1921-05-03 Regular CC Mintes1 2 e/ REGULAR MEETING OF TEE COUNCIL OF THE CITY OF ALAMEDA TUESDAY EVENING, MAY 3RD, 1921. The meeting convened at 8:15 p. m. with. Counci1-presieiit Otis presiding. The roll was called and Councilmen Adams, Latham, Probst, Tilden and. President Otis, (5) were noted present. The minutes of the regular meeting of April 19th, 1921 were approved as read. The minutes of the adjourned regular meeting of April 26th, 1921, were approved as read. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 380. Transferring $2202.47 from the Electric Light Fund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following were received: Bond of the American Dredging Company,to dump dredged materials materialsoflTrqCts 39, a42Th•nd 45, approved by the City Attorney. Ordered Mad. 3/ Report of the Municipal Electric Light Plant for the month of February, 192 Ordered filed. 4 N/' Copy of executed lease of tidelands to Lars A. Pedersen.Ordered filed. The following communications were received: 5/ From Clark Aerial Service Company, requesting permission to operate a comma sea-plane at Neptune Beach. Mr. Tilden moved that the City Manager be instructed to give Mr. Clark a teraporary permit for two weeks, to fly over the water only, seconded by Mr. Latham and carried. From Mayor Frank Otis, appointing Frederick Maurer as a member of the Board of Trustees of the Alameda Free Library. Ordered filed. Mr. Maurer being present he was duly sworn in by the City Clerk. From Mayor Frank Otis, appointing Charles M. Cadman, as a member of the Board of Education. Ordered filed. 8/ From Mayor Frank Otis, appointing E. Howard Baxter as a member of the Board of Public Utilities. Ordered filed. The Clerk stated that he had on hand the oaths of office of E. Howard Baxter, Frederick Maurer and Charles M. Cadman. The same were ordered filed. 10 / From the American Legion, Alameda Post, No. 9, regarding the observance of Memorial Day. Mr. Tilden moved that Mayor Otis be appointed a committee of one to confer with Alameda Post, No. 9, regarding the matter, seconded by Mr. Probst and carried. A petition was received from property owners adjacent to the east and west sides of Walnut Street, at its southern terminus, asking the council to proceed with the pav- ing of the unpaved portion of said street, together with necessary curbing and street end abutment wall, signed by Messrs. H. G. Mathewson, D. J. McKean, G. E. Edmunds, J. M. Bliss and. G. Soderwall. Mr. Probst moved that the City Attorney be instructed -co prepare the necessary papers to proceed with the work as requested, seconded by Mr. Tilden and on roll call carried unanimously. 106 May 3rd, 1921. 1 The Clerk stated that he was in receipt of a petition for the reclassification of 420 Santa Clara Avenue, from a Class I to a Class II District. Mr. M. H. MacDonald being present explained the proposed changes to the Council. There being no objectors present Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 381. Reclassifying Property Situate at 420 Santa Clara Avenue." Mr. Tilden seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote: Ayes: Councilmen Adams, Latham,Probst Tilden and esident Otis, (5). Noes; None. Absent:None. The Clerk stated that he was in receipt of a petition for the reclassification of the following described property: BEGI:TNING at a point on the western line of Sherman Street distant thereon 95 feet southerly from the intersection thereof with the southern line of Encinal Avenue; thence southerly along said westerly line of Sherman Street 135 feet; thence at right angles westerly 150 feet; thence at right angles northerly 135 feet; thence at right angles easterly 150 feet to the place of beginning. from a Class I to a Class II District. Mr. George H. Noble the petitio vas present and explained to the council in detail the contemplated changes and improvements. He presented to the council two petitiompurported to be signed by property owners within the district affected favoring the changes as requested. The names of the signers of the petition were read to the council and petition then ordered filed. A number of petitions against the proposed change, signed by purported property owners within the district affected were presented to the council. The names of the signers were read and the petitions ordered filed. E. A. Freeman of the East End Improvement Club, spoke of the necessity for action by the council towards housing conditions in Alameda and favored the granting of the request to the petitioner. Mr. W. H. Kollmeyer acted as spokesman for a number of the property owners present who were protesting against the change being made. President Otis stated that the evidence submitted to the council would be taken under advisement at a meeting of the Com- mittee of the Whole and that a decision would be rendered at the earliest practicable moment. 141 The Clerk stated that he was in re eipt of a petition for the reclassification of 1604 Santa Clara Avenue, from a Class I to a Class II District. Dr. E. R. Schroeder, representing the petitioner wa present and explained to the council the proposed changes. Mr. C. W. Griffin and. H. F. Dexter spoke against the granting of the request. President Otis stated that the evidence submitted. would be taken under advisement in a Committee of the Whole meeting and a decision 7ould be rendered at the earliest practicable moment. 