1929-12-17 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF.ALAMEDA, TUESDAY EVENING, DECEMBER 17TH, 1929. The meeting convened at 8 P. M. with Council-president Schaefer :presiding. The roll was called and Councilmen Brodersen, Calcutt, Henning, Latham and President Schaefer, (5) were noted present. Absent: None. The minutes of the regular meeting of December 3rd, 1929 were approved as read. NEW BUSINESS. 1.1 A communication was presented by Mr. E. H. Levy of the East Bay Veterans Hospital Association, requesting the cooncil to pass a Resolution re additional hospital facilities for war veterans. After discussion, Mr. Latham introduced and moved the adoption of 2.V 3. "Resolution No. 1465. Endorsing H. R. Bill 234 Relative to Hospitalization of Veterans." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The Clerk stated that in response to published notice inviting sealed pro- posals, under Resolution of Intention No. 92, N. S., re Park Street lighting, he Was in receipt of four bids. Mr. Latham moved that the bids be opened and read, seconded by Mr. Calcutt and carried unanimously. Thereupon the Clerk opened and read the bids as follows: Taper Tube Pole Co. accompanied by certified check of 2500.00. Amount of bid, 24,100.00. Globe Electric dorks, accompanied by bond. Amount of bid 324,350.00. T. L. Rosenberg Co. accompanied by bond. Amount of bid, 25,275.00. Western States Construction Co., acoornpanied by bond, Amount of bid, 325,000.00. After discussion, Mr. Latham introduced and moved the adoption oof "Resolution No. 1460. Resolution of Award." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the followins vote, to wit:- Ayes: Councilmen Calcutt, Latham and Schaefer, (3). NOGS: Councilmen Brodersen and. Henning, (2). Absent: None. Mr. Henning moved that the Charter Committee be requested to submit a report as to its progress at the next meeting of the Council. The motion was seconded by Mr. Brodersen and same carried unanimously. RESOLUTIONS: Mr. Henning introduced and moved the adoption. of "Resolution No. 1461. Resolution Adopting Plans. (Third Street)" Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Henning introduced and moved the adoption of "Resolution No. 1462. Resolution of Intention, No. 93, N. S. Third Street." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 60/ . Mr; Henning introduced and moved the adoption of "Resolution No. 1463. Resolution Adopting Plans. (Buena Vista Ave.)" Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Brodersen introduced and moved the adoption. of "Resolution No. 1464. Resolution of Intention No-. 94, N. S. Buena Vista Avenue." Mr. Henning seconded the motion to adopt the Resolution and on roll call •it was adopted and passed unanimously. Executed Lease, Alameda Airport, Inc. Executed Lease, Harbor Tug and Barge Co. Recorded Deed,Stephens, et al, re Golf Cburae property. . Quitclaim Deed to Phelan et al re straightening out Calhoun Street. Executed contract, J. J. Groden & Co., re Washington Park bathhouse. Continuation Certificate on bond of Edith Anderson, M. E. L. P. COMMUNICATIONS: The following communications were received: 17.V1 From Warren S. Palmer commending Fire Department. Ordered filed. 18.,/ From Fernside Home Own?. rs Association, relative to congestion on boats. There being no objection, this matter was referred to the City Manager to investigate and report back. 19d rom the City Manager relative to options for property at Franklin Park. After discussion and verbal report by the City Manager, City Attorney Locke rendered an. opinion that should condemnation proceedings be instituted for the purchase of the Alfred W. Pie propertyit would be necessary to include the property owned by Mrs. Bianca Conti Royce and Ernest H. Crook in the same proceedings. Thereupon Mr. Latham moved that it be the sense of the Council that condemnation proceedings be initiated when desirablefori:theo'Turchase Ofothe'othree pieces of prop3rty covered by the City Manager's report. The motion was seconded by Mr. Calcutt and same carried unanimously. 2O/ Wm. J. Locke, tendering his resignation as City Attorney, effective January 1st, 1930. A motion prevailed referring the communication to a meeting, of the Committee of the Whole. Mr. Calcutt moved that at the conclusion of this meeting the Council recess for fifteen minutes, and that the communication be dis- cussed et that time. The motion was seconded by Er. Henning and carried unanimously. 21./ From Building Inspector, E. H. Rogers, relative to building at 2847 Encinal Avenue. In view of the report of the Building Inspector, the petition requested that the building be condemned was ordered filed and the Clerk in- atructed to notify the petitioners accordingly. 22.1 From the City Planning Commission recommending the reclassification of a lot situated on the south ,line of Encinal Avenue, adjoiningaMort on Station to a Business District, Class III., Mr. Latham moved that the recommendation of the planning Commission be adopted, seconded by Mr. Calcutt and carried unanimously. Prom the City Planning Commission, recommending the reclassification of the northeast corner of Morton Street an d Encinal Avenue, to a Residence District Class II. Mr. Henning moved that the recommendation of the Planning Commission be adopted, see onde d by Mr. Calcutt an d carried una niMou sly . From the Alameda. Improvement Club, relative to flooding of streets during recent rains. Mr. Henning moved that no action by the council be taken, relative to this communication owing to the density of the storm. The motion was seconded by Mr. Brodersen and same carried unaniMously. 