1925-02-03 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA,
TUESDAY EVENING, FEBRUARY 3rd, 1925.
The meeting convened at 8 o'clock with Council-president Otis presiding.
The roll was called and Councilmen Latham Neiss, Probst and. President Otis, (4)
were noted present. Absent: Councilman Tilden, (1).
The minutes of the regular meeting of January 20th, 1925 were approved as read.
The following were received and filed:
1.1 Bond of F. E. McNamara, as Clerk of Justice Court.
2.V Affidavit of publication Notice of Hearing re Spur Tracks on San Jose
Avenue.
Affidavit of Publication, Notice inviting sealed proposals, Resolution of
Intention No. 74, N. S. (Bay Island Avenue).
4•1/ Affidavit of publication, Notice of Public Works under Resolution of In-
, ention, No. 75, N. S. (Closing Benton Street, etc.)
5.4 Grant of Easement, N. and Emma Lena to the City of Alameda, strip of land
/for sidewalk purposes at the northeast corner of Encinal Avenue and Oak Street.
Reports of the Municipal Electric Light Plant for the months of October and
November, 1924.

120/ Mx. Latham introduced and moved the adoption of
"Resolution No. 842.
Transferring $2,702.06 from the Electric Light Fund
to the General Fund."
Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was adopted and
passed unanimously.
13. / Mr. Probst introduced and moved the adoption of
"Resolution No. 84
Granting a Permit for a License to Sell Soft Drinks."
Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and
passed unanimously.
14. Mr. Neiss introduced and moved the adoption of
"Resolutinn No. 844.
Providing for the Submission of an Initiative
Pension Ordinance."
Mr. Latham seconded the mbtion to adopt the Resolution and on roll call it was adopted
and passed unanithously.

15.V' Mr. Probst introduced and moved the adoption of
"Resolution No. 845.
Providing for Election Officers."
Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was
adopted and passed unanimously.
The following communications were received:
16.V/ From the Alameda Housewives League requesting appointment of a Milk
Commission to investigate the milk situation of the East Bay. Mr. Probst moved that
the matter be referred to the Committee of the Whole, seconded by Mr. Latham and
carried.
17.v From the City Planning Commission in the matter of the opening of Webb
Avenue through to Broadway. After discussion, Mr. Neiss moved that the matter
be remanded back to the Planning Commission for the purpose of holding public
hearings. The motion was seconded by Mr. Probst and carried unanimously.
18.V/ From the Alameda Improvement Club, re future reclassifications under
zoning ordinance. Ordered filed.
19.V From City Manager Hickok, re refuse disposal. Ordered filed.
20.V/ From City Manager Hickok re dredging operations at Neptune Beach.
Mr. Latham moved that the report of the City Manager be adopted, seconded by Mr.
Probst and carried.
21.V From City Manager Hickok, re shelter station at Central Avenue and
Webster Street. Mr. Latham moved that the City Manger's report be adopted
and that the City Manager communicate with the Railroad. Commission as per the
suggestion contained in the report, seconded by Mr. Neiss and carried.
22.v' From Councilman Tilden, requesting additional leave of absence. Mr. Neiss
moved that a further extension of sixty days be granted, seconded by Mr. Latham
and carried.
23,/ From the Treasurer, Auditor and Mayor, re rate of interest. Ordered
filed.
24.
From Hon. H. R. Spence, acknowledging receipt of Resolution No. 838.
O7aered filed.
2 . From the Board of Public Utilities, re state tax for publicly owned
utilities. After discussion, Mr. Neiss moved that the City Attorney prepare a
Resolution in accordance with the request, seconded by Mr. Probst and carried.

From City Attorney Locke re decision on Government Island and Londerman
cases. Ordered filed.
27.V From various residents of Bay Farm Island requesting adequate fire
protection. Mr. Probst moved that the matter be referred to the City Manager,
se onded by Mr. Latham and carried.
28. From Mrs. T. Hardy, requesting postponement of further action until
March 1st, 1925, re removal of delapidated building at 1727 Lincoln Avenue.
Mr. Latham moved that the request be granted, seconded by Mr. Probst and carried.
29. Application from Key System Transit Compan7 for revocation of permit and
consent to abandonment of service. Ordered filed.
30.j Mr. Latham introduced and moved the adoption of
"Resolution No. 846.

31.V A second petition of protest was received under Resolution of Intention
No. 74, N. S. (Improvement of Bay Island Avenue). Mr. A. P. Stiefvater, repre-
senting various property owners addressed-the Council in support of the petition,
as did. Messrs. Benjamin and Lowell, representing the Stanford University. After
discussion Mr. Probst moved that the matter lay over until the regular meeting
of the Council to be held February 17th, 1925, at which time bids would be
received, seconded by Mr. Latham and carried.

