1921-11-15 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA TUESDAY EVENING, NOVEMBM 15,1921 The meeting convened at 8:20 p. m. with Council-president Otis presiding.. The roll was called and Councilmen Adams, Latham, Probst, Tilden and President Otis, (5), were noted present. The minutes of the regular meeting of November 1st were approved as read. The following communications were received: From C. L. Seavey, City Manager of Sacramento, inviting the council and mayor to be present at the Convention of the National Industrial Peace and Educational Association, on November 15-16. Mr. Latham moved that the invitation be accepted, seconded by Mr. Probst and carried. From the Southern Pacific Company, re steamer "Garden City". Mr. Veale representing the Southern Pacific Company, was present and stated the reasons for the •necessity of using the "Garden City" at the present time on this run. Mr. Latham vigorously protested the unsanitary condition, whereupon Mr. Veale assured the council that steps would be taken to immediately remedy the matter. From representatives of the press, requesting the use of Room 15 in the City Hall, as a flress room. Mr. Latham moved that the matter be referred to the city manager with power to act, seconded by Mr. Probst and carried. From the League of the Southwest, inviting members of the Council to be present and participate in a special general meeting, to be held at Riverside, California, on December 8 9 and 10. City Attorney Locke stated that as Executive Secretary of the League of California Municipalities he would undoubtedly attend the meeting, whereupon lex. Tilden moved that City Attorney Locke represent the City of Alameda at said convention, seconded by tr. Latham and carried. From Mayor Otis, Auditor Croll and Acting City Manager Varcoe, re count of moneyr in the city treasury. Ordered filed. From Erminio Chavez, re local street car fares and dogs. Ordered. filed. An application for a gratuitous license, signed by T. J. Suther.end, 2153 Alameda Avenue, to solieit for sale of match cases, was upon motion of Mr. Tilden seconded by Mr. Latham, denied. The clerk stated that he was in receipt of a petition for the reclassifi- cation of the property situated at 2027 Encinal Avenue, from a Class I to a Class II District, permitting the alteration of said building into flats; that notices had been posted in accordance with the requirements of Ordinance No. 149, N. S.; and that no protests had been filed with him. There being no objectors present in the council chamber, Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 435. Reclassifying the Property Situate at 2027 Encinal Avenue, from a Class 1 to a Class II District." 10/ iil November 15, 1921. The clerk stated that he was in receipt of a petition for the reclassifi- cation of the lot situated on the south siIe of Central Avenue, 110 feet west of Park Street, from a Retail Business District, Class III to a public Garage and Service Station District, Class V, permitting the erection of a steel frameand brick building for service station purposes; and that protests had just been filed against the granting of the petition containing among others, names of signers of the original petition. Mr. Latham moved that further action by the council lie postponed until the clerk hael time to have the original petition rechecked to ascertain Whether it still contained a sufficient number of signers to bring it before the council, seconded by Mr. Probst and carried. The clerk stated that he was in receipt of a petition for the reclassi- fication of the prooerty situated on the northeast corner of Webb Avenue and Park Street, from a Class II Retail Business District, to a Class V, Oil Supply and Service Station District; that notices had been posted in accordance with the requirements of Ordinance No. 149, N. S. and that no protests had been filed. Mr. Rainier, representing the Associated Oil Company, the petitioner, was present and explained to the council their desires. D. A. Eberly addressed the council protesting against the granting of the petition and requested that the matter lay over until the next regular meeting of the council. Mr. Tilden so moved, seconded by Er. Adams and carried. The clerk stated that he was in receipt of a petition for the reclassi fication of the property situated on the west line of Webster Street, fifty feet south of Buer.a Vista Avenue, from a Class I, Single Family Dwelling District, to a Class II, Retail Business District i that notices had been posted in accord- ance with the requirements of Ordinance No. 149, New Series, and that no protests had been filed. Mr. F. Ferrero and. Mr. F. R. Neville, were present and explained to the council their desires. Mr. Bernhard was also present and requested in- formation as to whether any grinding machinery would be installed. Upon being assured by Mr. Ferrero that such was not the case, Mr. Bernhard withdrew his objections. Thereupon a Bill entitled "A Bill For Ordinance No. New Series. Reclassifying Property on the West Line of Webster Street, South:. of Buena Vista Avenue, to a Class III, Business District." was introduced and laid over under a provision of the charter. 12/ The clerk stated that he was in receipt of a petition for the reclassi fication of the property situated at 1433 Morton Street, from a Class I, Single Family Dwelling District, to a Class VI, Hospital District; that notices had been posted in accordance with the requirements of Ordinance No. 149, New Series, and that no protests had been filed. flr. Latham stated that he did not believe it right for the council to grant this petition, inas much as he did not feel that justice was being done to other property owners and residents in the vicinity. Dr. Alfred. Bach, representing the petitioner, was present and explain- ed to the council that the building was to be used entirely as a rest home for November 15 Whole, seconded by Mr. Probst and carried. 13 The clerk stated that the time had arrived for the'acceptance of protest filed under Resolution of Intention No. 62, New Series, and that he was in receipt of a number of them. President Otis called upon City Attorney Locke, as Chairman of the Committee appointed by the Council for the creating of the Assessment District, to make a statement . Mr. Locke thereupon stated that since the publica tion of the Resolution of Intention numerous of the protestants had appeared before the Committee and advised that no objections would be offered,providing a larger assessment district than that contained in Resolution of Intention No. 62 N. S. be created; that it was the recommendation of this Committee that the proceedings taken under Resolution of Intention No. 62, New Series, be rescinded, especially in view of the fact that since the last meeting of the council offers have been made of the property needed, under certain conditiohs and suggesting that before new proceedings be taken the matter be referred to the City Planning Commission for clarifying. Mr. Tilden so moved, seconded by Mr. Latham and carried. The protests submitted were accepted and ordered filed. 14v7 Attorney H. F. Droste, representing E. B. & A. L. Stone Company, addressed the council requesting permission to run an automobile jitney service from Bay Farm Island to the Southern Pacific Station, south side, High Street. Mr. Latham moved that the matter be referred to the City Attorney, seconded by Mr. Probst and carried. Mr. Latham moved that council resolve itself into a Committee of the Whole, seconded by Mr. Probst and carried. Upon reconvening Mr. Latham moved that the Committee of the Whole arise, seconded by Mr. Probst and carried. 15/ A Bill entitled "A Bill For Ordinance No. New Series. Reclassifying. Property Situated at 1433 Morton Street to a Class VI, Hospital District." was introduced and laid over under a provision of the Charter. Claims against the General Departmentsamounting to $2550.99; a nst the Police Department amounting to 0400.07; against:the Fire Department amounting to $201.66; against the amounting t eet Department amounting to $1937.85; against the Health Department 6.96; against the Recreation Department amounting to $1264.02; against the Relief Fund (Council), amounting to y36.95; against the Electric Light Fund amounting to $5853.21; against the Park Purchase Fund amounting to .7080.00 and against the Sewer Construction Fund amounting to$125.50 having been approved and audited by the proper officials were listed by the Clerk as follows: GENERAL FUND.