25. Prom the Alameda Improvement Club, relative to opening of streets in the West End and reclassification of property therein. Mr. Henning moved that the matter be referred to the City Planning Commissi on to report back to the Council. The motion was seconded by Mr. Brodersen and carried unanimously. 24 .N1 26.V ?rom the Alameda Improvement Club, relative to the automobiles being carried on the 4:45 P. Y. ferry from San Francisco. Inasmuch as this communica- tion hed already been covered by action of the council thrOugh a letter from the Ferns ide Home Owners ,Asseciat ion,- there being no objection, the matter was referred to the City ::anager for consideration. 27 .I From the Alameda Im-oravement Club, requesting diagonal parking oa ifebster Street, between Lincoln and Santa Clara Avenues. After discussion, Mr. Latham moved that the City Manager and City Engineer be instructed to provide diagonal parking spaces with a greater slant on Webster Street, from Central Avenue to Pacific Avenue. Mr. Brodersen seconded the mot ion and same carried unanimously. 28.4 29./ An application for a permit to sell soft drinks was received from Fortunato Bonomini. Inasmuch as it had received the approval of the Chief of Police, Mr. Calcutt introduced and moved the adoption of "Resolution No. 1466. Granting a Permit for a License to Sell Soft Drinks." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following Ordinances came up for passage and "Ordinance No. - New Series. Reclassifying Propert ( Clark' s Pottery Works ere read by the Clerk:- Mr. Latham moved that the ordinance as read be adopted, seconded by 'Mr. Calcutt and on roll call it was adopted and passed unanimously. 30. 31.V 32./ 34.1/ 36.v/ "Ordinance No. New Series. Reclassifying Property. (Property known as 2051 Santa Clara Avenue.)" Mr. Calcutt moved that the ordinance as read be adopted, seconded by Mr. JaathaMtand on roll call it was adopted and passed unanimously. "Ordinance No. New Series:— Reclassifying Property. (South Side of Webb Avenue between Everett Street and Broadway.)" Mr. Oaleutt moved that the ordinance as read be .Pdopted,azeconded by Mr. Iatham.111±.. The motion upon the adoption of the ordinance being put to the Council resulted in its being adopted by the following vote:- Ayes: Councilmen Calcutt, Latham and President Schaefer, (3). Noes: Councilman Brodersen, (1). Not voting: Councilman Henning, (1). Absent: None. "Ordinance No. New Series. (Lot, on southeast corner of San Antonio Avenue and Union Street)" Mr. Calcutt moved that the ordinance es read be adopted, seconded by Mr. Latham and on roll call it was adopted and passed by the following vote, to wit: Ayes: Councilmen Brodersen, Calcutt, Latham and President Schaefer, (4). Noes: Councilman Henning, (1). Absent: None. "Ordinance No. New Series. (lot, N. side of Central Avenue, 300 ft. East of Chestnut Street.)" Ur. Latham moved that the ordinance as read be adopted, seconded by Ur. Calcutt and on roll call it was adopted and passed by the following vote, to wit: Ayes: Councilmen Brodersen, Calcutt, Latham and President Schaefer, (4). Noes: Councilman Henning, (1). Absent: None. The following Ordinances were introduced and laid over under a provision of the Charter: "Ordinance No. New Series. ReclassifYing Property. (N. E. Corner Morton Street and Encinal Avenue.)" "Ordinance No. New Series. Reclassifying Property. (S. line of Encinal Avenue, 88 ft. 6 inches East of Morton Street.)" "Ordinance No. New Series. Providing for the Preliminary Consideration of Reports and Other Matter by Members of the Council, Adopting Rules of Order for Conducting Council Meetings and Prescribing the Penalties for Violation of said Ordinance."' 37.V City Manager Hickok called attention to the dangerous condition of the Bay .Farm Island. Bridge and stated that the County was desirous of closing the bridge for a period of thirty days in order to make the necessary repairs, andif it were necessary to keep half of the bridge open to traffic during the contemplated repairs the cost to the county would be considerably greater. After discussion, Mr. Latham moved that in order to assure- the residents of Bay 'arm Island ingress and egree and also police and fire protecti on, that the County be requested to keep one-half of the bridge and roadWay open to traffic et all times. The motion was seconded by Mr. Henning and same carried unanimously. Calcutt moved that the claims as listed be paid, seconded by Mr. Henning and on roll call carried unanimously. The council then recessed for fifteen minutes. Upon reconvening all members of the Council were noted present. 39.4 Mr. Calcutt moved that the resignation of City Attorney Locke be accepted with regrets and that the resignation be accepted to take effect January 31, 1930. Cit'7 Attorney Locke stated that it was his desire to help in every way possible to assist his successor and if it were possible through later arrangements with the League •of California Municipalities the date of January 31st, as mentioned by Mr. Calcutt, would be satisfactory to him. Mr. Latham thereupon seconded Mr. Calcutt's motion to accept the resignation and expressed his regret; as did Mayor Schaefer. The motion carried unanimously. 40.1 Mr. Calcutt moved that the Hon. Edward J. Silver be appointed City Attorney to take effect February 1st, 1930, at a salary of 250.00 per month. The motion was seconded by Mr. Henning and on roll call carried unanimously. There being no further business to transact the Council adjourned to meet in regular session Tuesday evening, January 7th, 1930 at 8 o'clock. Respectfully submitted,
