above - entitled matter, under and pursuant to the provisions of the Acquisition and Improvement Act of 1925, reference being hereby expressly made to said Resolution of In- tention for further particulars, and WHEREAS, said work was done accordingly, and the superintendent of work and the contractor have filed a verified declaration and state- ment of the completion of said work, amount of incidental expenses and other matters, as required by the provisions of section twenty -two (22) of said act, and WHEREAS, the Council fixed Tuesday, the 3rd day of September, 1929, at the hour of 8 o'clock p. . of said day, in the chamber of the City Council as the day, hour and place for holding the final hearing, in the above - entitled matter as required by said act, and it appears from the affi- davits on file with the clerk that notice of said hearing was published and posted in the time, form and manner required by law, and ',WHEREAS, the time set for said hearing having arrived, and all persons interests in any of the work or improvement done under said proceeding or in any matter affecting said work and the assessment district there- for, feeling aggrieved by any action or determination done or made in said proceedings or claiming that any of the previous acts or proceed- ings are irregular, defective, erroneous or faulty, or that the work or improvement has not been performed according to the contract in a good and substantial manner, or that any portion of the work or improvement has not been performed according to the contract in a good and sub- stantial manner, or that any portion of the work or improvement for any reason was omitted or illegally included in the contract for the same, or having any objections to offer or any reason to advance why bonds should not .be issued in the amount set forth in the declaration and statement on file, have been duly granted a hearing, and the various protests and objections having been duly and regularly heard, weighed and considered, now therefore be it RESOLVED, determined and declared by the City Council of the City of Alameda, that, in the opinion of the council, the said work has been completed and performed according to the contract in a good and substantial manner, and that said work be and the same is hereby accepted; that the amount of the contract price for the doing of said work and improvement is Forty -one Thousand, Nine Hundred and Fifty-two and 29/100 Dollars, ($41,952.29) and that the amount of the incidental expenses thereof and of the proceedings therefor, which are to be charged against and to be paid by the eontractoi are One Thousand, One Hundred and Fifty -three and 13 /100 Dollars, ($1,153.13). The aggregate amount for which bonds are to be issued to the contract or his assigns is Forty -three Thousand, One Hundred and Five and 42/100 Dollars, ($43,105.42). This resolution and order shall be entered in full upon the minutes of the Council." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 30. President Schaefer reported for the Committee of the Whole, relative to the communication of A. FeldhamrIB r, that the action of the Committee was unanimous°"'v4n that the Board of Public Utilities was entirely within the law and therefore legal in its recent award to the Street Lighting and Equipment Company for lighting standards. Mr. Latham moved that the council adopt the verbal report made by President Schaefer, seconded the Mr. Calcutt and carried unanimously. 31.✓ Mr. Calcutt introduced and moved the adoption of "Resalu ti on No. 1418. Expressing Confendence in the Board of Public Utilities. WHEREAS, the Board of Public Utilities of the City of Alameda has been publicly criticised for its recent action in awarding the contract for electric light poles on 'Webster Street, and .WHEREAS, it appears that the action of the board was prompted solely by the desire to secure the greatest amount of oompetitive bidding; and the notice inviting sealed proposals was prepared by the city attorney, who advised the board that the practice of inviting alternate bids on different materials was followed by may public bodies, including the board of supervisors of our own County of Alameda, and WHEREAS, it appears that the Board of Public Utilities acted wisely under the circumstances and for the best interests of the people and taxpayers of the city, besides being entirely within their legal rights, now therefore be it RESOLVED, by the City Council of the City of Alameda that, in the opinion of said council, the attacks made on our Board of Public Utilities are wholly unjust and without any warrant whatsoever. RESOLVED FURTHER, that we take this opportunity of ex- pressing our complete confidence in said board, and we believe that the people of Alameda are exceedingly fortunate in securing the services of the men Who are now devoting their time and attention to the work of the board without one cent of compensation. RESOLVED, that these resolutions be spread upon the minutes and records of the council, and a copy thereof sent to the members of said board." Mr. Lathamseoonded the motion to adopt the Resolution and on roll call it was adopted and passed by` the following vote, to wit : - Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2) . Absent: None. 32.