1922-06-06 Regular CC Minutes1/ REGULAR MEETING OF THE COUNCIL OF TEE CITY OF ALAMEDA, TUESDAY EVENING, JUNE 6TH, 1922. The meeting convened at 8:10 P.M. with Council-p e ident Otis presiding. The roll was called and Councilmen Adams, Latham, Probst Tilden and President Otis, (5) were noted present. The minutes of the regular meeting of May 16th, 1922 were approve& as read. Prob st introduced the falowing Resolution and moved its adoption: "Resolution Vo. 487. Transferring 026,900.00 from the luunicipal Electric Light Pund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 488. Transferring 2369.19 from the Electric Light Fund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 489. Rescinding. Resolution Po. 484, "Transferring 01500.00 from the Electric Light Fund to the Franklin Park Fund." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 490. Transferring 1500.00 from the Electric Light Fund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No • 491. Creating the "Franklin Park Fund" and Transferring "1500.00 from the General Fund to the Franklin Park Fund." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Lr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 492. Rescinding Resolution DO. 483. "Transferring 83500.00 from the Electric Light Fund to the Health Center Fund." June 6th, 1922. hr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 493. Transferring 03500.00 from the Electric Light Fund to the General Fund." Mr. Adams seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Latham introduced the following Reso1uiion and moved its adoption: "Resolution No. 494. Creating the "Health Center Fund" and. Transferring l'i33500.00 from the General Fund to the Health Center Fund."' Mr. Probst seconded the motion to adopt the Resolution And on roll call it was adopted and passed unanimously. 9/ mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 495. Transferring 7,535.00 from the General Fund to the Franklin Park Fund." Mr. Tilden seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 10/ mr. Adams introduced the following Resolution and moved its adoption: "Resolution No. 496. Transferring 5,57O.00 from the General Funa to the Park Purchase Fund." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was ai)pted and passed unanimously. 11/ ivir. Tilden introduced the following Resolution and moved its adoption: "Resolution No. 497. Resolution to Exercise Option on Landsberger Property." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 12 \I ivir. Latham introduced the following Resolution and moved its adoption: 14 Resolution No. 498. Resolution to Exercise Option for Addition to Washington Park." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 499. Authorizing ilayor to Execute Lease." kr. Tilden seconded the motion to adopt the Resolution and on roll call it was adppted and passed uhanimously7. hr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 500. Authorizing Mayor to Sign Petition for Redistricting." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. June 6th, 1922. 15 The Clerk stated that he was in receipt of a petition for the reclassifi- cation of the property situated at 2850 Jackson Street, from a Class I, Residence District, to a Class II, Residence, District; that notices had been posted in accordance with Ordinance No. 144, New Series, and amendments thereto and that no protests had been received. There being no objectors present, hr. Proly't introduced the following Resolution and moved its adoption: "Resolution No. 501). Reclassifying the Property Situated at 2850 Jackson Street to a Class II, Residence District." Mr. Latham seconded the motion to adopt the Resolution and on roll cal it was adopted and passed unanimously. 16" The Clerk stated that he was in receipt of a petition for the reclassification of the property situated at 1724 Santa Clara Avenue, from a Class 11, Residence District, to a Class IV, District, permitting the establishment of a kindegarten; that notices had been posted in accordance with Ordinance No. 144, New Series, and amendments thereto and that a letter of protest signed by Peter S. Kartinoni had been received and which was read. kr. L. Hazzard, the petitioner, Gerald Beaumont, Mrs. Emma Burke and kr. 0. H. Tenney, addressed the Council in favor of the proposed change. kr. kartinoni addressed the Council in protest. After discussion, a Bill entitled. For "A Bill Ordinance No. New Series, Reclassifying Property Situated at 1724 Santa Clara Avenue, to a Class IV, Kindegarten District.'1 was introduced and laid over under a provision of the charter. Lr. Tilden moved that it be the sense of the Council that the Bill be passed at the next regular meeting of the Council, seconded by kr. Latham and carried. The Clerk stated that he was in receipt of a petition for the reclassification of a portion of the lot on the southeast corner of Oak Street and. Santa Clara Avenue from a Class III District to a Class V District; that notices had been posted in accordance with Ordinance No. 144, New Series, and amendments thereto, and that no objections had been received. kr. E. M. Shaw, representing the owners of the property and kr. D. J. Sinclair, representing the Shell Company, were present. There being no objectors present in the Council Chamber, A Bill entitled "A Bill For Ordinance No. New Series. Reclassifying Portion of Lot an the Southeast corner of Oak Street and Santa Clara Avenue to a Class V District." was introduced and laid over under a provision of the charter. kr. Latham moved that it be the sense of the Council that this ordinance be passed at the next regular meeting, seconded by lur. Tilden and carried. The Clerk stated that he was in receipt of a petition for the reclas cation of the lot situated on the northwest corner of Oak Street and Lincoln Avenue from a Class II, Residence District, to a Class IV, Church District; that notices had been pcsted in accordance .7ith Ordinance No. 144, New Series and amendments June 6th, 1922. his proposed plans. itr. A. kathebat and others were present in the Council Chamber and protested against the granting of the peititon. After discussion, Mr Tilden moved that the application be denied, seconded by kr. Probst and on roll call carried by the following vote: Ayes: Councilmen Latham, Probst, Tilden and. President Otis, (4), Noes; Councilman Adams, (1). Absent: None. The following were received: Igy// Oath of office of Clyde P. Guy, as police officer. Ordered filed. 