1922-10-17 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, .1.1ESDAY EVENING, OCTOBER 17TH, 1922. The meeting convened at 8 o'clock with Council-p e ident Otis presiding - The roll was called and Councilmen Adams, Lathan, Probst Tilden and President Otis, (5) were noted present The minutes of the regular meeting of October 3rd, 1922 were approved as read. The regular order of business was suspended to permit of the hearings on petitions realassifying-verious zoning districts. The Clerk stated that he was in receipt of a petition for the reclassifi- cation of the property siauted at 2703 Central Avenue from a Residence District, Class I, to a Residence District, Class II; that notices had been posted in accord- ance with Ordinance No. 144, New Series, and amendments thereto and that no protests had been reueived. Mrs. L. L. Harford and. Ers. M. H. Barber, the petitioners were present and stated their desires. There being no objectors present in the Council Chamber, Mr. intham introduced the following Resolution and moved its adoption: "Resolution No. 558. Reclassifying he Property Situate at 2703 Central Avenue, to a Class II, Residence District." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopt ed and passed unanimously. The Clerk stated that upon motion of the City Council, notices were posted providing for a hearing for the reclassification of the property situated at the northwest corner of Grand Street and Central Avenue to a Claus II District. Plans were presented by Mr. Kaliski, the petitioner, show-ing the contemplated apartment house. There being no objectors present, Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 559. Reclassifying the Property Situated at the Northwest Corner of Grand. Street and Central Avenue, to a Class II District." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote:- Ayes: Councilmen Adams Latham, Probst and Tilden, (4). Noes; Couucil-president Otis, (1). The Clerk stated that he was in receipt of a petition for the reclassi- fication of the property situated on the southeast corner of Taylor Avenue and Jebster Street: from a Retail Business District Class III to an Oil Supply- Station District, Class V; that notices had been posted in accordance with Ordinance No. 144, New Series, and amendments thereto and that no protests had been received. hr. A. Moffatt, representing the Associated Oil Company the petitioner, was present. There being no objectors present in the Council Chamber, Mr. Probst introduced the following Resolution and moved its adoption: "Resolution NO. 560. Reclassifying the Property Situate at the Southeast Corner of Taylor Avenue and Webster Street, to a Class V Distrint." October 17th, 1922, The following were received: 4/ Continuation Certificate on the bond of Clarke G. Wbodbury, Collector Municipal Electric Light Plant. Ordered filed. V/ Copy of specifications for the wrecking of a wooden building on the north- west corner of San Jose Avenue and Parn Street. Ordered filed. Bond of Frieda 13. Tuchsen, of the Street Department. Ordered filed. 7/ Copy of dredging perrnit to American Dredging Company. Ordered filed. 8 Affidavit of publication.of Notice to Bidders, re wrecking of building Ordered filed. 9 V , Copy of opinion of the City Attorney to the Board of Education re ilability of school trustees. 10 / Copy of opinion of City Attorney to Board of Education re title of High School property in the event of a bond issue for a new high school. Ordered filed. 11P/ Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 561. Transferring 0200.00 from the General Fund to the Council Relief Fund." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 121 Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 562. Cnacelling Collection of Personal Property Deficiency Tax." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote:- Ayes: Councilmen Adams Latham, Probst and. President Otis, (4). Noes; Councilman Tilden, (1). 13 Mr. F. I. Kendall addressed the Council regarding the fencing of Harrison Avenue, which previously' was closed by the City of Alameda and which at the present time is used as a thoroughfare. Mr. Latham moved that the Council agree to the erection of a fence as stated, i.e. On the east side of Park Street; west side of Everett Street; east side of Everett Street; west side of Broadway; east side of Broadway; east side of Broadway; west side of Pearl Street; that the City Attorney and City Clerk be instructed to prepare a letter and forward same to Colonel Herbert Deakyne, stating that the City of Alameda had no objections to the erection of said fence, seconded by Mr. Probst and carried. Councilman Tilden requested permission to retire, which was granted. The following ±'ollowing cornmuflications were received: 14V From the League of California Municipalities and the Board of Supervisors of San Francisco, re the passing of a Resolution urging the defect o certain con- stitutional amendments. There being no objections, action was laid over to the next meeting of the Council. 