1930-11-05 Regular CC MinutesREGULAR M1i7TING OF THE COUNCIL OF THE CITY OF ALAMEDA WEDNESDAY EVENING, NOVEMBER 5TH, 1930. The meeting convened at 8 o'clock with Council-president Schaefer presiding. The roll was called and Councilmen Brodersen, Calcutt Hanning, Latham and President Schaefer, (5) were noted present. Absent: None. read. The minutes of the regular meeting of October 21st, 1930 were approved as NEW BUSINESS: 1.N/ Mr. Brodersen reported for the Convention Committee relative to the bills incurred by the committee in charge of the reception and banquet to Alameda High School Alumni World War Veterans, and moved that a sum of $100.00 be appropriated out of the advertising fund to pay for advertising in connection therewith. The motion was seconded by Mr. Latham and on roll call carried unanimously. Mr.Brodersen moved that the name of the Convention Committee be changed to Publicity and Convention Committee to act upon any matters referred to it by the Council. The motion was seconded by Mr. Henning and carried unanimously. 2. v' The Council recessed for the purpose of meeting with the City Planning Com- mission in joint session. Upon reconvening all councilmen were noted present. The Clerk stated that in response to advertised notice to bidders, he was in receipt of numerous bids for grading of the Industrial Highway. Mr. Latham moved that the bids be opened and read, seconded by Mr. Henning and carried. Thereupon the Clerk opened and read the bids as follows:- J. P. Holland, Inc., Certified check, $260.00. Amount of bid, 17i cents per cubic yard. Lee J. Immell, Certified check, $500.00. Amount of bid, 23 cents per cubic yard. W. C. Colley. Certified check, $400.00. Amount of bid, 27 cents per cubic yard. Hutchinson Co. Certified check, $600.00. Amount of bid, 41 cents per cubic yard. Harris-Knapp Co. Certified check, $350.00. Amount of bid 25 cents per cubic yard. L. L. Page, Certified check 0750.00. .Amount of bid, 18.9 cents per cubic yard. W. K. McMillan, Certified check, $500.00. Amount of bid, 36 cents per cubic yard. Paris Bros. Certified check $325.00. Amount of bid, 24 cents per cubic yard. J. Catucci, Certified check,$461.90. Total bid, $4619.00. Mr. Latham moved that the bids be referred to the City Engineer, City Attorney and City Manager for report. The motion was seconded by Mr. Henning and carried unanimously. Thereupon the City Manager and City Engineer recommended the acceptance of the bid of J. P. Holland, Inc., whereupon Mr. Brodersen introduced and moved the adoption of "Resolution No. 1551. Awarding Contract for the Grading of an Industrial Highway along the Southerly line of Tract 39 between the Westerly line of Webster Street and the. Easterly line of Tract 41, City of Alameda." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Henning moved that all checks be returned to the unsuccessful bidders The motion was seconded by Mr. Calcutt and carried unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1552. Transferring $3,539.90 from the Electric Light Fund to the General Fund." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Calcutt introduced and moved the adoption ar "Resolution No. 1553. Transferring $30,000.00 from the Electric Light Fund to the General Fund." Mr. Henning seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1554. Resolution of Intention No. 96, New Series. (Third Street)" Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced and moved the adoption of "Resolution No. 1555. Resolution of Acceptance and Consent to Recordation. (Plummer Property-Sadler School)." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 10.] Mr. ,Calcutt introduced and moved the adoption of "Resolution No. 1556. Authorizing Mayor to Execute Contract for Purchase of Water at the Alameda Municipal Golf Course .11 Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. FILING; The Clerk stated that since the last meeting of the council the following papers had been filed:- High wa.y. Recorded Grant of Easement, Alameda Belt Line to City of Alameda, Industrial Title insurance policy re Industrial Highway. Contract, Alameda Sanatarium and City of Alameda. Affidavit of publication, Notice to Electors. Affidavit of publication, Notice to Bidders for grading Affidavit of publication, Delinquent property sales to City of Alameda. COMONICATIONS: The following communications were received: 17. From Edgar A. Jones, relative to a 2.4 acre piece of property lying east of Lincoln Park, offering to purchase same. Mr. Brodersen moved that Mr. Jones be notified the property was not for sale, and the connunication ordered filed. The motion was seconded by Mr. Henning and carried unanimously. From the League of California Municipalities, re transcript of proceedings. Mr. Brodersen moved that three of the hard covered copies be purchased at a price not to exceed ,2.50 per copy.. The motion was seconded by Mr. Henning and on roll call carried unanimously. 19. From City Attorney Silver, relative to the reclassification of property under Ordinance No. 405, N. S. fronting both sides of Santa Clara Avenue, between Broadway and Everett Street. Mr. Latham moved that the council on its own initiative reclassify the lots in question and that a joint meeting of the Planning Commission and the Council be held for the purpose of a hearing at the next regular meeting of the Council. The motion was seconded by Mr. Henning and carried unanimously. From City Manager Hickok, containing report relative to widening of Park Avenue. The communication was ordered filed without action. From Tucker Investment Company, objecting to the widening of Park Avenue. _Ordered filed. 20 .V 21. 22. 