1921-06-07 Regular CC MintesREGULAR METING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, JUNE 7TH, 1921. The meeting convened at 8:15 p. m. with Council- president Otis presiding. The roll was called and Councilmen Adams, Latham, Probst, Tilden and President Otis, (5) were noted present. The minutes of the regular meeting of May 17th, 1921 were approved as read. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 395. Transferring $1304.28 from the Sewer Construction Fund to the General Fund." Mr. Latham seconded the motion to adopt the resolution and on roll call it was adopted and passed unanimously. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 396. Transferring 2038.31 from the Electric Light Fund to the General Fund." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The following were received: i 3V Report of the Municipal Electric Light Plant for the month of March, 1921. Ordered filed. Contract and Bond of the Tibbitts - Pacific Company for the construction of the North Side Sewer. Ordered filed. Contract and bond of N. Lena for work under Resolution of Intention No. N. S. Ordered filed. Affidavit of publication of Resolution of Intention No. 58, New Series. Ordered filed. 7/ Affidavits of City Engineer and City Clerk, re posting of Notices under Resolution of Intention No. 68, New Series. Ordered filed. 8f Affidavit of Publication of Resolution of Intention No 59, New Series. Ordered filed. 9 ✓ Affidavits of City Engineer and City Clerk, re posting of notices under Resolution of Intention No. 59, New Series. Ordered filed. The following communications were received: io ' From Hon. Wm. D. Stephens, Governor of California, re Assembly Bill No. 169. Ordered filed. 1.1✓ From the Mayor, Auditor and City Manager, re count of money. Ordered filed. 12 From J. R. Morris, 2110 Lincoln Avenue, requesting permission to remove a tree. City Manager Hewes stated that he had looked into the matter and that in his judgment same should remain. Mr. Latham moved that the request be denied, seconded by Mr. Probst and on roll call carried unanimously. From the City Planning Commission, recotending that Versailles Avenue 5/ 0 Buena Vista. Avenue to Harrison Avenue be opened. Also, suggesting ways of assessing for the work. Ordered filed. Mr. Probst moved that the matter be referred to City Attorney Locke and that he be instructed to prepare the necessary papers for proceed- L 9 June 7th, 1921. The Clerk stated that the time had arrived for the hearing of protests under Resolution of Intention No. 58, N. S. (Washington Street) and that no protests had been filed with him. There being no protestants present in the Council Chamber, Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 397. Resolution Ordering the Work." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. The Clerk stated that the time had arrived for the hearing of protests under Resolution of Intention No. 59, N. S. (Walnut Street) and that no protests had been filed with him. There being no protestants present in the Council Chamber, Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 398. Resolution Ordering the Pork." Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 16/ The hearing in the matter of the reclassification of the property situate t 1041 Lincoln Avenue, from a Class I, Single Family District, to a Class II, Flat District came up, Miss Hattie McDonnell, the petitioner, was present and stated to the council her desires. There being no protestants present Mr. Tilden introduced the following Resolution and moved its adoption: "Resolution No. 399. ?' Reclassifying the Property Situate at 1944 Lincoln Avenue." Mt". Probst seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 17 The hectring in the matter of the reclassification of the property situate at 1604 Santa Clara Avenue, from a Class I, Single Family District, to a Class II, Flat District, came: up. Mr. Latham introduced the following Resolution and moved its adoption: "Resolution No. 400. Reclassifying the property Situate at 1604 Santa Clara Ave." Mr. Probst seconded the motion to adopt the Resolution. President Otis requested Vice - president Probst to assume the chair and then addressed the Council, protesting against the change being allowed. Mr. Otis again took the Chair and called for a vote upon the Resolution as submitted. The vote was as follows: Ayes: Councilmen Adams, Latham and Probst, (3). Excused from Voting: Councilman Tilden. Noes: Council- president Otis, (1) . Mr. Tilden requested permission to be excused from voting on account of his absence from the city while this matter was being discussed. 181 The Clerk stated that he was in receipt of affidavits of Posting of notices covering the removal of the delapidated building at 215 Pacific Avenue; that the time had arrived for public hearing in the matter. Mr. John Iburg, one of the owners, was present and stated that the house in question belongs to an estate now in the process of distribution; that efforts are bring made at the present time to dispose of the same. Mr. Tilden moved that it be the sense of the council that June 7th, 1921 the same should be removed and that the owner be given the opportunity to dispose of same through the building inspector and that further action be postponed to the next regular meeting of the council, to be held. June 21,1921, seconded by Mr. Probst and carried. 19/ In the matter of the hearing of the protest of Suzzie H. Wells, re closing of Austin Avenue, etc., Mr. Latham moved that the matter be postponed to the next regular meeting of the Council June 21,1921, seconded by Mr. Probst and carried. 20 A Bill entitled For 'A Bill Ordinance No. New Series. Creating and Establishing a City Planning Commission." came up. Mr. Latham moved that the ordinance be referred to a meeting of the'Committee of the-Whole; Seconded by. Mr Probst and carried. 21/ A Bill entitled. POT A Bill Ordinance No. New Series, Providing for the Establishment of Set-back Lines on Private Property, Prohibiting the erection or Location of Buildings or other Structures between said Lines and the Street, and Prescribing the Penalty for a Violation of Said. Ordinance.'" came up. Mr. Probst moved that action on the ordinance lay over until the next regular meeting of the Council to be held June 21;1921, seconded by Mr. Tilden and carried. 22v/ Mr. Latham moved that it be the sense of the Council that they endorse any proposal for the establishment of a bridge across San Francisco Mr. Probst seconded the motion and on roll call it was carried unanimously. Claims against the General Departments amounting to $2769.63; against the Police Department amounting to $117,10; agaihst the Fire Department amounting to $160.48; against the Street Department amounting to $4591.53; against the Health Department amounting to $125.85; against the Recreation Department amounting to $210.98; against the Store Fund amounting to $91.85; against the Relief Fund amounting to $194.60; and against the Electric Light Fund amounting to 3341.19 having been approved and audited by the proper officials were listed by the Clerk as follows: Alameda Repair & Supply Co.