15, From the Alameda City Mid-winter Braseball League, extending an invitation to the Council to be present at the opening day ceremonies. Mr. Probst moved that the invitation be accepted and the City Manager instructed to represent the City, I A h seconded by Mr. Latham and carried. 16/ October 17th, 1922. From City Attorney Locke, stating that the garage situated on the easterly side of Park Street at the junction of the railroad right of way had bean set back from the railroad tracks so as to give the standard amount of clearance. Ordered filed. 17/ Messrs. D. M. Rue and Frank Valente addressed the Council regarding their application for holding free athletic shows at Surf Beach Park under the super- vision of the Police Department of the City of Alameda. After generl discussion Mr. Latham moved that the application he granted under the jurisdication of the City Manager and that such permit should be revocable at any time, seconded 13y Mr. Probst and carried. A communication was v d from Miss M. Fay Coughlin, requesting the Council to begin such proceedings as are necessary to validate her titile to Block I), bound- ed by Santa Clara Avenue, Mound Street, Johnson Avenue and the Cohen Tract, where a street called Shell Street formerly existed. Mr. Latham moved that the request be granted, providing the expense in connection therewith be borne by Miss Coughlin and that the City Attorney so advise her, seconded by Mr. Adams and carried. 19i A Bill entitled Bill For Ordinance No. New Series. Establishing Set-Back Lines on Thompson Avenue and Portions of High Street and Fernside Boulevard." came up for passage and was read by the Clerk. Mr. Probst moved that the Ordinance be adopted, seconded by Mr. Latham and on roll call it was adopted and passed by the following vote, to wit: Ayes; Councilmen Adams, Latham, Probst and. President Otis, (4). Noes; None. Absent: Councilman Tilden, (1). 20v A Bill entitled. For "A Bill Ordinance No. New Series. An Ordinance Authorizing- the Exchange of Certain Sewer Rights of Way over Portions of Alameda Marsh For a New Sewer Right of Way." came upftT passage and was read by the Clerk. Mr. Latham moved that the Ordinance be adopted, seconded by Mr. Probst and on roll call it was adopted and passed by the following vote, to wit: Ayes: Councilmen Adams, Latham Probst, and. President Otis, (4). Noes: None. Absent: Councilman Tilden, (1). 21V A Bill entitled "-A Bill For Ordinance No. New Series. Reclassifying the Property Situated at the Southe Corner of Alameda Avenue and. Oak Street to a Class IV, Church District." came up for passage and was read by the Clerk. Adams moved that the bid of Symon Bros. be accepted and that a contract and bond be drawn up in accordance with the specifications, seconded by Mr. Probst and on roll call carried unanimously. 2E5' The City Manager stated that in accordance with the instructionsof the City Council, prices were obtained on several makes of automobiles for the use of the Assistant Fire Chief. He recommended that the bid of H. G. Markham & Co., of Oakland, offering a Columbia, 6 Cylinder car for 0995.00,be accepted. Mr. Latham moved that the bid of H. G. Markahm & Co. for 8995.00 be accepted, seconded by Mr. Adams and on roll call carried unanimously. 24 V In the matter of the purchase of a new motorcycle for Traffic Officer Grey, Mr. Latham moved that the same be left in the hands of the City Manager, seconded by 1dr. Probst and carried. Claims against the General Departments amounting to 02464.23; against the Police Department amounting to 0375.92; against the Fire Department amounting to 8296.83; against the Street Department amounting to 81751.01; against the Health Department amounting to 063.47; against the Recreation Department amounting to 8182.10; against the Council Relief Fund amounting to 0214.66; against the Electric Light Fund amounting to 17,486.52; against the Franklin Park Fund amounting to 01368.00; against the Public Use Fund amounting to t2052.54 having been approved and audited by the proper officials were listed by the Clerk as follows: Labor Alameda Repair & Supply Co.
