1921-05-17 Regular CC Minutes2/ REGULAR 1:TEETING OF THE COUNCIL OF THE CITY OF 1LLAMEDA. TUESDAY ETTING, MAY 17TH, 1921 The meeting convened at 8:15 p. m. with Council-president Otis pre, g. The roll was called and Councilmen Adams, Latham, Prob st and President Otis, (4) were noted present. Absent: Councilman Tilden, (1). The minutes of the regular meeting of May 3rd were approved as amended. The minutes of the adjourned regular meeting of May 5th were approved as read. The following was received: Affidavit of 'osting Notice Inviting Sealed Proposals under Resolution of Intention No. 57, N. S. Ordered filed. The following communications were received: From the Alameda Improvement Club, re installation of electric sign on the Naval Base site, also other suitable signs to be placed in prominent sections of the city indicating distance and direction to its location. Upon motion of Mr. Probst, seconded by Mr. Latham and carried, the communication was referred to the City Manager. From the Southern Pacific Company, acknowledging receipt of Reso lution No. 377, of the City Council and advising that the Railroad Commission of the State of California is the only bCdy having authority to order the Southern Pacific Company to erect the station referred to. Mr. Probst moved that the communication be referred to the City Attorney, seconded by Mr. Latham and :carried. From C. F. Goddard, commending the prompt and courteous action on the part of the Street Superintendent, in complying with liis request to clean curbs etc., in front of his late father property. Ordered filed. From the League of California Municipalities, re meeting with the State Irrigation Association in Sacramento on May 20th, for the purpose of considering the conservation of water resources of the State. Mr. Latham moved that City Manager, 0. E. Hewes, and Cit7, Engineer, C. E. Hickok, attend this con- ference as representatives of the City of Alameda, seconded by Mr. Probst and carried. An AffLdavit showing due publication of Notice Inviting sealed Proposals under Resolution of Intention No, 57, N. S. was presented and ordered filed. In response to said Notice the Clerk statedhe was in receipt of four bids, Mr. Probst moved that the bids be received and opened, seconded by Mr. Latham and carried. Whereupon the Clerk opened and read the bids as follows: From N. Lena, accompanied by a certified check in the sum of 03.00, offering to do the work for the following: 18,330 square feet of concrete sidewaik. ........ 04032.00 From Riechei and Bredhoff, accompanied by a certified check in the stun of N13.00, offering the do the work for the following 18,330 square feet of concrete .dewalk....... 34130.0O From Downer & Amero, accompanied by a certified check in the sum of 0450.00, offering to fo the work for the following: May 17th, 1921. From Hugh C ammey, accompanied by a bond in the sum of 1500. OO, offering to do the work for the following: 28,330 sq. ft. of cement sidewalk per square foot, Twenty-eight Cents,($0.28) Mr. Adams moved that the bids be referred to the City Manager, seconded by Mx. Probst and carried 7V7 The re-hearing on the reclassification of 1604 Santa Clara Avenue. Mr. Latham moved that the matter be again referred to the Committee of the Whole, seconded by Mr. Probst and on roll call carried unanimously. The Clerk stated that he was in receipt of two petitions signed by purported owners of property in the district affected, protesting against the reclassification. Ordered filed. In the matter of the hearing of the request of the Li to Pencil Company for the reclassification of property situated on the eastern line of Park Street 100 feet south from the southern line of Eagle Avenue. Mr. Charles E. Wehn, represent- ing the petitioner,addressed the council. Mr. Knight spoke in favor of granting the petition. John Ralph Wilson, W. A. S. Nicholson, J. H. Ames and J. Wilson spoke against the granting of the request. The Clerk stated that he was in receipt of petitions purported to be signed by twenty-three property owners within the district affected. The petitions were ordered filed. Mx. Latham moved that the matter be referred to the Committee of the Whole, seconded by WI'. Probst and carried. 9v In the matter of the hearing of the application of G. Siem, for permission to reclassify the western forty feet of Lot 3, in Block A, of Alameda Station Homestead. Tract, Mr. C. Siem addressed the council and stated it was his intention as per the application to erect a frame structure for carrying on the business of automobile painting. Mr. Latham moved that the matter be referred to the Committee of the Whole, seconded by Mr. Probst and carried. 10e7 In the matter of the hearing of the application of Mrs. Estelle De Witt or permission to reclassify the property situated at 2515 Eagle Avenue from a Class I singled. Family District, to a Class II, Flat District, Mrs. De Witt was present and advised the council as to the contemplated changes. There being no protests, Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 388. Reclassifying Property Situate at 2515 Eagle Avenue." MX. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The Clerk stated that, he was in receipt of a letter from Ex. Richard. A. Barker, wherein he advised that the building referred to therein had been disposed of and was at the present time being wrecked. Ordered filed. MX. Probst moved that further action On the delapidated building at 1812 Park Street be postponed until the regular meeting of the Council to be held. June 21, 1921, seconded by Mr. Latham and carried. 12/ City Engineer, C. E. Hickok, presented plans and specifications for the improve- ment of the southerly half of Washington Street, from the easterly line of Broadway to a line 140.17 feet easterly from and parallel to the easterly line of Broadway. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 389 Resolution Adopting d.0ing Plans one Sr)Anificatinn_fl May 17th, 1921. and passed unanimously. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 390. Resolution of Intention, No. 58, N. S." (Washington Street) Mr. Adams seconded the motion to adopt the Resolution and on roll call it was adopt- ed and passed unanimously. 14V City Engineer, C. E. Hickok, submitted plans and specifications for the im- provement of the south end of Walnut Street. Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 391. Resolution Adopting Plans and. Specifications. (Walnut Street) Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed. unanimously. 15%/ Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 392. Resolution of Intention No. 59, New Series." (Walnut Street) Mr. Adams seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. In the matter of the hearing of Suzzie H. Wells protest re closing of Austin Avenue, etc., the City Attorney stated that all property owners had agreed to sign, thereupon Mr. Probst moved that the matter be postponed to the net regular meeting of the Council June 7, 1921, seconded by Mr. Latham and carried. Mr. Latham moved that the council adjourn to meet as a committee of the Whole, seconded by Mr. Probst and carried. Upon reconvening, Councilmen Adams, Latham, Probst and. President Otis, (4) e hoted present. Absent: Councilman Tilden, (1). Mr. Latham moved that the request Of Mr.- E. W. King, Promotion Vanager of Neptune Beach, be granted to hold amateur athletic exhibitions on each Wednesday evening, under a revocable permit to be revoked at the pleasure of the City Manager, seconded by Mr. Probst and on roll call carried unanimously. Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No 393. Reclassifying Property Situate on the East Line of Park Street, 100 feet South from the Southerly line of Eagle Avenue." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 191 Mr. Probst moved that the application of C. Siems for permission to construct a frame building on the western 40 feet of Lot 3 in Block A., Alameda Station Home- stead Tract, be denied and that Mr. Siems be interviewed by the City Manager, and that he advise him if a fire proof building constructed either of brick or concrete would be substituted for the frame building, the permission would be granted by the Council seconded by Mr. Latham and carried. nn ./ ^4, +Ina Ilenriflcr nf the netition on the reclassification of property may 17th, 1921. and carried. 21v// Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 393. Resolution of Award." (Sidewalks) Mx. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 22/ Mr. Probst moved that all certified checks and bonds filed with bids for the construction of concrete sidewalks under Resolution of Intention No. 57, N. S. be returned by the City Clerk to the unsuccessful bidders seconded by Mr. Latham and carried. Mr. Latham moved that the request of the 7th Day Adventists to the City Manager, for permission to hold a 10 day revival meeting on the waterworks:property on High Street, be denied, seconded by Mr. Adams and carried. Action in the matter of the Resolution received by the Mayor, from G. H. Powell of the Producers' Transportation Company, re railroad rates, was upon motion of Mr. Latham, seconded by Mr. Probst and carried, referred to the Mayor for further report to the Council. In the matter of the communication from Alameda Post No. 9, American Legioa, regarding Memorial Day services, the Mayor reported that he had been advised by the American Legion that they had decided not to hold the exercises as planned. 5" City Attorney Locke requested the council to instruct the City Clerk to send an official communication to the Governor of the State of California, under theSeal of the City, asking him to sign Assembly Bill No. 169, providing for the determining of boundary lines of cities towns, counties, or cities and counties. Mr. Latham moved that the Clerk be instructed to send such a letter, seconded by Mr. Probst and carried. A bill entitled 28' For "A Bill Ordinance No. New Series. Providing for the Establishment of Set-back lines on Private Property, Prohibiting tile Erection of Buildings or Other Structures between said Lines and the Street, and. Pre- scribing the Penalty for a Violation of said. Ordinance." came up for passage. Mr. Latham moved that further action be postponed until the next regular meeting of the council to be held.
