1929-09-17 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, SEPTEMBER 17TH, 1929. The meeting convened at 8 o'clock with Council-president Schaefer presiding. The roll was called and Councilmen Brodersen, Calcutt, Henning, Latham and President Schaefer, (5) were noted present. Absent: None. The minutes of the regular meeting of September 3rd, 1929 were approved as read. NIEV BUSII Mr. Latham introduced and moved the adoption of "Resolution No. 1419. Fixing the Salaries of the Officers and Members of the Police and Fire Departments of the City of Alameda." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Calcutt introduced and moved the adoption of a Resolution calling, providing for and giving notice of a special election to be held in the City of Alameda, on Tuesday, the 5th day of November, 1929, for the purpose of submitting to the electors a proposition to lease certain tide and submerged lands for a yacht harbor. Mr. Latham stated he thought the introduction of this resolution at this time was out of order, and suggested delaying the matter until definite action was taken bi the council on the proposed ordinance covering yacht harbor lease, to be presented for passage at this meeting. There being no objection, such was the order. A report and communications were received from the Board of Public Utilities, relative to the plans submitted by Mr. Henning at the last meeting of the Council. Mr. Henning and Mr. G. M. Simonson, a consulting electrical engineer, who prepared the sketch for Mr. Henning addressed the council relative to same. Messrs. Traver, Presi- dent of the Chamber of Commerce; Holtkamp, President of the Park Street Merchants; Leydecker, representing the Alameda Improvement Club, and Strom, addressed the council favoring an underground system. Dr. Pierce addressed the council protesting underground service. After further discussion, Mr. Calcutt moved that the Board of Public Utilities be instructed to proceed with the overhead wiring and that the City Attorney be instruct- ed to prepare the necessary papers covering this improvement. The motion was seconded by Mr. Latham and on roll call carried by the following vote:- Ayes: Councilmen Calcutt Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Mr. Brodersen stated that he would have an injunction issued against the Board of Public Utilities before the work is begun. Mr. Carl Werner, through his representative, submitted plans and specifications for the proposed bath house at Washington Perk. Mr. Latham moved that the plans as submitted be adopted and that the City Clerk be instructed to advertise for bide. The motion was seconded by Mr. Calcutt and on roll call carried unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1420. Determing the Rate and Levying the Tax 1929-30." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adapted and passed unanimously. 6.41 Mr. Latham introduced and moved the adoption of "Resolution No. 1421. Fixing Salary of the Health Officer of the City of Alameda." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote, to wit:- Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Mr. Calcutt introduced and moved the adoption of "Resolution No. 1422. Fixing Salary of the Starter at the Municipal Golf Course of the City of Alameda." Mr. Brodersen seconded the motion to adopt t1 Resolution and on Toll call it was adopted and passed unanimously.. "Resolution No. 1423. Favoring the Substitution of a Bus Line for the Present Street Railroad on Park Street and Park Street Bridge." was presented. Mr. Latham moved that the Resolution be referred to a meeting of the Committee of the Whole, seconded by Mr. Henning and carried unanimously. 9.\/ Mr. Latham introduced and moved the adoption of "Resolution No. 1424. In the Matter of Acquisition and Improvement District No. 2 of the City of Alameda. Resolution and Order for the Issuance of Bonds." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Calcutt introduced anti moved the adoption of "Resolution No. 1425. Requesting the Railroad Commission of the State of California to Grant a Petition of the Western Natural Gas Company For Rehearing" Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote, to wit:- Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). The Clerk stated that since the last meeting of the Council the following papers had been filed:- 11.1/z Affidavit of publication of tentative budget. 12./ Affidavit of publication of Notice of Public Hearing, re tentative budget. 13. Contract of employment, of Carl Werner, as architect. 14. - Copy of quitclaim deed, City of Alameda to Callie Buck. 15.‘<, Bond of Bay Shell Company to City of Alameda. 16O, Copy of Agreement, Alameda Belt Line, re power line crossings. 17. Various communications pertaining to yacht harbor, previously referred to the Committee of the Whole and reported back to the council. 