23 24/ From the Secretary of the Council Convention Committee-requesting informa- tion as to the duties of the Committee.. Mr. Henning moved„that the communication be referred to the City Attorney for answer and that the City Attorney define the duties in connection therewith.. The motion was seconded by Mr. Latham and carried unanimously. From the Convention Committee relative to bills of the Alameda High School,Alumni War Veterans Banquet. was covered by former motion of Councilman Brodersen, the filed. Mr. Calcutt moved that the Mayor be authorized t thanks to the 1-b6.r Tug and Barge Company for courtesies boat on an inspection tour of the harbor. The motion was and carried. incurred upon the occasion Inasmuch as this matter communication was ordered o send a communication of extended and use of a tug seconded by Mr. Brodersen 25. From L. L. Page requesting permission to improve Bay Island Avenue, under private contract. Mr. Latham moved that the request be granted, seconded by Mr.. Calcutt and carried unanimously. 26.1 From Lucien C. Finch, relative to increase of transportation ferry rates and decrease of service in Alameda. After discussion, Mr. Brodersen moved that the City Manager be requested to investigate the matter of traffic conditions between San Francisco and Alameda relative to passengers and autos and that a traffic count be made for certain periods during the next Sixty days. The motion was seconded by Mr. Henning and on roll call carried unanimotsly. 270/ From George Harman, Chairman of a committee representing Alameda Chapter No. 8, Disabled Veterans of the World War, relative to place of meeting. Mr. Latham moved that the matter be referred to the City Manager and City Attorney to confer with the County Board of Supervisors, in an endeavor to obtain the relief requested. The motion was seconded by Mr. Brodersen and carried unanimoutIy. BEARINGS: 28/ In the matter of the reclassification of the northeast corner of Oak Street and Santa Clara Avenue, the Secretary,of the City Planning Commission stated tt.t as a result of a hearing between the Planning Commission and the members of the Council, the City Planning Commission unanimously recommend to the council the reclassification as requested. Mr. Henning moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Latham and carried unanimouSly. 29.1 A petition complaining of the keeping and maintaining of dogs and the building of kennels at the northeast corner of Fourth Street and Central Avenue, signed by fifty-one citizens, was presented and read to the Council. The council was addressed by George H. Noble and Fred Nietenstein in support of the petition. After discussion, Mr. Henning moved that the matter be referred to the City Manager and City Attorney for action, tending towards the abatement of the nuisance, and if this cannot be done otherwise, the City Attorney be instructed to prepare an ordinance covering the matter. The motion was seconded by Mr. Latham and same carried unanimously. 30./ An application for a soft drink license was received from George Whitson, Mr. Latham introduced and moved the adoption of "Resolution No. 1557. Granting a Permit for a License to Sell Soft Drinks." Mr. Calcut seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. ORDINANCES FOR PASSAGE: The following ordinances came up for passage:and were read by the Clerk:- 32. "Ordinance No. New Series. Amending Secti.ms 401,802,1102,1202,1302,2202, 3804, and 3806 of the Uniform Building Code of 1927 Adopted by Ordinance No. 387, New Series." Mr. Latham Moved that the ordinance asread he adopted, secondedlbT:Mr. Brodersen and on roll call it was adopted and passed unaniMously. "Ordinance No. New Series. Authorizing Annual Vacations for City Employees, and Repealing All Ordinances in Conflict Herewith, Including Ordinance No. 314, N. S." Mr. Latham moved that the ordinance as read be adopted, seconded by Mr. Brodersen and on roll,call it was adopted and passed by the following vote:- Ayes: Councilmen Broderaen, Henning and Latham, (3). Noes: Council-president Schaefer and Councilman Calcuttl.(2). Absent: None. ORDINANCES FOR INTRODUCTION: 34. 5. 36.41' 37. 38. The following ordinances were introduced and laid over under a provision of the Charter:- "Ordinance No. New Series. Amending Section 77, Article 2, Chapter III, of Ordinance No. 1, New Series, Known as the Municipal Code of the City of Alameda, Approved January 14, 1913." "Ordinance No. New Series. Amending Ordinance No. 54, N. S., relating to Publication of Notice When Taxes Shall Become Delinquent, and Repealing Sections 76,78, 79, 80, 81, 82, 8b, 86, 37,9?, 95, 96 and 97, Article 2, Chapter III, of Ordinance No. 1, New Series, Known as the Municipal Code of the City of Alameda, Approved January 14,1913." "Ordinance No. New Series. Reclassifying Proparty. . (N. E. corner Santa Clara Ave. & Oak Street.)" Mr. Brodersen moved that the City Manager be granted sufficient time to attend a meeting of the International City Managers' Association at Clevelana,Ohio, and that the City Clerk be appointed City Manager pro tem , during his absence. The motion was seconded by Mr. Henning and carried unanimously. City Engineer Hamilton report as to condition of sidewalks in the West End. Mr. Latham moved that the City Engineer be authorized to communicate with the property owners to have the sidewalks installed within thirty days or that the matter would be taken up tinder public proceedings. The motion was seconded by Henning and carried unanimously. Mr. Brodersen moved that in the future all matters presented to the council should be presented through the City Clerk's office. The motion was seconded by Mr. Henning and the same carried unanimously. Mr. Henning stated he wished to vote for the payment of all claims with the exception of those of the East Bay Municipal Utility District.
