1931-04-28 Special CC MinutesSPECIAL MEETING OF THE COUNCIL OF TEE CITY OF A
TUESDAY EVENING, APRIL 28th, 1931.
The meeting convened at 8 o'clock with Qouncil-preeident Henning presiding.
The roll was called and Councilmen Brodersen, Leydecker, Murray, Schaefer
and President Henning, (5) were noted present. Absent: None.
The Clerk read the call for the special meeting, attached to which was the
affidavit of delivery to the councilmen's addresses. Ordered filed.
The Council then proceeded with the hearing relative to the recent reclassi-
fication of certain property on the north side of Fernside Baalevard, between
Versailles Avenue and High Street. Communications in support of the reclassifi-
cation were read from the Ownes-Illinois Glass Company?) Alameda Chamber of
Commerce, Fred T. Wood. Company, North Side Protective Club, Alaska Packers Assn.,
Encinal Terminals, American Foundry Company, Bethlehem Shipbuilding Corporation,
Rosefield Packing Company, Harbor Tug and Barge Company, Boyle Manufacturing
Company, Pacific Coast Aggregates, Inc., J. H. Baxter & Company and the General
Engineering and Drydock Company. A communication and petition of protest was
received from residents and tax payers of the Fernside Tract. Also, a petition
of protest was received and read from the Veterans of Foreign Wars. A statement
was made by Mayor Henning as to the reason for calling the special meeting of
the Council and then called for general discussion. Mr. A. C. Keane, representing
the Oakland Bank, presented to the Council a communication from that institution,
wherein they agreed to set aside in escrow the sum of $4,000.00, as a fund to be
used in defraying necessary expenses of a referendum election; this sum to be
paid to the City Treasurer immediately upon the council calling said election
and that the legally requisite referendum petitions demanding the sane are filed
with the City Clerk, not later than May 7th, 1931. Mr. J. Bettencourt addressed
the council on behalf of the protestants present, who was immediately followed
by Messrs. A. C. Keane, F. J. Malley, F. Neville and. E. G. Ryder, in support of
the ordinance as passed. Mr. Fred. B. Mellmann made the closing argument for the
protestants. The Council then recessed.
. Upon reconvening), all members of the Council were noted present, and Presi-
dent Henning made the following statement on behalf of the Council, to thase
present:- "If we repeal'the ordinance we are faced with an initiative election at
the city's expense, or deny the will of the people. If we do not repeal the
ordinance we are faced with a referendum election at the owner's expense or
no expense to the city. Both sides desiring an election, we choose the least
expensive to the city and in line with our expression we will submit the proposal
to the voters to ascertain the will of the people."
There being no further business to transact, the Council adjourned to meet
in regular session, Tuesday evening, May 5th, 1931, at 8 o'clock.