20v/ Certificate of the City Clerk that no objections were filed re Resolution of Intention No. 63, New Series. Ordered filed. 21/ kr. Probst introduced the following Resolution and moved its adoption: "Resolution i■o. 502. • Resolution Ordering the Work (Res. of Int.o. 63,E.S.)" Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 22/ Lir. Adams introduced the following Resolution and moved its adoption: "Resolution No. 503. Commending Patrolman Charles Edward Keyes."' WHEREAS, on July 11, 1892, Charles Edward Keyes, entered the police force of the city of Alameda as patrolman, and although two years ago he was entitled to retire on a pension he did not do so, preferring to attend to his duties as an officer until Lay 30, 1922, on which day he finally withdrew from his employment; and. WHEREAS, during this long period of almost a generation, his service to the municipality was constant, faithful and dis- cerning, and his record excellent, NOW, THEREFORE, in recognition of these facts, be it RESOLVED, by the Council of the City of Alameda, that high commendation of Patrolman Charles Edward Keyes be recorded on its minutes and that the good wishes of the council and every member thereof go with him in his retirement. kr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 504. Ratifying Lease Regarding Franklin Park." Mr. Latham seconded the motion to adopt the Resolution aril on roll call it was adopted and passed unanimously. Ordered filed. 26/ From the Federation of kothers' Clubs of Alameda, re putting into effect the curfew law. Mr. Latham moved that the matter be referred to the Committee of the Miele, seconded by Mr. Probst and carried. 27/ From Wm. J. Locke, City Attorney, re proceedings now pending on ownership Government Island. Ordered filed. 28(/ From 4m. J. Locke, City Attorney, re validity of an ordinance requiring butcher shops to be closed on Sunday. Ordered filed. June 6th, 1922. 01 From Wm. E. Varcoe, City Clerk, requesting three weeks vacation to leave the State. Mr. Latham moved that the request be granted, seconded by Mr. Probst and carried. 314 From Wm. J. Locke, City Attorney, requesting two weeks vacation to leave the State. Dir. Probst moved that the request be granted, seconded by -Mr. Lath and carried. 32 A Bill entitled For "A Bill Ordinance No. New Series. •■•••••■• An Ordinance Regulating the Hour a of Business When and The PlacesTof7Busineas Where Uncured and Uncooked Meats are Sold, Offered for Sale, Received or Delivered; Pre- scribing a Penalty for the Violation thereof, and. Repealing All Ordinances and Parts of Ordinances in Conflict Therewith.' came up for passage and was react by the Clerk. . Probst moved that the Ordinance be adopted, seconded by Mr. Latham and on roll call carried unanimously. hr. Latham introduced the following Resolution snd moved its adoption: 'Resolution No. 505. Authorizing the Mayor to Execute Bond." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 41 Otis D. Treiber of 2515 Noble Avenue, addressed the Council applying for a rebate of certain penalties which were added_ to the tax bill, amou,ting to t'>6007• After discussion, Mr. Tilden introduced the following Re.olution and moved i adoption: 'Resolution No. 506. Refunding 6 .07 to A. D. Treiber ." Mr. Latham seconded the motion and on roll call it was adopted and passed unanimously. Mr. Adams stated that while he voted. Aye upon this application, he wished to go on record. as opposing future rebates for penalties on taxes. 35/ hr. Latham stated that the residents of the south era of St. Charles Street were quite anxious to have same repaired and had raised a sum of Money towards this improvement. City Engineer Hamilton stated that the matter had been referred back to the property owners and that he would try to ascertain their further Yr. Tilden introduced the following Resolution and moved its adoption: "Resolution No. 507. Authorizing the City Clerk to Advertise for Sealed Proposals for Caterpillar Tractor." Mr. Probst seconded the motion to adopt the Resolution and on roll a adopted and passed unaniMously. 7 The City Lianager stated that he was in receipt of an offer from Mr. E. K. Taylor., to supply the city with two boats for use by the Police Department and offered the suggections that the city purchase three more in addition. Mr. Latham moved that the matter be referred to the City iianager to take up with the County Board of Supervisors, seconded by Mr. Tilden and csrriea. June 6th 2'. 8V The City Manager state a that he was in receipt of an application from Claud I. Deal, representing the local post of the American Legion, to hold monthly athletic shows at Surf Beach Park. Mr. Tilden moved that the matter be referred to the City Manas:er, seconded by Mr. Latham and carried. Latham moved that the hayor, City hanager and City Attorney be requested to attend a meeting to be held at'the Merchants Echange Building in the near future for the discussion of a proposal to build a railroad extension to Coat. Island, seconded by Mr. Tilden and carried.
