1925-04-21 Regular CC Minutesii2(.1131,/ R ME'',TING OF THE COUNCIL OF ?HE CITY OF iLALED?, TUESDAY EVENING , AP.RIL 21, 1925. The meeting convened at 8 o'clock p. m. with Council-president Otis presiding. The roll was called and Councilmen Latham, Neiss, Noble -Probst and President Otis, (5) were noted present. Absent: None. The minutes of the regular meeting of April 7th, 1925 were approved as read. The following papers were ordered filed: Various applications to sell soft drinks. Affidavit of posting Notice of Improvement, Resolution of Intention No. 77, N. S. (Opening Nest End Streets), 3.V Affidavit of publication Resolution of Intention No. 77, N. . (Opening West End Streets). 4,V' 7./ 8 9 Affidavit of posting Notices inviting sealed proposals, Resolution of Intention No. 76, New Series. (Calhoun Street). Oath of office, Ernest R. Neiss, as Counci Oath of office, George H. Noble, as Councilman. Oath of office, Frank Otis, as Councilman. Oath of office, Leon H. .der, as Treasurer and Tax Collector. Oath of office, F. J. Croll as Auditor and Assessor. 10.v' President Otis relinquished the chair and the same was taken by City Clerk, W. E. Varcoe, who proceeded to read the following sections of the Charter:- Article II, Section 1, Section 6, and Section 5, Subdivision 4. Nominations were then called for President of the Council, for the term expiring the third Monday in April, 1927, Mr. Latham moved that Councilman Frank Otis be nominated as president of the Council and ex-officio Mayor, seconded by Er. Probst. Mr. Neiss moved that the nominations for President be closed and that the Clerk be instructed to cast the ballot for Mr. Otis, seconded by Er. Probst and carried unanimously, and such was the order. The Clerk stated that nominations for Vice-president were in order for the term expiring the third. Monday in April, 1927. Er. Neiss nominated Mr. Probst as Vice-president, seconded by Mr. Latham. Ex. Noble moved that the nominations be closed and that the Clerk be instructed to cast the ballot for Mr. Probst. The motion was seconded by Yr Latham and carried unanimously, and such was the order. Mr. Otis then resumed the chair. The following communications were received: From the City Planning Commission, contain o -ion re industrial development of naval base site. Ordered filed. 12. From the City Planning Commission, re budget appropriation of 125.00 for the year 1925-26. Er. Latham moved that the communication be referred to the meeting of the Committee of the Whole, seconded by Mr. Probst and carried. 13. rom the City Planning: Commission, re installation of curbs and gutters throughout the City. Mr. Neiss moved that the communication be referred to a meeting- of the Committee of the Whole seconded by Mr. Probst and carried. 14./ From the Alameda Chamber of Commerce re concrete curbing. Mr. Neiss moved that the coMmunication be referred to a meeting of the Committee of the Whole., seconded by Mr. Probst and carried. 15»' From the Alameda Chamber of Commerce, re additional traffic officers. Mr. Probst moved that the communication be referred to a meeting of the Committee of the Whole, seconded by Mr. Neiss and carried. 16.1/ From the Alameda ImprOvement.Clubnre acquiring a park and playground for the west end. Er. Latham moved that the communication be referred to a meeting of the Comrittee of the Whole, seconded by Er. Probst and carried. 17.V/ From the Alameda Improvement Club re turn-out switches on San Jose Avenae. The communication was ordered filed. 18.V/ Pacific and Buena Vista Avenues. The communication. was ordered filed. 19./ From the Alameda Improvement Improvrnent Club, re the setting aside of 2,000 acres of the naval base site for commercial and industrial development. Ordered filed. 20o/ From City Attorney Locke, together with a copy of a letter from the Railroad Commission, requesting action in the matter of additional turn-out switches on the San Jose Avenue car line. After discussion, Er. Noble moved that the Key System Transit Company be denied the right to install additional switches and that the Council request the said Company to remove the cars and tracks and to operate in lieu thereof motor busses, along the right of way now held from Park Street and San Jose Avenue to 9th Street and Santa Clara Avenue. The motion was seconded by Mr. Neiss and carried unanimously. From the Alameda Improvement Club re paving of Concordia Street, between April 21 21.V Copy of Resolution passed by the Oakland City Council Agreeing in cooperating with the City of Alameda, to cause the removal of buildings on Government Island when requested by the United States District Engineer. Ordered filed. 22. Communication and opinion of City Attorney Looke, concerning request of J. H. Baxter & Co., for permission to construct a petroleum tank under plans not authorized by the provisions of our present ordinances. After discussion, Mr. Latham moved that inasmuch as the installation referred to had met with the approval of the Fire Chief and City Manager, the request be granted, seconded by Mr. Probst and carried unanimously. 23.V From Hutchinson Company requesting permission to grade, curb, gutter and macadamize Washington Street, from the western line of Mound Street westerly, under private contract. Mr. Probst moved that the requested be granted, seconded by Yr. Noble and carried unanimoUSly. 24d Mr. Latham introduced and moved the adoption of "Resolution No. 888. Granting a Permit far a License Sell Soft Drinks." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 25.'/ The Clerk stated that he was in receipt of a petition signed by residents and property owners living in the vicinity of 1622 Broadway, requesting an investigation as to the sanitary condition of a stable located at the place mentioned, stating thatthe building was in'a delapidated condition and is bei used as a stable for a large nanber of horses and requested that the buildin be removed. Mr. Latham moved that the petition be referred to the City Manage with power to act, seconded by Mr. Probst and carried unanimously. 26.%i The Clerk stated that the time had arrived for the opening of bids under Resolution of Intentipn No, 76, N. S. (Calhoun Street), and that one bid had been received. Mr. Probst moved that the bid be opened and read, seconded by Er. Latham and carried. (Calhoun Street) Mr. Noble seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 27.4 A Bill entitled "A Bill For Ordihance No. New Series. Regulating the License Fee on Theaters, Moving Picture Shows and Such Like Places of Amusement." came up for passage and was read by the Clerk. Mr. Probst moved that the ordinance be adopted, seconded by Mr. Noble, and on roll call it was adopted and passed unanimously. A Bill entitled "A Bill For Ordinance No. New Series. Reclassifying Property. (West side of Park St. 95 ft. inches northerly from Eagle Avenue.) came up for passage and was read by the Clerk. Mr. Latham moved that the ordinance be adopted, seconded by Mr. Probst and on roll call it was adopted and passed unanimously. 29.4 A Bill entitled "A Bill For Ordinance No. New Series. An Ordinance Providing for _e Licensing of Peddlers, Defining the same, Providing a Penalty for the Violation Thereof, and Re- pealing any and all Ordinances in Conflict therewith." 300/ A Bill entitled "A Bill For Ordinance No. . _New Series. He Reclassification of Portion of Webster Street." was introduced and laid over under a provision of the charter. 310V A Bill entitled 32 11.4 Tor "A Bill Ordinance No, New Series. Extending Fire Limits, No. 1 on Park Street and Fire Limits No. 2 on Webster Street." was lntroduced and laid over under a provision of the charter. A Bill entitled For "A Bill Ordinance No. New Series. Providing for the Licensing of Certain Peddlers, providing a penalty for the Violation thereof, and Repealing any and all ordinances in conflict Therewith." 1925. was introduced and laid over under a provisions of the Charter. 33.V A discussion was held as to the advisability of opening Calhoun Street throagh from Regent St. to Broadway. Mr. Latham moved that the owner of the property in question, Mr. Magnus Hollested, be invited to attend the next meeting of the Committee of the Whole to be held at 7 o'clock., Tuesday evening, Eay 5th, for the Purpose of further discussion. The motion was seconded by Mr. Probst and ; carried unanimously. 34:1 Mr. Harold 3. Jacobs, one of the owners of the premises at 1518 Bay Street, addressed the counail and renested the Council's sugnature to a petition for the reclassification of this property, from a Residence District, Class I, to a Residence Distriat, Class II, stating that in order to acquire the number of square feet necessary to the granting of the petition, the school property owned by the City of Alameda would have to be taken into consideration. Mr. Latham moved that the Mayor be instructed to sign the petition on behalf of the city for the reclassification, seconded by Mr. Neiss and carried. 35V Er. Lochiel M. King addressed the council in the matter of depositing dredged slickens on Government Island from the Estuary, and suggested the laying of a pipe lince across the City of Alameda to carry the slickens for the reclama- tion of the south and east shore tidelands east of Perk Street. After discussion, Er. Latham moved that this be referred to the Government Island Committee consisting of Messrs. King, Locke , Hickok and Hamilton, to report back at a later date seconded by Mr. Noble and carried. 36.V City Maier Hickok stated thLt, the Encinal Terminals had advised him that the closing of the Webster Street bridge to navigation for a period of time in the morn- ing and in the afternoon, was working a hardship upon the Encinal Terminals, and after discussion, Er. Neiss moved that the City Manager take up with the proper • authorities the matter of having these restrictions removed to the extent that the bridge may be opened to permit ocean-going vessels of 3,000 to capacity or over to pass through. The motion was seconded by Er. Probst and carried ananimoasly. 374/ City Manager Hickok brought to the attention of the council the if)tter- of ac- quiring 2.47 acres of tideland owned by Mrs. Betty H. Norris, at a cost of 32500.00 adjoining Washington Park for park purpo ses. Mr. Latham moved that the matter be referred to a meeting of the Committee of the Whole, seconded by Mr. Neiss and carried. 38.V/ City Engineer Hamilton stated that he bad exhausted all efforts to come to an agreement with the Bruzzone interests in the matter of opening and extendintr Eagle Avenue, from the railroad right of way, west to Webster Street, and submitted maps of a proposed assessment district to cover the work under public proceedings. After discussion, Mr. Latham moved that the City Attorney and City Engineer prepare the necessary papers for streEt opening proceedings, seconded by Mr. Neiss and carried unanimously.