In the matter of the change of grade of Webster Str
et Mr. Probst moved that all
former action by the Council be rescinded, seconded by Mr. Latham and on roll
call carried unanimously.
33j The Clerk stated that the final day of protest under Resolution of Intention
No. 75, N. S. (Closing Benton,Jay,etc. Streets) adjoining the Alaska Packers
Association property, had expired and that no protests had been received. There-
upon Mr. Probst introduced and moved the adoption of
"Resolution No. 847.
Resolution No. 75 NewSeries, Closing Benton Street
from the North Line of Buena Vista Avenue Northerly
to the Marshland Line, also Portions of Eagle Avenue
Adjacent to and South of said Marshland Line between
Benton and. Arbor Streets as said. Arbor Street was
Formerly Laid out, also Jay Street Northerly from
the Northerly Line of Buena Vista Avenue to the Marsh-
Land Line."
Mr. Neiss seconded the motion to adopt the Resolution and on roll call it was
/adopted and passed unanimously.

Regulating the Periods of Absence from Duty in
Case of Sickness or Injury."
came up for passage and was reqd by the Clerk. Mr. Latham moved that the Ordinance
be adopted, seconded by Mr. Probst and on roll call it was adopted and passed
unanimously.

Amending Section 504 of the Municipal Code by
Increasing the License Fee or Tax on Fortune
Tellers, Phrenologists, etc."
came up for passage and was read by the Clerk. Mr. Neiss moved that the ordinance
be adopted, seconded by Mr. Probst and on roll call it was adopted and passed
unanimously.

An Ordinance granting to The Atchison, Topeka and.
Santa Fe Railway Company, a railroad corporation, and
The Western Pacific Railroad Company, a railroad
corporation, and to each of them and to the successors
and assigns of each of them, the right to use portions
of certain streets, highways and properties within the
City of Alameda for the purposes of the construction,
maintenance and operation of lines of railroad."

An Ordinance granting to Alameda Belt Line, a rail-
road corporation, and its successors and assigns, the
right to use portions of certain Streets, Highways
and Properties within the City of Alameda for the Purpose
of the Acquisition, Construction, Maintenance and Opera-
tion of a Belt Line Railroad to Serve the Industrial
Area and Waterfront of said. City of Alameda, and the
Right to Acquire, Construct, Maintain and Operate such
Belt Line Railroad upon, along, and across designated.
Portions of said. Streets, Highways,and Properites.T'
came up for passage and was read by the Clerk. Mr. Probst moved that the ordinance
be adopted, seconded by Mr. Latham and on roll call itwasadopted and passed
-unanimously.
A Bill entitled
"A Bill
For Ordinance No. New Series.
An Ordinance Providing for the Licensing of Peddlers,
Defining the Same, Providing a Penalty for the
Violation Thereof and Repealing any and all Ordinances
In conflict therewith."
was introduced and laid over under a provision of the Charter.
39.v/ Hon. T. C. West was present in the Council Chamber and addressed the
Council relative to proposed amendments to the city charter, suggesting
that elections held in the City of Alameda be advanced thirty days in order
to permit any amendments to the city charter voted upon by the people to receive the
immediate approval of the legislature. After discussion, Mr. Latham moved that
the City Attorney be instructed to prepare the necessary amendment to go on the
ballot at the coming municipal election to be held March 10, 1925, seconded by
Mr. Neiss and carried.
The following claims having been approved by the proper officials were
listed by the Clerk:- General Departments, $1,689.24; Police Department, $178.81;
Fire Department, $396.17; Street Department, $2,088.45; Health Department, $172.06;
Recreation Department, 4577.69; Store Department, $55.93; Council Relief Fund, $84.40;
Health Centr Department, $131.08; Electric Light Fund, $3,519.65; School Construction
Fund, $8,613.00; Pension Fund, $785.00; Initiative Relief Fund, $138.50 and Com-
pensation Insurance Fund, $5.00.

roll call, carried unanimously.
Mr. Latham moved that when the Council adjourned, it do so to meet in regular ad-
journed session Tuesday evening, February 10th, 1925, at a o'clock, P.M., seconded by
Mr. Probst, and carried.
There being no further business to transaot, the Council adjourned, to meet in
regular adjourned session, Tuesday evening, February 10th, 1925, at 8 o'clock, P.M.