✓ Mr. Latham moved that the City Attorney be instructed totake the necessary proceedings to acquire under the Acquisition and Improvement Act the land known as the Stanford Tract in the vicinity of Pearl Street and Bay Island Avenue, and also sufficient property to square Franklin Park, comprising three lots and that sufficient money be included in these pro- ceedings to improve the properties referred to for park purposes. The motion was seconded by Mr. Calcutt and on roll call carried unanimously. The following ordinances were introduced and laid over under a provision of the Charter:- Es 35.1 36./ 38. 39. "Ordinance No. New Series. An Ordinance Providing for the Erection of Traffic Stop Signals on both sides of High Street and Requiring the Drivers of all Vehicles to come to a full Stop at Street Intersections before crossing said Street." "Ordinance No. New Series. An Ordinance Providing for the Erection of Traffic Stop Signals on both sides of Versailles Avenue, Approaching the Intersection with San Jose Avenue." (Property; 7 inches, The following ordinances "Ordinance No. New Series. Reclassifying Property. North side of Calhoun Street, 196 feet, East of Regent Street.)" Dame up for passage : - "Ordinance No. New Series. Regulating the Expenditure of Public Money for Advertising Purposes." Mr. Latham moved that the passage of the ordinance be laid upon the table. The motion was seconded by Mr. Henning and on roll call carried unanimously. "Ordinance No. New Series. Reclassifying Property. (Central Avenue, between Oak and Everett Streets to a Business District, Class III.)" Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Henning and on roll call it was adopted and passed unanimously. "Ordinance No. New Series. Reclassifying Property. (Santa Clara Avenue, between Broadway and Everett Street.)" Many people addressed the Council favoring and protesting the passage of the ordinance and after discussion, Mr. Latham moved that the matter be referred to the City Attorney and City Engineer for additional information, and that the passage of the ordinance be continued to the next regular meeting of the Council. The motion was seconded by Mr. Brodersen and carried unanimously. "Ordinance No. New Series. Reclassifying Property. (Southwest corner, Buena Vista Avenue and Arbor Street to a Business District, Class V.)" Mr. Latham moved that the ordinance as read on roll call carried by the following vote Calcutt, Latham and President Schaefer, (4 Absent: None. be adopted, seoonded by Mr. Calou tt and to wit: - Ayes: Councilmen Brodersen, Noes: Councilman Henning, (1). "Ordinance No. New Series. Reclassifying Property. (Lot on the south side of Clinton Avenue, 148 ft. Lest of Lafayette Street.)" Mr. Henning moved that the ordinance be rejected, seconded by Mr. Brodersen and on 41. roll call the motion was lost by the following vote : -. Ayes: Councilmen Broder- sen and Henning, (2). Noes: Councilmen Calcutt, Latham and President Schaefer, (3). Absent: None. Mr. Calcutt then moved that the Ordinance as read be adopted. The motion was seconded by Mr. Latham and on roll call carried by the following vote : - Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Absent: None. "Ordinance No. New Series. An Ordinance Authorizing and Providing for the Leas- ing of 50 Acres of Tide and Submerged lands on the western water -front of the City for a Yacht Harbor, in Exchange for 53 acres, more or less, of such Land at the Eastern End of the Alameda Airport." Mr. Calcutt moved that the ordinance as read be adopted, seconded by Mr. Latham. Thereupon President Schaefer called for discussion, relative to the Ordinance from those present in the Council Chamber. Mr. L. M. King fila d a petition containing approximately 1700 names favoring the granting of the proposed lease and addressed the council in support of same. Messrs. E. K. Taylor, C. Strom, L. H. Ader, Byron Lopp, Dr. Pierce, Virgil Skinner and Captain Chadwick Thompson addressed the council, in support of the lease. Messrs. E. R. Sanford, A. T. Spence, end A. Feldhammer addressed the Council opposing the granting of the lease as at present drawn. The question of the adoption of the ordinance then being put to the members of the Council resulted in the following vote : - Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilman Brodersen and Henning. Councilman Calcutt then requested permission to change his vote to "NO ", which was granted, leaving the final vote on the adoptioh of the Ordinance as follows : - Ayes: Councilmen Latham and President Schaefer, (2) . Noes: Councilmen Brodersen, Calcutt and Henning, (3). 42. Councilman Calcutt then moved that the council reconsider the adoption of the ordinance at the next regular meeting of the council. The motion was seconded by Mr. Latham, whereupon Councilmen Brodersen and Henning stated that their reasons for voting "NO" was due to various conditions contained in the lease as at present drawn. The motion to reconsider then being put, to the members of the council, resulted in the following vote : - Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2).. 43. "Ordinance No. New Series. Authorizing Lease to the Harbor Tug and Barge Company." Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Henning and on roll call it was adopted and passed unanimously.