5 In the matter of the hearing on the delapidated building situated at 2240 Buena Vista Avenue, the Clerk read the affidavit of E. C. Maillot, Building Inspector, stating that the structure was sold at public auction in accordance with Section 7 of Ordinance No. 181, New Series, for the sum of 050.00; that the expense in connection therewith amounted to 04.55 and that the balance of 045.45 was deposited with the treasurer of the City of Alameda to the credit of H. Brand, reputed owner of the property. The affidavit was ordered filed. The Clark stated that he was in receipt of an affidavit of due postinE, of Notice .of T]xpenses. Ordered filed. Mr. Probst introduced the following Resolution and moved its adontion: May 3rd, 1921 Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 16v/ In the matter of the ark hearings which were postponed from the reE;t1ltr I.:loot- ing of April 19th, Attorney Llfred A. Van Hovenberg, repres:;nting about twenty of the ark owners, was present and addressed the council at length. After discussion, Mr. Tilden moved that the entire matter be referred to a Committee of the Whole meeting for consideration, seconded by Mr. Latham and carried. The Clerk stated that he was in receipt of six bids in response to the notice inviting sealed proposals for the construction of the North Side Sewer. Mr. Latham moved that the bids be received and opened, seconded by Mr. Probst and carried. There- upon the Clerk opened and read bids from the following: Tibbitts-Pacific Company Kopperud & Heafey C. H. & A. W. Gorrel Healy, Tibbetts Construction Company Cahil/-Venscino Company R. C. Storrie & Company. Mr. Latham moved that the bids be referred to the City Manager, seconded by Mr. Probst and carried. Mr. Latham moved that the council adjourn to meet in adjourned regular session, Thursday, May 5th at 8 o'clock p. m. Dow Estate Company, protesting against proposed curbing on Oak Street, in accordance with Resolution of Intention No. 56, N. S. Mr. E. K. Taylor was present and explained to the council more fully the objection of the Dow ..state Company. Mr. Baum representing the Baum Estate, entered a verbal objection against the proposed curbing on Morton Street, under Resolution of Intention 'To. 56, N. S. Mr. Tilden introduced the following Resolution and moved its adoption: "Resolution No. 383. Resolution Overruling Protests." (Resolution of Intention No. 56,N.S.) Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 1 Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 384. Resolution Ordering the Work. (Resolution of Intention No. 56,N.S.) Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 20/ The Clerk stated that he was in receipt of a written objection signed by Mrs. Jeanette MacPherson, against the laying of sidewalks in front of her property at the northeast corner of Van Buren Street and Fountain Street, under Resolution of Intention No. 57, N. S. Street Superintendent, C. E. Hickok, explained to the council that objections had been made by this party heretofore. The council agreed that this work should be done, thereupon Mr. Latham introduced the following Resolution and moved its adoption: 408 May 3rd, 1921. Mr.'_ Adams seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. Mr. Probst introduced the following Resolution and moved its adoption: 'Resolution No. 386. Resolution Ordering the Work." (Resolution of Intention No. 57, N.S.) Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted nd passed unanimously. 22 A Bill entitled "A Bill For Ordinance No. New Series. Amending Section 5 of Ordinance No. 192, New Series, Entitled "An Ordinance Regulating the Operation of Airplanes, Balloons, and other aircraft in the City of Alameda", Relating to the License Fee Payable by Owners and. Operators." was introduced and laid over under a provision of the Charter. A Bill entitled For "A. i11 Ordinance No. New Series. Creating and. Establishing a City Planning Commission." came up for passage. Mr. Latham moved that the same lay over to May 17th, 1921, seconded by Mr. Probst and carried. 24/ A Bill entitled "A. Bill For Ordinance No. New Series. Amending Section '780 of the Municipal Code of the City of Alameda, Relative to the Use of Fire Works in the City of Alameda." came up for passage. Mr. Tilden moved that the same lay over to May 17th, 1921, seoond- ed by Mr. Latham and carried. 251 A Bill entitled "A Bill For Ordinance No. New Series. Prohibiting the Placing of Torpedoes or Other Ecplosives on Railroad Tracks." came up for passage. Mr. Latham moved that the ordinance be adopted, seconded by Mr. dams and on roll call it was adopted and passed unanimously. 26' Mr. P. H. Scullin addressed the council re National Industrial Peace and Educational Association Convention, to be held at Sacramento under date of September 28 and 29, 1921 and asked that he be appointed as the representative of the City of Alameda at that meeting. Mr. Tilden moved that the matter be referred to the meeting of the Committee of the Whole for further discussion, seconded by Mt. Probst and carried. Mr. Ghiglione addressed the council regarding delinquent taxes and asked if it was possible to remit the penalty which he had to pay. Er. Ghiglione was informed by the President of the Council that no action could be taken in the matter. 28/ City Manager Hewes reported that the condition at Park Street Station, north, as complained of in a communicated received and read at the last meeting of the council m.
