ADOPTING A SUBSEQUENT MITIGATED NEGATIVE
DECLARATION AND ADOPTING A MITIGATION MONITORING
AND REPORTING PROGRAM FOR THE DEL MONTE
WAREHOUSE PROJECT
WHEREAS, TL Partners 1, LP ( "the Developer") is currently in contract to
acquire approximately 11.06 acres of real property located at the northeast
corner of the intersection of Sherman Street and Buena Vista Avenue and
commonly known as the Del Monte Warehouse; and
WHEREAS, the Developer proposes to redevelop the Del Monte
Warehouse building and construct several new structures on the site; and
WHEREAS, the project entails modifications to the proposed conceptual
redevelopment of the Del Monte Warehouse Building analyzed in the previous
Northern Waterfront General Plan Amendment EIR (GPA EIR) (State
Clearinghouse No. 202102118); certified by the City of Alameda in 2008; and
WHEREAS, the proposed project would include a combination of
residential and commercial uses that would be housed in the Del Monte
Warehouse building and other new structures to be built on the site, including up
to 414 housing units and 30,000 square feet of commercial space; and
WHEREAS, the City prepared an Initial Study /Subsequent Mitigated
Negative Declaration (IS /SMND) evaluating the potential effects of the proposed
redevelopment of the Del Monte Warehouse Project; and
WHEREAS, the IS /SMND was circulated for comment in April of 2014,
and
WHEREAS, the Planning Board held a duly noticed public hearing to
receive public testimony on the IS /SMND on September 22, 2014, examined
pertinent maps and documents, and considered the testimony and written
comments received and recommended approval of the IS /SMND to the City
Council; and
WHEREAS, the IS /SMND was presented to and independently reviewed
and considered by the City Council on December 2, 2014.
NOW, THEREFORE, BE IT RESOLVED that the City Council finds that
the IS /SMND and Mitigation Monitoring and Reporting Program have been
prepared for the project in compliance with CEQA, Public Resources Code
section 21000 et seq., the State CEQA Guidelines, California Code of
Regulations, title 14, section 15000 et seq., and all applicable state and local
guidelines, and reflects the independent judgment of the City.
NOW, THEREFORE BE IT FURTHER RESOLVED that the City Council
adopts the IS/SMND and Mitigation Monitoring and Reporting Program for the
Project, attached hereto as Exhibit A.
I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly adopted and passed by the Council of the City of Alameda in a
regular meeting assembled on this the 2nd day of December, 2014, by the