18.v Various communications referred to Committee of the Whole by previous Council, reported back and ordered filed. COMMUNICATIONS AND 00MMITT1E REPORTS. The following communications were received:- From Alameda County Veterans Association, requesting directors of East Bay Municipal Utility District to employ only citizens of the United States. Mr. Henning moved that the Council convey the demands of the Alameda County Veterans Association to the Board of Directors of the East Bay Municipal Utility District, as requested, seconded by Mr. Brodersen and carried unanimously. From the Fernside Home Owners Association, requesting the insta11tion of improved electroliers throughout Fernside Tract. The City Manager stated that this work would be done in conjunction with the installation on Santa Clara Avenue. Mr. Henning moved that the communication be referred to the Board of Public Utilities, seconded by Mr. Brodersen and carried. 19.v 20./ 21.1/ From the Veterans Welfare Board, requesting cancellation of taxes. Mr. Latham moved that the matter be referred to the City Attorney to report back to the Council. The motion was seconded by Mr. Calcutt and carried unaniMously. 22.y7 From the Public Welfare League, requesting passage of an ordinance prohibiting the sale in Alameda of wine tonics or bitters, having an alcoholic content of over one-half of one per cent. After discussion, Mr. Henning moved that the communication be referred to the City Manager to report back. The motion was seconded by Mr. Brodersen and carried unanimously. 23.J From the City Planning Commission requesting the City Attorney to create a separate section in the zoning ordinance for the establishment of gasoline and oil service stations. This communication was referred to a joint meeting of the members of the Council and the City Planning Commission. 24.a/ From the City Planning Commission requesting the council to meet with the Planning Commission for the purpose of discussing various phases of zoning problems, throughout the city. Mr. Brodersen moved that the Mayor be instructed to call such a meeting. The motion was seconded by Mr. Latham and carried unanimously. 25." From the Board of Public Utilities, recommending the application of Benj. Walters for a permit to lay cable for the transmitting of electrical energy, covering his dredging contract. Mr. Henning moved that the application be approved, seconded by Mr. Brodersen and on roll call carried unanimously. From Homer R. Dallas, City Treasurer, advising of the appointment of Harold E. Crabb, to succeed Henry A. Lewicki, resigned. Ordered filed. From the League of California Municipalities, containing official call to the Thirty-first Annual Convention. Mr. Latham moved that all members of the Council, City Manager, City Clerk, City Attorney, City Engineer and City Health Officer, be appointed delegates to represent the city at this convention. The motion was seconded by Mr. Calcutt and carried unanimously. From the League of California Municipalities, relative to organization of a municipal water works association, to be affiliated with the League. Mr. Latham moved that the communication be referred to the Board of Public Utilities. There being_ no objections, such was the order. 26. 28.N/ 29./ From R. E. Taylor, re reclassification of the southwest ocnor of Pearl Street and Encinal Avenue. There being no objection,on the suggestion of Councilman Henning this matter was referred to the proposed meeting of the Committee of the Whole of the City Council with the City Planning Commission. 30.V From the City Manager recommending that the soft drink license of Sam Carlson be revoked. Mr. Latham moved that the recommendation be adopted, seconded by Mr. Brodersen and on roll call carried unanimously. 31. From the City Planning Commission, recommending the reclassification of a lot situated on the east side of Benton Street, 140 feet south of Santa Clara Avenue, to a Residence District, Class 1 3/4. Mr. Latham moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Calcutt and on roll call carried unanimously. From the City Planning Commission, recommending the reclassification of a lot situated on the east side of Broadway, 145 feet, 9 inches, north of Santa Clara Avenue to a Residence District, Class 1 3/4. Mr. Latham moved thatthe recommendation of the City Planning Commission be adopted, seconded by Mr. Calcutt and on roll call carried unanimously. 321 From the Alameda Improvement Club, relative to improvement of certain west end streets, referred to the Committee of the Thole, under date of August 6th, 1929, reported back to the council. Mr. Brodersen moved that the matter be re-referred to the Committee of the Whole and that the matter be continued to October 15th, 1929. The motion was seconded by Mr. Henning and carried. 34.V From S. Blum, re burning of garbage in the rear of 2001 Alameda Avenue. Mr. BluMarlas.present and addressed the council relative to his com- plaint. After discussion, Nr. Henning moved that the matter be referred to the City Attorney, seconded by Mr. Latham and carried unanimously. From H. M. Bradley, Capt. 159th Infantry, requesting permission to use the polio yard as drill grounds on Tuesday evening, when the Council do not meet. Mr. Brodersen moved the request be granted, seconded by Mr. Latham and carried unanimously. HEARINGS: 37 36. In the matter of the removal of the dilapidated building at 1914 Webster Street, Building Inspector Rogers and Fire Chief Steinmetz being sworn by the Mayor, stated under oath that the building was approximately fifty years old; was sagged and dangerous; the roof was open and the chimney leaked; would not be worthy of repair and constituted a fire menace. Mr. Brodersen stated inasmuch as the occupant had now been moved to other quarters, there was not reaspn why the building should hot be declared dilapidated and introduced the following Resolution and moved its adoption: "Resolution No. 1426. Declaring Building at 1914 Webster Street to be a Public Nuisance." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following Ordinances came up for passage and were read by the Clerk; "Ordinance No. New Series. Reclassifying Property. (Santa Clara Avenue, between Broadway and Everett Street' Mr. Calcutt moved that the ordinance as read be adopted. The motion was seconded by Mr. Latham. The council was then addressed by Messrs. Hansen; Dunbar, Milliken and Mrs. Courtney in protest of the passage of the ordinance. Messrs. Gibson and Knoop addressed the council favoring the passage of the ordinance. After further discussion, the motion being put to the members of the council, on roll call the ordinance was adopted and passed unanimously. "Ordinance No. New Series. Reclassifying Prope (North side of Calhoun Street 196 ft. 7 in. Bast of Regent Street. Mr. Calcutt moved that the ordinance as read be adopted. Mr. Latham seconded the motion and on roll call it cwas adopted and passed,unanimously. "Ordinance No. New Series. An Ordinance Authorizing and Providing for the Leasing of 50 acres of Tide and'Submerged lands on the Western waterfront of the City for a Yacht Harbor, initichange for 53 acres more or less, of such land at the Eastern End of the Alameda Airport." City Attorney Locke °ailed attention of the Council to amendments which had been made in the lease in order to clarify the same. Mr. Calcutt moved that the amendments as read by the City Attorney be adopted. The motion was seconded by Mr. Latham and on roll call they were adopted by the following vote:- Ayes: Councilmen Calcutt and Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). The amendments were thereupon declared adopted. Mr. Calcutt then moved that the ordinance as amended be adopted. The motion was seconded by Mr. Latham. Mr. Samuel Wright addressed the council in support of the passage of the ordinance and stated that in view of the seeming impossibility of the council to agree on its passage, the matter should be submitted to a vote of the electorate of the city. The council was also addressed by Byron Lopp, in cupport of the passage of the ordinance, and by A. C. Freese against its passage. Thereupon the motion of the adoption of the ordinanoe being put to the members of the council, upon roll call, was lost by the following vote:- Ayes: Council- ment Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and Henning, (2). Mr. Calcutt then introduced and moved the adoption of 40.1 "Resolution No. 1427. A Resolution Calling, Providing for and Giving Notice of a Special Election to be held in the City of Alaneda, State of California, on Tuesday, the 5th day of November 1929, for the Purpose of Submitting to the Electors of said City a Proposition to Lease Certain Tide and Sub- merged Lands for a Yacht Harbor." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote, to wit: Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilmen Brodersen and. Henning, (2). Absent: None. "Ordinance No. 1 f New Series. An Ordinance Providing for the Erection of Traffic Stop Signals on Both Sides of Versailles Avenue Approaching the Intersection with San Jose Avenue." Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Brodersen and on roll call it was adopted and passed unanimously. 41. "Ordinance No. New Seriee. An Ordinance Providing for the Erection of Traffic Stop Signals on Both Sides of High Street, and Re- Quiring The Drivers of All Vehicles to Come to a Full Stop at Street Intersections before Crossing Said Street." Mr. Calcutt moved that the ordinance as read be adopted, seconded by Mr. Brodersen and on roll call it was adopted and passed unanimously. The following Ordinance were introduced and laid over-under a provision of the Charter:- 43/ 44,t 45. 46./ 47V "Ordinance No. ___ Series. Reclassifying PropeF (East line of Benton Street, 140 ft. South of Santa Clara Avenue, thence southerly 50 ft. x 100 ft.)" "Ordinance No. New Series. Reclassifying Propel:TT— . (East side of Broadway, 145 ft. 9 inches northerly from Santa Clara Avenue, thence northerly 50 ft., Easterly 206 feet; Southerly 50 feet, Westerly 206 feet)." "Ordinance No. ael.e,eNew Series.----- Regulating the Hours of Business of Those Occupatiom and Callings Which are so ConductedAhat the Patrons Thereof are Served with Food or Drink Out-of-doors." Mr. Latham moved that the budget submitted by the City Manager for the fiscal year 1929-30 be approved and filed. The motion was seconded by Mr. Henning and on roll call carried unanimously. Mr. Latham moved that the specifications subrnitted by the City Manager, covering the purchase of an aerial ladder truck, be adopted, and that the City Clerk be in- structed to advertise for bids accordingly. The motion was seconded by Mr. Calcutt and carried unanimously. Mr. Henning moved that the Mayor be authorized to enter into a new contract with the - Alameda Sanatorium for the emergency hospital facilities for a period of three years, commencing October 22nd, 1929, at a cost of $2300a00 per year, and that the City Attorney be instructed to prepare the necessary papers relative thereto, The motion was seconded by Mr. Brodersen and carried unanimously.
